1. 2. Announcements – Mr. LaFleur indicated that staff would be testing new automatic transcription software during the meeting.
3. Review and Approval of May 2, 2018, Legal Action Report and Minutes – Member De La
Torre moved for approval of the Legal Action Report. The motion was seconded by Member Clark. The motion passed by a voice vote of 3-0.
4. Water Service Request – 8381 S Alice Vail Lane
a. Report from Tucson Water Staff – Mr. Sarti provided a summary of the Tucson Water
Service Area Policy (SAP), and an explanation of the Water Service Area map, including areas which Tucson Water is obligated to serve, those already being served, and those that are considered non-expansion zones. He explained that a residential parcel located in a non-expansion zone of unincorporated Pima County must be smaller than 20 acres and must be bordered on three sides by parcels already receiving Tucson Water service, in order to qualify for new water service. Mr. Sarti indicated that the parcel at 8381 S Alice Vail Lane is located in unincorporated Pima County and is bordered on two sides by parcels receiving Tucson Water Service. He explained that the parcel did not meet the criteria for new service under the SAP, and was denied service accordingly.
b. Response from Appellant – Ms. Ward read from a prepared statement, which has
been submitted for public record with this Legal Action Report. Ms. Ward answered questions about the property from members of the Board.

c. Call to the Audience – There were no audience comments.
d. WSARB Deliberation, and Recommendations or Decisions – Members discussed the appeal with the appellant and staff, and asked additional questions about water service at neighboring parcels, and about the precedence of similar water service denials.
Member Clark indicated that the Board is authorized to determine if Tucson Water erred in its decision. He explained that there was no basis for the Board to find error or to recommend an alteration to the SAP. Member Clark moved to uphold Tucson Water’s denial of water service. Member De La Torre seconded the motion. Member Elias noted that the SAP is not intended to apply to any one parcel, but is intended to address larger policy issues. The motion passed on a voice vote of 3-0.
5. Call to the Audience – There were no audience comments.
6. Adjournment – The meeting was adjourned at 4:33 p.m.

Hi!This is an appeal to the decision made on 8381 S Alice Vail Lane to deny water service
Before I purchased the property at 8381 S Alice Vail Lane, I called City of Tucson Water and asked them if they serviced this area. They said yes, that they had water on the street. I asked them what I needed to do to get a meter put on the property. They said that I needed to fill out an application and pay the $2900 to have a meter installed. At no point during this conversation did the subject of you may not be approved to get water come up. I then went on purchased the property, started improvements on the property, when I almost had enough saved to get the water meter I came downtown to the Alameda office, I proceeded to fill out my application for a water meter. When I was turning in the application, at this point, the subject of I may be denied water to my property came up. I wasn't too worried about it because I had already been told that there was water on the street. A couple of weeks later, I received a letter in the mail saying that I was denied water and to call another office to see if they could help me, I called them, they said no, they couldn't help me either. So I am left here without water, I am already thousands of dollars invested in this property with improvements started. The idea that one could be denied water based on the location of their property isn't really public knowledge. I thought I had done my due diligence by calling to find out if I could get a meter at the property before I purchased it. I called all of the other utilities as well at that time. I am asking you kindly to reconsider. I have lived in Tucson for the last 29 years. I raised my children here, my daughter graduated from the U of A 2 weeks ago, we are citizens of Tucson. My son is attending college in Colorado but he will most likely end up in Tucson long term. I will not be increasing the water usage to the Tucson water supply, I do understand that this is a real concern on a local, national and global level. I am only one person and 2 dogs. My water usage will be moved from inside Tucson City limits to outside city limits, but it will not increase. I would not choose to move outside the Tucson city limits, I love Tucson, but I am not in a financial position to purchase a home within Tucson, if I ever had the chance of property ownership and to create a living situation for myself to take me into retirement, I had to do it this way, pay for one thing at a time. If there is anyway that I could get water at my property it would be greatly appreciated. Thank you,Jill Ward
