The Mission of Legal Aid Foundation of Santa Barbara County is to provide high-quality civil legal services to low-income and other vulnerable residents in order to ensure equal access to justice. We change lives through direct representation, legal advice and information, and community education. Our vision is a community where low-income people and other vulnerable residents are empowered to thrive and where all residents have meaningful access to the civil justice system.

Elder Abuse/Foreclosure PreventionOur clients were a senior couple and the husband had recently been diagnosed with dementia. Their adult daughter, who lived with them, had convinced them to authorize her as their power of attorney, giving her access to all of their finances. Unbe-knownst to them, their daughter was stealing their money instead of paying the mortgage, which triggered foreclosure proceedings. When the couple came to our office, they had recently fled to a family member’s house because their daughter had become aggressive and controlling. We assisted our clients with stopping the foreclosure, removing the daughter from their home, and revoking her authorization and access to their accounts. Our clients were able to keep their home and move back in knowing it would now be peaceful and safe.

Family Violence Prevention Our client had been in an abusive relationship with a man who physically, mentally, and verbally abused her. During the client’s pregnancy, the abuser struck her with his laptop, which caused her to go into labor. She pleaded for help and asked to be taken to the hospital. The abuser took her phone away and blocked her from leaving the room. A family member finally overheard her pleas and drove her to the hospital. After she delivered the baby, the abuse continued. With the help of her family, she finally escaped from the home. The police escorted her out, along with her children, and they fled to a domestic violence shelter. Legal Aid successfully obtained a permanent, 3-year order of protection for the client and her two young children.

In the last fiscal year, Legal Aid staff attorneys advised or represented 856 individuals and families with critical civil legal matters involving housing, intimate partner violence, elder abuse, consumer protection and probate. Our volunteer attorneys and law students assisted another 501 individuals and families, and our Legal Resource Centers assisted 6,750 self-represented litigants. In all, Legal Aid services reached 8,107 community residents.

soaked mattress on the patio. The so-called “caretaker” often used the client’s limited income but the client struggled to protect himself. Thanks to the successful advocacy by the Legal Aid attorney, the client obtained a 3-year Elder Abuse Restraining Order against the “caretaker.” The client also reached a settlement with the landlord, which allowed him to remain in his home, but the client lat-er sustained severe injuries. Due to the inju-ries, the client was unable to meet the terms of the agreement and the landlord obtained an eviction judgment. After an emergency hearing with the Legal Aid attorney, the client was allowed to stay in his apartment on reasonable terms ordered by the court. The client was able to keep his home, live free from financial abuse, and recover from his injuries.

Immigration Legal Aid previously assisted a client with securing a permanent restraining order against an abusive spouse. The man severely abused our client and her children for many years. He had threatened to report the client to immigration authorities if she reported to the abuse, but she finally had enough. After ensuring that the client and her children were safe, the Legal Aid attorney applied for a U-VISA on the client’s behalf. The U-VISA is a special visa granted to survivors of abuse who cooperate with law enforcement. After a four-year wait, the client was finally grant-ed the U-VISA. The client is now able work, financially support her children, and live free from abuse.
