Newsletter 2016-34 August 26, 2016 LEGISLATIVE CANDIDATES RECEIVE HUB/PAC QUESTIONNAIRE The HUB/PAC Board of Directors this year developed a two-question questionnaire for candidates running for the West Virginia Senate and House of Delegates. The questionnaire asks whether they support or oppose increasing and prioritizing direct infrastructure investment and whether they support or oppose new funding for highway and bridge construction and maintenance. “The CAWV believes that our state’s infrastructure must remain a top priority,” said HUB/PAC Co-chair Dan Cooperrider. “Public safety, education, healthcare, jobs and the economy grow from a foundation of reliable infrastructure.” HUB (Highway-Utility-Building) PAC used to send questionnaires to candidates but stopped since the CAWV has multiple issues that cross many lines. Candidates may support one area of concern to CAWV members while opposing another. Given difficulties of the past few sessions to focus on infrastructure, HUB/PAC seeks to give candidates the opportunity to present their views and recommendations on infrastructure financing. “I am thoroughly convinced that we are not doing the taxpayers of West Virginia a favor by kicking the can down the road,” says CAWV immediate past president Cooperrider. The questionnaires are due August 29. HUB/PAC will share candidates’ responses with CAWV members and will use them as a basis for possible endorsement in the general election. CAWV members will also be receiving a letter from HUB/PAC seeking contributions for this election cycle. “We must be prepared to help elect delegates and senators who believe infrastructure investment is vital to jobs and economic development,” Chairman Cooperrider stated. AGC PUSHES BACK AGAINST BURDENSOME WAGE REPORTING REQUIREMENTS The Associated General Contractors of America (AGC) recently submitted a second set of comments to the Office of Management and Budget (OMB) opposing the Equal Employment Opportunity Commission’s (EEOC) proposed rule to revise the Employer Information Report (EEO-1). The proposal intends to collect compensation and hours-worked data in addition to already collected race and gender data. AGC submitted comments on the rule, as initially proposed, in April. A final rule is expected in the Fall. The proposal to revise the report references wage discrimination as the basis for the need to collect compensation data from employers. In both comment letters, AGC explains that the collection of wage data is not necessary, because research from both the Commission and the Office of Federal Contract Compliance Program shows there is scant evidence that such discrimination exists. Additionally, AGC addresses other reasons why the collection of wage data is unnecessary in our comments. While AGC’s comments stress that this data collection is not needed, AGC urged the Commission to consider a number of revisions to the final proposed rule in an effort to limit the burden on contractors if the rule is finalized. AGC will continue to monitor the developments of the proposal and will keep members informed.

OVER $16 MILLION IN POWER INITIATIVE GRANTS AWARDED TO WEST VIRGINIA State and federal officials gathered in Huntington this week to announce 29 grants totaling $38.8 million in funding for groups in West Virginia, Kentucky, Ohio, Virginia, Pennsylvania and Alabama. Over $16 million in funds are being disbursed to groups in West Virginia as part of President Barack Obama’s POWER initiative, an ongoing push to disburse billions of dollars into regions of the country that are being disproportionately affected by the decline of the coal industry - the result of slumping foreign markets, low-priced natural gas, the higher cost of mining and federal regulations meant to reduce air pollutants. The awarded funds will help advance efforts in education, infrastructure improvements, business development, manufacturing expansions and workforce training. West Virginia was awarded over $16 million for 13 projects. The largest grants included $2.5 million for water infrastructure improvements near the Mercer County Regional Airport, $2.1 million for entrepreneurial education in Charleston, $2.28 million for an innovation business center in Buckhannon, $1.87 million for workforce training programs with Coalfield Development, $1.82 million to expand the hardwood manufacturing business in Elkins, $1.64 million for water and sewer improvements at the Mingo County Airport, $1.37 million in relation to the Hatfield and McCoy Regional Recreation Authority and $1.25 million for the Natural Capital Investment Fund in Shepherdstown. Click here to see a complete list of awards. One of the smaller grants that West Virginia received is for Gov. Earl Ray Tomblin’s development plan for the Hobet surface mine, which he pitched during his State of the State address earlier this year. The West Virginia Development Office will be receiving $200,000 from the federal government to help develop a detailed plan for the Boone County surface mine, which Tomblin wants to connect with a $99 million highway. HOBET HIGHWAY PROJECT SUBJECT OF LEGISLATIVE INTERIM MEETING Legislators received a presentation on the proposed 2.6 mile four-lane highway to the Hobet surface mine site during their August legislative interim meetings. Members of the Joint Legislative Oversight Commission on Department of Transportation Accountability Sunday listened to WV Secretary of Transportation Paul Mattox and Commerce Secretary Keith Burdette on the benefits of the Boone County site being developed into an industrial, retail and residential area. Legislators serving on the commission had a number of questions on the proposed 12,000 acre site, particularly relating to taking $100 million out of the State Road Fund to build the access road. The CAWV Board of Directors announced August 12 that the CAWV is opposed to taking money from an already distressed highway fund to pay for the road. The association stated another funding mechanism needs to be found if the project is to move forward. REP. MCKINLEY MEETS WITH CAWV OFFICERS Rep. David McKinley, P.E. (R-First District) met with CAWV officers in the CAWV Headquarters last week to discuss topics of interest to West Virginia’s construction industry, including additional funding for the federal aid highway program. Members also discussed the West Virginia Division of Highways’ new policy for interaction with industry representatives and the impact this is having on federally-funded highway projects. Also discussed was OHSA’s proposed rules on silica.

CAWV AND YCF MEMBERS NEEDED FOR COMMUNITY PROJECT – SEPTEMBER 9 Over ten members have signed up to volunteer at the CAWV Young Contractors Forum (YCF) restoration project for Kanawha State Forest’s (KSF) Spotted Salamander Trail, but more are still needed. The trail has unfortunately fallen into a terrible state of disrepair. The ¼ mile trail is wheelchair accessible and is equipped with braille and interpretive signage. CAWV representatives recently attended a planning meeting at KSF to discuss asphalt/paving repairs and the installation of posts to support guide ropes for the blind. Several CAWV member companies have already committed to donating equipment and supplies. West Virginia Paving, Inc. has just completed paving the trail’s handicap parking lot. In order to get the trail renovation projects moving forward, YCF Chairman Josh Booth is asking all CAWV members, not just YCF members, to help install posts along the trail. A work date has been set for September 9, with a rain date of September 16. Members can visit the YCF Facebook page to view a video on the project. YOUNG CONTRACTORS AND THE COAL RIVER GROUP TO HOST THIRD COAL RIVER KAYAK TOUR The Coal River Group, which has partnered with the WVDEP on a multi-million dollar stream restoration project, will lead a kayak tour of the Big Coal River hosted by the CAWV Young Contractors Forum on September 30. The stream restoration project involves building instream structures in the river channel to redirect the river's flow and thereby flush excess sediment in an attempt to improve water quality and habitat for fish and insects. This year’s event will start at 9:00 a.m. and will conclude at a location on the Big Coal River that the Coal River Group has asked the YCF for help to conduct a few hours of river cleanup. The location has seen many years of tires being disposed of in the river and on the riverbank. This is a great opportunity for CAWV members to participate in a community service project that will only require a few hours of work. The full day, including the kayak trip and the volunteer work, will end at 5:00 p.m. and will include lunch and cold drinks. The cost of the approximately three to four hour trip is $30 and includes Kayaks, PPE and a boxed lunch. Josh Booth, YCF Chairman, would like to invite all CAWV members to attend the kayak portion of the day even if they cannot stay to help with the river cleanup. The group will meet at 9:00 a.m. at Coal River Kayaks located at 181 Pettigrew Lane, Tornado. Come join your fellow CAWV members and enjoy the river and fall foliage season of West Virginia! This is the perfect time of year to tour the Coal River since the water is still fairly warm and the days are a little cooler. A registration form is attached to this week’s Newsletter. JOINT ARCHITECTS COMMITTEE MEETING SEPTEMBER 20 Chairman Derick Foster has scheduled a meeting of the CAWV Joint Architects Committee on Tuesday, September 20, at 10:00 A.M. at the CAWV headquarters. WOOD COUNTY SCHOOLS OFFICIALS APPROVE FINAL LANGUAGE OF SCHOOL BOND Wood County Schools officials met with representatives of the state School Building Authority this week to discuss a possible $10 million state pledge toward a $51 million facilities project. The Wood County Board of Education approved the final language of a $41,140,000 bond call which will be brought before local voters in November. Wood County Schools officials will present the bond call to the Wood County Commission on Monday for including on the November ballot. During the initial bond call process, the SBA indicated it could pledge about $10 million toward the facilities project, which includes building a new Williamstown-area elementary school, expanding the Wood County Technical Center and roof repair and replacements throughout the district. The application process for grants begins in December, after the November bond issue will be voted on, and funding won't be awarded until next year. FEMA ASKS SCHOOLS TO RECONSIDER USING PORTABLE CLASSROOMS The Federal Emergency Management Agency asked Kanawha County Schools last week to consider alternatives to portable classrooms because of how expensive it would be to use the units for such an extended time while replacement schools are built, according to Charles Wilson, the Kanawha County school system’s executive director of facilities planning. Wilson said the cost of using portables would top $12 million. Wilson also said FEMA, the state’s School Building Authority and the school system are committed to building new schools and that FEMA’s request only relates to where students will go to school until new facilities can be built. FEMA has not said it won’t pay for the portable classroom units, only that it wants the school system to consider other options that might be more cost-effective. If the school system would go forward with the portable-classroom plan without first getting the promise that FEMA would pay its share, the county or the SBA could be on the hook for millions. The Upshur County Development Authority has been awarded a $2,285,049 EDA grant for the Upshur County Knowledge and Innovation Business Center. This project consists of the construction of the new Business Center on property donated by the City of Buckhannon, which will host a small business development center to be managed by the Upshur County Development Authority. Small business development support services will be targeted to IT and other technology-based business interests. The Center will also provide flex-office and incubator space. Broadband access will be available at the facility as a result of a privately-funded initiative to address the current lack of broadband access in Upshur County. One technology
