Licensing Sub-Committee – Tuesday 3 September 2013 Rise, Third Floor To Fifth Floor, 1-4 Leicester Square, WC2 (St James’s Ward / West End Stress Area) – application for expedited review submitted by the Metropolitan Police. Under the provisions of the Licensing Act the Licensing Authority is required to consider within 48 hours of receiving the review whether it is necessary to take interim steps pending the determination of a full review of the premises licence. The Sub-Committee heard from the Police that an assault had occurred on the premises on 28 August 2013 with one man appearing to be hit by a metal bottle. The Police set out in the report and at the hearing that the venue had not called the Police, the men had not been detained and no crime scene had been preserved. The Police also had concerns that the premises had only been operating for a few months and there had been a previous GBH incident at the premises on 30 June 2013. The Police as part of the expedited review were seeking a reduction in hours from 03:00 to 02:00 hours as the incidents had taken place late into the night and it would give the premises the opportunity to improve its operation.

The Sub-Committee did not consider that the evidence at this stage warranted interim steps being taken before the full review. The Police were still investigating the incidents and Members were of the view that they needed to be in full possession of the full facts which were only likely to be received at the time of the full review hearing. .
Licensing Sub-Committee – Thursday 5 September 2013 Hyde Park Premier London Paddington Hotel, 14-16 Craven Hill, W2 (Lancaster Gate / not in stress area) – This was an application for exhibition of film to show pay per view films in hotel bedrooms and the sale of alcohol for consumption on the premises Monday to Sunday 24 hours a day. The specific concern of local residents was the use of the patio area for the consumption of alcohol in front of the hotel by hotel residents and guests and that it would change the character of the street. The Sub-Committee considered that the application was for a café style operation for hotel residents and guests (4 tables were proposed seating 2 persons per table) and not an alcohol led operation which might give rise to public nuisance. Labels, Basement, 23 Frith Street, W1 (West End Ward / West End Stress Area) – Application to extend the permitted hours for late night refreshment and the sale of alcohol to 01:00 Monday to Sunday, extend the sale of alcohol to 10:00 Monday to Sunday and extend the terminal opening hours to 01:30 Monday to Sunday. The Sub-Committee granted 1am for late night refreshment, the sale of alcohol and the terminal opening hours, considering that the premises could only operate as a restaurant. The Sub-Committee permitted the proposed commencement hour of 10:00 hours except on Sunday when midday applied. This is in line with the Council’s Core Hours policy. The applicant also sought to have a bar area available for customers prior to dining and after dining. The Sub-Committee considered that it was not appropriate for customers to remain in the stress area and drink after dining. Members also limited the numbers permitted to have a drink prior to their meal to 10 taking into account the capacity of 60. Grillshack, Basement And Ground Floor, 61-63 Beak Street, W1 (West End Ward / West End Stress Area) - Variation application for layout alterations at the premises which would be operated as a restaurant and fast food takeaway in the basement and ground floors. The Sub-Committee heard concerns from local residents that in the event the application was granted there would be greater intensification of use causing public nuisance from odours at the premises and takeaway being purchased and eaten in the vicinity. The Sub-Committee had heard that the applicant was seeking to have earlier opening hours than were on the existing licence although this had not specifically been applied for. The applicants were advised that the Council would interpret this as a breach of licence. The Sub-Committee took into account in granting the layout alterations the Environmental Health Officer’s point that the conditions proposed were more onerous than standard public nuisance enforcement conditions and there was an emphasis in the conditions for the applicant to ensure that no noise or odours that would give rise to a nuisance being experienced by residents. The Sub-Committee decided to prohibit the sale of takeaway food and drink after 23:00 hours when it becomes licensable.

Bocconcino, 19 Berkeley Street, W1 (West End Ward / not in stress area) – Application for late night refreshment: indoors Monday to Sunday 23:00 to 00:30 and sale of alcohol for consumption on the premises 12:00 to 00:30 hours. The Sub-Committee granted the proposed hours for the licensable activities Monday to Saturday as the premises could only operate as a restaurant. However, Members were aware of the saturation of licensed premises in the vicinity as had been pointed out by a local resident and granted Core Hours on Sunday (midday to 22:30 hours). Units 1.12 & 1.13, First Floor Units 12 And 13 Kingly Court, Kingly Court, W1 (West End Ward / West End Stress Area) – Application granted under delegated powers prior to the hearing. Grove End Food & Wine, 18 Abbey Road, NW8 (Abbey Road Ward / not in stress area) – Application by Premises Management – Licensing Authority for a review of the premises licence on the grounds of prevention of crime and disorder and protection of children from harm. The licensee had been written to following an inspection of the premises in May 2012, reminding him of his responsibilities as the premises had appeared to be unsupervised for short periods of time and young people had remained on the premises for long periods. In March 2013, alcohol had been sold to a Police Cadet who was 15 years old during a test purchase. The licensee’s representative stated that his client would ensure that all the conditions proposed by the applicant were complied with in the next couple of working days. The licensee was currently installing the required CCTV system and there were also conditions proposed that no super strength alcohol or single cans were sold. The Sub-Committee attached all the conditions to the licence and warned the licensee that if there was a breach of conditions he would be open to prosecution or a further review. If Members heard a review relating to a further sale to an underage individual it was likely it would lead to revocation of the premises licence. Maida Hill Place, 4 Fernhead Road, W9 (Harrow Road Ward / not in stress area) – Application for the premises to operate as a kitchen incubator and for venue hire purposes. The Sub-Committee heard concerns from the Environmental Health Officer that there were a range of licensable activities sought including regulated entertainment and there was a lack of precision how they would be applied. There would need to be specific conditions when external people wished to use the premises as a restaurant and also conditions when regulated entertainment was due to be played. He also had concerns about noise breakout from regulated entertainment. The Sub-Committee decided to adjourn the application to a later hearing in order that the applicant and Environmental Health were able to discuss in more detail conditions for when ticketed events took place and when pop-up events attended by the public took place. The local resident who had objected to the application would also need to be consulted. Regulated entertainment would feature in these discussions. West One Food Fayre, 85 Duke Street, W1 (West End Ward / not in stress area) - Application by Westminster Police Licensing Team for a review of the premises licence on the grounds of prevention of crime and disorder and protection of children from harm. There had been two test cases when alcohol had been witnessed to be sold to underage persons in April 2013 and June 2013. The Sub-Committee attached an extensive list of conditions to the licence proposed by the Police and

Environmental Health, including the implementation of a Challenge 25 policy and that no super strength alcohol or single cans would be sold. The licensee was warned that if there was a breach of conditions he would be open to prosecution or a further review.
