S. R. 0. No. 66/2013.- l u exercise of lhc powers conferred by sub· section (I) of section 2 1 of the Kerala Lifts and Escalntors Ordinance, 2012

(Ordmoncc No. 51 of 2012), the Government of Kerala hereby makes the following rules. namely:-

I. Short title a11d commcnccment.-(1) These rule> may be called the

Kerala Lift> <1nd Escalators Rules, 2012.

(2) They >holl come into force at once.

2 . Defitriflons. - (1) In these ru les, unlc>s the context otherwise requires,-

( a) "Authorised manu facturer" IllCflllS the manufac turer of Hft/ escalator approved b y the Department of l:lectrical Inspectorate;

(b) "Form" means fonn appended to these roles;

(c) '' Inspector" rncans an Electrica l ln•pcctor appo inted unde r Section 2 (d) of the Ordinance;

(d) "Licensee" me:.os the owner of the lifi!cscalator tO whom the hcense is granted:

(e) "Licensed Electrical Contractor" means the contractor who is licensed by the Kcrala State E lectrici ty Licens ing Board for carrying out e lectrica l works:

(f) "Local Body" means the Corpontion, Municipality or Panchayath;

(g) "Ordrnance" mean; the Kerala Lifts and Escalator:. Ordinance, 20 12 (Ordinfrnce No. 51 of 20 12);

(h) "section)' means section of the Ordinance.

(2) All other word' and expressions used herein and not defined shall have the meaning assigned to them rn che Ordinance.

3. Procedure for permission to erect a lifrlescalator or for making additions or tliteratiqn to existing lijil.escalalor.- (1) Every owner of a place intending,-

( a) to erect a lift/escalator is such place; or

(b) tO make additions <>r alterations to cxrsting lift/escalator shall make an apphca1ion in Fomt ''/\'' to the Inspector. Every such ;~pplication shall be accompanied by:

(i} Quadrupli cate copies of drawings duly signed by the applicant, authorised signatory of manufacturer of lifi!escalator to whom the lift/escalator erection work is entrusted and licensed electrical contractor to whom the e lectrica l e rec tion work is e ntrusted sho wing the fo llowing particulars, namely:-

(a) the schematic drawing of lifliescalator installation including the earthing diagram;

(b) Layoul of plan ofcrcction with machine details;

(c) Sectional elevation;

(d) Passenger capacity:

Provided that the additions or altcrati9ns proposed to be made 10 existing liftlc:::cala(or installation shall be sho\vn by distinct colour .

(ii) Copy of approva l obtained from the Local Body concerned for the 13ui1ding Plan;

(iii) An original chalan for ~ 2000 (Rupees Two Tll()usand only) l<>wards application fee fo r each life/escalator remicted in{O Government Treasury.

· (2) On receipt of an application under sub-rule (I) above, the Inspector shall after makin,g such scrutiny either grant permission in form "8'~ or refuse the pcnnis~ion within one month.

4. License for, working a liftlescnlator.- (l) Eve1y owner of a place who is permilted to erect a lift/escalator in such place under rule 3 shall on comple tion of such erection of lift/escalator intimate the matter to the Inspector and apply for a license. The intimation regarding the completion of the erection of lifllescalntor and the application for license shall be in J'onn "C" atong with the fo11owiog:-

(a) A work completion report of the erection of the lifllcscalator in Form "'Du as obtained from the authorised rnanufacturer of li fts or escalators;

(b) A completion report in Fonn "E";

(c) An original cha)an for fee of~ 2000 (Rupees Two Thousand only) towards the license remitted into a Govenunent Treasury~

(d) Copy of insurance policy taken by the owner of the li ft/ escalator, covering insurance for the person using such lifr/ escalator.

(2) On receipt of an applicar<qn under sub-rule (I) above the Inspector shall arrange for inspection of the lift/esca lator within fifteen days and if he is satis fied that all the tequircmcnts in accordance with the provisions of the Ordi.nance and these rules are complied with he may grant license in Fonn "F" within foftcen days from the date of receipt of report of rectification of defects if any.

5. Renewal of License.-{l) (a) An application for renewal of license to

work n li!Vescalator shall be made in Form "G" to the lnspe~tor three months prior to the date or" expiry of the license along with a fee of~ 1000 (Rupees Thousand only) for each lift/escalator remitted in a Govenuncnt Treasury.

(b) If the app lication For renewal of license along with fees and

copy of renewed insurance pol icy taken by the owner of the li ft/escalator

covenng insurance for the persons using the lift/escalator is not produced to

the Inspector within the period retcrred to in Clause (a) an additional fee of f 100 (Rupees One Hundred only) for each lift or escalator for the delay of

each month or a fraction thereof shall also be remitted m the Government treasury by the licensee and the chalan shall accompany the apphcation for rcnewnl of license.

(c) The application for renewal of license to work th~ Jill shall be

accep ted beyond one mon th from th e da te o f exp iry of license, if the

application in form "G" along with a fcc of ~ 2000 (Rupees Two Thousand only) per !ill/escalator is produced to the Inspector, otherwise tl1c ~upply to the

li!Ve>calator shall liable to be d•sconnccted.

(d) If the supply to the installation is disconnected under Clause

(c) above, rce<mncction will be etlccted only after complying the provisions under Rule 4

(2) On receipt of an application with the requ ired fees under

sub-rule (I), the Inspector shall make an inspection within filtecn days and on gelling himself satisfied that the provisions of the Ordinance and rules are comphcd wiU1 the Inspector shall renew the license in Form ""F"' within fifteen

days from the date of receipt of repon of rectification of defect> if any.

6. Application for /ice>O.ve in Cll>e of existing Lift/Escalator-{1) Every owner of a place in which a li IV escalator has been erected and is being worked

immcdit1tCly before the date of the commencement of rhc Ordinauce and is in opera tion shall apply in form "'II'" a long with a fee of~ 1000 (Rupees

One Thousand only) remitted in n Government treasury and u copy o f insurance policy for the persons using such li!Vcscalator and obtain license in Form "F"

within two months from the date of commencement of the Rules.

. (2) Existing lift/escalators which have been erected and being worked before the comrncllccmcnl of this rule is liable to be discontlccted if failed to ob~1in 1he license m l'onn 'F' as per rule 6 (I) above.

7. Term.< and co11ditions of license for worki!'g of liftlescnlntor. Every

lifflcse~~lator shall be opernled, subjecl lo the following lcm1s and conditions, namely.-

(I) The hcensec shall forthwith report to I he Inspector any defecl in the opcrut10n of the lifVescalator.

(2) The licensee shall nol t'arry out any additions or alterations to a

lift/escalator erected withou t obtaining permission in thut behalf from the Inspector as required under these rules.

(3) The licensee shall not usc the lift/escalator which is not in a safe

conditio11 8t1d shall be solely responsible for the safe maintenance of lift! escalator, so that these rules an: always complied wilh.

(4} The lllPilllcnWJcc ·or the liftlescaltator shall be done by llll authorized manuf.1crurcr of lifts or escalators.

(5) No other person shall willfully interfere with any mechanism of U1c I ift/esca Ia tor.

(6) Presence of at least one operator, trained by the mttnufactttrer, shall

be avai lable at the prcm i~cs during the lift!escalalor is in opcmtion.

(7} When lift/esca lator erected at any place ceased to be used as such,

the owner shall either remove it or maintain it in safe nlcchanical condilion

after disconnecting it entirely from tbe elctrie supply. /\II entries shall be

security locked, so as to prevent the accidental entry to prevent inadvertent use.

(8} All electrtcal works in connection with erection of lifts or

escalators shall be carried out in accordance with the provisions of the Electricity Act, 2003 and the Central .Electricity Authority (Measures Relating to Safety nnd Electric Supply} Regulation, 2010.
