1 Los Angeles '■ World Airports t- TM RESOLUTION NO. 26075 WHEREAS, on recommendation of Management, there was presented for approval, Second Amendment to Contract DA-4941 with Ricondo and Associates, Inc. to increase contract authority by $4,155,922 for a total contract amount of $15,066,322, extend the term two (2) years for a total term of five (5) years and modify the contract scope to include additional environmental documentation support for the proposed Landside Access Modernization Program at Los Angeles International Airport; and LAX WHEREAS, the Ricondo team has been instrumental in helping LAWA prepare the requisite environmental analysis to meet LAWAs milestone targets and address interagency questions and concerns throughout the process. Specifically, LAWA, with Ricondos assistance, completed the following actions as anticipated in the scope of work: Completed the CEQA Notice of Preparation and Initial Study with a thirty (30)-day public review period Completed modeling and CEQA analysis for the Draft EIR for noise, air quality, human health risk, and other impacts Completed CEQA analysis for the Draft EIR for traffic and performed extensive traffic modeling Completed the proposed Project Stormwater Management Plan (SMP) as a pilot study for implementation of the campus-wide SMP in addition to providing the necessary hydrology and water quality technical analysis for the Draft EIR Completed a Community Based Study as stipulated in the Community Benefits Agreement and incorporated recommendations into the Draft EIR Participated in numerous stakeholder outreach meetings with local municipalities, neighborhood groups and associations, and the Gateway Business Improvement District (BID) Initiated the NEPA process and conducted a NEPA EA Scoping Meeting Conducted extensive agency coordination with FAA, Federal Transit Administration (FTA), Federal Highway Administration, Environmental Protection Agency (EPA), SCAG, and AQMD to determine air quality conformity approach for NEPA analysis Draft EIR was released on September 15, 2016; and LA/Ontario Van Nuys City of Los Angeles Eric Garcetti Mayor Board of Airport Commissioners Sean 0. • Conducted extensive strategic planning and stakeholder coordination with respect to traffic impacts and mitigation with the Los Angeles Department of Transportation, CalTrans, Metro and SCAG

• Developed a traffic demand management program in consultation with LAWA, Gateway BID, and various City agencies designed to increase transit ridership

• Prepared conceptual land use plan, streetscape/landscape/open space/land use concepts, architectural/vertical element design guidelines and green building design guidelines in support of the City of Los Angeles entitlement processes

• Conducted strategic planning and stakeholder coordination in association with potential relocation of the Bright Star Secondary Charter Academy and the Stella Middle Charter Academy to facilitate the schools’ relocation

• Developed Standard Control Measures for LAWA and the proposed Project as a consistency guide for all of LAWA’s environmental documents; and

WHEREAS, the scope of the contract requires adjustment to replenish funds spent on unanticipated items and to complete the environmental and entitlement process due to the release of the Draft EIR. Ricondo will be authorized to complete the full scope of the environmental review to comply with CEQA and NEPA and approval through the City of Los Angeles entitlement processes. LAWA will request Ricondo to undertake the following:

• Continue coordination with Metro, FAA, FTA, SCAG and other regulatory agencies at the local, state, and federal level

• Respond to comments to the Draft EIR and prepare the Final EIR including coordination of public release and participation in certification hearings

• Complete entitlement approvals with the City of Los Angeles and local agencies including the preparation of new tract maps

• Provide project facilitation and agency coordination for the completion of CalTrans Project Study Report, Project Development Support and Intelligent Transportation Services coordination with Caltrans and local transportation agencies

• Complete and publish the NEPA draft and final document including participation in the associated public meetings

• Assist LAWA in addressing federal environmental clearances and NEPA process requirements; and

WHEREAS, funding for this contract is available in LAWA's operating and capital budgets in cost center 1140003. Staff requests that funds for the CEQA/NEPA Support Services be appropriated and allocated from the LAX Revenue Fund to the Landside Transportation Program Capital Projects and their respective Work Breakdown Structure Elements as may be required; and

WHEREAS, feasibility and planning studies for possible future actions, although such studies shall include consideration of environmental factors, is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Article II Section 2(d) of the Los Angeles City CEQA Guidelines; and

WHEREAS, Ricondo is required by contract to comply with the provisions of the Living Wage Ordinance; and

WHEREAS, Procurement Services Division reviewed this action (File 10038245) and set a mandatory 15% Small Business Enterprise (SBE) levels of participation for the project. Ricondo committed to 18% SBE participation and has achieved 31.19% participation to date;and

WHEREAS, Ricondo is required by contract to comply with the provisions of the Affirmative Action Program; and

WHEREAS, Ricondo has been assigned Business Tax Registration Certificate 0000951699­000-0; and

WHEREAS, Ricondo is required by contract to comply with the provisions of the Child Support Obligations Ordinance; and

WHEREAS, Ricondo has approved insurance documents, in the terms and amounts required on file with LAWA; and

WHEREAS, pursuant to Charter Section 1022, staff determined the work specified on this contract can be performed more feasibly and economically by independent contractors than by City employees; and

WHEREAS, Ricondo has submitted the Contractor Responsibility Program Pledge of Compliance, and will comply with the provisions of said program; and

WHEREAS, Ricondo has been determined by the Public Works, Office of Contract Compliance to be in compliance with the provisions of Equal Benefits Ordinance; and

WHEREAS, Ricondo will be required to comply with the provisions of the First Source Hiring Program for all non -trade LAX jobs; and

WHEREAS, Ricondo has submitted the Bidder Contributions City Ethics Commission form 55, and will comply with its provisions; and

WHEREAS, actions taken on this item by the Board of Airport Commissioners will become final pursuant to the provisions of Los Angeles City Charter Section 373;

NOW, THEREFORE, BE IT RESOLVED that the Board of Airport Commissioners determined that this action is exempt from the California Environmental Quality Act requirements; adopted the Staff Report; approved the Second Amendment to Contract DA-4941 with Ricondo and Associates, Inc. to increase contract authority by $4,155,922 for a total contract amount of $15,066,322, extend the contract term two (2) additional years for a total term of five (5) years and modify the contract scope to include additional environmental documentation support; and authorized the Chief Executive Officer to execute said Second Amendment upon approval as to form by the City Attorney and upon approval by the City Council.
