FOREWORD

History

This comprises the recodification of the Ordinances of the Township of LowerSwatara. The original Code of Ordinances of the Township was prepared by Penns ValleyPublishers and was adopted by the Board of Commissioners on February 10, 1982, by Ord.1982-3. The Township of Lower Swatara was incorporated as a Second Class Township onMarch 18, 1840, from parts of Swatara Township. On November 7, 1961, the Township ofLower Swatara become a First Class Township.

The Recodification of the Ordinances of the Township of Lower Swatara wasprepared by Penns Valley Publishers, a division of Fry Communications, Inc., and adoptedby the Township Board of Commissioners on November 15, 2000, by Ord. 448.

Organization

The Code contains four Parts which are; (1) the valid current Ordinances of theTownship of Lower Swatara contained in Chapters 1 through 27, (2) the Appendix, whichlists by abstracted title all Ordinances of a temporary or "one time" nature, (3) the Key tothe disposition of each Ordinance ever enacted by the Township of Lower Swatara, and (4)the Index, which is an alphabetical arrangement of subjects.

In the Code each Chapter is separated by a divider tab, and specific Ordinancescan be located by subject on the contents page at the beginning of each Chapter. The Indexmay also be used to search for a subject when one is looking for general information on aparticular subject, or if it is not known in which Chapter the subject might be found. TheAppendix consists of several general categories containing a chronological listing of shortsubject descriptions along with a reference to the original Ordinance and its date ofenactment, if known.

The Key to disposition indicates what action has been taken by the TownshipBoard of Commissioners with regard to every Ordinance ever enacted. An Ordinance haseither been (1) specifically repealed, (2) superseded by another Ordinance, (3) is located ina Chapter of the Code book, or (4) is located in the Appendix. Annual tax rate and budgetOrdinances are located only in the Key. The Key is a cross reference to the originalOrdinance books of the Township Board of Commissioners, and to the location within theCode of each Ordinance by number.

AN ORDINANCE ADOPTING THE CODE OF ORDINANCES OF THE TOWNSHIP OFLOWER SWATARA, DAUPHIN COUNTY, PENNSYLVANIA; CONSOLIDATING,REVISING, AMENDING AND REPEALING CERTAIN ORDINANCES; ENACTINGCERTAIN NEW PROVISIONS; PROVIDING A PROCEDURE FOR AMENDING THECODE AND FOR THE CITATION OF THE CODE AND THE EFFECTIVE DATETHEREOF; ESTABLISHING RESPONSIBILITY FOR MAINTENANCE OF THE CODE;SAVING CERTAIN PROVISIONS FROM REPEAL; AND PRESCRIBING PENALTIESFOR VIOLATION.

The Township of Lower Swatara hereby ordains:

Section 1. Adoption. The "Code of Ordinances, Township of Lower Swatara," asprepared and published for the said Township, is hereby adopted as a consolidation,codification and revision of the Ordinances of the Township. Chapters 1 through 27 thereofcontain the text of the body of all general administrative and regulatory Ordinances of theTownship of Lower Swatara organized as follows:

Index

The Appendix of the volume lists, by subject matter, in chronological order, the titles (oran abstract of title) of enactments of special nature or of historical interest, for the completetext of which the official records of the Township of Lower Swatara shall be authoritative.

Section 2. Citation and Effective Date. The codification referred to in Section 1 of thisOrdinance shall be known and cited officially as the "Township of Lower Swatara Code ofOrdinances," and all future Ordinances shall make reference thereto. This Ordinance shallbecome effective immediately upon publication of notice of final enactment as required bylaw.

Section 3. Saving Clause. The provisions of the Township of Lower Swatara Code ofOrdinances, so far as they are the same as those Ordinances and Regulations in forceimmediately prior to the adoption of said Code, are intended as a continuation of suchOrdinances and Regulations and not as a new enactment. The provisions of the Townshipof Lower Swatara Code of Ordinances shall not affect any suit or prosecution pending orto be instituted to enforce any of the prior Ordinances or regulations.

Section 8. Procedural Changes. The following minor procedural changes have beenmade to existing Township Ordinances:

Section 9. Amending the Code of Ordinances. The procedure for amending the Codeof Ordinances shall include the citation of the Chapter, Part, Section and subsection to beamended, revised, repealed or added as follows:

A. Amendment or Revision - "Chapter ___, Part ___, Section ___, Subsection___ is hereby amended [revised] to read as follows..."

B. Additions - "Chapter ___, Part ___, Section ___, Subsection ___ is herebyamended by the addition of the following..."

C. Repeal - "Chapter ___, Part ___, Section ___, Subsection ___ is herebyrepealed in its entirety."

Section 10. Responsibility for Code of Ordinances. It shall be the responsibility ofthe Township Secretary to maintain an up-to-date certified copy of the Code of Ordinances.This copy shall be the official copy of the Township of Lower Swatara Code of Ordinancesand shall be available for public inspection.

Section 11. Penalties. It shall be unlawful for anyone to change, alter or tamper withthe Code of Ordinances in any manner which will intentionally misrepresent the laws ofthe Township of Lower Swatara. Whosoever shall violate this Section shall, uponconviction thereof, be sentencd to pay a fine of not more than $600 and costs or, in defaultof payment thereof, shall be subject to imprisonment for a term not to exceed 30 days.

Section 12. Severability of Parts of Codification. It is hereby declared to be theintention of the Board of Commissioners that the Chapters, Parts, Sections, paragraphs,sentences, clauses and phrases of this codification are severable. If any Section, paragraph,sentence, clause or phrase of this Code is declared unconstitutional, illegal or otherwiseinvalid by the judgment or decree of a court of competent jurisdiction, that invalidity shallnot affect any of the remaining Chapters, Parts, Sections, paragraphs, sentences, clausesor phrases of this codification.

For all hearings, residential, commercial or industrial in nature, held before theAppeals Board, a fee of $500 payable in advance, shall be paid by the applicant orappellant to Lower Swatara Township to cover compensation for the secretary,compensation for Board members, notice and advertising costs, administrativeoverhead for the hearing, the appearance of the stenographer and any transcriptioncosts.

2. Upon conclusion of the proceedings and determination of the actual costs of the aboveitems, any unused portion of the fee will be returned to the applicant or appellant.When multiple hearings are necessary, a determination will be made by theTownship as to whether additional fees in increments of $500 should be depositedwith the Township. In the event that the actual costs exceed the amount of theoriginal deposit, such additional costs shall be paid to the Township by the applicantor appellant prior to the rendering of any opinion on the application or appeal.

3. No hearing shall be conducted before the Appeals Board before and until the abovefees have been paid.

Building Construction Permits

1. Purpose. Permit fees are collected to cover the costs associated with the CodeEnforcement Department that include in part permit application, plan review, theissuance of the permits, required on-site inspections and the issuance of a Use andOccupancy Certificate as required by the Uniform Construction Code.

2. Value of New Construction. The Building Valuation Data, as part of andcontained in this Resolution (p. xxi), shall be used to compute the minimum value ofnew construction. The Building Valuation Data represents the current averageconstruction costs per square foot. The average costs include structural, electrical,plumbing, mechanical, sprinkler systems, interior finish, and normal sitepreparation. This Building Valuation Data (BVD) was developed and is published bythe International Code Council. The BVD will be updated and printed at 6-monthintervals. The construction cost per square foot is calculated based on the averagecost (published in the July-August, 2008, Building Safety Journal).

Stormwater Management

1. Plan Review Fees.

A. Every application for approval of a Stormwater Management (hereinafter“SWM”) Plan shall be accompanied by a fee payable to the Township Secretaryin accordance with the following fee schedule:

(1) For areas of disturbance less than 1 acre, the fee is based on the squarefootage of new impervious area as follows:

(a) Less than 1,000 square feet $ 0

(b) 1,000–20,000 square feet $500

(c) Greater than 20,000 square feet–1 acre $700

(2) For areas of disturbance greater than 1 acre, the fee is based on thesquare footage of disturbed acres as follows:

(a) 1 acre–5 acres $ 1,000 + 300/acre over 1 acre

(b) >5 acres to 25 acres $ 2,500 + $200/acre over 5 acres

(c) >25 acres to 100 acres $ 6,700 + $100/acre over 25 acres

(d) >100 acres $14,300 + $50/acre over 100 acres

B. Every applicant shall pay to the Township Secretary the recording fee whichis based on the Dauphin County Courthouse schedule of fees. The recording feeshall be determined prior to the Township’s recording of the plan. Recordingfees shall be paid for all plans and documents as set forth in the provisions ofthe Lower Swatara Township Stormwater Management Ordinance [Chapter26].

C. Should the aforesaid fees be insufficient to cover the cost of the Township’sprofessional consultants or engineer for review of the plan, the applicant shall,when called on to do so, furnish additional amounts to cover all such reviewcharges.

2. Permit Fees.

A. None are required; however, zoning and building permits may be applicable.

3. Inspection Fees.

A. On or before the date on which the SWM Plan is to be considered by the Boardof Commissioners for approval, the applicant shall pay a check, payable toLower Swatara Township, an amount determined or approved by the TownshipEngineer sufficient to cover the costs of:

(1) Inspecting the site layout for conformance with the plan.

(2) Reviewing cost estimates of required improvements (as applicable).

(3) Inspecting required improvements during installation.

(4) Final inspection on completion of installation of required improvements.

B. Upon conclusion of the inspection and determination of the actual costs of theabove items, any unused portion of the fee will be returned to the applicant. Inthe event that the actual costs exceed the amount of the original deposit, suchadditional costs shall be paid to the Township by the applicant.

Claims

Interest at a rate of 10% per annum shall be collectible on all Township claims fortaxes, water rents or rates, lighting rates or sewer rates from the date of the filingof the lien therefore or, where the claim is for work done by the Township, from thedate of completion of the work after it is filed as a lien. 5. Connection, Tapping, Reimbursement and Special Purpose Fees.

A. Definitions. The following terms and phrases as used in this Section shallhave the meanings ascribed as follows unless the context clearly otherwiserequires:

(1) AUTHORITY - the Municipal Authority of Lower Swatara Township.

(2) CONNECTION FEE - a fee which shall not exceed the amount basedupon the actual cost of the connection of the property extending from theAuthority’s main line to the property line or curb stop at the property soconnected.

(3) EQUIVALENT DOMESTIC UNIT (“E.D.U.”) - a measure of volumeor flow or expected flow of sanitary sewage or industrial waste from animproved property as determined by the consulting engineer to theAuthority or Township, as applicable, in accordance with soundengineering practices; each such equivalent domestic unit being equal to228 gallons per day; and, further defined as follows:

(a) One E.D.U. equals 228 gallons per day.

(b) Each residential unit, including single-family apartment units andmobile homes, but not limited thereto, shall be equivalent to oneE.D.U. and charged as such when connected to the sanitarysewage system.

(c) All other users, including commercial/industrial users, but notlimited thereto, shall be charged a minimum tapping fee equal toone E.D.U. for each separate tenant within the building and inaddition to this minimum fee shall have their tapping feecomputed as follows:

Number of E.D.U.s = Average Daily Flow or Estimated Average Daily Flow 228 Gallons per day

Note: 0.01 to 1.0 E.D.U.s shall be billed as 1.0 E.D.U.1.01 to 2.0 E.D.U.s shall be billed as 2.0 E.D.Us, etc.

Equivalent Domestic Units (E.D.U.s) applicable to all users otherthan residential units shall be computed on the basis of averagedaily flow used during the calendar quarter preceding connection.Should there be no consumption figures available for the precedingquarter, the flow shall be estimated by the Authority Engineer andthe owner of such property billed accordingly. However, theAuthority reserves the right to adjust the number of E.D.U.sestimated based on the actual consumption figures obtained forsuch property at such time as construction of the building is fullycompleted and the building is fully occupied and for a period of oneyear after the completion of the structure and full occupancy of thesame.

For example, if the Authority estimates 25 E.D.U.s andactual consumption figures indicated 30 E.D.U.s, the propertyowner would be responsible for an additional 5 tapping fees.Likewise, if the Authority estimates 25 E.D.U.s and the actualconsumption is 15 E.D.U.s, but there are 20 separate tenantswithin the building, the Authority would rebate five tapping fees.

(4) SEWER LATERAL - the facilities serving the connected property fromthe property line or curb stop to the dwelling, building or structure to beserved.

(5) TAPPING FEE - a fee which shall not exceed an amount based upon allor some of the components as described in Act 57. [Res. 2005-R-7]

(6) TOWNSHIP - the Township of Lower Swatara, Dauphin County,Pennsylvania.

B. Connection. No person shall connect any improved property with any partof the sewer systems without first making application for and securing apermit, in writing, from the Township as provided by the ConnectionOrdinance [Chapter 18, Part 3]. Such application shall be made on a formprovided by the Township. [Res. 2002-R-7]

C. Tapping Fee. There is hereby fixed and imposed a tapping fee upon theowner of each improved property and whenever such owner hereafter shallconnect said improved property with the sewer system. The tapping fee shallbe imposed upon any connection to the sewer system regardless of whethersuch connection is direct or indirect, including changing the type of use ofproperty previously connected or connecting one or more new uses to anexisting connection, regardless of whether such property is connectedseparately or through one or more existing or new laterals or serviceconnection lines owned by the Authority or by any person other than theAuthority.

D. Amount of Tapping Fee. The amount of the tapping fee payable with respectto each connection of each improved property to the sewer system shall bedetermined in accordance with the following:

(1) Background. Act 57 requires a tapping fee to be based upon certainspecified parts or components. The Authority has researched itshistorical costs and its estimated cost and concluded that the applicableparts or components in the maximum amounts to be used in determiningsuch tapping fee per equivalent domestic unit basis are as follows:

The Authority hereby imposes a reimbursementfee payable with respect to each connection of improved property to thesewer system whose ultimate flow passes through that portion of thesewage system constructed by Watkins Motor Lines, Inc., and dedicatedto the Municipal Authority of Lower Swatara Township in the amountof $162 per E.D.U., $368 per E.D.U. for each connection of improvedproperty to the sewer system whose ultimate flow passes through thatportion of the sewage system constructed by Double M DevelopmentCompany, $160 per E.D.U. for each connection of improved property tothe sewer system whose ultimate flow passes through that portion of thesewage system constructed by R.A. Burkholder, Inc., $169 per E.D.U. foreach connection of improved property to the sewer system whoseultimate flow passes through that portion of the sewage systemconstructed by Phoenix Contact, Inc., $200 per E.D.U. for eachconnection of improved property to the sewer system whose ultimate flowpasses through that portion of the sewage system constructed by BaluPatel, and $262 per E.D.U. for each connection of improved property tothe sewer system whose ultimate flow passes through that portion of thesewage system reconstructed by Messick Construction, Inc. These feesshall not be applicable to any residential properties in existence as of thedate of this resolution, nor shall this fee apply to any users that theAuthority transfers from one treatment facility to another treatmentfacility. (3) Allocation of Tapping Fee/Maximum Permissible Tapping Fee.With respect to the tapping fee set forth above in the amount of $2,600per E.D.U., the capacity part of said tapping fee shall be $1,500 (58%),and the collection part shall be $1,100 (42%). [Res. 2005-R-7]

(4) Imposition of Special Purpose Part - Lumber Street Interceptor(Highspire). With respect to the special purpose part for the LumberStreet interceptor, all further development within the drainage basinserved by the Lumber Street Interceptor shall pay a special purpose partcomponent of $1,000 per E.D.U. at the time of permit application. TheMunicipal Authority of Lower Swatara reserves the right to enter intospecific agreements with owners and developers to do specificconstruction upgrades to the Lumber Street interceptor in lieu of thespecial purpose part. The special purpose part shall be in addition to allother connection and tapping fees and shall be payable at the time ofsewer permit application.

(5) Imposition of Special Purpose Part-Cherry Alley Interceptor(Highspire). With respect to the special purpose part for the LumberStreet interceptor, all further development within the drainage basinserved by the Cherry Alley Interceptor shall pay a special purpose partcomponent of $1,000 per EDU at the time of permit application. TheMunicipal Authority of Lower Swatara reserves the right to enter intospecific agreements with owners and developers to do specificconstruction upgrades to the Cherry Alley interceptor in lieu of thespecial purpose part. The special purpose part shall be in addition to allother connection and tapping fees and shall be payable at the time ofsewer permit application. [Res. 2002-R-7]

E. Connection and Inspection Fees. This Authority does hereby impose aconnection fee against the owner of the improved property whenever suchowner hereafter shall connect any such improved property with the sewersystem. The connection fee is charged for the connection of each improvedproperty by the owner of such improved property to the sewer system.

(1) Connection Fee ($500). A connection fee for each improved property,utilizing the average cost of similar or previous connections, is herebyestablished at $500 for the construction of the stub and the inspection ofthe same from the Authority’s main sewer to the property line or curbstop. Said connection fee shall include the cost incurred by the Authorityin constructing that portion of the lateral from the Authority’s sewermain to the property line or curb stop and the cost of inspection of thelateral from the property line or curb stop to the owner’s building.

(2) Inspection Fee ($250). Owners required to tap into the sewer systemof the Township who have previously had a lateral run from the sewersystem to the edge of the Township right-of-way at the owner developer’sexpense shall be required to pay an inspection fee of $250 payable at thetime of application of permit.

F. Mobile Home Reinspection Fee ($50). In the case of a connection of amobile home to an existing and previously improved house connection, eachowner or customer shall pay a mobile home reinspection fee of $50 to defraythe cost of inspection and administration required by regulation. Should theaforesaid fee be insufficient to cover the cost of the Township’s professionalconsultants or engineer for review or inspection, the applicant shall, whencalled on to do so, furnish additional amounts to cover all such charges.

G. Other Reinspection Fee ($50). In the case of a sewer lateral, which needsto be repaired, replaced or reconnected, each owner or customer shall pay arepair permit charge of $50 to defray the cost of inspection and administrationrequired by regulation. Should the aforesaid fee be insufficient to cover thecost of the Township’s professional consultants or engineer for review orinspection, the applicant shall, when called on to do so, furnish additionalamounts to cover all such charges.

H. All fees, and inspection fee or mobile home reinspection fee, shall be due andpayable at the time application is made to the Township to make suchconnection to the sewer system, as provided in subsection (B).

I. All fees shall be payable to the Treasurer of this Authority or to such other

officer or representative of this Authority as shall be authorized, from time totime, by resolution of this Authority, to accept payment thereof.

Solid Waste and Recycling Program

An administrative service fee is set at $2 per quarter ($8 per year) per residential unit asbid by the contractor and shall be reflected on and collected with the contractor's quarterlybilling.

Street Openings and Excavations.

1. Improved Roadway Surface. Permits issued for trenching, tunneling, boring ordrilling from one side of a street, alley or thoroughfare to the other shall be $35 fora length not to exceed 25 feet, plus $1 for each additional foot or fraction thereof.

2. Unimproved Roadway Surface. Permits issued for trenching along a street, alleyor thoroughfare shall be $35 for a length not to exceed 25 feet, plus $5 for eachadditional 100 feet or fraction thereof.

3. Curb or Sidewalk Cuts. Permits issued for curb or sidewalk cuts shall be $5.Curbs and sidewalks shall only be removed in sections extending from expansionjoint to expansion joint. Replacement shall be according to Township specifications.

4. Utility Pole Placement. Permits issued for the erection or replacement of utilitypoles, whether located within the cartway or dedication of every street, alley orthoroughfare shall be $5 for one to five poles and $1 for each pole in excess of five, inevery permit issued hereunder.

Subdivision and Land Development

1. Fee in Lieu of Dedication of Land for Recreation Purposes. $1,500 per resi-dential unit (§22-510). [Res. 2003-R-9]

2. Plan Approval Fees.

A. A plan of six lots or less may be submitted as a preliminary/ final plan in accordance with the provisions of the LowerSwatara Township Subdivision and Land Development Ordinance [Chapter22].

B. Every application for approval of a preliminary plan, final plan or preliminary/final plan shall be accompanied by a fee payableto the Township Secretary in accordance with the following:

(1) Residential Subdivision Plan $ 500 plus$ 20 per lot

(2) Residential Land Development Plan or PRD. $ 500 plus$ 20 per unit

(3) All Other Subdivision or Land Development Plans. $ 500 plus

$ 40 per acre

C. Every applicant shall pay to the Township Secretary a fee of $50 for therecording of all plans and documents as set forth in the provisions of the LowerSwatara Township Subdivision and Land Development Ordinance [Chapter22]. In the event that the actual costs exceed the amount of original deposit,such additional costs shall be paid to the Township by the applicant prior torecording of plans or documents.

D. Should the aforesaid fees be insufficient to cover the cost of the Township’sprofessional consultants or engineer for review of the plan, the applicant shall,when called on to do so, furnish additional amounts to cover all such reviewcharges.

Transient Retail Business

1. License Fee (15 days) (§13-102) $ 50

Zoning Fees (§27-2705)

1. Zoning Permit. The fee for a zoning permit (or for a temporary zoning permit) shallbe as per schedule below. Such fee shall be payable at the office of the Zoning Officerupon making application for such permit, and no permit shall be issued until suchfee is paid.

A. All construction of structures greater than 1,000 square feet and/or requiringa building permit shall be charged a zoning permit fee of $1 per $1,000 ofconstruction value or fraction thereof, with a minimum fee of $20.

B. All construction of structures where a building permit is not required shall becharged a fee for zoning review as follows:

Accessory structures, including detached garages-Up to 250 sq. ft.-251 to 500 sq. ft.-over 500 sq. ft.

2. Hearings and Appeals before the Zoning Hearing Board.

A. For all hearings, residential, commercial or industrial in nature, held beforethe Zoning Hearing Board, a fee of $500, payable in advance, shall be paid bythe applicant or appellant to the Township of Lower Swatara to covercompensation for the Secretary, compensation for Board members, notice andadvertising costs, administrative overhead for the hearing and one-half of theappearance fee of the stenographer, and transcription costs.

B. Upon conclusion of the proceedings and determination of the actual costs of theabove items, any unused portion of the fee will be returned to the applicant orappellant. When multiple hearings are necessary, a determination will bemade by the Township as to whether additional fees in increments of $500should be deposited with the Township. In the event that the actual costsexceed the amount of the original deposit, such additional costs shall be paidto the Township by the applicant or appellant prior to the rendering of anyopinion on the application or appeal.

C. No hearing shall be conducted before the Zoning Hearing Board before anduntil the above fees have been paid.

3. Changes or Amendments to the Zoning Ordinance or Map.

A. For every application for a change or amendment to the Zoning Ordinance orMap, a fee of $500, payable in advance, shall be paid by the applicant to theTownship of Lower Swatara to cover the actual costs incurred for advertising,mailing notices, and services of attorneys, stenographers, engineers andconsultants as may be required to properly process the application.

B. Upon conclusion of the proceedings and determination of the actual costs of theabove items, any unused portion of the fee will be returned to the applicant.In the event that the actual costs exceed the amount of the original deposit,such additional costs shall be paid to the Township by the applicant prior tothe rendering of any opinion on the application. 4. Home Occupation License.

A. The license fee for all applications for home occupation use shall be $25. Thisfee shall be required for any original license issued to any applicant, as well asthe annual renewal of each license.

B. All residents within the Township of Lower Swatara, Dauphin County,Pennsylvania, desiring to operate a home occupation use, shall apply to theTownship in writing prior to the issuance of each original license and eachannual renewal license.

C. Each such application shall be reviewed by the Lower Swatara Township CodeEnforcement Officer who shall approve or disapprove such application and

issue or not issue the aforesaid license, which license shall be entitled“Certificate of Home Occupation.”
