MEMRANDUM FOR SEE DISTRIBUTION

SUBJECT: Contingency Shipments of Radioactive Materials

1. Radioactive canrrdity shipInents have been delayed for wipe testing atcertain Azrmy depots and other AnrTy locations. Do not delay these shinrents.The following information which was checked with both the Department of

Transportation and Nuclear Regulatory Carmission will assist in expeditingshipments.

a. To meet shipment schedules, depots should expedite testing in advanceof need, wipe test several packages at a time with a single wipe and anal!vzethat wipe in lieu of testing each package with individual.wipes. Original ornew packaged carrcdities do not remuire wipe testing as long as the packag---ghas not been damaged. Army installations receiving shipments frcn depots orcontractors can reship to any consignee provided the original packaging hasnot been damaged or altered in any nanner. This is in accordance with Title49, Ccde of Federal Regulation Part 173.7 (a).

b. LAW Title 49, Code of Federal Regulations, Section 173.443, Depart-rent of Transportation has authorized Army organizations to use a visualcheck as an alternate to wipe testing Army contingency radioactive materialshipnent/receipt packages. Based on Army's control and provided that suchpackages have been previously tested, a visual check that the package or ccar-modity is not cbvicusly damaged is sufficient for further ship-rent or use.Shipment of undamaged packages and camicdities should proceed while obviouslydamaged items are held for testing. Packages frcn depots, TMDE units andmanufacturers will have been previously tested.

c. Title 49, Code of Federal Regulations,_ Part 173.7 (b) states, "Shin-rents of radioactive materials, made by or under the direction or supervisionof the U.S. Departnent of Energy or the Department of Defense, and which areescorted by personnel specifically designated'by or under the authority ofthose agencies, for the purpose of national security, are not subject to theregulations in Parts 170-189 of this subchapter." -

d. In addition to the DoD exErution in para c above and the exetquantities published in Title 49, other exemptions which- can be used toassure prcnpt shipments for contingencies are DOT-E-9232, DOT-E-3498, orDOT-E-2136 (encls 1, 2, and 3).

to clarify ambiguities

In issuing the exemption, it was my intention to grant to the Department ofDefense (DOD) sufficient flexibility to move essential material in an expeditious

.manner without experiencing unnecessary delays that may be encountered if strictadherence to the Hazardous Materials Regulations (HMR) were required. However,it was intended that the exemption would only apply to cases involving declarednational emergencies or In cases in which, due to unforeseen events, the nationalinterest would requireisuch .exp.edtious movement. To make thi., point clear, I ammodifying the exemption.-

It must be emphasized that DOT-E 34H does not apply t6 ouLini DOD logiitickJoperations or to scheduled maneuvers that are conducted routinely and which maybe characterized as pre'-planned events, In such cases, I find no basis forapplication of the exemption in the public of national interest- and, therefore, DODis expected to conform to the FIMR during routine operations unless specifiedotherwlse In an exemptl6ri other than DOT-E 3498.

U.S. Department of Defense (DOD), Washington, D.C., Is hereby grahted anexemption from those -provisions of this Department's' Hazardous MaterialsRegulations specified in paragraph 5 below to offer hazardous materials describedherein..for transportation in .commerce subject to the -limitatlons •nd specialrequiremnents specified hereir.f-This exemption provides no relief from any regulationothe'r-than as specifically stated.

2.. BASIS. This exemption is based on DOD's application dated September 30, 19S0,supplemented by letters dated November 25, December 2, 1980, August 12, 1981 andOctober 21, 1981, submitted in accordance with 49 CFR 107.105,

3. HAZARDOUS MAýTERIALS (Descriotor and clasý). Vehicles loaded withmilitary explosives"- classed as e. lostves A, B or C, and other hazardous materialsessential for ml.it&ry operations (e.g., oxygen, acetylene, medical supplies, etc.).

4. PROPER SHIPPPING NAME (45 CFR 172.101).

a. The proper shipping narne for each hazardous material asprescribed in S172.101.

5. REGULATION AFFECTED. 46 GFR Subparts 6,0f-?in, 114,n5 and 140Sections 146.29-43 to and including 146.29-100; 49 CP. Subpart B, of Part 107, Parts172, 174,176.3, Subparts B, C, D, F, H, 1, J, L, M4, N, 0 of Part 176, Part 177.

"6. MODES OF TRANSPORTATION AUTHORIZED. Motor vehicle, rail freight,cargo vessel.

7. SAFETY CONTROL MEASURES.

a. Ammunition must be transported in starndard DOD packagings,with fuzes (if removable)'in'separate packagings.

b. Fu ueVtanks of vehlcleg may'not be'filled to more tharn 75% oftheir capacity.

c. Additional fuel may be carried in 5 gallon packaging meetingor equivalent to DOT specification 5L. Further, shipment of 5 .gallonpackagings Is permitted only if: (1) packagings are secured In the.vehicle in buIlt-in" cradles designed for such purpose, or. (2) thepackalngs" are carried In standard DOD packagings. This p'agraph"does not apply to diesel fuel which may be carried In any packagingmeetiig DOD specifications.

d. . If the holds of .compart.ments In which vehicles rre loaded aremechanically ventilated, the restriction specified in $S176.905(c)pertaining to conn.ected battery cables does not apply.

e.' Loading and stowage of military :explosives and otherhazardous materials within vehicles shall be in. accordance with ... .-

For cargo vessel movement, where It is shown to the.satisfaction of the Coast Guard Captain of the Port having.jurisdiction that it *is impractical to comply with a spenificrequirement in 46 CFR Part 146, 49 CFR Parts IOD-179, or anyprovision of this exemption, the'Captain of the Port may issue awritten waiver of that requirement including a reference to thisexemption.

f. The 49 CFR Part 107 Appendix B (1) requirement for markingeach package with the exemption number is waived.

g. A copy of this exemption must be carried aboard each vesseltransporting packages covered by this exemption. Also, forshipment'by.rail, a. copy of this exemption must accompany theshipping papers.

Department of Defense, Washington, D.C., is hereby grantedan exemption from certain provisions of this Department'sHazardous Materials Regulations to offer packages prescribedherain of radioactive material& with explosives fortransportation in commerce subject to the limitations and stecialrequirements specified herein. This exemption authorizes shipnentin Department of Defense approved containers and packaging andloading by the Department of Defense without carrier inspection,and provides no relief from any regulation other than asspecifically stated.

2. BUIS. This exemption is based on the DepartmQnt ofDefense's application dated January 3, 1990, submitted inaccordance with 49 CFR 107.105 and the public proceeding thereon.

3. HAZARDOUS P ATERIALS (Desoriptor and class). Radioactivematerials with explosives subject to security considerations,classed as Class A explosives.

C. Department of Defense (DOD) shipper must, in lieu ofthe railroad representative's signaturQ, write or stamp onthe car certificate: "FINAL INSPECTION MADE UNDER DOTEXEMPTION NO. 2136.11

d. DOD is also exempted from the requirements of Sections173.1(b); 174.3(4), 177.801 and 177.802 of the designated

- regulations relating to the requirements for marking," label*ing, description, and the methods of manufacturing,packaging and stbrage, or the loading and staying thereof,shall not be open to inspection except when authorized bythe DOD. The DOD must insure that the loading andstaying of all cars and vehicles is such as to preventshifting of the lading under normal transportationconditions.

e. Provisions of Section 174.10(a) as they apply tointerior of cars and lading at interchange points are hereby waived.

f . nail cars containing shipments as described above mustbe transported under military escort and be placed in trainsaccording to Section 174.90(a), except that when the trainlength permits they must be placed not closer than five carsfrom any other placarded rail cars in the train in whichthey are transported. The rail cars occupied by escorts maybe placed next to but must be behind the rail carscontaining the shipment. Shipments made by highway must betransported under military escort.

g. -Rail cars and motor vehicles containing shipmentsconsisting of radioactive materials with explosives must beplacarded EXPLOSIVES. When cars- or vehicles containexplosives and .radio active materials, sufficient advicemust be furnished the carrier of the material or hazardsinvolved to insure that proper precautions for safe carriageor accident prevention can be arranged. -"

h. Except as provided herein, DOD must roquire that allshipments made under this exemption will be in accordancewith DOD's instructions and directives covering shipments ofradioactive materials with explosives.

2. BASIý. This exemption is based on DOD's application dated Jazus-' 23,1990, submitted in accordance with 49 CFR 107.103 and 107.105 and the publicproceeding thereon, and supplemental correspondence dated October 13, 1588.

3. E.AzARDOUS MATERIALS (Descrintor and class). Aircraft loaded vithmilitary explosives and am=unirion - classed as explosives A) B, or C andother hazardous materials essential for military operatioms.

4. PROPER SHIPPING NAME (45 CFM 172.101). The proper shipping name foreach ha:ardous material as prescribed in Section 172.101,

5. REGULATION .AFFECTED. 49 CFR Subpart B. of Part 107, Parts 172 and 175.

6. MODES 0? TRANSPORTATION AUTEORIZED. Cargo-aircraft only andpassenger-cArrying aircraft. (See exemption DOT-E 3498 for authorized ,urfacetransportation)-

7. SAFETY CONTROL MEASURES.

.A. Authorized Airpraft. The aircraft to be used must. be (1) U.S. civilaircraft allocated to Stage III of the Civil Reserve Air Fleet (CP.Kr) ?rogre,(2) U.S. tvil Aircraft, not i-n the CRAP Program, whLih -are priori•-zed orallocated by the Department of Transportation to augmen t defensk airliftcapability or (3) Foreign-flag aircraft made available to the UVnited StatesGovernment (USG) through foral Security Agree-a-ts betveen the USG and theinvolved foreign government(s).

B. Authorized Hezardous Haterials, Hazardous materials authorizedby this exemption are limited to materials authorized to be transportedby motor vehicle in conformance with 49 CFR Parts 107, and 171-179.

C. Operational Reauir-epents .

(1) The DOD must have advance permission from the owner or opqtrgor of

each manned airport where the matarial is to be'loaded or unloLded orwhere the aircraft is tCo land while the aterial is on board.

(2) Prior to its use, the name of each airport being used in movingClass A and B explosives shall be designated by DOD for use under thisexemption and must be provided to the Office of Hazardous l.aterialsTransportatlon (OHHT) accompanied by a copy of the airport operator';written approval (Note: This latter requirement should be accc--plishedby preplanning which results in predesignation of airports anddesignated locations at airports for loading and unloading ofexplosives).

(3) .-7 When the des-tinaticn is changed after departure because cf Veatheror other unforesepn circu=3sances, permission free the owner cr operatcrof the alternate airpcrt shall be obtained as soon as practicable.

(4) Each shipment =oving under this exemption must be accc_;a:_!d b-" iDOD representative at all time.s

(5) Loading and stowage of militgiy explosives (including =urit.ion)and other hazardous materials within aircraft shall be in accordancewith procedures specified in AFR 71-4. All loading and unloadingoperations under this ex--ption shall be monitored by a qualified DODrepresentative to ensure ccmpliance with the prescribed prcceduracof kSR 71-4.

(6) During loading and Unloading, no person may smoke, carry a lightedcigarette, cigar, or pipe, or operate any device capable of cmus.ing anopen flame or spark vwithi.n 50 feet o! the aircraft.

(7) Unless emergency ccnditionB prescribe otherwise, the loadin. andunloading of the asircraft shall be conducted at a safe distance fromheavily populated areas, and from any place of human abode orassembly. 1Powever, at an a'rport where'the airport owner, operator, crauthorized representative thereof has designated a specific locati.n forloading or unloading, explosives may -not be loaded or unloaded at apyother location,

(8) No fueling operations of the aircraft mxf be conducted duri-: the

loadiný and unloading of explosives.

(9) Fuel tatks of vehicles may not be filled to more than 75X of theircApacity.

(10) Additional fuel may be carried in 5 gallon packagings meetin2 orequivplent to DOT Specification 5L. This paragraph does not apply todiesel fuel vhich may be c.arried in any packaging meeting DOD -

specifications.

(11) Operation of the aircraft during take-off -enrouteI and landingmiust be conducted at a safe distance from heavily populated areas.

a. Beforn movement of the aircraft prior to take-off, the pilotof the aircraft shall notify the control tower of the class(Q;) ofexplosive(s) (including ammunition) on board,

b, The pilot of the aircraft, prior to entering an airporttraffic area, shall notify the control tower of the clans(es) cfexplosive(a) (including ammunition) on board and request thisiuformation be relayed to the appropriate airport officials,

. .- c, When under radar control during the approach gnd landingphase, the pilot shall request appropriate vectors so to to avoidheavily poptflated areas.

(12) No person-other than a required flight crewaymbor, at FAAinspector, the shipper or consignee of the material or a reprsentative.of the shipper or cons'_gee so dasignated in vriting, military forctinecessary for execution of a contingency action, 'or a person neceasar.for handling the material csy be carried on the aircraft. Prior tot take-off, all crevrenbers will be instructed in proper procidures tc befollowed during an emergency involving hazardous materials.

8. SPECIAL PROVISIONS.

a. This exemption applies only to emergency movment•s during (1) xdeclared National Emergency or (2) in defense crisis conditions whichrequire the activation of arr s tage of the CRAF Program or the use c!Foreign-flag aircraft made available to the USC pursuant to formalSecurity Agreements between the USG and the involved foreigngovarnment( a).

b, Except as otherwise stated in this exemption, the followinSregulations do not apply to operations performed in conformance Viththis exemption: 49 CPR, Appendix B to Part 107; and Parts 172 and175*.

c6 Shipping papers are required for all hazardouz material carriedunder this exe=ption.

d. A eopy of this exemption must be carried aboard each aircraftoperatin under this exemption.

e. This exemption authorizes transportation of hazardous =aterials inaircraft of United States registry or in aircraft of foreign registryioperating within the jurisdiction of the United States, It does notgrant authority to use foreign controlled airspace or airpcrts outsidethe United States,
