Cllr Devine recently led a delegation from St Brigid’s Action Group to the Dublin Mid Leinster Health Forum to seek clarification from the HSE on the future of the nursing home. The delegation had expressed their frustration at the Health Forum for failing to progress the matter and they presented the HSE with a cost analysis that clearly showed the ludicrous and wasteful practise of retaining patients in acute care at Tallaght hospital at a cost to the taxpayer of approximately €1,000 per day as opposed to €280 per day at St Brigid’s. Cllr Devine continued: “Seven months ago the Fine Gael/Labour Government issued a closing order on this unique facility which caters exclusively for elderly, frail and high dependency female patients. “Following months of pressure and the passing of Sinn Féin motions to the Health Forum on behalf of myself and party colleague Cllr Cathal King a three year reprieve was granted. “66 beds will remain in the newly upgraded lower units of St Brigid’s and it will be possible to use these units in the short term while complying with the current HIQA standards. This is a victory for everyone a VicTORY fOR cOMMON SeNSe who campaigned so determinedly for this important healthcare amenity to remain open and it is a victory for common sense.” Both Councillors pledged to work with their party colleague Seán Crowe TD and the formidable Action Group to secure the long-term future for this much needed public health faclity. Cllr King said: “Work is in progress to upgrade the facility and it should return to full

It was reported lastyear (by the MotorInsurance Bureau ofIreland) that 5/6% ofthe Irish population gowithout motorinsurance and the IrishBrokers Association hascalled on the State toconfiscate the cars ofthose who drive withoutinsurance as theybelieve that the currentpenalty mechanismisn’t working. According to BrianMcnelis, Director ofGeneral Services at theIrish BrokersAssociation, “There are490,534 licensedprivate cars in Dublinand it’s estimated that29,400 of these couldbe uninsured. What thegeneral public in Dublin

may not know is thatthese uninsured driverscould be indirectlycosting them anadditional €30 on theirannual car insurancepremiums”.Figures show that 2286claims payments weremade by the MotorInsurer’s Bureau ofIreland (MIBI) in 2010totalling €58.9m inclaims compensation,legal and medical costscaused by uninsuredand untraced drivers.The figures for 2011have not been releasedas yet however, theIrish Brokers Associationdon’t expect to see anyimprovement in theoverall volume or cost.They say that claimsare paid by the MIBI,

which is 100% funded bythe motor insurers andthat the funds to payfor such claims aremade up of consumer’smoney as they arefunded out of theinsurance premiumspaid by other drivers –approximately €30 perdriver.The experts say thatmotor insuranceoffences are punishableby a fine of up to€2,500, disqualificationof one year or more fora first offence and twoyears or more for asecond offence, and, atthe discretion of thecourt, a term ofimprisonment notexceeding six months,though these maximumpenalties are rarely

imposed. Where thecourt decides not toimpose adisqualification, driversconvicted of a firstoffence of drivingwithout insurance willincur 5 penalty pointson their licence recordin addition to any otherpenalty imposed by thecourt.

Brian concluded,“However, if claimsgrow so too will theamount insurers needto contribute to theMIBI... which meansthat these increasedcosts will be borne byconsumers in general.This is unfair on thosewho are compliant andpay annually for theirmotor insurance”.

A research paper publishedin ‘Tobacco Control’ by theBritish Medical journal (BMj)shows that tobacco controlpolicies implemented inIreland between 1998 and2010 have contributed to areduction in smokingprevalence, and also showsclose to 2000 fewer‘Smoking AttributableDeaths’ (SAD’s) over thesame period. The researchesmakes an estimate, based oncurrent policies, of over50,000 less smokingattributable deaths by 2040.Professor Luke Clancy,Director of the TobaccoFreeResearch Institute and oneof the authors of theresearch said, “In the lastdecade or so, Ireland hasmade immense strides in thearea of tobacco control. Wehave introduced SmokefreeWorkplaces to the world; wehave extended marketingrestrictions; improved

health warnings; raisedtaxes and increased theavailability of cessationservices. It will be importantfor Government and othersto have it established thatthere are positive outcomesto these measures; despitethe ongoing efforts of profitseeking vested interests tocontinually block healthmeasures, when tobaccosales might be affected”The research was based onthe SimSmoke model, whichselects one baseline year –before major policyinterventions commence.(1998 in this case) In 1998we had the first nationalSurvey and Attitudes tnutrition (SLAn) survey, andthis provided us withaccurate baseline date, onwhich to base the research.Professor Clancy went on tosay, “our research shows arelative decrease in male (18years and over) smoking

Sinn Féin DublinMid-Westrepresentative Eoin ÓBroin has said that CSOfigures “show a sharprise in the number ofpeople on the liveregister in Clondalkinand Lucan.” The figuresfor May show that 9,261people signing on, anincrease of 255 on theprevious month.

Ó Broin said: “Thelatest CSO figuresreleased last weekshow a sharp rise in the

number of people onthe live register inClondalkin and Lucan.At the end of May therewere 9,261 peoplesigning on, an increaseof 255 on the previousmonth.“Once again DublinMid-West isexperiencing a higherlevel of unemploymentthan elsewhere. At atime when the overalllive register figureremains staticClondalkin and Lucanare experiencing a rise

of 3%.“There is an urgentneed for theGovernment to look atconstituencies such asDublin Mid-West toidentify the causes ofthe higher than averageunemployment . Thereis also a need forincreased levels ofinvestment to getpeople back to work.“In the weeks leadingup to the referendumvote GovernmentMinisters waxed lyricalabout the need for a

‘growth agenda’.“Talking about jobsdoesn’t get people offthe dole. Onlyinvestment, by theGovernment, in real jobcreation will addressthe unemploymentcrisis.

“The Governmentneeds to spell out whatit intends to do to getpeople off the dole andback to work. Words arenot enough; the peopleof Dublin Mid-Westneed action”.

Grant onLine aPPLicationRobert Dowds has welcomed the introduction ofthe new central online system for student grantapplications which went live last week. “In the past, students and parents had to applyto their local authority or VEC for a grant. Theprocess was not centralised and each authorityor VEC had their own criteria and applicationprocess. This new system, SuSI (Studentuniversal Support Ireland) will process allapplications and distribute payments to studentsfor the coming academic year. “The application process is quick and easy to useand should see an end to the long delaysencountered by students in the past whereapproval and payment often took a long time.In future payments will be made electronicallyon a monthly basis throughout the academicyear. SuSI is run by City of Dublin VEC where 65staff will operate the new system. not only willthe whole process be more beneficial tostudents, it will actually save the taxpayerapproximately €5 million in efficiencies once thetransition is complete. “I would like to reiterate the Minister forEducation and Skills, Ruairí Quinn's advice tostudents and their parents to apply on-line assoon as they can through the website atwww.studentfinance.ie. “

Sinn Fein representative in Dublin MidMid-West Eoin Ó Broin had called on theGovernment to honour its commitment toinclude the issue of same-sex marriages aspart of their review of the Constitution.

Ó Broin said that "under the Civil PartnershipAct 2010 same sex couples cannot marry,although they can enter a 'Civil partnership'.While this is a step in the right direction it'snot far enough. Civil Partnerships do notoffer the same benefits and protection asMarriage in legal terms."A civil partnership does not permit childrento have a legally recognised relationship withtheir parents - only the biological one. Thisleads to massive problems in terms of

custody, benefits, guardianship etc."The Fine Gael-Labour Programme forGovernment contains a clear commitment toinclude the issue of gay marriage in theforthcoming Creview of the Constitution.However it appears that due to pressurefrom back bech Fine Gael TDs theGovernment may not honor thiscommitment. One thingconsumers can becertain of however isthat they have rightsand entitlements ifsomething goes wrongon their travels.However, it isimportant forconsumers to knowexactly what theserights are so that theycan make sure they getthe benefit of them.

FLIGHT DELAYS ANDCANCELLATIONS

When flying in theE.u., consumers haverights if theyencounter problemssuch as delays andcancellations.Depending on theflight distance and thelength of delay,consumers may beentitled torefreshments, meals,phone calls and anovernight stay.

If the delay is morethan two hours, theairline should informyou of the problem.Disrupted passengersmust receive adequatecare and part of this isreceiving information.If the delay is morethan 5 hours,passengers are entitledto look for a refund forthe part, or parts, ofthe journey notcompleted. If yourjourney has alreadystarted and youroriginal travel plansare no longer feasiblebecause of the delay,you can request toreturn to the firstpoint of departure atno extra cost andreceive a refund forthe part of the journeyalready made. Theairline does not haveto offer an alternativeflight. If your flight iscancelled withoutnotice or overbooked,you have the right tochoose between beingre-routed to yourdestination or havingthe price of your ticketrefunded. If yourequest a refund, youno longer have a rightto further assistance orre-routing.

If your flight iscancelled withoutnotice or arrives morethan three hours late,you may be entitled tocompensation of

between €250.00 and€600.00. The amountof compensationdepends on the lengthof the flight. If theairline offered you analternative flight with asimilar schedule, thecompensation you areentitled to may bereduced by 50%.Consumers are notentitled tocompensation if theflight cancellation wasbecause ofextraordinarycircumstances. Thatsaid, the airline mustoffer you the choicebetween a refund andbeing re-routed.

When airlines give atleast two weeks noticeof changes, most ofthese rights no longerapply. However,passengers should stillbe given a choicebetween re-routing totheir final destinationor a refund. If anairline cancels a flightand informs you twoweeks before thescheduled flight dateand offers you analternative flight forthe same route with asimilar schedule to theoriginal one, youcannot claimcompensation.

Beyond these rights, ifyou have travelinsurance, it may alsocover flight delays andcancellations, or evenairline insolvency, socheck the terms andconditions of yourpolicy.

MAKING A COMPLAINT

To apply forreimbursement orcompensation, you cancomplete the E.u. airpassenger rightscomplaint form andsend it to the airline(www.ec.europa.eu/transport/passengers/air/doc/complain_form/eu_complaint_form_en.pdf). If you areapplying for a refundfor any assistance suchas meals oraccommodation, keepall receipts so that youcan include them whenyou submit your claim.Also keep a copy of thedocuments yourself. If

LUGGAGE PROBLEMS

If your luggage fails toshow up at baggagereclaim, report theproblem to the airlinein the baggage hall andcomplete a PROPERTYIRREGULARITYREPORT or PIR. Keepyour boarding card andthe sticker given to youat check-in. This willhave your bag’sreference number. Youwill also then need toclaim to the airline.under the MONTREALCONVENTION claimsmust be made within acertain time period.Submit your claim inone week for damagedluggage, or threeweeks if your luggagewas delayed.

Consumers can claimcompensation if theircheck-in luggage islost, damaged ordelayed. If travellingwith expensive items,it is advisable to takeout private travelinsurance. Whentravelling by ferry,claims can also bemade for lost ordamaged luggage and alost and/or damagedvehicle including anyluggage in or on yourvehicle.

AIRLINE INSOLVENCY

Because flights areoften booked well inadvance of travel, thisleaves consumersvulnerable if the airlinebecomes insolvent.Currently there is littleprotection forconsumers if thishappens. Last year, theEUROPEANCOMMISSIONERconducted an impactassessment ofpassenger protection inthe event of airlineinsolvency. In thereport, it estimatedthat from 2000 – 201076% of passengers whopurchased stand-aloneair tickets did not haveany form of protection

when affected byinsolvency. Accordingto the E.C. reportpublished following theimpact assessment,some protection isavailable throughSCHEDULED AIRLINEFAILURE INSURANCE(SAFI) however, its’scope and availability islimited. Other optionsare: - if purchases aremade by credit card,consumers can claim arefund from the bankthat issued the card.Also, payments fortickets purchasedthroughINTERNATIONAL AIRTRANSPORTASSOCIATION (IATA)travel agents are heldby a central paymentmechanism beforebeing passed on to theairline. If the airlinebecomes insolvent,passengers whosepayments have not yetbeen passed on shouldbe able to recover theirpayment. If consumersbuy a package holiday,under the PACKAGETRAVEL DIRECTIVEorganisers or retailersmust be able to refundmoney paid and/orcover costs of gettingthe consumer home inthe event of airlineinsolvency. The E.C. iscurrently looking intothe possibility ofextending the existingrules on consumerprotection in this areaso consumers can getrefunds if an airlinebecomes insolvent.

PACKAGE TRAVEL

When you buy apackage holiday, youare entering a Contractand should be providedwith a written copywhich should outline,for example, the costof the holiday, taxesand charges, and theorganiser’s complaintprocedure. The annual RespiteCare Grant of €1,700 ispaid to carers providingfull-time care andattention to an olderperson or a person witha disability, regardlessof their means or socialinsurancecontributions.Approximately 77,000carers will benefit fromthe grant in 2012.Minister for SocialProtection, joan BurtonTD, said: “I haveprovided over €132million for the RespiteCare Grant which ispaid to full-time carersin june each year. Ithelps carers to get

some respite forthemselves or for theperson for whom theyare caring. This yearthe amount of the grantis unchanged at €1,700in respect of each carerecipient.”The Grant is paidautomatically to carersin receipt of schemes,such as Carer’sAllowance, Carer’sBenefit and DomiciliaryCare Allowance. Otherfull time carers who arenot eligible for theseschemes may applyseparately for the grantwhich is not meanstested.Minister Burton

The cost of a child are highin infancy, before falling atpre-school age, and thengradually rising as childrengrow older, according to anew study carried out bythe Vincentian Partnershipfor Social justice (VPSj)According to the study “TheCost of a Child”,expenditure fluctuatesbecause of the needs ofchildren at particular ages,location, parentalemployment status and thesubsequent need forchildcare.

A child at second level hasthe highest weekly costs(€144.92 in an urbanhousehold and €140.20 in arural household) and apre-school child has thelowest. (€48.29 urban and€50.03 rural). When a childenters adolescence costsincrease for a number ofcategories including food,education, social inclusionand participation andcommunications.

With childcare included aninfant has the highest costper week (€296.13 urbanand €260.31 rural) and achild at primary age the

lowest (€130.30 urban and€134.72 rural).

While Child Benefitaccounts for 11% of the costof an infant in an urbanhousehold where there ischildcare costs, this rises to67% for a Primary schoolchild in an urban householdwhere there are nochildcare costs. Therespective percentages fora rural household are 12%and 65%The study examined thedirect cost of a child at fourstages of childhood - Infant,Pre-school, Primary Schooland Second level, acrossurban and rural households.It shows the fluctuation incosts across 13 areas ofexpenditure directly relatedto a child, e.g. food,clothing, childcare. Itexcludes costs shared incommon with parents, suchas heating or the use of afamily car.

It also considers thecontribution that childincome support paymentsmake at Infant, Pre-school,Primary and Secondaryschool levels. “This will beparticularly relevant to

policy makers, and to allindividuals andorganisations concernedwith the well-being ofchildren. At a time ofeconomic recession it isimportant to support thoseon low incomes and ensurechild income supports makea realistic contribution tothe cost of raising a child.”said Dr Mac Mahon.

The latest figures on privatemortgage arrears, publishedby the Central Bank,indicate a grave crisis in thehousing market. That’saccording to Threshold, thenational housing charity.

The figures indicate that10.2 per cent of residentialmortgages are now over 90days in arrears – up from 9.2per cent in the last quarterof 2011. The number ofmortgages in arrears forover 180 days has alsoincreased: from 6.9 percent in the last quarter of2011 to 7.8 per centcurrently.

Commenting, Bob jordan,Director of Threshold, said:“Mortgage arrears havebeen increasing now foralmost four years. Thecrisis in our housing marketis worsening and, yet, theGovernment continues todelay over implementingeffective policies to helpthe situation.

“Taking into account theKeane Report and thePersonal Insolvency Bill, astrategy is being developedto deal with arrears inresidential mortgages. Butprogress has been slow, and

the Personal Insolvency Billneeds to be published andenacted as soon as possible.

“Furthermore, as previouslyhighlighted by variousorganisations, there is anurgent need forindependent advice to bemade available fordistressed homeownersengaging with financialinstitutions. Advisors shouldhave strong legal andfinancial backgrounds, sothat they are engaging withfinancial institutions on alevel playing field. Therealso needs to be sufficientnumbers of advisorsavailable to ensure thateveryone who needsindependent advice andrepresentation can avail ofit.

“The Government must actimmediately to implementmeasures such as these.Otherwise, the crisis withresidential mortgage arrearswill just continue to getworse.”

In addition to highlightingthe crisis in relation toresidential mortgagearrears, Threshold warnedthat the situation in thebuy-to-let market is also

extremely grave.

“We know the arrears ratefor buy-to-let mortgages iseven worse than that forresidential mortgages,” saidAideen Hayden, Chairpersonof Threshold. “But nostrategy is being developedto deal with arrears inbuy-to-let mortgages. Andunless we act to tackle thisissue now, there is a seriousrisk that the private rentedsector will fall apart.

“The majority of those whoown buy-to-let propertiesare not developers and donot own vast amounts ofproperty; they are justordinary people. Many ofthem were encouraged tobuy property during theboom years and are now innegative equity. And manyof their properties aresecured against familyhomes so, ultimately, anincrease in arrears inbuy-to-let mortgages putsfamily homes at risk.

“Furthermore, the latestCensus figures show theprivate rented sector hasgrown from 11 per cent ofhousing stock in 2006 to 19per cent currently. In otherwords, dependency on

private rentedaccommodation has almostdoubled over the past sixyears. More and morepeople are choosing to rent– or are faced with no otheroption – because of a lack ofsocial housing andstagnation in the propertymarket.

“Private rentedaccommodation is a defaultsafety net for people who

cannot access housing inany other way. If thatsafety net is taken awaybecause small-timelandlords can no longerafford buy-to-letmortgages, then whatoptions are left for thosewho currently depend onthe private rented market?

“The Central Bank hasindicated it will publish thearrears rate for buy-to-let

mortgages later this year,but this information shouldbe made available now, sowe can assess the scale ofthe problem and developmeasures in response. Theprivate rented sector is theonly housing sectorexperiencing growth indemand at the moment; wecannot allow it to falterbecause of delays inaddressing buy-to-letmortgage arrears.”

tHresHoLD caLLs for action on crisis on mortGaGe arrears

The Minister for Communications, PatRabbitte T.D., has announced that he isextending the availability of basic digitalskills training under the BenefIT 3 scheme.This means that the training that was dueto come to an end at the end of june cannow continue into the second half of theyear. “This training is proving very popular. Thisis clear from the very positive feedback weare getting from the people who haveavailed of the training all over the country.I am very heartened to see the beneficialimpact it is having on so many people. Thisis clear from the feedback we are getting.It’s reflected too in that almost everyone(99%) who has completed the training saysthey would recommend it to others. “In response to requests from several of ourtraining partners I am arranging to extendthe scheme so that training can continue tobe provided through the autumn and into

A new Eu-wide reportclaims 55 per cent ofaccidental childhood deathin Ireland could beprevented if thegovernment stepped up itschild safety measures.Ireland received a goodoverall performance gradein its national Child SafetyReport Card published thisweek by the Eu HealthCommissioner john Dalli,grading standards across arange of child safety areasincluding transportaccidents, water accidents,falls, burns, poisoning andchoking or strangulation.The figures used date from2009, when 125 childrenand adolescents agedbetween 0-19 died inIreland as a result of injury.The report claims that 69 ofthose lives could have beensaved, if Ireland’s rate ofinjury death could bereduced to that of thenetherlands, one of thesafest countries in Europe.Ireland scored poorly in theareas of preventing falls andstrangulation, butperformed very well inpassenger, pedestrian and

driver safety.Reacting to the report,Dublin Fine Gael MEP GayMitchell pointed out thatIreland has managed to savehuge amounts of lives onthe roads by simplyenforcing better safetystandards.“We used to accept poorroad standards, until theRoad Safety Authority andthe gardaí got tough incourts. If the governmentpulls out the stops andenforcing better safetystandards, we could preventso many tragic childhooddeaths by accidents. It’s acase of, for example,educating parents andchildren to be more carefulon farms, making surethey’re properly harnessedin their car seats, keepingpoisons away,” said MrMitchell.

Call for Europe-wide‘skills passport’ to boost

volunteering

A proposal for a European“skills passport” providingofficial cross-borderrecognition of theprofessional skills gainedthrough volunteering moveda step closer this week,when it got the stamp of

approval at the EuropeanParliament.MEPs in Strasbourg voted infavour of creating the ‘skillspassport’ to enable peopleto use their volunteeringexperience to help themfind jobs or furthervolunteering work acrossthe Eu. The move was partof an initiative to boostsupport and recognition forthe work volunteers aredoing at community level.MEPs also proposed settingup a European Voluntary AidCorps, to send volunteers toareas of natural disasters.Other measures put forwardincluded making smallvoluntary organisationsexempt from paying VAT -this was the brain child ofIndependent MEP MarianHarkin.Ms Harkin, a well-knownvolunteering champion, alsosuggested that voluntaryorganisations involved inEuropean projects should begiven funding matching thehours of work they put in.Speaking in Strasbourg, MsHarkin said it’s vital thatvolunteers are supported,particularly at a time whenthey are taking up the slackfor cutbacks in someessential State services.“Volunteers are unpaid, but

A survey from ulster Bankhas revealed that, parentsspent significantly less ontheir child’s First HolyCommunion this year at anaverage of €744, down25.6% from €1,000 last year.

Theceramic stone wall muraldepicts the journey ofphysics through the agesand is a creation of girlsfrom the school’s art classwho worked under theguidance of their ArtTeacher niamh Garvey andartist niamh Sinnott.

“I’m delighted to officiallyopen this fantastic muralwhich has been aneducation to all of us andwill continue to educatestudents here in St.joseph’s for decades tocome. An awful lot of workwas needed to get thisproject from thebrainstorming sheets on thewall here to the colourful,ceramic journey throughhistory on this wall,” saidMinister Frances Fitzgerald.

The mural “The Future ofPhysics” depicts majorachievements down theyears in the field of Physicsand now decorates theroute to the Physics Room inSt. joseph’s College.
