MARION COUNTY COMMISSION JANUARY 4, 2017 1 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, December 14 th , 2016. Present were Commissioner Elliott, Commissioner Garcia were in attendance and Commissioner VanGilder was present via skype. Sabrina Haught from Central Communications and a Minister led the Court with a prayer. Sheriff Jimmy Riffle led the Court with the Pledge of Allegiance. Commissioner Elliott called the meeting to order. The Commission presented the nomination of the Commission President and Commission President Pro Tempore. Commissioner Elliott moved that Ernest J. VanGilder be nominated and serve as President of the Commission through December 31, 2017. Commissioner Garcia seconded. President VanGilder concurred. Commissioner Garcia moved that Randall J. Elliott be nominated and serve as President Pro Tempore of the Commission through December 31, 2017. President VanGilder seconded. Motion passed. Both President VanGilder and Commissioner Elliott thanked all for their support in nominating them once again for their current positions. The proceedings of Wednesday December 14 th , 2016, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on December 15 th , 16 th , 19 th , 20 th , 21 st , 22 nd , 23 rd , 27 th , 28 th , 29 th 30 th , 2016 and January 3 rd , 2017 were approved as submitted and signed. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, December 14 th , 2016 and accept them as presented. Commissioner Garcia seconded. President VanGilder concurred. The Commission received the Order Confirming and Ratifying Fiduciary Supervisor’s Report of Claims and Settlement Report; Order #381. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on the 28 th , day of December, 2016. This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved.

The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, December 14th, 2016. Present were Commissioner Elliott, Commissioner Garcia were in attendance and Commissioner VanGilder was present via skype. Commissioner Elliott stated that hearing no objection moved that the Commission sign the Order. Commissioner Garcia seconded. President VanGilder concurred. The Commission received a request for advice and consent from the Sheriff’s Department to hire Andrew Wolfe as Deputy Sheriff, effective Thursday, December 22nd, 2016, full time with benefits. County Administrator Kris Cinalli stated that Mr. Wolfe is returning to work as a deputy and that he had left in good standing.

Commissioner Elliott moved that the Commission grant its advice and consent to re-instate/hire Andrew Wolfe as Deputy Sheriff, effective Thursday, December 22nd, 2016, full time with benefits. Commissioner Garcia seconded. President VanGilder concurred. The Commission received a request for request for advice and consent from Robin I. Gomez, City Manager, to accept the appointment of Tracy Evans to the Marion County Parks and Recreation commission for a term ending December 31, 2019. Commissioner Elliott moved that the Commission appoint Tracy Evans to the Marion County Parks and Recreation commission for a term ending December 31, 2019. Commissioner Garcia seconded. President VanGilder concurred.

The Commission received a request for Reimbursement from West Virginia Division of Justice and Community Services (15-VA-015) to cover expenditures from December 1, 2016 to December 31, 2016. County Administrator Kris Cinalli stated that this reimbursement is in the amount of $3,462.00 for our victim’s Advocate grant.

Commissioner Elliott moved that the Commission President pro Tempore sign the agreement. Commissioner Garcia seconded. President VanGilder concurred. For the record, note the Marion County Commission received a commitment of $1,500,000.00 in Small Cities Block Grant funds for the Colfax Public Service District Sanitary Sewer Improvements and Upgrade Project.

A lengthy discussion ensued over the Resolution whereby the Commission submitted the document in support of naming the new Bridge that will go over coal Run Hollow in memory of James S. Maddox. Mr. George Ramsey spoke on behalf of John “Fuzzy” Knight and added that he and others had put together letter of support to the House of Delegate member Mike Caputo. D. D. Meighen added that name of Rose Cousins to the list of candidates who should be considered for the naming of the bridge and present evidence that would make her a worthy person. Kip Wilson then presented the name of Johnny Johnson as a potential candidate for naming the bridge in memory thereof.

Commissioner Elliot stated that the Commission as a whole was unaware of the potential naming of the bridge in memory of John “Fuzzy” Knight. He added that they would speak with the City of Fairmont and members of the House of Delegates to see what would make the best person for the naming of the bridge in memory. Commissioner Elliott introduced the new Assessor Mark Trach and the new Sheriff James Riffle who were both in attendance today. President VanGilder spoke again about the current budget crisis in West Virginia and is now asking all Elected Officials to reduce their budgets once again this upcoming fiscal year and thanked all of them for their reductions in their budgets last fiscal year. He also added that we should look into some type of metro government and also work with the City of Fairmont to combine services that each provide separately currently. He added that we need to be proactive while things are fiscally good so that we can stave off budget issues down the road.

There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, January 18th, 2017 at 10:00 a.m. for the next scheduled County Commission Meeting. __________________________________
