WELCOME TO MARRINGTON AT COBBLESTONE

Dear Homeowners, On behalf of the Marrington at Cobblestone Homeowners Association (HOA) Board of Directors and homeowners of Marrington, we would like to welcome you to your new home and our community. We look forward to meeting you out for a walk, at the pool, or at a community activity. The purpose of this Handbook is to provide homeowners with an informational guide regarding communication methods and the Rules and Regulations adopted by the Marrington at Cobblestone Board of Directors (Board) as authorized by the Marrington at Cobblestone Homeowners Association (HOA). The Board is committed to keeping homeowners informed about everything that is going on and to seeking their input, suggestions and questions. Whether you are a new homeowner or have been in the community for a while, please take time to familiarize yourself with the following information about the community and your responsibilities as a homeowner. Included in this handbook is general information about your HOA and the First Service Residential of Charleston, our contracted property management company. Also included is other helpful information regarding utility services, taxes and excerpts from the governing documents with FAQ’s. If you are a new homeowner, this information should get you off to a smooth start. For others this will be a useful reference. Again, welcome to the Marrington at Cobblestone community! We look forward to you falling in love with this neighborhood as much as we have. We know you’ll find our neighborhood is a great place to live and we encourage your participation in our activities and meetings.

Marrington at Cobblestone HOA and First Service Residential

As of the date of this handbook, a board of five volunteer directors governs the operation of your HOA. The Board of Directors is elected by the community to oversee the daily functions and financial responsibilities of the Association. Please take the time to read through the Bylaws and Covenants documents you received during the home purchase process. There are specific provisions regarding what can and cannot be done on your property. Copies are available on the community web site. First Service Residential of Charleston is our contracted community management company. They may be reached at 843.795.8484 or [email protected]. They should be contacted for service issues on community property, complaints regarding specific bylaw violations, and for questions regarding your monthly homeowners’ dues assessment. HOA Fee Payment Options to First Service Residential

Monthly payments online should be set up ONLY if you have received monthly payment coupons. The payment coupon booklet will have your account number required to set up recurring payments. You will receive mailing envelopes from FSR with a payment booklet and a new supply each year. Your monthly HOA fees are due on the first day of each month. Do not drop payments off at the clubhouse office. Option 1: Online payments

Register your account online at https://cmg.cincwebaxis.com/. Enter your account number from your HOA payment booklet. You can arrange to make a single payment each month or follow directions for setting up recurring payments.

Option 2: Sign up for automatic bill payment on your bank’s website. Be sure to include your HOA account number from your payment booklet. Option 3: Pay by check mailed along with your payment slip from your payment booklet. Be sure to include your HOA account number on your check. Send your payment to:

Note: Any payment mailed to the Charleston First Service Residential address will be forwarded to the Commerce, GA post office box adding 3-4 days of processing time, which could result in late penalties on your account. RESTRICTIONS ON THE USE OF HOA FACILITIES

The use of the clubhouse and pool facilities is limited solely to Marrington RESIDENTS and ACCOMPANIED GUESTS. - A “resident” is a Marrington property owner or member of an owner’s family,

residing in the home. Visiting relatives in a resident’s home are “guests”

and are NOT “residents”.

- A “member in good standing” is a member of the Marrington HOA whose assessments and fines are paid in full and whose membership privileges (including the use of the clubhouse and pool area) and the right to bring guests have not been revoked.

- A “guest” is a non-resident who is invited to the Marrington facilities when

escorted/accompanied by a resident. Visiting relatives in a resident’s home are “guests” and are NOT “residents”.

In no manner are these rules intended to purposely discriminate or exclude non-residents from participating in Marrington events but as an HOA these rules are in place for the benefit and protection of this community. All residents of the community must abide by these rules. All guests are expected to obey all HOA rules. A resident MUST accompany all guests at all times while on the property. Homeowner Insurance Responsibilities

As a homeowner you should obtain an HO-6 policy to provide coverage for your personal property, loss of use, personal liability, loss assessment and other exposures. Download a copy of the information letter (available on the community website

for Marrington at: http://fsresidentialcharleston.com/marrington-villas-at-cobblestone/ from The Steadman Agency, Inc., the master insurance provider for the community, for a summary of the coverage of the master insurance policy. Use this information for obtaining the amount of coverage you determine to be appropriate for your needs from your own insurance company. To obtain a Certificate of Insurance for your mortgage company or yourself, email your request to: [email protected]. Include mortgagee clause wording as required by your mortgage company and your name, address and loan number. You may also contact The Steadman Agency on: 843.723.4001. Important Information About Community Restrictions and Use of Amenities

We have added here extracts of the most commonly searched restrictions from Declaration of Covenants, Conditions, Easements and Restrictions, often referred to as the governing documents, for Marrington Villas at Cobblestone. There is a section of FAQs you may find helpful for further explanation of these rules. Also attached are the rules concerning use of the pool and clubhouse amenities. As an owner, you may already have some ideas on how you’d like to improve your property. Please keep in mind; the HOA has an Architectural Review Board (ARB) which functions to evaluate the plans for all exterior landscaping, repairs and remodeling to ensure compliance with all Covenants and Bylaws. The purpose of this review is to protect our scenic environment and maintain the quality and value of our homes. All modifications to the exterior of your property must be submitted for approval before any work begins. If work is started without prior approval, the homeowner risks being cited for a covenant violation and may be required to alter or remove the changes at significant additional cost. The use of the clubhouse and pool facilities is limited solely to Marrington residents and escorted guests of Marrington residents.

EXTRACTS OF IMPORTANT ARTICLE III RESTRICTIONS FROM THE

MARRINGTON AT COBBLESTONE GOVERNING DOCUMENTS 3.1 Changes to Unit Exteriors. No changes, alteration or additions may be made to Unit Exteriors or to the landscaping on any Unit without the prior review and approval of the Board,

which may condition its consent and approval upon the Owner’s agreement, (a) to be solely

responsible for the maintenance of such change, alterations or additions of or (b) to pay all

additional costs incurred by the Association to maintain such changes, alteration or addition if part of the Unit Exterior. The foregoing agreements shall be binding upon future Owners of such

Unit. The foregoing shall not apply to those changes, alterations or additions, which this

Declaration already provides shall be maintained by the Association if, Board consent and approval is given for the making thereof. In the event changes, alterations, or additions are made

without the prior consent and approval of the Board, the Board may: (a) require the Owner to

remove all changes, alterations and additions and restore the Unit Exterior or Unit to its original condition, or (b) cause the Unit Exterior or Unit to be restored to its original condition at the

Owner's cost and expense, or (c) ratify the actions taken subject to the Owner's compliance with

any conditions that the Board may impose.

3.5 Parking. No Commercial Vehicle, recreational vehicle, motorcycle or other motorized

vehicle and no boat; trailer hitch or other similar personal property shall at any time be parked or stored on any portion of the Property other than in a garage. Pursuant to rules and regulations

adopted by the Board, driveways may be used on a non-recurring basis to park Commercial

Vehicles, recreational vehicles, boats, trailers, or other similar vehicle for not more than twenty-four (24) hours at a time and to park operable automobiles. Parking of any vehicle on the

sidewalk is prohibited.

3.8 Landscaping. No Owner may add to or change the landscaping on the Property owned by

such Owner without approval by the Board…

3.9 Signs; Commercial Devices. No sign, insignia, display, device, or form of external evidence

of commercial advertising or use, of any kind, shall be displayed to the public view on the

Property or on anything on the Property, except: (i) on the Common Areas, signs regarding and regulating the use of the Common Areas, provided they are approved by the Board; (ii) on the

interior side of the window of a Unit, one professionally prepared sign not in excess of nine

square feet in size, advertising the Unit for sale; and (iii) on the Common Areas and model Units, signs advertising the sale of Units by Developer during the period of its sale of Units shall be

permitted, provided, if these limitations on use of signs, or any part thereof, are determined to be

unlawful, only the signs described in Subsection (i), above, shall be permitted after Developer's period of sales of Units.

3.16 Holiday Lights. Except for seasonal holiday decorative lights and outdoor holiday decorations, which may be displayed between the period beginning December 01 and ending on

January 10 of the next year, all additional exterior lights require Board approval.

3.17 Yard Improvements. All exterior sculpture, exterior fountains, and yard ornaments must

be approved by the Board…

3.19 Exterior of Units. The exterior portions of Units which are visible from other Units and

from the street shall be kept in a neat, orderly, and aesthetically pleasing condition at all times.

No debris, trash, or waste from pets and other animals shall not be kept, stored, or allowed to accumulate thereon. The Association shall have the right to clean and remove debris, trash, pet

and animal waste therefrom with the costs thereof charged to the Owner.

3.20 Garbage. Garbage cans and other receptacles containing trash and other debris placed on the

curb or outside for collection shall be returned to the interior Unit within twenty- four (24) hours.

MARRINGTON VILLAS AT COBBLESTONE SWIMMING POOL FACILITY RULES AND REGULATIONS

The Marrington at Cobblestone Homeowners Association Swimming Pool is a community facility intended for the residents’ private use and personal enjoyment. These rules and regulations are intended to provide maximum benefit to Association members while maintaining a safe and wholesome environment for the community. The following rules and regulations are to be complied with by every resident and their guest(s). There is no lifeguard on duty. Residents and their guests using the pool facility do so at their own risk. Pool Rules are also posted in the pool facility and in the area surrounding the pool itself. The rules and regulations set forth below are intended to enhance and clarify any and all posted and previously established pool facility rules.

USE OF THE POOL FACILITY

The use of the clubhouse and pool facilities is limited solely to Marrington residents and escorted guests of Marrington residents. - A “resident” is a Marrington property owner or member of an owner’s family,

residing in the home. Visiting relatives in a resident’s home are “guests”

and are NOT “residents”. - A “member in good standing” is a member of the Marrington HOA whose

assessments and fines are paid in full and whose membership privileges (including the use of the clubhouse and pool area) and the right to bring guests have not been revoked.

- A “guest” is a non-resident who is invited to the Marrington facilities when escorted/accompanied by a resident. Visiting relatives in a resident’s home are “guests” and are NOT “residents”.

- The “pool facility” or “pool area” is the “swimming pool”, the “area immediately surrounding the swimming pool”, the “rest-room access to the pool”, “exterior shower units” and the “deck area at the side of the swimming pool”.

POOL USE FACILITY RULES

1. All Marrington at Cobblestone residents in good standing are entitled to use the pool facilities. Physical access to the pool area is with a key, which is provided only to residents of the community. Residents who are not in good standing with association dues are subject to revocation of pool facility use privileges.

2. A resident may NOT knowingly allow a non-resident to use their pool access key. The pool access key is for a resident’s use only and is NOT to be loaned to or shared with neighbors, friends, or guests. A resident is subject to a loss of pool facility privileges for allowing a non-resident or unaccompanied guest to use their pool access key.

3. Residents are responsible for the actions of their children and guests. 4. Residents are ultimately responsible for the safety and behavior of their

minor children. 5. Residents are required to accompany their guests using the pool facilities

AT ALL TIMES. 6. Doors to the adjoining clubhouse and the pool gate MUST be closed AT

ALL TIMES. Do NOT prop gates or doors open for any reason. 7. When you leave the pool area ensure that the gate is closed behind you.

POOL FACILITY HEALTH AND SAFETY RULES

1. An emergency telephone is located on the exterior wall of the clubhouse area near the pool gates.

2. Proper pool attire is mandatory for everyone. Infants and young children must wear “swimmies” or rubber pants specifically designed for use as swim wear. NO CLOTH OR DISPOSABLE DIAPERS ARE PERMITTED.

3. Skateboards, scooters, bicycles, inline skates, etc., are not permitted in the pool area.

4. Pool furniture is available on a first come, first served basis. 5. No running, rough or boisterous play. Rude and inappropriate behavior

that disturbs other pool users will not be permitted. 6. No person under the impairment of drugs or alcohol may use the pool. 7. No spitting or blowing nose into the pool. 8. Persons with diarrhea, nausea, open wounds/lesions, skin, eye, ear or

respiratory infections are not allowed in the pool. 9. No animals or pets are permitted in the pool area. 10. No glass is permitted anywhere in the pool area. 11. SMOKING OR VAPING IS NOT PERMITTED ANYWHERE IN THE POOL

AREA OR DECK. 12. All persons should shower before entering the pool. 13. No inappropriate contact between individuals is permitted at the pool area. 14. No propping doors or gates open at anytime. 15. No littering. Please use the proper trash receptacles located around the

pool area.

POOL FACILITY OPERATION

1. The pool facility is open from Dawn to Dusk during the pool season. 2. The pool season is from 01 April until 30 September. 3. The pool may be closed at any time during inclement weather, (including

rain, thunder and the presence of lightening or severe storms), or for the purpose of maintenance and repair, or a danger to the health and safety of pool patrons.

ENFORCEMENT OF POOL FACILITY RULES AND REGULATIONS

A. In General 1. Any violation of these rules should be reported to the property

management company and the Board of Directors of Marrington at Cobblestone, giving complete details of the incident in writing. The property manager and the Board will investigate each incident and take

such corrective action as deemed necessary. 2. Violation Subject to Immediate Action. Any conduct or activity

occurring at the pool facilities that is unsafe or unlawful or not in compliance with the provisions of this resolution shall subject the Resident, guests, or other persons to immediate removal from the premises.

3. The Association reserves the right to exercise all other powers and remedies provided by the Association’s governing documents or the laws of the State of South Carolina and Berkeley County.

B. Attorney’s Fees and Costs. If the Association must enforce this resolution through any form of legal action, the offending resident shall be responsible for all expenses and attorneys’ fees incurred by the Association in enforcing the provisions of this Resolution.

C. Liability

1. The Association assumes no responsibility for any accident or injury during such use of for any loss or damage to personal property at the pool facilities.

2. Residents shall be held liable for any expenses incurred by the

Association as a result of any damage done to the pool facilities and common areas by the use or as a result of negligence, whether on the part of the resident or guests.

3. All exceptions or changes to the above policy must be approved in writing

by the Board of Directors of the Marrington at Cobblestone Homeowners Association, Inc.

The Marrington at Cobblestone Homeowners Association Clubhouse is a community facility intended for the residents’ private use and personal enjoyment. USE OF THE CLUBHOUSE FACILITY

The use of the clubhouse and pool facilities is limited solely to Marrington residents and escorted guests of Marrington residents. - A “resident” is a Marrington property owner or member of an owner’s family,

residing in the home. Visiting relatives in a resident’s home are “guests” and are NOT “residents”.

- A “member in good standing” is a member of the Marrington HOA whose assessments and fines are paid in full and whose membership privileges (including the use of the clubhouse and pool area) and the right to bring guests have not been revoked.

- A “guest” is a non-resident who is invited to the Marrington facilities when escorted/accompanied by a resident. Visiting relatives in a resident’s home are “guests” and are NOT “residents”.

- The “clubhouse facility” or “clubhouse” is the “building designated as 201 Village Stone Circle, Summerville, SC 29486”, which includes the “meeting rooms”, “fitness room”, “rest rooms”, and “kitchen area” inside the building.

GENERAL CLUBHOUSE USE RULES

1. All Marrington at Cobblestone residents in good standing are entitled to

use the clubhouse facilities. Physical access to the clubhouse is with a door key code, which is provided only to residents of the community. Residents who are not in good standing with association dues are subject to revocation of clubhouse facility use privileges.

2. A resident may NOT knowingly allow a non-resident to use their door access key code. The key code is for a resident’s use only and is NOT to be shared with neighbors, friends, or guests. A resident is subject to a loss of clubhouse facility privileges for allowing a non-resident or unaccompanied guest to use their access key code.

3. Residents are responsible for the actions of their children and guests.

4. Residents are ultimately responsible for the safety and behavior of their minor children.

5. Residents are required to accompany their guests using the clubhouse facilities AT ALL TIMES.

6. No one under the age of 18 shall be allowed to utilize the fitness equipment.

7. Doors to the clubhouse and the pool gate MUST be closed AT ALL TIMES. Do NOT prop doors open for any reason.

8. No animals or pets are permitted in the clubhouse with the exception of service animals.

9. Wet swimsuits are not allowed in the clubhouse, except in restrooms accessed through the exterior doors.

10. SMOKING OR VAPING IS NOT PERMITTED ANYWHERE IN THE CLUBHOUSE.

11. No inappropriate contact between individuals is permitted in the clubhouse.

12. No roughhousing, general horseplay or disorderly conduct that may endanger the safety of others is allowed in the clubhouse.

13. Be considerate of volume level when using sound producing devices and musical instruments in the clubhouse. Live bands are only permitted in the clubhouse. You may not create not an unreasonable annoyance, inconvenience or nuisance to other residents or unreasonably interfere with the quiet enjoyment of their property.

14. No bicycles, skateboards, roller skates, or roller blades are permitted in the clubhouse.

15. The parking area surrounding the clubhouse may not be used as part of an event other than for guest parking.

16. The fireplace is gas controlled. DO NOT BURN WOOD OR ANY OTHER MATERIALS IN THE FIREPLACE UNIT.

17. Use the proper trash receptacles located in the clubhouse. 18. The clubhouse microwave and oven are to be used only to reheat pre-

cooked food items. All food must be prepared prior to using the clubhouse appliances. Appliances are not to be left unattended while in use.

19. No grills are allowed in the clubhouse. NOTE: Prior authorization for use of a grill on the clubhouse property is required.

20. Residents are responsible for leaving the clubhouse in the same clean condition in which it was found.

21. If you are the last person to leave the clubhouse please turn OFF all lights, ceiling fans and appliances. Ensure that the refrigerator door is closed and the fireplace is off. Lock the door behind you so that it may only be opened using the key code.

CLUBHOUSE FACILTY ALCOHOL AND SMOKING RULES

The clubhouse is a private facility and as such alcohol may be consumed in the clubhouse within the restrictions of South Carolina law. Alcoholic beverages may NOT be sold at any time at the clubhouse. The clubhouse is a smoke-free environment. Smoking and vaping is prohibited in the clubhouse and at the pool area. The area outside the clubhouse entrance is the only designated area.

CLUBHOUSE FACILITY RESERVATIONS PROCEDURES

1. The Marrington at Cobblestone Clubhouse is available for rental by

residents in good standing of the Marrington Homeowners Association. 2. Residents are required to complete the Marrington at Cobblestone –

Clubhouse Rental Agreement, to reserve the clubhouse facility for a special function.

3. Reservations of the clubhouse DOES NOT convey privileges for a resident or their guests to use of the pool facility or fitness room.

4. Reservations of the clubhouse for a private party are limited to the interior clubhouse only. Attendance cannot exceed fifty (50) persons.

5. At no time shall the private function encroach upon the pool area or fitness room of the clubhouse.

6. The use of the clubhouse for a private rental includes the use of existing furniture. The resident is responsible for making arrangements for the rental delivery and removal of any additional furnishings that may be required for the function.

7. Residents are responsible for the actions of their guests while renting the clubhouse for a special function.

8. Specific procedures and rules for the arrangement of reservations including, requesting reservation dates, security deposit requirements, use of decorations, clubhouse inspections and cleanup lists are all detailed in the Marrington at Cobblestone – Clubhouse Rental Agreement.

ENFORCEMENT OF CLUBHOUSE FACILITY RULES AND REGULATIONS

D. In General

1. Any violation of these rules should be reported to the property management company and the Board of Directors of Marrington at Cobblestone, giving complete details of the incident in writing. The property manager and the Board will investigate each incident and take such corrective action as deemed necessary.

2. Violation Subject to Immediate Action. Any conduct or activity

occurring at the clubhouse that is unsafe or unlawful or not in compliance with the provisions of this resolution shall subject the Resident, guests, or other persons to immediate removal from the premises. Should law

enforcement need to respond to a call for disturbance of the peace or false fire alarm, the resident will be responsible for any and all fines issued by Goose Creek Police Department, Berkeley County Sheriff’s Office or local Fire Department.

3. The Association reserves the right to exercise all other powers and remedies provided by the Association’s governing documents or the laws of the State of South Carolina and Berkeley County.

E. Attorney’s Fees and Costs.

If the Association must enforce this resolution through any form of legal action, the offending resident shall be responsible for all expenses and attorneys’ fees incurred by the Association in enforcing the provisions of this Resolution.

F. Liability

1. The Association assumes no responsibility for any accident or injury during such use or for any loss or damage to personal property at the clubhouse facility.

2. Residents shall be held liable for any expenses incurred by the

Association as a result of any damage done to the clubhouse facility and common areas by the use or as a result of negligence, whether on the part of the resident or guests.

3. All exceptions or changes to the above policy must be approved in writing

by the Board of Directors of the Marrington at Cobblestone Homeowners Association, Inc.
