I know my girls would be devastated when they learn that Ms. Joseph will not be at school anymore. Please do not do this to these kids right now when they return in September they need to see some familiar faces. Thank you for your time to listen to my concerns Talisha Brown - [email protected] Good afternoon. What are the plans for Future-Ready Prep? Will the school remain at the Hart Complex? Will the school go up to 12th grade eventually? What is the district planning to do for the 2020 High School seniors to help them celebrate their hard-work? Thank you, Marie Jean-Philippe - [email protected] What exactly are the plans for the remodeled on Grove Street in East Orange? Pertaining to the name? How was that selected? Are the students and staff from the Carver School on Glenwood Ave in East Orange all going to this new school over on Grove street (in East Orange)?

Lina Montoya-Hussain - [email protected] Esteemed Board Members and Upper Administration I am writing in regards to the recent email I received from Mr. Heaphy. He confirmed the move of Ms. Kelly as vice principal from E. T. Bowser Elementary School. During better times this news would be upsetting, yet during current circumstances it proves more heart wrenching and difficult. A transformation during a time of crisis is thoughtless and careless. The people who return to schools are 3-18 year olds. They have developed relationships with teachers, administrators, and school employees. As we conduct online instruction, it's clear many families are dealing with food insecurity, loss of employment, and online connectivity. School administration at Bowser has been there every step of the way. I pray you reconsider your decision. The schools as we know, have little consistency because of circumstances. Teachers and students are stronger when they understand who is at the helm. Mr. Heaphy and Ms. Kelly are caring, thoughtful. I can go on about their worth.

Kim Jordan - Thanked the East Orange B.O.E and all the wonderful teachers for doing a stellar job in this historical period in our lifetimes. These personal tragedies and technological disadvantages have made it almost impossible to do the work assigned to us. I am asking for -A pass/fail system in lieu of grades for all students this year. -No penalty on late assignments. -Finally, is there a program where we can apply for a loaner laptop to complete this work? We are in unprecedented times which calls for unprecedented measures. Students should not be punished during this time for being in these circumstances through no fault of their own. Jamilah Stephens - [email protected] We (the parents of Austin Bailey) are opposed to the constant changing of school administration in East Orange. We find it appalling that we may possibly have a new principal and entirely new administration for the 2020-2021 school year. I saw the school board say, these changes are meant to disrupt stagnation. Please provide the numbers that CLEARLY show how disruption supports your theory of improvement. Numbers meaning, test scores, attendance, etc. Additionally, as parents, we demand an answer as to why Dr. West's contract was not renewed?!?! We would also like to see and hear a comprehensive and cohesive plan for the school district. This includes but is not limited to, Chrome Books for each and every student in the city (to take home). Our child's elementary school experience is very important to us and we do not, AT ALL support any kind of upheaval to the norms that he hopes to return to this fall. Kind Regards, Gabrielle Melvin - [email protected] What measures will the Board take for September to ensure our kids can go inside of the building not worrying about catching or spreading the virus? How will you implement social distancing in the elementary grades if classrooms are already small? Also, why is switching administrators a priority instead of getting things prepared for the students in September? I also think keeping our current Principal would keep things afloat until the next school year. She has done an amazing job this far it’s no reason she should be moved. Leah White Spoke on concerns with the reorganization changes in all district schools. Believe moving Principal Sharon Vincent from Banneker in the midst of the pandemic of Covid 19 would not be wise at this time. We respectfully asked that you stay the decision to relocate Ms. Vincent as well as all the principals. Nadirah Laboo - [email protected] Please rethink the proposition of transferring the faculty at schools during this time. This is a critical time in our lives especially the students. So for them to have to come back to school without any normalcy that can cause trauma on them which they don’t need! Emely Bryan - [email protected] Good evening, As a citizen of East Orange and a parent of a student at Benjamin Banneker school, I am deeply concerned about the shift in the administration happening within the school district during this pandemic time. My son is in Pre-K4 and the current staff at Benjamin Banneker is all he knows. I believe that if a change occurs during this time, he will be deeply impacted. I also have a three year old that will be entering the same school this coming school year and she as well knows the staff just from my bringing her to pick him up. They will both be deeply impacted if there are any changes made, especially since they have already had a dramatic shift in the school system and how he learns. Please reconsider these changes and above all, keep the children's mental well being in mind when making these kinds of decisions. This can impact them for the rest of their lives. Donnya Johnson-Brown - [email protected] Why is there a high turn-over for Superintendents for this district? What is the Board of Education doing to mitigate this problem? Kenya Pace - [email protected] As a resident of East Orange and a parent of students at Benjamin Banneker Academy, the 2019-2020 Top Ranked Elementary School in East Orange. I am concerned about the potential changes being made to building administration. Our children were already forced into the new normal of distance/virtual learning and to change school administration in the middle of a pandemic is selfish and will not help our children experience some type of normalcy when returning to school in September.

Parris Pellicia - [email protected] As an East Orange Public School employee and a teacher at Benjamin Banneker Academy, I am greatly concerned about the potential changing of our building administrators Mrs. Vincent and Ms Hayes. In the midst of the COVID-19 pandemic, it worries me that when schools reopen the administrators who helped students, parents, and staff get through all the trials and tribulations of virtual learning will no longer be apart of our school community. I believe after this crisis that our country and community are living through, more than ever, we would want to come back to our familiar supportive administrators. At this moment in time when so many of us are facing uncertainty, let’s provide the students with certainty that Mrs. Vincent and Mrs. Hayes will be there to greet them when they return. Ebonin Randolph - [email protected] As a resident of East Orange and parent of a student at George Washington Carver, I am concerned, about the potential changes being made to change building administration in the school district during a pandemic. Whos' discussion is it to make these changes and why? Especially since there will be a new Superintendent for the school year 2020-2021. These changes do not have our children's best interest at heart, many have suffered loss of family members, sick parents and mental issues. Many children and parents have suffered abrupt changes such as lack of food, not attending school, socialization, and loss of jobs. Now the powers that be decides another abrupt change to add to the trauma that we are already experiencing. Before making any drastic changes please consider including the parents, grandparents, guardians and teachers as those changes and decisions effects all of us. Gaietri Shiwdin - [email protected] As an educator in the East Orange School District and a teacher at Benjamin Banneker Academy I am very concerned about the potential changes being made to building administrators in the East Orange School District during this COVID-19 pandemic. It will be very devastating for the students to return to Benjamin Banneker Academy and unable to see the familiar face of their beloved Principal Mrs. Sharon Vincent So please, I am urging you to reconsider moving Mrs. Sharon Vincent from Benjamin Banneker Academy. Angela Brantley - [email protected] As a proud member of the East Orange community and a teacher at Benjamin Banneker Academy, I am extremely concerned about the possible moving of our administrators, Mrs. Vincent and Ms. Hayes. Our Administrators at Benjamin Banneker Academy knows the students, parents, and staff and I trust their leadership and judgment as we return back to our school building. Changing school principals and vice principals would be unethical during this time of crisis. Sophia Glaspie - [email protected] Why are administrators being moved around at a such a crucial time are they not worried that this decision will affect the children? Maria Musano - [email protected] Dear Members of the East Orange Board of Education I am reaching out to you to please consider placing the district restructuring on hold for the 2020-2021 school year. In conclusion, I reach out to you because drastic changes at this time may only create more disruption. Please help us to keep a sense of normalcy in our schools and for our children during these difficult times.

Jacqueline Owes - [email protected] With COVID-19 taking over, we have lost valuable time to help our students of the East Orange School Community grow. This pandemic has not only effected the students but has effected the entire world in a way. A seed only has the potential to grow if it is planted properly. As stakeholders, we are the solidifying soil, water, and sunlight that helps the students sprout and flourish. I am very concerned about the Board’s impending decision to rotate administrative personnel within the overall district and its ramifications. This will have devastating effects on the social emotional well being of our children, as well as future achievement levels. Again I ask, who do you believe will be equipped with the best knowledge the reopen schools? Are there protocols being established to reopen schools? With a superintendent whose term ends next month, how are you ensuring the citizens best interest without an assigned leader. How does this move of administration have the students' best interests at heart? Sharon Vincent - [email protected] The weight for a decline in student achievement is not just a principal responsibility. The qualities of the district's curricula, instructional, and assessment practices have a profound effect on students' progress. The East Orange School District (EOSD) will not experience continuous student academic achievement if the alignment of curricula, instruction, and assessment to the New Jersey Student Learning Assessments (NJSLA) does not exist. There is no alignment between the EOSD's curricula for ELA, Mathematics, and Science and the NJSLA or related assessment practices. In summary, curriculum and instruction, and the department of assessment must assume some responsibility for the declining test scores. These are issues that should be thoroughly reviewed and discussed. Most importantly though, we need to get through the COVID-19 crisis. Knowing the school’s stakeholders, culture and climate are important for a successful reentry back to school. Please do not put our schools at a disadvantage during this very difficult and traumatic time! Sania Grandchamp - Benjamin Banneker Academy Community East Orange schools cannot be defined as simply educational entities. They’re families that thrive on each other’s positive energy and that provide exceptional academic environments for our children. In light of the current state of the COVID-19 pandemic, how are you going to address the trauma and mental health issues that our children are facing and is it wise to destabilize their lives at this time with this district transformation? Ibrahim Fobay - [email protected] As a former student of East Orange School District, the question that needs to be asked is how the board could allow Dr. West to make such drastic changes when they hadn't renewed his contract. He will not be present to oversee the implementation and effectiveness nor destruction caused by such a radical move as well as be held accountable.

PLEASE READ AND ACKNOWLEDGE THE COMMENTS OUR BENJAMIN BANNEKER COMMUNITY HAS LEFT. We, the Benjamin Banneker Academy Community, call on East Orange Board of Education, Superintendent Kevin West, Assistant Superintendent Dr. Deborah Harvest, Assistant Superintendent Anita Champagne and City of East Orange Mayor Ted R. Green to implement a MORATORIUM ON THE ROTATION OF PERSONNEL FOR THE 2020-2021 SCHOOL YEAR. Implementation of these extreme changes given the current circumstances surrounding the COVID-19 pandemic sets teachers, administrators and, most importantly, our children up for failure. These planned changes will have devastating effects on the social emotional well being of our children, as well as future achievement levels. This overhaul will affect the most vulnerable of our diverse minority community. In this diverse community, we need vibrant, healthy, stable, and familiar public schools in order to foster and support all children, and best serve their needs during these very challenging times. A concerned member of the East Orange Community LangstonHughes PTA <[email protected]> Good Evening Board Members, Can the proposed changes (Administration Rotation) be postponed to the following school year 2021? While we understand the rationale behind the proposed changes, we simply do not feel with all the chaos inflicted on our district by COVID-19, that it is the right time. We have circulated a Petition on Change.org, MI asking that the district not move forward with the plan to rotate school administrators for the upcoming school year 2020-2021. The petition has 780 signatures as of 4 pm today. There is also another petition listed specifically for Banneker which also has over 326 signatures as of 4 pm today. We appreciate your response. Thank You in advance Joshua Barney Ayanna Bradshaw - [email protected] From my family to yours, we certainly hope you and your loved ones are healthy and staying safe now and always. I am a parent of a 3rd grade student of Cicey L. Tyson Elementary School of Performing Arts. I have been notified that our Principal and Vice Principal, Drs. Moss-Hassan and McCray have been informed they will not return to the school for the 2020-2021 school year as per the Board of Education. I write to you in sincere concern and objection to the removal of this schools’ administrative leadership team. My question: Why are these two strong administrative leaders among 16 others abruptly being removed from their schools, robbing our children of a sense of stability as they enter a new normal under the heavy cloak of Coronavirus? What data (performance measures, 2020 testing scores, etc.) are being used to justify these changes? Why not lean on the same tried and proven, and trusted strong leadership to guide the teachers and students towards success into the 2020-2021 academic school year? May it be considered to postpone this proposition at a time that will be less destructive and more beneficial to our children’s sense of normalcy when there will be many changes ahead this school? Are we working together to decrease a negative compounded effect on our school community and children? Is it feasible to expect transitioning in administrators to effectively begin to restore normalcy, create a safe atmosphere and establish new leadership in an unfamiliar building with unfamiliar staff, students and parents? As administrators of the East Orange School District, we understand that we work for the district and can be moved at any time but is this the right time? Monica Burton As members of the EOAA, Monica D. Burton and Annie Jackson recommend the implementation of a moratorium on involuntary transfers for the 2020-2021 school year due to the negative impact it will have on the culture and climate of the District, over student success, and the ability to facilitate an effective reentry plan. The correspondence received on April 28, 2020, delineated multiple reasons for “transformational transfers” to take place immediately following an unprecedented pandemic; COVID 19. Although there are multiple identified contradictions and available research that counteract the reasons outlined in the correspondence, I am illuminating a specific line pinned in the first paragraph for review. How were the selected administrators’ strengths and weaknesses assessed? Were multiple data sources utilized to make a correlation between the strengths and weaknesses of selected administrators and administrators with schools with similar assessment data? Most of the selected administrators were not at their locations for 4 – 5 years. Therefore, 4 – 5 years of State assessment data were not available to determine strengths and weaknesses. Besides, research shows that it takes a minimum of 3 - 5 years to begin to realize the transformation of a school. Also, the evaluation process was not completed this school year for administrators (Executive Order 117). There were no evaluation conferences or discussions with any of the affected administrators in reference to strengths and weaknesses. There were no recommendations made to address any immediate areas of concern. There were no collaborative efforts made to identify how strengths can be used to support being moved to another location. Instead, with no warning, affected administrators received an emailed document stating, “…you will be assigned to a different building for the 2020 – 2021 school year...” As a District focused on meeting the many needs of our students, staff, and families, we must shift our attention towards developing a solid reentry plan for the 2020-2021 school year and action steps to address the learning deficits due to being out of school for nearly 6 months in lieu of involuntary transfers.

Passon Moss-Hasan Greetings Board Members & Community Members. As a member of the EOAA, I, Passion Moss-Hasan, recommend the implementation of a moratorium on involuntary transfers for the 2020-2021 school year due to the negative impact it will have on the culture and climate of the District, overall student success, and the ability to facilitate an effective reentry plan. Statement: “The movement of building administrators is part of the transformation process that is often done to avoid complacency, allow assistant principals to experience leadership under different administrators, and to prevent a sense of stagnation in both the principals and the teachers.” The question becomes what “transformational process” are we referencing, as principals were never informed of administrative shifts and/or restructuring initiatives during the school year. Throughout past years, prior to assignment changes, administrators were always informed both informally and formally about the possibility of transfers, pending transfers and confirmed transfers; this never happened this year. Additionally, we were never given an opportunity to serve as stakeholder on committees to assist with the development of this reform. As leaders in this district who commit ourselves to addressing the needs of students and staff every day from a holistic perspective, the least that we should be entitled to is receipt of proper notification of transfers. While we are aware that from a legal standpoint, we received letters on April 28, 2020, the process was not in accordance with past practice. More importantly, the process undercuts the very core of what this superintendent and his leadership team pose as the district’s mantra: Rigor, Relevance & Relationships. Research suggests that it requires approximately 3-5- years to effectively reconstruct a school district’s grade configurations on a large scale. It also suggests that massive undertakings such as this should include feedback from a diverse group of stakeholders, inclusive of parents, teachers, central office leaders and students. Additionally, when referencing a “transformational process” and “complacency,” there is an even more important characteristic that we must consider, and that is the mental health of our students and staff, and how these changes will compile issues that are perhaps exacerbated by this horrific pandemic. There is clearly no research, which will confirm that such processes should occur amid a life changing crisis. According to an article from the School’s Superintendent Association, there are possible implications that must be considered when making changes of this magnitude. It states, “every transition from one narrowly configured school to another seems to disrupt the social structure in which learning takes place, lowering achievement and participation for many students. Predictably, this damage will be most severe in the cases of students from impoverished backgrounds. Short of providing an adequate living for poor families, we can at least restructure our educational system to mitigate the detrimental effects of poverty.” To our leaders we declare, “Change uses external influences to modify actions, but transformation modifies beliefs so actions become natural and thereby achieve the desired results.” Therefore, we ask, is this action predicated on change or true transformation? The data referenced below is in response to the statement “When reflecting on the current placement of our administrators, over 65% of the building principals and/or assistant principals have been in their same position or building for 5 or more years, with little growth with regards to student achievement”. The data reveals that 51% of building administrators have been in their current location 4 years or less. Additionally, of the 51% of administrators, 27% have been transferred twice within the last four years. Given the revelation of the facts regarding movement on administrators within the last 4 years, only 49% of administrators have been at their location for 5 or more years. We are facing a global health crisis — one that is killing people, spreading human suffering, and upending people’s lives. But this is much more than a health crisis. It is a human, economic and social crisis. What is the path to reopening our schools? When will we reopen? What will it look like? How do we reinstate classroom learning and daily schedules? How do we accommodate individual student needs? What health and safety precautions will be in place? When will there be a vaccine? Are we entering a financial depression?

Brian Heaphy As members of the EOAA, Leslie Shults and Brian Heaphy recommend the implementation of a moratorium on involuntary transfers for the 2020-2021 school year. On March 13 the East Orange School District sent students home for the final time of the 2019-2020 school year. This is the date that the East Orange School District staff “stepped out of their comfort zone”. We immediately began to move into an online learning platform as the primary means of delivering student instruction for the remainder of the school year This ‘unprecedented’, ‘new and challenging’ undertaking has resulted in the following as reported by Assistant Superintendent Dr. Harvest on May 11, 2020. Total District School enrollment 8598 students; 85% (7,180 student) are participating in online classes. Administrators work with and encourage teachers to use a variety of online tools and strategies to increase student engagement. Many of which are new to staff and students-Flip Grid, Screen Castify, Google Meet, Google Hang Outs, to name a few. With all of the new challenges we must call upon our personal relationships with our students, parents, and staff to make this work. We do not know what the future will bring, but when we do return to our schools we need to re-enter, rebuild, and grow stronger and better together. This is a time for continuity of leadership and school community to ensure that “our comeback is stronger than our setback”.

Thelma Ramsey, [email protected] The administrators on this letter would like to call a moratorium on the transfers that are pending board vote at this meeting. As members of the EOAA, we understand that contractually, we can be moved at any time, however, this is an unprecedented catastrophic event that is having a major impact on the East Orange Community. According to the letter that many of our colleagues received, the following statement is being addressed here: “As we look for ways to ensure significant gains that have not been seen over the past 4 – 5 years, these movements are being done to help leadership step out of their comfort zones, accept new challenges based on their strengths and their weaknesses, and become the driving force for school improvement.” At this point the whole community is outside of the comfort zone and we still do not know what our new “normal” is going to be. With the advent of social distancing and how to implement that safely in a school setting has yet to be established. The benefit that a principal has, once schools reopen, is familiarity; with students, parents, staff and the facility itself. As it stands, students will already be at an academic deficit. The goal should be to provide stability from a socio-emotional standpoint while trying to address their academic needs simultaneously. It will be difficult to be the driving force for school improvement with a staff and students that we are unfamiliar with. We will use precious time trying to become acclimated to the new school, getting to know new staff, parents, and students. If the principal is the driving force of any school improvement, in the cases of the other two principals, they have no other administrator working with them, so familiarity of staff will be totally removed for them. In addition to the statement of little to no progress, one principal listed on this email will be experiencing her second involuntary move in four years; if progress is to be realized, research supports that it takes three to five years to transform any organization. WHEREAS, N.J.S.A. 18A:19.3 and N.J.S.A. 18A:19-4 authorizes the School Business Administrator/Board Secretary to make payments between board meetings for all claims that have been duly audited; and WHEREAS, the School Business Administrator/Board Secretary has reviewed the documentation supporting the attached list of bills; NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, ratifies the payment of bills on the attached lists totaling $4,111,830.81. (Attachment 3-a)

b. List of Bills WHEREAS, N.J.S.A. 18A:19.1 and N.J.S.A. 18:6-31 provides for the Board of Education to

authorize the payment of bills; and WHEREAS, the School Business Administrator/Board Secretary has reviewed the documentation

supporting the attached list of bills; NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, upon the

recommendation of the Superintendent of Schools, authorizes and approves the payment of bills on the attached lists for the Tuesday, May 12, 2020 board meeting in the amount of

$6,349,423.14. (Attachment 3-b) c. Appropriation Transfers

WHEREAS, N.J.S.A. 18A requires that the Board of Education approve appropriation transfers; and WHEREAS, Board of Education Policy #6422 delineates the process for transfer of funds between line items; and WHEREAS, the Superintendent has authorized the budget adjusted to reflect the appropriation transfers; NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, does ratify the transfers approved by the Superintendent of Schools. (Attachment 3-c)

d. T-1 Request for Taxes from the City of East Orange

WHEREAS, N.J.S.A. Title 40 provides for a board of education in a Type I School District to requisition Tax-Levy monies from the municipality in an amount estimated to represent the balance of its projected cash flow needs; and WHEREAS, the Secretary of the Board has determined this amount to be $1,862,022.83 for the month of May 2020;

recommendation of the Superintendent of Schools, authorize and direct the Board Secretary to execute and serve the T-1 Request for Tax-Levy monies from the City of East Orange. (Attachment 3-d)

e. A-148 Secretary’s Report

WHEREAS, pursuant to N.J.S.A. 18A-17-9, the Secretary of the Board of Education shall report to

the Board at each regular meeting but no more than once each month, the amount of total appropriations and the cash receipts of each account, and the amount for which warrants have been drawn against each account and the amount of orders and contractual obligations incurred and chargeable against each account since the date of the last report; and

WHEREAS, the Commissioner has prescribed that such reporting take place on Form A-148;

NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, upon the

recommendation of the Superintendent of Schools, accept and adopt the A-148 and for it to become part of the official minutes of this meeting: (Attachment 3-e)

WHEREAS, pursuant to N.J.S.A. 18-A:17-31 et seq. boards of education are required to have the appointed position of Treasurer of School Monies; and

WHEREAS, the Treasurer shall serve in trust to receive and hold all school monies belonging to the district; and WHEREAS, the Treasurer shall report to the Board of Education on a monthly basis on the Form A-149, which is prescribed by the Commissioner of Education; NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, for the period ending February 29, 2020 upon the recommendation of the Superintendent of Schools, adopt the A-149 and cause it to become a part of the official minutes of this meeting: (Attachment 3-f)

BE IT RESOLVED: that the East Orange Board of Education, upon the recommendation of the

Superintendent of Schools, and pursuant to N.J.A.C. 6A:23-2.12(c)4, certify that, after a review of the Secretary’s Reports, and the A-149 Treasurer’s Reports, and upon consultation with appropriate district officials, to the best of the Board of Education’s knowledge, no major account or fund has been over expended in violation of N.J.A.C.6A:23-2.12(b) and that sufficient funds are available to meet the district’s financial obligations for the remainder of the fiscal year. h. Rescind School Youth Tennis Initiative Grant (Funded by the USTA)

BE IT RESOLVED: “that the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, approves the acceptance of grant monies from United States Tennis Association(USTA) in the amount of $1,200.00 for all tennis related activities (after-school program, field trips, etc.) for Bowser Elementary School students, headed up by Ms. E. Alfaro, Physical Education Teacher, Tuesday, April 21, 2020 thru Tuesday, June 2, 2020 twice a week every Tuesday and Thursday at no cost to the district.

i. Preschool Revised Budgets for the East Orange School District Private Providers and Head Start Teacher Salary Increase for the 2019-2020 SY

BE IT RESOLVED: “the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, approves” the submission and acceptance of the One-Year Preschool Program Plan Annual Update and budget for the 2020-2021 school year in the amount of $20,448,178. BE IT FURTHER RESOLVED: that the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, directs administration to obtain a purchase order and have it provided to the vendor/consultant prior to receiving any goods or services from said vendor/consultant. k. Resolution Authorizing Use of Competitive Contracting

BE IT RESOLVED, that the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, hereby recommends the use of the Competitive Contracting Process in accordance with N.J.S.A 18A:18A-4.1 et. seq. to procure Web-Based Autism Resource Program – Dept. of Special Education 2020-21 SY Title 1 Services to Non-Public Schools -Div. of Operations 2020-21 SY BE IT FURTHER RESOLVED, the technical specifications will be developed by the stakeholders involved, with guidance from The Purchasing Agent. The evaluation criteria, along with The Competitive Contracting process will be prepared and administered by Racquel C. Ferguson, Purchasing Agent.

3. BUSINESS SERVICES m. Approval of Contract - Food Service Management

WHEREAS, Sodexo Management, Inc. guarantees that the District shall receive an annual return of Four Hundred Thousand Four Hundred Sixty Eight Dollars ($400,468.00) for the 2020-2021 school year; and WHEREAS, if the annual financial return for the Food Service Program falls short of the aforementioned amount, Sodexo shall pay the difference to the District in an amount not to exceed one hundred percent (100%) of Sodexo’s annual Management Fee of $.1134 per meal and General Support Services Allowance of $.0864 per meal (“Sodexo’s Share”). Sodexo reserves the right to recover any such reimbursement made during the current contract year from that year’s surplus on a monthly basis; and WHEREAS, any annual deficit greater than Sodexo’s share shall be borne by District; and

WHEREAS, pursuant to N.J.S.A 19:44A-20.26 (P.L.2005, c. 271, s.2) the aforementioned entity has submitted the required Political Contribution Disclosure Form and Stockholder Disclosure Certification, of which they both are on file; NOW, THEREFORE, BE IT RESOLVED, that the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, approves a contract for the provision of Food Service Management to Sodexo Management. Inc. for the 2020-2021 school year at for their annual Management Fee of $.1134 per meal and General Support Services Allowance of $.0864 per meal;

BE IT FURTHER RESOLVED, the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, accepts the Sodexo guarantees that the district shall receive a Surplus of Four Hundred Thousand Four Hundred Sixty-Eight Dollars ($400,468.00) for the 2020-2021 school year. If the actual Surplus for the Food Service program falls short of the aforementioned amount, Sodexo shall pay the difference to district in an amount not to exceed one hundred percent (100%) of Sodexo’s annual Management Fee and General Support Services Allowance. Sodexo reserves the right to recover any such reimbursement made during the current contract year from that year’s Surplus on a monthly basis. (Attachment 3-m)

n. Acceptance of Food Donations from Jersey Cares - Amended

BE IT RESOLVED, the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, approves acceptance of food donations from Jersey Cares and The Bass Foundation for select families of students who attend a few of the EOSD elementary schools: Cochran, Louverture, Whitney Houston, Parks and Cicely Tyson, at no cost to the district. The food will be distributed on Wednesday, April 22, 2020, between the hours of 9:00am and 12:00 noon. Personnel from the East Orange Police Department will assist in enforcing the “social distancing” protocol. The boxes will be strategically placed on the curbside to facilitate easy pick up and departure, without the need for physical contact. (Attachment 3-n)

Recommendation to Exceed the Awarded Contract Amount for Audit Services WHEREAS, on May 16, 2019, the Board of Education of the City of East Orange awarded contract to Lerch Vinci & Higgins for Audit services for the 2019-20 fiscal year in an amount not to exceed $125,000.00; WHEREAS, as a result of increased Audit services required, the School Business Administrator projects the spending for the balance of the year will be an additional $40,000.00; and WHEREAS, the additional funds will be charged to account# 20.11.000.230.332.028.020.4101 (Audit Services); NOW, THEREFORE, BE IT RESOLVED, that the Board of Education approves the increase of the contract amount for Lerch Vinci & Higgins by an additional $40,000.00 from the amount of $125,000.00 to a revised amount not to exceed $165,000.00.

p. Application for 2020 Safety Grant Program

BE IT RESOLVED, the East Orange Board of Education hereby approves the submission of Grant application for the 2020 Safety Grant Program through the New Jersey Schools Insurance Group for the purposes described in the application, in the amount of $35,440.00 for the period July 1, 2020 through June 30, 2021.

q. Remington & Vernick Engineers Support Services for George Washington Carver Institute

BE IT RESOLVED, the East Orange Board of Education, upon the recommendation of the Superintendent of Schools, approves Remington & Vernick Engineers to provide engineering support services related to the preparation and submission of various emergent NJDOE project applications for improvements at George Washington Carver Institute. Remington & Vernick proposes to complete the proposed work on a time and material basis for a fee not to exceed $6,200. (Attachment 3-q)
