A race against the clock: Truckers cite problems with HOS rulesThere has been a lot about what truck drivers and fleets say should be changed concerning the Federal Motor Carrier Safety Administra-tion's (FMCSA) HOS regulations. But after an article in Fleet Own-er that was seeking input since about the full enforcement of the electronic logging device (ELD) mandate was printed, hundreds more comments flooded in. This is clearly an issue that many drivers feel very strongly about. Overall, the complaints aren't focused on ELDs themselves but on the HOS rules the devices enforce. Here's what they heard.

Don't add to the overall time frame allowed for driving, many commercial truck drivers say, but allow that time to be paused when drivers are delayed, rather than requiring those 14 hours to keep running down and forcing a race against the clock. Or allow the off-duty/sleeper berth time the HOS rules call for to be split up to allow drivers to rest when they need to and break up the on-duty clock.

Another comment addressed the rigidity and inflexibility. "The [HOS] rules themselves aren't terrible; it's the lack of flexi-bility that is the worst," the president of one trucking company said.

Fuel haulers get conditional rest exemption from FMCSAAn announcement from the Federal Motor Carrier Safety Ad-ministration states that under certain conditions fuel trucks can operate for 12 hours a day without triggering the rest break requirement. FMCSA has granted an exemption from the 30-minute rest break requirement for trucks hauling petroleum products.

FMCSA recognized that “these drivers receive several short ‘breaks’ each day when they unload at service stations.”

“This is a great development for our fuel haulers and a shin-ing example of association partnership for trucking advo-cates,” said Daniel R. Furth, the National Tank Truck Carriers president. “We are thrilled that the agency agrees that this relief will lower costs for carriers and prices for consumers without compromising safety on our nation’s roadways.”

The NTTC and the Trucking Association of Massachusetts (TAM) jointly applied for the exemption in August 2017. The two organizations requested that FMCSA exempt

the drivers that would be on-duty more than 12 hours so long as their vehicles were carrying petroleum products and were equipped with an electronic logging device (ELD). FMCSA agreed that the time these drivers spend unloading provides rest that is equivalent to, and often great than, rest from the traditional 30-minute rest break. Accordingly, the exemption allows these drivers a 14-hour window to make their fuel runs.

“This announcement will provide relief that allows our drivers to get more rest and creates flexibility that will provide improved customer service and greater efficien-cies throughout the fleet,” former TAM chairman and NTTC memberJohn Hamel, president of J&S Transport Co. of Lynn, MA, said recently.

Former trucker gets consecutive life sentences for role in deadly 2017 human smuggling caseA former Florida-licensed truck driver has been sentenced to two concurrent life sentences without parole for his rolein the deaths of 10 immigrants who died while being transported in a sweltering tractor-trailer in San Antonio lastsummer.

According to a report from the San Antonio Express-News, the judge in the case equated former owner-operator JamesMatthew Bradley Jr.’s actions to torture. Bradley originally pleaded not guilty in August, but later changed his plea inOctober to guilty, the report states, on two counts of conspiracy to transport undocumented immigrants for profit,resulting in death.

The crime unfolded in a Walmart parking lot in San Antonio on July 22, 2017, when 39 undocumented immigrantswere found in the back of a trailer. The trailer had a reefer unit, but it wasn’t working while the immigrants were inroute from Laredo to San Antonio.

Bradley reportedly had his CDL revoked in April 2017 and had a criminal record dating back to the 1990s. At the timeof the smuggling discovery, Bradley had been working as an owner-operator, without a CDL, for Iowa-based PyleTransportation, which has since been shut down by the Federal Motor Carrier Safety Administration for hours-of-service and driver fitness violations.

FMCSA assigns CSA severity weights to ELD violations

The Federal Motor Carrier Safety Administration has assigned severity weights to each of about a dozen electronic logging device-related violations that are being recorded on a driver’s or motor carrier’s safety profile score.

In a posting earlier this month on the agency’s Compliance, Safety, Accountability website, FMCSA said that any of the ELD-related hours-of-service violations written up will be added to safety measurement system scores. The severity weights range from five points for not having an ELD to one point for failing to make annotations on the ELD when appli-cable.

“As of April 1, 2018, violations related to electronic logging device regulations found during roadside inspections are being used in the SMS,” the agency said in a web posting. “These violations are not being applied retroactively; viola-tions recorded prior to April 1, 2018, will not be counted in SMS. Motor carriers that have received ELD-related violations have seen them reflected in their HOS Compliance BASIC from early May."

Carriers keep rolling out driver pay raisesThe need for truck drivers has spurred a number of carriers recently to raise compensation and entice qual-ified drivers to stick around. Trucking companies find themselves competing for talent as the unemployment rate hovers around 4%, the economy expands and the freight market moves at a boiling-hot pace.

For instance, the value of Truckstop.com’s Market De-mand Index in March was near its all-time high, demon-strating an extraordinarily strong need for trucks and truck drivers. And a study in 2017 by American Trucking Associations found that driver pay had gone up in the previous four years at a measured pace. ATA report-ed that truckload drivers last year working a national, irregular route received pay of $53,000, a rise of $7,000, or 15%, from 2013. A private fleet driver in 2017 earned more than $86,000, up $13,000, or nearly 18%, from 2013.

In response, Memphis, Tenn.-based Intermodal Cartage Co. said it would give its drivers pay raises averaging more than 30% as of April 15. Intermodal is a division of IMC Cos., a national network of intermodal logistics businesses. “Our goal is to retain seasoned drivers while attracting new talent to our growing industry,” IMC Chairman Mark George said. IMC ranks No. 84 on the Transport Topics Top 100 list of the largest for-hire car-riers in North America. Maverick Transportation raised the pay of its over-the-road, temperature-controlled division drivers by 5 cents a mile. The increase will took effect April 29th and brought starting pay from 51 cents to 55 cents per mile. Drivers in the division also are part of a $1,000 weekly minimum guarantee pay program, and the firm is offering a $5,000 sign-on bonus for driv-ers with at least one year of experience.

1. The step van class has an unique form for registration. The step van class is not eligible to win the team or grand championship categories.

2. Stopwatches are no longer allowed for usage during pre-trip or on the course. A wrist watch is allowed.3. Drivers may bring flashlights to help with their pre-trip inspection.4. Equipment drop off will take place at the course location this year. A golf cart will be available to take you

back up to the hotel. 5. A cookout lunch will no longer be provided on Saturday. Food trucks will be on location and have food avail-

able for purchase. Please ensure that your drivers and their families are aware of this change.

CERTIFICATION BY EMPLOYER. I hereby certify that I am aware of the provisions of Chapter V, Truck Driving Championships Eligibility Rules, of the ATA Truck Driving Championships Rules and Procedures, State and National and applicable appendixes includ-ing the Step Van Driving Championships rule summary; that the contestant named herein is eligible to compete under these rules; that the contestant’s employer is a member of an ATA-affiliated State Trucking Association, and that all information furnished about them is true to the best of my knowledge and belief.

AGREEMENTS AND RELEASEIn consideration of my being permitted to participate in the ATA’s National and/or its affiliates’ Truck Driving Championships (TDC) or Step Van Driving Championships (SVDC) and be eligible for awards offered to participants, I hereby stipulate and agree to the following:

1. I acknowledge that I am not in the employ of ATA or a State Trucking Association.2. Both as to myself and my heirs and personal representatives, I release ATA, its directors, employees, agents and/or any of its

affiliates and the State Association noted above, its directors, employees, agents and/or any of its affiliates from any and all liability and any right of action that may arise from any damage or injury which I may receive while attending or participating in said State or National TDC or National SVDC.

3. I grant the State Association noted above and ATA and its designated agencies exclusive right to make use of information about myself and of photographs supplied with this entry form, along with photographs subsequently taken under ATA’s direction, in publicity and advertising activities. I further agree to make myself available for publicity enterprises arranged by ATA, with newspaper and magazine writers and radio and television personnel.

4. I grant State Association noted above and ATA the right to exam my CDL and MVR for the purposes of determining my eligibility to compete at both the State and National TDC or SVDC.

5. I will be bound by all orders, rules and regulations governing ATA’s National and/or its affiliates’ TDC or SVDC while participating in said competitions.

CERTIFICATION BY CONTESTANT. I certify that during the 12 months prior to the 2018 TDC:

1. I have been continuously employed as a truck or step van driver by my present employer [exception: 11 of 12 months if previous employer went out of business and all other eligibility requirements are met]; and

2. I have driven and performed the regular duties of a truck driver or step van driver for at least 11 of the 12 months, and that my regular duties of a truck driver or step van driver constituted not less than 60% of my work hours and at least 1200 hours annually.

3. I have not been involved in a fleet motor vehicle or motor carrier vehicle accident in the course of such employment.4. I have the proper class Commercial Driver’s License (if a SVDC applicant, not required), plus required endorsement(s) for the class

of competition indicated above.5. That I hold a CDL from or have been occupationally domiciled in the state of . Occupational domiciled

means the terminal, garage or other operating base from which the driver normally and usually works and/or issupervised.6. That the class of competition I am entering in 2018 is not a class in which I won at the state or regional TDC and/or competed at

the National TDC in 2016 and 2017 or 2015 and 2016; or if I am entering the step van class, I did not win the state or regional TDC and/or compete at the National SVDC in the step van class in 2016 and 2017. I understand that after winning two consecutive years at the State TDC and/or competing two consecutive years at the Nationals in that same class of competition, I am not eligible to compete in that same class for one year if a step van competitor and two years if a competitor in any other class.

7. I further certify that I have not received any form of pay, bonus, prize or other consideration for time spent in practice as set forth in the ATA Truck Driving Championships Rules and Procedures, State and National.

8. I agree that if I compete and win the State TDC, that I will compete at the National TDC or SVDC (as applicable), unless disqualified or am detained due to a medical emergency, in which case I will notify the applicable State Trucking Association immediately.

9. I acknowledge that any misstatement made with respect to my eligibility for the TDC or SVDC competition may result in the forfeiture of my right to compete or in my disqualification from said competition.

2018 Truck Driving Championships Meal Ticket Order FormAll meal tickets must be purchased by June 14th. We recommend one person in your company be responsible for completion of this form. Send in only one copy as soon as possible. Be sure to include family members of the drivers. If you purchase meal tickets before the registration deadline of June 1, 2018, you will receive early bird pricing.

Lunch and dinner will be provided on Friday for the contestants in addition to the Saturday evening banquet. Saturday lunch is no longer provided, however, we will have food available for purchase on site. Safety directors, company offi-cials, spouses, children, guests, etc. need to purchase meal tickets for the Friday evening meal and Saturday evening banquet.

The championships banquet will again have reserved seating. NO BANQUET TICKET SALES ON SATURDAY. Your meal tickets will be given to you on Friday, June 16th. Drivers tickets will be with their registration information.
