Dear Mr Smith

I am writing on behalf of The University ofNorth Carolina at Chapel Hill (UNC-CH) in response to your April 28 2010 (received April 29 2010) Notice of Violation and Recommendation for Enforcement for the Bingham Facility In your Notice you requested a written response within 30 calendar days of our receipt of the Notice The North Carolina Division of Water Quality (DWQ) requests are shown in bold and our responses follow

1 Please explain when construction ( excavation grubbing and clearing) began at the site

Site construction began in February 2008

2 Please clearly explain why appropriate 401 Water Quality Certification and a 404 Permit were not secured

A lapse in internal communication occurred during the project However upon discovery the University hired Biohabitats Inc to delineate the wetlands and streams and the University reported the results of that effort to DWQ and the US Army Corps of Engineers (USACOE) Additionally after the report representatives of DWQ and USACOE visited the site

3 Please provide a map that exactly details the streams and wetlands on the tract and the areas that were impacted

The requested map is included as an attachment to this letter (Attachment A)

4 Please submit a Restoration Plan to this office for review and approval You are encouraged to secure a consultant to assist you with your plan development permit certification and authorization necessary to achieve compliance This plan should include the following

a) The restoration plan must detail how the earthen fill material placed in wetlands (including all side castings) will be removed and how excavated wetlands will be restored This information must be clearly depicted on a map that you provide as a part of this response This map should also indicate all of the wetlands locations of the tract as well as the wetland areas that have been impacted

Attachment A is a map of all of the wetland locations on the tract as well as the wetland areas that have been impacted The attached wetland restoration plan (Attachment B) explains how Impact A will be restored UNC-CH requests that wetland Impact B remains in place and a Pre-Construction Notification (PCN) Form for this impact is attached to this response letter (Attachment C)

b) Satisfactory wetland restoration requires the replanting of at least 2 native hardwood wetland species and the maintenance of a stem densitysurvivorship of at least 320 trees per acre at the end of 3 years Also this plan will require an herbaceous wetland seed mix for all wetlands that are disturbed

The attached wetland restoration plan (Attachment B) contains a replanting plan for Impact A that meets the requirements of the above request

c) Stream Restoration Plan - Please explain how you plan to restore the pattern profile and dimension of the impacted stream channels to include the removal of pipes fill and riprap The streambed must be restored to the original profile the stream bank must be stabilized and any fill material must be removed from the riparian zone Replanting of the riparian zone will be required

UNC-CH requests that the stream crossing at Impact C remain in place A PCN Form for this impact is attached to this response letter (Attachment C)

d) Permit Application - If you wish for any impacts to remain in place you must contact the US Army Corps of Engineers (USA COE) for information on the type(s) of permit required Depending on the type of permits

USACOE requires application for a 401 Water Quality Certification to DWQ will also be required

The USACOE has authorized Impacts Band C under a Nationwide Permit 39 in their Notice of Unauthorized ActivityPermit Noncompliance letter dated May 18 2010 (Attachment D) UNC-CH has included a PCN Fonn for the 401 Water Quality Certification for Impacts B and C with this response letter (Attachment C)

e) Please indicate in your response a schedule with dates detailing when the restoration will be accomplished and if your plan to seek a permit for the permittable impacts This schedule should include a three-year monitoring plan to ensure that the wetlands are restored

As requested a schedule for restoration and a three-year monitoring plan are attached to this response as part of the wetland restoration plan (Attachment B)

f) Wetlands are located in a wastewater spray irrigation field Please explain how yon intend to reconfigure the sprayfield and eliminate the application of waste onto wetlands

The current wastewater treatment system (including the sprayfield) is not being operated at this time Wastewater at the facility is being pumped and hauled to the Orange Water and Sewer Authority Wastewater Treatment Plant in Chapel Hill NC pursuant to DWQ permit number WQ0034607 The Bingham Facility wastewater treatment system is currently undergoing an evaluation and redesign Modifications will be made to the wastewater treatment system and its permit status before it begins operating again including closure and demolition of the portions of the sprayfield that are located within wetland areas

Finally please explain how you propose to prevent these problems from reoccurring on future projects

UNC-CH EHS is in the process of implementing a regulatory training program for all UNC-CH FPC managers and School of Medicine planning personnel The training program will cover planning and construction-related regulatory requirements for wetlands and streams stream buffers stormwater management and erosion and sedimentation control The training program will also provide information to FPC managers on available in-house enviromnental regulatory resources and technical assistance opportunities

In addition all construction drawings will be reviewed for regulatory compliance by the UNC-CH EHS Environmental Affairs staff to ensure that projects have the proper environmental permits prior to the start of construction

UNC-CH response to DWO NOV Items 4 a) - e)

4a) The earthen fill which was placed in the wetland (Impact A on the attached map and Restoration Plan drawing) will be removed excavated using small mechanized earthmoving equipment (Backhoe Bobcat skid steer etc) The material will be loaded onto a small dump-bed truck and removed to an upland disposal site controlled by UNCshyCH Appropriate erosion control measures will be put in place at the disposal site and maintained until permanent vegetative stabilization of the fill material is established

The wetland will be restored by excavating and removing the unauthorized fill until the buried A horizon of the existing soil profile is visually evident This work will be supervised by Biohabitats Inc on behalf of the University The area defined on the attached restoration plan drawing as limit of wetland restoration by USCOE represents the survey location of the unauthorized fill perimeter This perimeter was flagged in the field and agreed upon with DWQ and USACOE during the site visit on April 22 2010 The flags were located by a registered land surveyor and a map with the flag locations was provided to UNC-CH

The sequence ofwork for the wetland restoration is proposed as follows bull Silt fence will be placed between the work area and the existing undistnrbed

wetlands bull The perimeter of the restoration area will be excavated as required and final grades

will be tied in to existing elevations to create maintainable slopes bull Wetland trees shrubs and herbaceous seed (see species list below) will be installed

within the restoration area bull A silt fence will be installed on the uphill side of the restoration area at the base of

the newly graded slopes to prevent potential erosion into the restoration area during heavy rainfall events The silt fence will be removed once vegetation on the slope is well established

bull Slopes up-gradient from the silt fence will be seeded with an upland native grass mix at an application rate of 8 pounds per acre and covered with an approved erosion control blanket (ECS2 straw blanket with photodegradable netting on both sides) The species listed in the table below should be broadcast seeded into a firm bare seedbed If planting occurs after June 30 then 10 lbs of foxtail millet (Setaria italica) will be included with the mix

b) A minimum of2 native hardwood species at a planting rate of320 stems pr acre is required (320 x 010 acre= 32 trees) at the end of three years

Following removal of the fill material to preexisting conditions 50 trees and 20 shrubs will be installed The additional material planted should ensure that the restoration planting meets the stemsacre requirement throughout the monitoring period Tree species to be planted include Willow oak (Quercus phellos) (17) Overcup oak (Quercus lyrata) (15) and Green ash (Fraxinus pennsylvanica) (18)

Shrub species to be planted include Buttonbush (Cephalanthus occidentalis )(5) Winterberry (flex verticillata)(5) Spicebush (Lindema benzoin) (5) and Elderberry (Sambucus canadensis) (5) As agreed upon in the field with DWQ and USACOE on April 22 2010 all installed woody plants will be one gallon container size

The entire wetland restoration area will be broadcast seeded with a herbaceous wetland seed mix at an application rate of 25 pounds per acre with equal amounts of each species After seeding straw mulch shall be spread over the area such that a minimum of 75 ground cover is achieved with the mulch Herbaceous species to be planted are listed below

Herbaceous wetland seeding will be considered successful if there is a minimum 60 coverage at the end of the first growing season following seeding and 90 coverage at the end of the third growing season

The Monitoring report will include the following bull Cover letter with general overview monitoring dates and plant replacement(s) performed bull Plant list documenting plantings installed initially bull List ofreplaced trees and shrubs bull Areal coverage ofwetland herbaceous seed

The University requests the option to change the composition of the restoration plant community if survivability of one or more woody species is poor Under no circumstance will the change result in a plant community that does not meet the wetland hydrology criterion or the ratio of tree species to shrub species

The 6 impervious calculation was completed by the civil engineer after the most recent building was constructed at the site The engineer for that building prepared a Stormwater Management Permit Application (SWU-101) in 2009 That application stated that the site met the low densiity requirements and did not require stormwater treatment This permit application was not submitted to DWQ and therefore was not reviewed by DWQ to verify the low density of the site As part of the most recent building construction a limited number of storm drains and storm drain inlets were installed As part of future planning for the site a civil engineering firm is preparing a stormwater concept plan for the site This plan will propose stormwater management for the existing development to meet the Jordan Lake Nutrient Loading Reduction Target for existing and future development The concept plan is scheduled to be completed in August 201 O At that time a pre-application meeting will be scheduled with the DWQ Stormwater Program Although a Stormwater Management Plan is not required for this site under the 401 Program the Phase II Program does require require submital of a Stormwater Management Plan

4 Please submit a Restoration Plan to this office for review and approval You are encouraged to secure a consultant to assist you with your plan development permit certification and authorization necessary to achieve compliance This plan should include the following

a) The restoration plan must detail how the earthen fill material placed in wetlands (including all side castings) will be removed and how excavated wetlands will be restored This information must be clearly depicted on a map that you provide as a part of this response This map should also indicate all of the wetlands locations of the tract as well as the wetland areas that have been impacted

Attachment A is a map of all of the wetland locations on the tract as well as the wetland areas that have been impacted The attached wetland restoration plan (Attachment B) explains how Impact A will be restored UNC-CH requests that wetland Impact B remains in place and a Pre-Construction Notification (PCN) Form for this impact is attached to this response letter (Attachment C)

b) Satisfactory wetland restoration requires the replanting of at least 2 native hardwood wetland species and the maintenance of a stem densitysurvivorship of at least 320 trees per acre at the end of 3 years Also this plan will require an herbaceous wetland seed mix for all wetlands that are disturbed

The attached wetland restoration plan (Attachment B) contains a replanting plan for Impact A that meets the requirements of the above request

c) Stream Restoration Plan - Please explain how you plan to restore the pattern profile and dimension of the impacted stream channels to include the removal of pipes fill and riprap The streambed must be restored to the original profile the stream bank must be stabilized and any fill material must be removed from the riparian zone Replanting of the riparian zone will be required
