Kalb's Q&A for Contractors By David Kalb & Shauna Krause, Capitol Services, Inc.

Like the timber wolf that has been in the news looking for new territory across the borders of Oregon and California, contrac-tors across the west are also looking for opportunity in new places. For contractors with longer reach, knowing the varia-tions in license law can make the difference between success and failure. We share some of the problems and some of the ‘profit’ in working across state lines…

Q: Capitol Services helped us years ago with obtaining our GC contractor’s license in Nevada and California and I have a question for you. The Responsible Managing Officer (RMO) on the license (who also happens to be my Uncle) is planning to retire at some point in the near future and we were wondering if there is a way to add me as a second Qualifier on the licenses so it doesn’t lapse. We were also thinking this would be beneficial in case anything unex-pected were to happen to him. A: Thanks for thinking of us. Since California only allows one Qualifier per classification, you cannot both be Qualifiers on the CA license simultaneously. You can either replace your Uncle on the li-cense now as a pre-emptive step, or you could obtain your own Sole Owner license as a “back-up” so the process of replacing him will be easier down the road. Keep in mind that even if you do nothing now, you will have 90 days to replace him if he were to retire or something unexpected occur.

With regards to Nevada, you certainly can be added to the license as a second Qualifier. In fact, Nevada actually allows up to TEN qualifiers on each license! Please contact us if you’d like assistance with this process.

Q: My company has had a General Building (“B”) license since 1985. In 2009 we obtained an “A” license by having one of our employees take the necessary exams. He is now leaving the com-pany and I was wondering if there is any way for me to qualify the “A” portion of our license without having to take the tests? I am currently the RMO/President for the General Building license. Our company has been doing “A” projects for over 12 years. A: Unfortunately, you will have to take the trade exam to replace your employee for the General Engineering or “A” classification.

The only way to qualify for a waiver is if your company had held that classification (and the license has been in good standing) for 5 of the prior 7 years. The “A” work you reference was actually done without benefit of a license “in good standing” and would not be counted as experience. Q: I currently have a “C-61”/”D-06” (Concrete related services) li-cense in CA. My company does concrete pumping. We have some potential work in Nevada and I have reviewed Nevada’s classifica-tion list and it doesn’t appear that they have anything that is equiva-lent. Do I even need a license to perform this work in Nevada? A: Thank you for contacting us. If all you are doing is delivering and pumping from the truck then no, a contractor’s license is not required in Nevada. We hope this advice helps ‘pump’ up your profit line!

California Gov. Jerry Brown upsets environmentalist friends with his CEQA critiqueBy David Siders The Sacramento Bee

If the full extent of Gov. Jerry Brown’s frustration with the California Environmental Quality Act was not already clear, it became so last week, when he said, “I’ve never seen a CEQA exemption that I don’t like.”

The remark, Brown’s plainest yet about the state’s landmark environmental protection, reflects his emerging record. Less than two years into office, Brown has signed three bills limiting the ability to challenge projects under the act, and he is openly supportive of at least one more.

Meanwhile, Brown’s top political adviser, Steve Glazer, is quietly advising a group of business leaders on other ways to modify the law.

Environmentalists are dismayed: This is the Democratic governor and champion of environmental causes whose election they once cheered.

“We’ve got a Democratic governor who ran on a platform of being an environmentalist coming in and undermining fundamental environmental laws,” said Kathryn Phillips, director of Sierra Club California. “In the past we’ve had to worry more about Republicans than we have about Democrats, and now we have to worry about the Democratic governor who ran on a pro-environment platform.”Environmentalists praised Brown when, soon after taking office, he signed legislation requiring California utilities to obtain one-third of their electricity from renewable sources by 2020. He set a goal of creating 20,000 new megawatts of renewable energy by that year.

The relationship quickly soured. Last fall, Brown signed legislation relaxing environmental regulations for certain infill projects and

accelerating judicial review of environmental challenges to a proposed football stadium in Los Angeles. A third, broader bill, Assembly Bill 900, extended exemptions to major developments certified by the governor as “environmental leadership” projects.At a bill-signing event in downtown Los Angeles, Brown said it is time for “big ideas and big projects,” especially ones to “get people working.”

Earlier this year, Brown approved the state’s first “leadership” project, a new Apple Inc. campus in Cupertino, while proposing new legislation to insulate California’s $68 billion high-speed rail from challenges brought under the environmental law.

He abandoned the high-speed rail measure, which would have limited circumstances in which a court could halt construction of the project, after environmentalists protested. But Brown suggested he was only delaying the effort until sometime after the Legislature approved initial funding for the project, which it did last month.Brown saw Oakland obstaclesBrown’s interest in an exemption for high-speed rail highlights one of his chief complaints about CEQA – that an environmental regulation can be used to block projects he believes are beneficial for the environment.

“I think the governor very deeply believes that climate change is real and the most profound issue of our time,” Ken Alex, a senior adviser to Brown, told environmental lawyers and academics at a CEQA conference in November.Asked if Brown might seek to exempt projects from other requirements of CEQA if their contribution to reducing global warming is significant enough, Alex said he “wouldn’t foreclose that idea.”

Brown has not always been so critical of CEQA. He promoted environmental protections when he was governor before, from 1975 to 1983, and as state attorney general he used the law to pressure cities and counties to consider climate change in their long-range development plans.

But as mayor of Oakland, Brown experienced firsthand how restrictive

the law could be. In 2001, he lobbied successfully for legislation to relax standards for infill housing projects in the city core.

The Planning and Conservation League’s David Mogavero said Brown in Oakland “saw how CEQA could be an impediment to good infill development. That’s what’s coloring his thinking these days a lot.”

Mogavero’s group has filed a lawsuit challenging the legality of Assembly Bill 900. Like many environmentalists, Mogavero said some procedural changes to CEQA may be warranted, but not at the risk of environmental degradation.Recent efforts to change the state’s environmental legislation, including a package of proposals abandoned during unsuccessful state budget talks last year, have largely been at the law’s margins. Environmentalists remain influential with legislative Democrats, the majority party.

“There’s an element of what I would say is religious fervor around CEQA,” Alex said at the conference last year. “On one hand, it’s blamed for the fall of Western civilization, the unemployment rate and the rise of terrorism in the world. On the other hand, it’s anointed as the only thing keeping us from Armageddon, or at least looking like New Jersey.”

Brown’s pronouncement of his appetite for CEQA exemptions came during a news conference at which he discussed his controversial plan to build a pair of tunnels to move water through the Sacramento-San Joaquin River Delta to the south. Brown said the administration is not seeking an environmental exemption for the project, but his broader statement resonated.

Assemblyman Jared Huffman, D-San Rafael, said he was “trying mightily not to be offended.”

“The way he was so dismissive of environmentalists … dismissive of CEQA,” Huffman said. “That just wasn’t the thoughtful problem-solver that I normally see in Jerry Brown.”

Former governors urge updatesCritics of CEQA have tried to weaken the law almost since its passage four decades ago, largely unsuccessfully. But Brown has been accommodating of business interests since taking office, and Huffman fears the weak economy may afford opponents an opportunity they have not had previously.

“You’re having the discussion at the nadir of a really lousy economy, so for those who want to pit jobs against the environment, this is a window of opportunity unlike anything they’ve seen in the last 30 years,” he said. “They’re going for it.”This month, former Govs. George Deukmejian, Pete Wilson and Gray

Davis wrote in a letter in the U-T San Diego that CEQA “is in need of modernization.”

“While CEQA’s original intent must remain intact, now is the time to end reckless abuses of this important law; abuses that are threatening California’s economic vitality, costing jobs, and are wasting valuable taxpayer dollars,” they wrote. “There has been a lot of talk about the need to confront CEQA litigation abuse, but unfortunately it’s been mostly talk. … We must tackle this important issue now.”

Glazer promoted the letter on Twitter.Late last year, a group of business interests hired him to begin advising them on potential changes they could propose to the environmental law. The group includes the Silicon Valley Leadership Group, retailers and other business and labor interests.

Glazer said in an e-mail that “in order to preserve CEQA for the long term … we need to eliminate opportunities for abuse.”

Expectations for immediate action are not high. The group is still “trying to get people interested in forming some sort of broader coalition,” the Silicon Valley group’s Shiloh Ballard said.

Ballard said Glazer’s role is to be a “long-term strategic thinker on this stuff,” and that his advice is separate from his relationship with Brown.

Though it “would be wonderful if he could just bring the governor along,” Ballard said, “I’m told the governor’s his own man.” Cal/OSHA takes a proactive, comprehensive approach to protecting workers from heat illness

Oakland—Cal/OSHA is reminding all employers to protect their outdoor workers from the risk of heat illness, especially with heat waves expected this week in the Central and Inland Valleys.

Cal/OSHA has maintained a constant presence to ensure that employers protect their outdoor workers from the risk of heat illness. While these ongoing efforts have saved lives due to greater compliance by employers, constant vigilance is particularly necessary during periods of high heat.

“Cal/OSHA’s enforcement of the nation’s first and most comprehensive heat illness prevention regulation has saved many lives since its adoption, as is evident by the reductions in fatalities and serious illnesses since 2005,” said Christine Baker, Director of the California Department of Industrial Relations. “California is a better place to work because of our standard and partnerships with employers and labor to protect all outdoor workers from heat illness.”

The Department of Industrial Relations’ Division of Occupational Safety and Health (Cal/OSHA) has been out in force since April this year, beginning in the Coachella Valley when temperatures hit the 100 degree mark. Cal/OSHA’s comprehensive approach includes strong enforcement of the heat regulations, extensive outreach and training, continuation of an award-winning public safety campaign that includes media coverage, and partnerships to increase Cal/OSHA’s reach and impact.

“Our heat illness prevention campaign combines proactive, coordinated inspections in different regions of the state to ensure that employers have good heat illness prevention programs,” said Cal/OSHA Chief Ellen Widess. “These heat inspections often result in the discovery of serious problems that can be corrected before workers become sick from the heat. When temperatures spike, our district offices also send inspectors out locally to ensure workers are safe, and may shut down the worksite if we find imminent hazards.”Cal/OSHA inspections occur year round to ensure that farm workers and other outdoor workers are protected from heat illness. The comprehensive inspections include a thorough review of employers to ensure they have enough water and shade, are providing rest breaks, and have provided adequate training for supervisors and workers about emergency procedures in case workers become ill from the heat.

During California’s heat season – April through September – these efforts are redoubled. Employers who fail to adhere to the heat regulations are cited and required to correct the violations. Where appropriate and necessary, outdoor worksites are shut down when inadequate shade, water, or emergency response procedures constitutes an imminent hazard. Those sites remain closed until the employer can demonstrate that the dangerous conditions are mitigated.

“Last year, over 35% of our total inspections were focused on preventing heat illness. This combined with our extensive outreach to employers has resulted in a higher than ever compliance rate of 76 percent in agriculture,” said Cal/OSHA Chief Ellen Widess. “Yet there are farm labor contractors, growers and employers in other industries who fail to provide enough water, shade, training and emergency procedures. Ultimately, it is the responsibility of every employer to ensure the safety of their workers, including compliance with the heat illness prevention standard. Cal/OSHA is committed to enforcing that standard when employers fail to protect workers.”

Cal OSHA has extended its effective statewide public awareness campaign that targets the most underserved population of outdoor workers and includes messages in Spanish, Punjabi, Hmong, Mixteco and Trique. The award-winning Water. Rest. Shade campaign is a multi-faceted initiative combining outdoor and radio announcements with

written materials and a safety DVD in the targeted languages as well as a comprehensive outreach campaign. When you are working around others, especially if they are new to our workplace, it is your turn to share that knowledge to protect them and yourself. Those that have never held a job before or were employed by a firm with a weak safety program will need considerable safety instruction and leadership. While managers will attempt to train them in workplace safety as thoroughly as possible, employees will naturally look to you for advice and information. Their early impressions of the way you value safety will set the stage for their future work habits. Always Demonstrate Safety In this important transition time, your actions will speak louder than your

words, as the saying goes. If you use a ladder carelessly or take dangerous shortcuts on scaffolding, for example, you demonstrate to a new employee that safety is not important at . If you try to impress others by wearing jewelry or loose clothing that can be hazardous on the job, you are ultimately putting new employees that are learning from and imitating you in danger. On the other hand, some new employees may come to from firms that emphasize safety like we do. In that case, their personal respect for you will grow when they see that you care about workplace safety as much as they do. You are aware that accidents are a reality in construction and contracting work. Take care to be sure that your new co-workers are aware of the danger, too. Doing so will help to keep everyone at your worksite safe. Think again of that co-worker that has inspired you, and do your best to keep him or her in mind when you are working with new employees. Everyone will be safer when you make a good impression on a new employee, so do your part. Now is your chance to inspire!

New employees will naturally look to you for advice and information. Demonstrate respect of safety policies to help them start on the right track!
