Asphalt Shingle Recycling: Big Tons, Big PartnershipsCalifornia Resource Recovery Association 2014 Conference
In February of 2013, the Marin Builders Association in partnership with Marin Sanitary Service and ZeroWasteMarin.org launched the Roofs to Roads pilot program. The project gave local roofers the opportunity to recycle composition shingles at Marin Sanitary Service. The discarded roofing shingles are turned into a renewable asphalt base or hot mix additive for paving.
On August 6th the Marin Builders Association and the Roof to Roads partners were asked to present at the 2014 California Resource Recovery Association’s annual conference and trade show.
The speakers included:• Steve Devine, County of Marin• Casey Mazzoni, Marin Builders Association• Kimberly Scheibly, Marin Sanitary Service• Joshua Fookes, Asphalt Shingle Recyclers. • Delyn Kies, Kies Strategies, Moderator
The “Roofs-to- Roads” presentation described the perspectives and objectives of all partners – the generating roofers, the receiving facility, the recycling processor, and the end user.
The successes discussed included contractor incentives, contractor compliance and the successful public/private partnership. Another success discussed was the diversion rate, which will help in the county’s goal of zero waste by 2025.
The presentation also educated the audience about AB 2355 (Levine), which states:
“By January 1, 2017, a local government that has jurisdiction over a street or highway to either adopt the standards developed by the Department of Transportation for recycled paving materials and for recycled base, subbase, and pervious backfill materials, or discuss why it is not adopting those standards at a public hearing.”
The challenges discussed included the lack of Caltrans specifications allowing for the use of recycled asphalt shingles in road base which affects any public works project in the state.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.
LLC’s, SSN’s and INS, oh my! We put a ‘finger’ on some issues with Nevada licensing to get us started on our contractor Q&A. Another contractor needs to avoid digging himself into a hole he can’t get out of, while we have a ‘yes’ and a ‘no’ for two others…
Q: You helped our company with a CA license and now we need your assistance with obtaining a Contractor’s License in Nevada. The entity is a General Partnership with one Partner being a corporation and the other is a LLC, or Limited Liability Company. I understand that we will need to have an Officer/Member/Manager sign on behalf of each entity. The issue we had in California is that all individuals listed on the license application were required to have a US Social Security number (SSN). The personnel that make up each of these entities are not US citizens and they don’t have SSN’s. Is this going to be an issue in Nevada? And does Nevada require that the individuals come to Nevada to get fingerprinted?
A: First of all, thank you for contacting us again. Nevada does not require that all personnel have US Social Security numbers. The Qualifying Individual on the other hand will need to have a SSN or INS card for proof that he/she can work in Nevada. To answer your second question, they don’t need to travel to Nevada to get fingerprinted. They can do the fingerprinting on the fingerprint cards provided
by the fingerprinting agency, or they can request the forms from the NV Board.
Q: I am a “C-27” Landscaping contractor and I have a customer who wants me to re-design and landscape the entire background; including new grass, rock gardens, sprinkler and drip system, a waterfall, etc. As part of the project my customer wants me to construct an in-ground spa next to their existing pool. Am I allowed to do that since it’s part of the overall landscape project?
A: No, you cannot self perform the spa construction. A landscaping contractor may enter in to a contract for the construction of a spa if it’s part of a landscaping project, however you are required to subcontract that portion out to a properly licensed “C-53” Swimming Pool contractor.
Q: I am a “C-36” Plumbing contractor and I have several work trucks that my employees use that have our business name and license number on the side. One of my employees recently said that on a job site he was told by another plumbing contractor that, “we are required to have our address on our trucks” as well. Is that accurate?
A: 7029.5 of the CA Contractors License Law states that every Plumbing contractor (C36), Sign contractor (C45), and Well-drilling (C57)
contractor is required to “have displayed on each side of each motor vehicle used in his or her business…his or her name, permanent business address, and contractor’s license number”, so yes, what your employee was told is in fact accurate.
Q: We have pending litigation against a contractor who we are fairly certain “fibbed” on his work experience in order to obtain his license. We would like to get a copy of his Certification of Work Experience that he originally submitted. Is that something that you can help with?
A: No, while we can assist with obtaining copies of a Contractor’s entire file, the Certification of Work Experience form is considered personal and confidential so the only way to get a copy of that is to Subpoena it. Even then, certain entries would be redacted from the form such as the third person information.

They’re Baaack!The Legislature returned this week ‘bright eyed and bushy tailed’ after a month-long recess. Jumping out of the starting blocks first thing Monday morning was a hearing in the Senate Appropriations Committee. Most of the remaining ‘bad’ bills were set to be heard in this committee and, thankfully, most were held under suspense in committee due to their costs to the state. Although the committee will decide on Thursday, August 14th which bills will survive and which will remain held on suspense, chances are good that most, if not all, will be dead for the year (but I will have to remain vigilant the remainder of the month to ensure they don’t ‘pop up’ as a ‘gut and amend).’ Following are the ones of largest interest to us and their outcome.
AB 52 (Gatto) – Held on Suspense - Would allow Indian Tribes to challenge virtually any proposed construction project contending that it is a sacred site or other designation, even if it is not within their current tribal boundaries. This measure, if it were to pass, could make the current CEQA process seem like a ‘walk in the park!’
AB 1522 (Gonzalez) - Held on Suspense - Would enact the Healthy Workplaces, Healthy Families Act of 2014 to provide that an employee who on or after July 1, 2015, works in California for 7 or more days in a calendar year is entitled to paid sick days, to be accrued at a rate of no less than one hour for every 30 hours worked. An employee would be entitled to use accrued sick days beginning on the 90th calendar day of employment.
AB 1634 (Skinner) - Held on Suspense - Would prohibit the Division of Occupational Safety and Health a stay of an abatement period during the pendency of an appeal of a citation for a violation that is classified as a serious violation, repeat serious violation, or willful serious violation. The bill would, however, authorize the Division of Occupational Safety and Health to stay these abatement periods, upon request, if the division determines that a stay will not adversely affect the health and safety of employees.
AB 1650 (Jones-Sawyer) - Held on Suspense - This bill would require any person submitting a bid to the state on a contract involving onsite construction-related services to certify that the person does not ask an applicant for onsite construction-related employment to disclose orally or in writing information concerning the conviction history of the applicant on or at the time of an initial employment application. This bill would not apply to a position for which the person or the state is otherwise required by state or federal law to conduct a conviction
history background check or to any contract position with a criminal justice agency.
AB 1705 (Williams) – 5% Retentions – Passed out of committee - Defines ‘substantially complex’ to ensure that, in particular, school districts don’t classify every project as substantially complex which under current law allows them to require the full 10% retention instead of 5%.
AB 1723 Nazarian D - Employees: wages. – Passed out of committee - Current law authorizes the Labor Commissioner to recover liquidated damages for an employee who brings a complaint alleging payment of less than the minimum wage fixed by an order of the commission or by statute. This bill would expand that penalty, restitution, and liquidated damages provision for a citation to also subject the employer to payment of any applicable penalties for the willful failure to timely pay wages of a resigned or discharged employee.
AB 1897 Hernández, Roger D- Labor contracting: client liability – Held on Suspense -Recently amended to not affect business entities with a workforce of less than 25 workers including those hired through a temp agency unless they are supplying more than 5 workers at one time, it would require a employer to share with a temp agency all civil legal responsibility and civil liability for the payment of wages, the obligation to provide a safe working environment and workers

AB 2188 (Muratsuchi) – Solar Permit Streamlining - Passed out of committee - Requires cities and counties to adopt an ordinance streamlining the permit process for small rooftop solar energy systems. Unfortunately, the streamlining would be at the expense of virtually every other type of construction permit which could result in lengthy delays for other types of permits and approvals. This measure was recently amended removing the mandatory 5 day turnaround; however, even with this amendment, the League of California Cities and most construction groups still oppose this measure.
AB 2271 Calderon, Ian D - Employment: discrimination: status as unemployed - Held on Suspense -Would make it unlawful, unless based on a bona fide occupational qualification or any other provision of law, for an employer, an employment agency, or a person who operates an Internet Web site for posting jobs in this state to publish an advertisement or announcement for any job that includes provisions pertaining to an individual’s current employment or employment status.MBA’s Bill AB 2355 (Levine) - Held on Suspense -MBA’s bill that would require local governments to either adopt the January 1, 2017 Cal Trans recycling mandate for roadways or discuss in a public hearing why it has not, was sent to Suspense back in late June. While debatable, the committee consultants believe that a local government could bill the state for the costs to adopt the Cal Trans mandate and that the potential cost to the state could far exceed the $50,000 threshold. The consultants have informed our author, Assemblyman Marc Levine that they believe the bill will ultimately be approved. This is important since the Department of Finance has also previously raised this concern about costs the state which
could be a reason for the governor to ultimately veto the bill. As with the remainder of the bills on suspense, we will know the outcome next Thursday, August 14th
AB 2416 Stone D - Liens: laborers and employees - Held on Suspense -This bill would allow an employee to record and enforce a wage lien against all of his employer’s real property for failure to pay any wages and other compensation, penalties, and interest owed to the employee. Amendments were recently taken that state if a court or the Labor Commissioner sends to the employer an order stating that the employee does not have a reasonable likelihood of success on their claim, then the lien must be extinguished within 30 days or receive attorney’s fees and a fine of up to $1,000.
On Wednesday of this week, the Assembly Appropriations met. Following is the outcome of bills that were set:
SB 315 Lieu D - Contractors’ License Board Enforcement Capabilities – Passed out of committee - Would allow the CSLB’s enforcement staff when participating in a joint strike operation against the underground economy to enter any place of business that has labor present.
SB 785 (Wolk) – Design Build - Passed out of committee - This bill repeals existing law authorizing state and local agencies to use the design/build procurement process, and enacts uniform provisions authorizing this process for specified public works projects costing more than $1 million. This bill does not include projects on the state highway system or school construction projects.
SB 1077 DeSaulnier - Vehicles: mileage-based fee pilot program – Held on Suspense -
Would establish a Mileage-Based Fee (MBF) Task Force within the California Transportation Commission. The bill would require the task force to study MBF alternatives to the gas tax and to make recommendations to the Department of Transportation and the commission on the design of a pilot program.
SB 1159 (Lara) – Use of Individual Taxpayer ID in Lieu of SSN # - Held on Suspense - This bill would allow applicants or licensees to provide an individual’s taxpayer identification number (ITIN) in lieu of a SSN to a licensing board. This bill resolves inconsistencies throughout the code and provides additional identification options to applicants and licensees, thereby increasing access to California professional licenses to immigrants according to the author.

AB 1939 (Daly) - Public works: prevailing wages: contractor’s costs. Chapter 161 of 2014 Statutes – Will authorize a contractor to bring an action in a court of competent jurisdiction to recover from the public agency they are performing the work for any increased costs, including labor costs, penalties, and legal fees incurred as a result of any decision by the Department of Industrial Relations, the Labor and Workforce Development Agency, or a court that classifies, after the time at which the public agency accepts the contractor’s bid, awards the contractor a contract when no bid is solicited, or otherwise allows construction to proceed, the work covered by the project, or any portion thereof, as a public work. The bill takes effect January 1, 2015.
AB 2376 (Weber) - State construction projects: insurance. Chapter 115 of 2014 StatutesCurrent law generally prohibits property belonging to the state from being insured

against risk of damage or destruction by fire, with specified exceptions. Existing law, notwithstanding this general prohibition, authorizes the Director of General Services to establish a master builders’ risk insurance program for all state construction projects during construction. This bill will require the contractor’s deductible under a master policy to be outlined in the request for bids or proposals.
Update On Big Issues
Besides the aforementioned, there are several BIG issues that the Legislature is dealing with.
Water BondI have previously reported that the long-delayed water bond approved by the Legislature years ago is now on the November ballot. It is proposing a roughly $11.1 billion water bond that includes some storage and lots of ‘pork.’ Polling shows it will be rejected so the governor has announced he is developing his own replacement bond that would be valued at around $6 billion.
My ‘inside sources’ told me yesterday they are urging the governor to drop his replacement water bond efforts. Polling shows that even a $6 billion bond would likely fail. So, it means that the $11.1 billion bond loaded with pork will remain on the ballot as is and will be rejected by the voters. It will likely be 2016 before another bond comes before the voters; however, with reports in today’s paper that the El Nino effect in the Pacific Ocean disappearing, chances of a fourth-year drought this winter have greatly increased, meaning that a costly emergency bond measure and/or other governmental actions in 2015 could appear. Stay tuned.
School Bond – Set to be heard in Senate Appropriations Committee next week, this bill would place
on the November ballot the “Kindergarten-University Public Education Facilities Bond Act of 2014” for an undecided (at this time) amount of billions of dollars. Following is a recent article that discusses the need for this bond measure.
California Needs a Statewide School BondBy Joe DixonChair of the Coalition for Adequate School Housing
The Coalition for Adequate School Housing (C.A.S.H.) announced leading a radio and television issue advocacy effort in support of Assembly Bill 2235, a measure that would allow voters to decide this November on urgently needed funding for school facilities throughout the state.
California schools are aging, desperately in need of billions of dollars in repairs, upgrades and technology to prepare students for today’s workforce. This backlog grows by the day and our schools need new funding.
It has been nearly a decade since California provided state voters with the opportunity to vote on a statewide school bond.
There are no more construction dollars. Local districts are doing their part to partner with the state, it’s time for the state to meet their end of the bargain.
Since its inception, the state facilities funding program has overseen the construction of safe and secure classrooms for over 1.3 million of California’s children and modernized facilities for over 3.4 million more. State funds are disbursed when they can be matched with local district funds, providing for a strong state and local partnership.
With the State of California’s Department of Finance projecting that 343,000 new students will be entering the public school system within the next decade, it is critical that schools be able to meet the facilities needs of the incoming children and the existing 6.2 million students currently enrolled in California’s K-12 public school system.
Also supporting this critical issue advocacy effort is the California Building Industry Association.“Providing our children with safe and modern schools has always been a top priority of new homebuyers and our industry,” said Dave Cogdill, CEO of the California Building Industry Association. “Preservation of California’s successful school facilities program is essential for our long-time educational allies and the overall health of our fragile state economy,” added Cogdill.A study by the Center for Strategic Economic Research found that the existing $3 billion pipeline of new school construction and modernization work could result annually in more than 15,000 new jobs, $990 million of employee compensation (salaries/wages and benefits), $99.8 million in state and local tax revenue and more than $2.5 billion in additional economic benefits for California’s economy.
Both the radio and television issue advocacy ads stress the importance of allowing voters the opportunity to approve new funding for school facilities and calling on state policy makers to approve AB 2235.
It’s critical that we put our Children first and that voters be given the chance to decide on whether or not to maintain a school funding program essential to students and their success. We strongly believe that if given that opportunity voters will ultimately make the right decision, but first we need California’s

policy makers to give them that opportunity by passing and signing into law AB 2235.

Cap and Trade Tax On FuelsDid you know that starting on January 1, 2015 transportation fuels (gasoline and diesel) will start being taxed under the AB 32 program known as the ‘cap and trade program.’ Assemblyman Henry Perea has amended his AB 69 to roll back this new tax for several years while a more definitive study is performed to determine the true impact it would have on the economy, were this tax to take effect next January it would add the following costs to gasoline. Assemblyman Perea also asked the Legislative Analyst’s office (LAO) to do a study that would estimate the true effects were this tax to take effect next year. I have attached the entire letter from the LAO, but highlights state:
“Your staff asked us about some of the effects of including transportation fuels in California’s cap-and-trade program. In particular, they asked us to summarize and comment on estimates of the effects of that action on the retail price of gasoline. As we discuss in this letter, the studies we reviewed suggest that, by 2020, the resulting price increase likely will be about 13 cents to 20 cents per gallon, but the price increase could exceed 50 cents per gallon. The actual price increase will depend on a wide variety of economic, technological, and regulatory factors that are difficult to predict. We note that if transportation fuels were not part of the cap-and-trade program, alternative policies to meet the AB 32 emissions targets might be adopted that also have the effect of increasing gasoline prices.” Again, I am attaching the full letter so you can read it in detail if you like. I should add, politically,
this measure has little chance of making it out this year, meaning that the tax will go into effect on January 1st. I should add, disturbing to many is the power the California Air Resources Board has on the state that far exceeds the power of the Legislature! It truly is a ‘Frankenstein Monster!’
Drones Could Help Check If Buildings and Bridges Are SafeBy Kevin Ebi.After a disaster, inspectors may have to put their lives at risk to get a close look at damage to buildings and critical infrastructure to keep the public safe. But thanks to German researchers who have developed an inspection drone, soon they may not have to.
The technology may also help engineers better assess structures even before disaster strikes by allowing them to cover more ground in more detail in less time.
Providing a rich detailThe drone is an octocopter, a remote-controlled helicopter that has eight rotors. Special sensors help it detect and adjust for wind and keep it safely away from the structure it’s inspecting.
But the real power is in its on-board imaging systems. A high-resolution digital camera can capture exquisitely detailed images. Images can even be combined to give building engineers a three-dimensional view.
That’s a huge boost for inspectors who have largely been limited to what they can see with their own eyes. In many cases, performing detailed inspections has been hugely laborious and required extensive set-up.
A thermal imaging camera could also be added to measure the effectiveness of the building’s insulation.
More information in less timeBecause of the ease at which the drone can reach tough spots, it can complete a detailed survey of an area in two or three hours that would take a human two or three days to personally inspect.
The developers are also working on the ability for the drone to fly completely on autopilot. The next phase of the project is to allow the drone to fly on pre-programmed tracks.
One final note, in today’s Capitol Alert was notice of a hearing today about drones: “But when the skies fill with hovering eyes, what becomes of personal privacy? A joint hearing of three Assembly committees will take a look today. Witnesses at the “Drones in our Future: Opportunity and Privacy Considerations” meeting will include representatives from the Aerospace States Association, the California Broadcasters Association, the American Civil Liberties Union, UCLA Law School and the sheriff’s departments of Ventura and Los Angeles County, respectively.”

Material Handling - Hand Truck Safety
Hand trucks are effective for reducing strain while moving heavy materials. However, injury can still occur. Use the following tips to prevent strains, trips and falls when using a hand truck. Lifting practices:
• Load and unload the hand truck carefully, following proper lifting technique. − Always keep your back straight while lifting.
• Get help if the load is too bulky for proper lifting techniques to work or if the load cannot be handled safely for any reason.
Before moving a load:
• Prepare the path. − Inspect and clear your path for ease of movement. − Use ramps if the path has stairs or curbs. − Measure openings to be sure that there is enough space. − Clear the set point.
• Ensure that you have a good view of your path. The load should not be so tall that it obscures your vision.
• Put the heaviest part of the load on the bottom of the hand truck. • Secure the load as needed, and ensure that the straps are tight. • Inspect equipment before use. • Check the tire pressure. Balloon-type tires are more
prone to losing pressure, adding strain on the person pushing the hand truck.
Using the hand truck:
• Grip the hand truck firmly. Push with a straight back, leaning into your walk.
• Walk forwards, unless you are trapped in a tight space. • Push or pull loads with both hands. • Tilting the truck back enables you to push the load uphill
more easily, but be aware that this action increases the overall weight that you are carrying.
General safety:
• Ensure that you are trained and authorized for work.
• Wear supportive, closed toe, and non-slip shoes.

SEEKING ESTIMATING ADMINISTRATOR
Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.

Wedge Roofing, Inc. is currently looking for an Estimator in the Commercial Roofing Market for the San Francisco Bay Area. Experienced Estimator who is capable of performing hard bid and conceptual estimates in both private and public
work markets. They must be able to manage multiple estimates at one time along with some minor project management.
This person will need to have the ability to work with plans & drawings, clients, consultants, subcontractors and municipali-
ties. This position will be expected to work in both a team atmosphere and function autonomously at various times. Local
market estimating experience is also preferred. Commercial Estimator position works from Petaluma office facility.

SEEKING CONTRACT ADMINISTRATOR IN
ESTIMATING DEPARTMENT
Ghilotti Bros., Inc. is seeking a Contract Administrator in our Estimating Department. This position reports to the Vice
President of Estimating.
Some duties may include: processing/reviewing Owner and subcontractor contracts, insurance and bonding; maintaining
appropriate public agency business licenses; initiating and completing job folder; maintain jobs in progress log;
processing change orders; tracking owner and subcontractor final pay estimate timeline; coordinating final contract closeout documentation. Annual salary depends on experience. Become
part of our growing and successful team.
We are in search of someone who is very organized, proactive, works well under pressure & detail-oriented. This person must
also have strong computer skills, specifically in Microsoft applications. Preferred experience with contracts and/or in
construction field.
