Cal/OSHA has issued revisions to their original
proposal to modify the heat illness prevention
regulation. Changes were made to address
our coalition’s concerns and, thankfully, the
revisions have improved the original proposal.

California’s Construction Industry’s
Underground Economy – What Does it
Cost?
I was recently asked, “What impact does the
underground economy in the construction
industry have on California’s economy?” I
went to the Contractors State License Board‘s
registrar, Steve Sands for his input on this
question. In response, he provided me with
the following information. REMEMBER,
this is ‘JUST’ tax losses, NOT the size of the
underground economy:
The actual size of the underground economy
is difficult to measure. In January of 2012,
the Internal Revenue Service released a new
set of tax gap estimates for tax year 2006.
The tax gap is defined as the amount of tax
liability faced by taxpayers that is not paid on
time. After adjusting for audit and collection
activities, the Internal Revenue Service
estimates that in 2006 the net national tax gap
was approximately $385 billion. Based on this
figure, the California Franchise Tax Board
estimates California’s tax gap (for the personal
and business taxes that they administer) to be
about $10 billion per year.
Barron’s Online featured the article, Going
Underground, on January 3, 2005. This article
states in part:
“America has two economies, and one is
flourishing at the expense of the other. First,
there’s the legitimate economy, in which
craftsmen are licensed and employers and
employees pay taxes. Then there’s the fast-
growing underground economy, where
millions of workers are paid off-the-books,
their incomes largely untaxed.”
Reports on the underground economy indicate
it imposes significant burdens on revenue
needed to fund critical state programs and
businesses that comply with the law. When
businesses operate in the underground
economy, they gain an unfair, competitive
advantage over businesses that comply with
labor, licensing, and payroll tax laws. This
causes unfair competition in the marketplace
and forces law-abiding businesses to pay higher
taxes and expenses.
Workers of noncompliant businesses are also
affected. Their working conditions may not
meet the legal requirements, which can put
them in danger. Their wage earnings may
be less than what is required by law, and

benefits they are entitled to can be denied or
delayed because their wages are not properly
reported. Consumers can also be affected
when contracting with unlicensed businesses.
Licensing provisions are designed to ensure
sufficient skill and knowledge to protect
consumers.
The ultimate impact of the underground
economy is erosion of economic stability and
working conditions.
High-Speed Rail Authority Releases First
Quarter Small Business Participation and
Jobs Report
The California High-Speed Rail Authority
(Authority) issued the Small Business
Participation and Jobs Report for the First
Quarter of the 2014/15 Fiscal Year. The report
covers the period of July 1 through September
30, 2014 and looked at 23 prime contractors.
For this reporting period, the prime contractors
and their subcontractors logged 328,388 man
hours worked that resulted in 632 full-time
equivalent jobs. Combined, these 23 prime
contractors have 190 certified small businesses
committed to perform work on the high-speed
rail program, including 28 Disabled Veteran
Business Enterprises and 47 Disabled Business
Enterprises.
This report is the second in the series of reports
launched in 2014 with the purpose of providing
a timely and transparent accounting of jobs and
small business participation in the high-speed
rail program. The reports are available on the

New Standard Mileage Rates Now
Available; Business Rate to Rise in 2015
The Internal Revenue Service has issued the
2015 optional standard mileage rates used to
calculate the deductible costs of operating an
automobile for business, charitable, medical or
moving purposes.
Beginning on Jan. 1, 2015, the standard mileage
rates for the use of a car, van, pickup or panel
truck will be:
• 57.5 cents per mile for business miles
driven, up from 56 cents in 2014
• 23 cents per mile driven for medical or
moving purposes, down half a cent from
2014
• 14 cents per mile driven in service of
charitable organizations
The standard mileage rate for business is
based on an annual study of the fixed and
variable costs of operating an automobile,
including depreciation, insurance, repairs, tires,
maintenance, gas and oil. The rate for medical
and moving purposes is based on the variable
costs, such as gas and oil. The charitable rate is
set by law.
Taxpayers always have the option of claiming
deductions based on the actual costs of using a
vehicle rather than the standard mileage rates.
A taxpayer may not use the business standard
mileage rate for a vehicle after claiming
accelerated depreciation, including the Section
179 expense deduction, on that vehicle.
Likewise, the standard rate is not available
to fleet owners (more than four vehicles used
simultaneously). Details on these and other
special rules are in Revenue Procedure 2010-
51, the instructions to Form 1040 and various
online IRS publications including Publication
17, Your Federal Income Tax.
Besides the standard mileage rates, Notice
2014-79, posted today on IRS.gov, also includes
the basis reduction amounts for those choosing
the business standard mileage rate, as well as
the maximum standard automobile cost that
may be used in computing an allowance under
a fixed and variable rate plan.
Most Retirees Need to Take Required
Retirement Plan Distributions by Dec. 31
The Internal Revenue Service is reminding
taxpayers born before July 1, 1944, that they
generally must receive payments from their
individual retirement arrangements (IRAs) and
workplace retirement plans by Dec. 31.
Known as required minimum distributions
(RMDs), these payments normally must be
made by the end of 2014. But a special rule
allows first-year recipients of these payments,
those who reached age 70½ during 2014, to
wait until as late as April 1, 2015 to receive
their first RMDs. This means that those born
after June 30, 1943 and before July 1, 1944 are
eligible for this special rule. Though payments
made to these taxpayers in early 2015 can be
counted toward their 2014 RMD, they are still
taxable in 2015.

The required distribution rules apply to owners
of traditional IRAs but not Roth IRAs while
the original owner is alive. They also apply to
participants in various workplace retirement
plans, including 401(k), 403(b) and 457(b)
plans.
An IRA trustee must either report the amount
of the RMD to the IRA owner or offer to
calculate it for the owner. Often, the trustee
shows the RMD amount on Form 5498 in Box
12b. For a 2014 RMD, this amount was on the
2013 Form 5498 normally issued to the owner
during January 2014.
The special April 1 deadline only applies to
the RMD for the first year. For all subsequent
years, the RMD must be made by Dec. 31. So,
for example, a taxpayer who turned 70½ in
2013 (born after June 30, 1942 and before July
1, 1943) and received the first required payment
on April 1, 2014 must still receive the second
RMD by Dec. 31, 2014.
The RMD for 2014 is based on the taxpayer’s
life expectancy on Dec. 31, 2014, and their
account balance on Dec. 31, 2013. The trustee
reports the year-end account value to the IRA
owner on Form 5498 in Box 5. Use the online
worksheets on IRS.gov or find worksheets and
life expectancy tables to make this computation
in the Appendices to Publication 590.
For most taxpayers, the RMD is based on Table
III (Uniform Lifetime) in the IRS publication
on IRAs. So for a taxpayer who turned 72 in
2014, the required distribution would be based
on a life expectancy of 25.6 years. A separate
table, Table II, applies to a taxpayer whose
spouse is more than 10 years younger and is the
taxpayer’s only beneficiary.
Though the RMD rules are mandatory for all
owners of traditional IRAs and participants
in workplace retirement plans, some people
in workplace plans can wait longer to receive
their RMDs. Usually, employees who are
still working can, if their plan allows, wait
until April 1 of the year after they retire to
start receiving these distributions. See Tax
on Excess Accumulations in Publication 575.
Employees of public schools and certain tax-
exempt organizations with 403(b) plan accruals
before 1987 should check with their employer,
plan administrator or provider to see how to
treat these accruals.

New Construction Laws for 2015
Over 4200 bills were introduced by the California Legislature
in the 2013-2014 session. Below are summaries of some of
the more important bills affecting contractors in their roles as
contractors, effective January 1, 2015 unless otherwise noted.
Many other bills will impact them in other roles, such as being
businesses, taxpayers, and employers. For MLC’s Law Note
reporting on changes in the laws affecting employers in 2015,
please visit our website’s Employment Law Notes page. Each
of the summaries are brief, focusing on the gist of the bill, while
most of the bills have additional provisions that are not men-
tioned. Links are provided to the full text of each of the bills
for those wanting to know in detail the provisions of the new
law. Lastly, reference is made to failed bills that are likely to be
revisited next session.
Retention Cap Protection
5% retention cap loophole closed. AB 1705 (Williams D)
SB 293 last year capped, through the end of 2015, public works
retention at 5% with certain exceptions including a finding by
the public entity that the project is “substantially complex”.
Entities started immediately abusing this law by finding es-
sentially every project to be “substantially complex”. This law
extends the operation of these provisions to January 1, 2018
and requires that the bid documents include details explaining
the basis for any “substantially complex” finding. This transpar-
ency will allow contractors to challenge unfounded findings and
enforce the 5% retention cap.
Design-Build
Design-build projects continue to gain ground in California.
New health care district authorized to use design-build. SB 268
(Gaines R)
Each health care district has specific duties and powers re-
specting the creation, administration, and maintenance of the
districts, including to purchase, receive, take, hold, lease, use,
and enjoy property of every kind and description within and
without the limits of the district. This law authorizes the Last
Frontier Health Care District to use this design-build process
when contracting for the construction of a building and im-
provements directly related to a hospital or health facility build-
ing at the Modoc Medical Center.
Transit design-build authority extended. SB 1433 (Hill D)
The Local Agency Public Construction Act until January 1,
2015, authorizes a transit operator, as defined, to enter into a
design-build contract, as specified. Current law requires certain
information submitted in this regard to be provided under pen-
alty of perjury. This law extends the authorization for a transit
operator to enter into a design-build contract until January 1,
2017.

This law allows all bonds and notes of the United States or the
State of California and cashier’s checks, payable to the officer,
to be deposited with the officer in lieu of a bond, as specified.
Payment bond claimants may have to deal with the entity’s con-
tracting officer instead of a surety in event of nonpayment.
Prevailing Wage Contractor Protection

This law empowers a contractor to sue a private owner for
increased costs, including labor costs, penalties, and legal
fees incurred as a result of any decision by the Department of
Industrial Relations, the Labor and Workforce Development
Agency, or a court that classifies the project or any part thereof
as a public work after bid acceptance, contract signing, or start
of work, except under circumstances specified. This law shifts
from contractor to owner the risk if improperly failing to classify
the project as public work.
Public Works Builder’s Risk Insurance
Notice of deductible on master builder’s risk policy required. AB
2376 (Weber D)
This law requires public entities to outline in requests for bids
or proposals the contractor’s deductible under the Director of
General Services’ master builders’ risk insurance program for
state construction projects during construction.
Licensure Enforcement
CSLB gains site access and citation authority. SB 315 (Lieu D)
This law requires employers to grant free access to all places of
labor to the CSLB’s enforcement division when participating in
the activities of the Joint Enforcement Strike Force on the Under-
ground Economy. Further, the CSLB’s authorized persons are
empowered to issue written notices to appear in court.
Contractor license applicants must provide tax ID numbers. SB
1159 (Lara)
No later than January 1, 2016, this bill requires the State
Contractors Licensing Board to require an applicant to pro-
vide the Board either an individual tax identification number or
social security number if the applicant is an individual. The bill
would require the CSLB to report to the Franchise Tax Board,
and subject a licensee to a penalty, for failure to provide that
information.
Lease-Leaseback
Prequalification process required for school lease-leasebacks.
AB 1581 (Buchanan D)
Requires, until January 1, 2019, the lease instrument and the
agreement with the lowest responsible bidder to include a
requirement for the person, firm, or corporation that constructs
a building to be leased and used by the school district upon a
designated site, including, but not limited to, the prime contrac-
tor and, if used, electrical, mechanical, and plumbing subcon-
tractors, to comply with the above-described prequalification
questionnaire and financial statement requirements when the
agreement is for a public project using moneys received pursu-
ant to the Leroy F. Greene School
Facilities Act of 1998 or moneys from future state school bonds
that involves a projected expenditure of $1,000,000 or more.
Requires a school district using lease-lease back construc-
tion procurement to use the same prequalification process as
required for design-bid-build construction.

New Construction Laws for 2015
Over 4200 bills were introduced by the California Legislature in the 2013-2014 session. Below are summaries of some of the more important bills affecting contractors in their roles as contractors, effective January 1, 2015 unless otherwise noted. Many other bills will impact them in other roles, such as being businesses, taxpayers, and employers. For MLC’s Law Note reporting on changes in the laws affecting employers in 2015, please visit our website’s Employment Law Notes page. Each of the summaries are brief, focusing on the gist of the bill, while most of the bills have additional provisions that are not mentioned. Links are provided to the full text of each of the bills for those wanting to know in detail the provisions of the new law. Lastly, reference is made to failed bills that are likely to be revisited next session.
Retention Cap Protection 5% retention cap loophole closed. AB 1705 (Williams D) SB 293 last year capped, through the end of 2015, public works retention at 5% with certain exceptions including a finding by the public entity that the project is “substantially complex”. Entities started immediately abusing this law by finding essentially every project to be “substantially complex”. This law extends the operation of these provisions to January 1, 2018 and requires that the bid documents include details explaining the basis for any “substantially complex” finding. This transparency will allow contractors to challenge unfounded findings and enforce the 5% retention cap.
Design-Build Design-build projects continue to gain ground in California. New health care district authorized to use design-build. SB 268 (Gaines R) Each health care district has specific duties and powers respecting the creation, administration, and maintenance of the districts, including to purchase, receive, take, hold, lease, use, and enjoy property of every kind and description within and without the limits of the district. This law authorizes the Last Frontier Health Care District to use this design-build process when contracting for the construction of a building and improvements directly related to a hospital or health facility building at the Modoc Medical Center. Transit design-build authority extended. SB 1433 (Hill D) The Local Agency Public Construction Act until January 1, 2015, authorizes a transit operator, as defined, to enter into a design-build contract, as specified. Current law requires certain information submitted in this regard to be provided under penalty of perjury. This law extends the authorization for a transit operator to enter into a design-build contract until January 1, 2017.

Current law provides that where the Regents of the University
of California are of the view that a project of $100,000 or less
does not require the application of all provisions of law relating
to competitive bidding by the university, the regents shall solicit
bids in writing and award the work to the lowest responsible
bidder or reject all bids. This bill raises this dollar threshold
for the cost of a project to $640,000. This bill contains other
related provisions and other existing laws.
Gas Pipeline Work Notice
Gas pipeline work notice required. AB 1937 (Gordon)
Requires a gas corporation to provide not less than 3 working
days’ notice to a school or hospital prior to undertaking non-
emergency excavation or construction of a gas pipeline when
the work is located within 500 feet of the school or hospital.
Recycled Paving Materials
Recycled paving materials use requirements. AB 2355 (Levine)
Requires, by January 1, 2017, a local agency that has jurisdic-
tion over a street or highway to 1) either adopt the standards
developed by the Department of Transportation for recycled
paving materials and for recycled base, sub-base, and pervi-
ous backfill materials, or 2) discuss at a regularly scheduled
public hearing of the local agency’s legislative or other govern-
ing body why the standards are not being adopted.
OSHA Safety Violations
OSHA violations abatement rules. AB 1634 (Skinner)
Enacts various provisions of law related to an employer’s obli-
gation to abate an alleged workplace safety and health hazard.
Prohibits the Division of Occupational Safety and Health from
granting for serious violations, abatement or credit for abate-
ment unless the employer has abated the violation or has
submitted a statement to the division in accordance with exist-
ing law, and would additionally require supporting evidence
with the statement where necessary. The bill would authorize
the division to grant such a modification only if the violation has
been abated or the signed statement and supporting evidence
is received within 10 working days after the end of the period
fixed for abatement.
Failed Bills Likely to be Revisited
Los Angeles Unified School District: best value procurement:
pilot. AB 1971 (Bocanegra D)
Would establish a pilot program to authorize the Los Angeles
Unified School District to use, before January 1, 2017, a best
value procurement method for bid evaluation and selection for
public projects that exceed $1,000,000. The bill would establish
various requirements applicable to the use of the best value
procurement method under this authorization. These provisions
would be repealed on January 1, 2020. This bill contains other
related provisions.
Public contracts: change orders. AB 2471 (Frazier D)
Would require a public entity, as defined, when authorized
to order changes or additions to the work in a public works
contract awarded to the lowest bidder, to issue a change order
promptly, and no later than 60 days after the extra work is per-
formed and documentation has been submitted, as specified.
The bill would, if this requirement is not met, make the public
entity liable to the original contractor for the completed extra
work.

Cash ‘under the table’ won’t be a benefit for
anyone working in that scenario, whether
you are the ‘employee’ or the contractor
breaking the law. While most questions have
a yes or no, in some cases the answer I give
you depends on whether you are ‘domestic’
or ‘foreign’…
Q: I worked for a licensed contractor for over
five years under the table. I hate to admit that
we had this agreement for him to avoid paying
Worker’s Compensation. I recently applied
to get my own General Building license. The
contractor I worked for would not sign off on
my work experience in fear of getting in trouble
for his poor business practices. The CSLB is
requesting W2’s, check stubs, contracts, etc.
Obviously I cannot provide W-2’s or paycheck
stubs and I don’t have access to contracts and
permits. Is there anything I can do?
A: When you apply to obtain a license for a
“critical classification”, which includes the
General Building classification, and you do
not have verifiable experience the CSLB will
request further documentation such as the items
you stated. If you cannot provide evidence of
your experience there is nothing else you can
do but withdraw your application and re-apply
at a later date when you have proof of work
experience.
There was a time when that was different and a
signature of anyone who had knowledge of your
experience was all you needed to get licensed.
Those days are gone and the CSLB has been
much more diligent about verifying work
experience for applicants applying for a critical
classification.
Q: How do I change the Officers on my
license? Can I just do it at the Board level or
do I need to it at the State level through the
Secretary of State?
A: It depends. Generally you want the
personnel you have listed with the Secretary of
State and the CSLB to match. However that’s
not always the case. The Secretary of State
requires that you list President, Secretary, and
Treasurer. Many companies have one or many
Vice Presidents listed on the contractor’s license
without being listed with the Secretary of State,
which is permissible. As another example, the
CSLB only requires foreign corporations to
list their President. So many companies only
have a President listed on the license but they
have a Secretary and a Treasurer listed with the
Secretary of State.
So to better answer your question I would
need to know first whether you are a domestic
or foreign corporation, and second, which
Officer(s) changed.
Regardless, if you have an Officer that is no
longer with the company you will definitely
want to make both agencies aware. This can be
done at the CSLB level with a Disassociation
Notice, and at the Secretary of State level with
a Statement of Information. Any time you are
disassociating someone from the CSLB you
need be sure that you have a current Officer
always on record for signing authority on the
license.

Influencing Attitudes for Safety
Do attitudes matter?
Attitudes have a great deal to do with how employees perform their daily tasks. Positive attitudes are conducive to safety performance and productivity, while negative attitudes can lead to accidents and injuries. Negative attitudes: Certain attitudes towards safety can put people at risk.
• Over-confidence: The belief that experience and skill can replace the need for safety precautions.
• Under-confidence: The belief that you are unable to influence your safety environment. Possible underlying beliefs include: − That safety is a matter of chance, fate, or destiny, rather than personal action. − That the nature of your job requires overlooking safety practices. − That your organization does not really care about safety, and they will not listen
to your concerns. − That making safe choices will have a negative impact on how you are perceived
by coworkers, because it will slow you down. Positive attitudes: People play an active role in their own safety when they believe that they can and should do so. Positive beliefs include:
• Accidents have causes, and they can always be prevented. • Accidents interfere with production; therefore, safe work is
efficient work. • Working safely shows care for family and loved ones. • Organizations want safe working environments. • Coworkers will respect good judgment and safe choices. • Working safely is a mark of skill and positive professional
conduct. • Contributing to an organization’s positive safety record is important. Create a culture of safety:
• Attitudes are contagious: Creating a good environment for safety practices and ideas makes everyone more likely to accept them.
• Attitudes are influenced by example: Set an example by working safely and working for safety. Others will be influenced by what they see.
• New hires are impressionable: They are strongly influenced by the behavior of the veteran workers and supervisors. Be sure new hires are given the correct direction and safety instruction right from the start.
Positive safety attitudes will spread throughout the work culture if each employee takes
an active part in the discussion of how accidents can be prevented.

Gas Powered Blowers are prohibited in the City of Mill ValleyGas-powered leaf blowers contribute to noise pollution, emitting tones at levels that could lead to hearing damage.
They also contribute to air pollution, causing smog and breathing problems such as asthma.
Mill Valley Municipal Code 7.16.090 states:
“It shall be unlawful for any person to operate a gas-powered device to blow leaves, dirt or other debris off sidewalks, driveways, lawns or other surfaces within any area of the City.”
Please discontinue the use of any gas powered blower in the City of Mill Valley immediately.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.
ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as be-tween Estimators and the Bid Runner on bid days. The BA is directly responsible for the preparation of, and the expeditious flow of, documents (pre‐qualification packages, project advertising, bid database maintenance, bid documents, bid bonds, etc.) to ensure timely and complete bid submittal packages. Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
