The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

A contractor with a great deal of on-the-job history is ‘shocked’ to learn that his work experience won’t do ‘double duty’ as he seeks to add a new class to his existing license. Another license-seeker is advised to remember the sunscreen when he visits California for a ‘fingerprint’ vacation from his starting point between a rock and a hard place…

Q: I have had a General Building (“B”) license since 2011. To obtain that license I used my work experience from 2006 thru 2011. As part of my building projects I have regularly done electrical work. I applied to add the “C-10” classification to my license and on the work experience page I documented my experience from 2006 up until now. The CSLB rejected my application stating that I had already used some of that time to obtain my “B” license. If I cannot re-use some of that time, and I’m only able to use the time period of 2011 thru the present, obviously I won’t meet the 4-year requirement. I have done nUMEROUS electrical projects that I’m confident would add up to a total of four years, but my electrical experi-ence was gained throughout the time I’ve been in the construction business which is since 2006. Can you help?

A: This could be difficult to prove as verifiable experience because you are correct; the CSLB considers this “overlapping experience”. Besides the overlapping experience, the CSLB assumes that since you have a “B” license you are completing a variety of trades on each job, and not the same trade day after day. In order to qualify for a specialty classification such as the “C-10”, you must show that you performed electrical work every day for 4 full years, day-in, day out, for approximately 8 hours a day.

While it will be difficult to prove, it’s not impossible! I assume that they sent you a letter requesting further information. If you are able to show proof of the electrical work by providing them with signed contracts or per-mits that were pulled then you will be in a better position to be approved. You should also consider submitting a letter explaining how you were able to perform electrical work full-time in conjunction with your building license. Get back with us for further help as needed.

Q: We are in the process of applying for a new contractor’s license in CA. Our CEO is based in South Carolina. We are being told that if he doesn’t fly out to California to get live scan fingerprints done, and instead does the hard copy fingerprint card method, the process may take 3-6 months! We have a job coming up and we just can’t wait that long to get the license but at the same time we are having difficulty getting our CEO, who is extreme-

ly busy, to fly to California just for that. Is there any way to pay extra to expedite the fingerprint card method? If not, can he do live scan in South Carolina? I know they have live scan facilities here and I don’t understand why that wouldn’t be acceptable?

A: Let me start by saying that you are not alone. We talk to people in this same predicament on a daily basis. There is no way to expedite the fingerprint card method, and it is true they take much longer to process than the live scan fingerprints. The CSLB will only accept live scan fingerprints done at a facility in the State of California. It’s unfortunate, but your only choices are to do the card method and have the application delayed, or have your CEO squeeze in a “fingerprinting vacation” to sunny California.

Despite income tax revenue running about $4.5 billion ahead of expectations through April, Governor Jerry Brown included relatively low revenue figures in the revised budget he released last Tuesday, likely dampening expectations for greater program spending.

The budget Brown proposed will assume revenue in the current fiscal year only $2.8 billion ahead of expectations, with revenue next fiscal year down $1.8 billion from Brown’s January estimate.

In the weeks leading up to Tuesday’s budget revision, speculation mounted that Brown could take advantage of $4.5 billion that rolled into state coffers unexpectedly this spring. But the governor took a more cautious approach, projecting that economic growth will be slower than previously thought because of federal spending cuts and a higher payroll tax on workers.

“Four percent growth has now become 2 percent,” Brown said.The governor also assumes that the spring revenue spike was partly due to

wealthy taxpayers taking more income in 2012 in anticipation of federal tax changes. That means the state potentially would receive lower tax revenues in 2013-14 than Brown previously expected.

“We have climbed out of a hole with a Prop 30 tax,” Brown said, referring to his initiative last year that hiked income taxes on the wealthy and sales taxes. “That’s good. But this is not the time to break out the champagne.”

The proposed budget includes a $1.1 billion reserve. It increases funding for Brown’s effort to overhaul California’s educational finance system by $240 million. In his education proposal, Brown also proposes $1 billion to implement English, math and other subject guidelines known as the Common Core Standards.

Brown continued to ask lawmakers to approve his new funding formula, which directs more money to K-12 districts with large numbers of impoverished students and English learners. He was skeptical of critics who consider his plan flawed because wealthier suburban districts stand to receive less money than they would otherwise.

“Ask somebody in Beverly Hills or Palo Alto or Piedmont, ‘Would you like to move to Compton? Would you like to move to Watts?’ And if they say, ‘Yeah, let’s do it because I want to get the extra money,’ then I’ll believe it,” Brown said.

The governor has dropped his January proposal to cap the number of state-subsidized classes that public university students can take. He had pitched the idea as a way to make the University of California and California State University systems more efficient.

Brown proposed a statewide approach - not a county-by-county effort - to implement California’s expansion of Medi-Cal under the federal health care

overhaul.The budget includes $500 million in additional Medi-Cal spending, and

more funding for California’s prison realignment, in which the state shifted responsibility for certain low-level offenders to counties.

Thankfully for “us taxpayers,” Brown seemed resistant Tuesday to Democratic proposals to raise additional taxes. He also dismissed calls to increase spending beyond education, mocking the Capitol as “a big spending machine.”

Interestingly, I received the Legislative Analyst’s report on the governor’s May-revise this morning. Following is their summary bulletin, followed by access to the report on the internet.

The 2013-14 Budget: Overview of the May RevisionIn the May Revision, the administration forecasts that weaker tax

collections in the coming months will erode the vast majority of the $4.5 billion of unexpected tax revenues collected since January. We do not agree with the administration’s view of the state’s revenue situation. As a result, our forecast now is $3.2 billion higher than the administration’s May Revision total for 2011-12, 2012-13, and 2013-14 combined.

While the state’s fiscal condition has improved, there are many good reasons for the Legislature to adopt a cautious budgetary posture. After years of “boom and bust” budgeting, California’s leaders now have the opportunity to build a budget for future years that gives the state more choices about how to build reserves in times of healthy revenue growth, prioritize future state spending, and pay off past debts. Given the improved fiscal forecast, we believe this is an ideal time for the Legislature to begin addressing its huge budgetary and retirement liabilities. In

addition, given various risks to the economic outlook and the state’s budgetary volatility, building larger state budget reserves in the coming years is an important priority, as doing so means there will be less necessity during future downturns to cut public spending, as occurred in recent years.

Don’t Take Anything for Granted Serious accidents can happen when you take safety for granted. Consider this situation: a man was priming the carburetor on a truck. He poured some gasoline, then took a step back with the open fuel can in his hand. Meanwhile, another person walked up behind him with a lit cigarette. The can touched the cigarette and the explosion burned both men. This accident was due to a lack of safety awareness. The man with the fuel can should have ensured there were no open flames in the vicinity, while the man with the cigarette should have checked that there were no flammable materials present. Taking things for granted often involves multiple safety violations, such as poor communication, not being alert and taking unsafe risks. Making assumptions when it comes to safety leads to serious accidents and injuries. Check and Double-Check Always check for proper safety precautions and mechanisms, and double check when necessary.

- Check tools for flaws or malfunctions before using them. Do not assume they are fine just because they were yesterday.

- Look before you step out into an aisle, even if power trucks and other equipment do not usually travel there.

- Never assume a situation is safe unless you verify for yourself. For instance, do not trust that a ladder that you come upon is secured properly unless you double check it yourself.

Personality Traits Can Lead to Accidents In a recent study of characteristics of accident-prone employees, one of the personality factors associated with repeated

injuries was self-assurance. These individuals are too confident that nothing will go wrong, rather than making sure safety procedures are followed. Confidence is good while working in hazardous conditions, but overconfidence can make someone take unnecessary chances, which often leads to accidents and injuries. Another accident factor was found to be the desire for dominance. Accident repeaters tend to have decided opinions of their own, and comparatively little regard for the opinions of others or for safety rules. Just because you are experienced or knowledgeable in a certain area does not mean it is okay to ignore safety precautions. Safety for Everyone’s Sake People who take safety for granted and think that they know best are often the most prone for accidents. It is important to remember that safety is a group initiative, and that everyone needs to follow safety precautions and avoid taking risks to maintain a safe workplace. If any misunderstandings or questions develop concerning your job, clear them up right away by consulting your supervisor. Never take safety for granted!

Minimum Qualifications:

• Typing skills minimum: 60WPM• 10 key by touch• Two years administrative experience• Computer experience including Microsoft Office Products.
