Thank you for your notification letter received on September 26,2011 inquiring about HealthCanada’s role in the environmental assessment of the aforementioned project under the FederalCoordination Rcguiations.

Based on the infonnation provided, Health Canada has determined that it is not a ResponsibleAuthority (RA) under Section 5 of the Canadian Environmentai Assessment Act (the Act) ivithregards to the present scope of the project

In the context of sibsection t2(3) of the Act, Health Canada currently has expeitise in the followingbiophysical areas related to human health that may apply to the prDject:

• Air quality health effects• Contamination of country foods (e.g. fish, wild game, garden produce, berries, ete)• Drinking and recreational water quality• Radiological effects• Elecric and magnetic fields effects• Noise impacts• Human health risk assessment (HIIEA) and risk management

Environmental Impact Assessment (EIA) prepared by Bob Sheedy for the above proposed project. EC is

not a Responsible Authority (RA) under the Canadian Enviro,,me,,tal Assessme,,t Act (CEA4) because’

active nests are present. If nests are found or indicated nests then they should be provided with a

endangered mammals ‘were cbsen,ed, The proponent does not indicate whether or not a species at nsk

survey was conducted by a qualified wildlife biologist. The proponent also fails to mention if a survey for

rare and native vegetation was conducted. EC recommends that a survey for rare and native

vegetation is conducted for the proposed project area by a quallflod biologist. EC requests the

opportunity to review tho sirvoy results and the corresponding proposed mitigations.

Every Derson who is required by, or under an Act of ParI;ament to ensure that an assessment ofLbs environmental effects of a pro;ect is conducted must without delay, notify the competentmister or ninisters r. writing of the project fits likely to affect a listed species or its criticaljiab it at.

“The person must identify the adverse effects of the project cn the Sted wildlife scecies and tscrUcal habitat and, if the project is carried out, rust ensure that measures are taken to avoid Cressen those effects and to monitot then. The measures must be taken in a way that is consistent

with any applicab!e recovery st’acegy and acton paris.

‘3) Land and VegetatiogThe section entitled Overview of Proposed Trenching and Maintenance Dev&opmenr, page 29, statesthat, ‘a trench be excavated spanning the distance from the SOUTh end of Center Salt Lake... A serviceroad would be built with part of excess excavation material to create a protective berm along eastern flankat trench”. EC is unclea, as to how much land will be affected by the excavation of the trench and theconstruction of a service road EC does not recognize the necessity of the protective berm along theeastern Flank of the trench. EC requests a descriptIon of the berms purpose as well as informationregardIng when the service road will be used and who is expected to have access to It.EC requests a project description that details, but is not limitod to, the project schedule, theamount of land that will be Impacted by the project, the amount of clearing that will be done, howmuch vegetation will ho removed, the length of the completed trench and access road, thoproximity of any construction activities to water, and the necessary corresponding mitigation.

EC would also like to draw the proponents attention to the section erititted About the 2 Main Maps’, thetwo main maps referenced in this section were not included in (he 1-lydrological Impact Study nor theEnvironmental Impact Assessment. EC request the opportunity to revIew the maps described in theabove montloned section.

(4) Water QualityWit respect to constrtctn activt}es ani sedimentation, the proponents remthded of Subsect2on 35(3)c the Fisheries Act that states:

Sutject to subsection (4). no parson snaIl deposit or permit the deposit of a de!e:enoussubstance of any iype in water frequented by fsn or any place under any condions where thedeleterious substance or any other deleterious substance that results from the deposit of ttedeleterious substance may enter any such water.’

Given mat. despite any aporovals that may be issued, there is no authorization for the deposit of mraterialsucn as noted above under the Fishefles Acr. The deposirrig of such substances wou:d be flcsntraventicn of the general prohibihon, Therefore, given fwther that subsection 78(6) of the Fisheries Actaso indicates that:

“No person shall be conv,cted of an offense under this Act if the person establishes that thepersona) exercised al due diligence to prevent the commission of the offense...”,

Ft would be prudent for the Responsible Authority to ensure the proponent demonstrates that allreasonable measures to prevent the deposit of deleterious substances are being exercised. As such, it ‘Srecommended that the proponent document and demonstrate the dynamic apptication of best practicabletechnology, including mitigation technology and the use of best management practices for the proposedconstruction.
