PRESIDENT Benigno S. Aquino III declared Friday night a State of National Calamity to hasten the res-cue, relief and rehabilitation efforts after Typhoon Pablo devastated several provinces in Mindanao.

[The Chief Executive also directed Lt. Gen. George Segovia, commander of the army’s Eastern Mindanao Command to lead the task

State of national calamity declaredforce on retrieval opera-tions for the 383 missing individuals as a result of typhoon Pablo.

He said six of the 14 government-owned heli-copters in the country will be deployed in the Davao Region specifically for the retrieval of the missing persons.

Aside from the chopper deployment, the national

government has also sent nine K9 (dog) teams in Davao Region to help secu-rity forces in the retrieval operations, Aquino said.]

They were apprehended by elements of the Sta. Josefa Police Station, 13th Regional Criminal Investigation and Detection Unit, Agusan del Sur Criminal Investigation Unit, 133rdRegional Public Safety Company, Regional Intelligence Division and 23rd IB of Philippine Army.

The warrant of arrest was issued by Judge Dante Luz Viacrusis of RTC Branch 6, Prosperidad, Agusan del Sur, under criminal case number 7837 for Arson without bailbond.

On the other hand, au-thorities simultaneously

implemented search war-rant number 2012-17 in the residence of David Mar-ron. Confiscated were four homemade shotguns; three fragmentation grenades; caliber .45 pistol; two cali-ber .22 rifles; 42 live bullets of 12 gauge shotgun; 27 live bullets of caliber .45; 9 live bullets of caliber .22 magnum; three improvised magazine assembly for shot-guns and two slingshots, with nine arrows.

The search warrant was

Arrested persons are now under the custody of San Francisco Police Station while cases for violation of RA 9516 and RA 3553 are now prepared against David Marron.

COTABATO City – The city government is now on final stage of preparations for the Shariff Kabunsuan Festival.

The 5-day activity on December 15 to 19 will have four major events, namely the grand civic-military parade, the Guinakit Fes-tival, the Grand Kanduli or Pagana and the Kuyog Street Dancing Competition.

Other activities include the traditional games and sports contest, Moro songs competition, cultural peace concerts and fireworks dis-play and other religious activities.

Unlike in previous years, this year's celebration of the Shariff Kabunsuan Festival will be a joint effort of the Cotabato City Government and the Autonomous Region

"We are inviting every-one to join us in celebrating the Shariff Kabunsuan Fes-tival and relive the rich and colorful history of Cotabato City and the whole island of Mindanao", City Tourism Officer Benjie Abarca said.

Cagayan de Oro City - The Bureau of Plant Industry-Plant Quarantine Service (BPI-PQS) hosted a training/workshop for the Mindanao wide BPI-PQS Inspec-tors on the implementation of banana export program to the United States of America (USA) held at Pearlmont Inn, this city on September 18-20, 2012. 50 plant quarantine officers from the cities of Davao, Cagayan de Oro, Cotabato, and General Santos participated in the training. The training aims to enhance the capability of the BPI- PQS for the purpose of banana export to the USA. As such, the participants are expected to gain knowledge on the systems ap-proach for banana in the Philippines based on US system and International Standard for Phytosanitary Measures (ISPM); familiar with different pests and diseases of banana and to be able to detect their presence in the commodity; to gain knowledge on fruit fly manage-ment program and the operational work plan for banana export; as well as the guidelines for accreditation/registration processes for a packing house facility. They say: “The apple doesn’t fall far from the tree.” The kind of life we live is largely influenced by our family.

From the time we’re born it’s our family’s example we naturally follow.

Home is where we learn about love, life, and laughter.

As someone said: “Hap-piness is home-made.”

It doesn’t matter if you’re rich or poor, because a small house will hold as much happiness as a big mansion.

But sadly, many homes are not loving and happy. As one sad guy said: “The first half of my life was ruined by

my parents, and the second half by my children.”

A best-selling book en-titled, It Takes A Village, says that raising children is the job of the community. But the reason some people expect the government and community to raise their children is because their marriage and family has broken down.

Millions of families are destroyed by divorce, adul-tery, greed for money, selfish parents who put themselves

first before their own chil-dren, domestic violence, alcoholism, teenage preg-nancies, drugs, and many other things.

The simple fact is there is no substitute for the family. A child’s need for security, love, and acceptance from both parents will never change.

God designed us all to grow up in a family with both a father and a mother who love each other and us without conditions, and who

teach us right and wrong.This is the way our char-

acter is shaped and built so we become healthy, happy and successful.

WITH KILLER STRENGTH: The killer typhoon that is “Pablo” returned to the

Philippines Sunday night, according to a weather bul-letin issued by PAGASA, or the Philippine Atmospheric, Geophysical, Astronomical Services Administration. What is surprising here is not that it has returned, but it returned with its strength still intact and deadly, with maximum sustained winds at 120 kilometers per hour near the center and gustiness of up to 150 kilometers per hour. That is still deadly and destructive, yes?

HIV TEST, PLEASE: Excuse me, but I think that the “challenge” for President Aquino and Health Secre-tary Enrique Ona to take the HIV test is downright unacceptable, even if the supposed

WHEN typhoon ‘Pablo’ struck last week, calloused politicians show off their antics once again. These poli-ticians never care at the expense of people’s welfare. They think people owe them that they deserve loyalty. After typhoon Pablo, the situation has changed.

Typhoon Pablo taught a bitter lesson. Enlightened constituents finally realized that heartless politi-cians are the cause of their miseries. Evacuees at barangay Macasandig cried shamelessly as they blamed themselves for blindly following their ‘punong barangay.’ Incidentally, Aaron Neri is the barangay captain of Macasandig.

About 400 families evacuated to Macasandig covered court when City Hall went on ‘alert’ in anticipation of ‘T-Pablo’ last Monday. City Hall immediately dis-patched social workers to attain the needs of evacuees in Macasandig.

Neri reportedly tried to drive the social workers away. He said assistance from his political allies would soon come. It did not. He reportedly told evacuees that they would move to an unfinished center in Taguanao when necessary. What will they do there? Certainly, the evacuees would starve there.

Evacuees cry during Typhoon ‘Pablo’What happened to Neri? Did he allow himself to be

cowed by politicians whose only purpose is to get the votes of city residents? Once, Neri was a good baran-gay leader. During Typhoon Sendong, he personally distributed relief goods to flood victims. He wanted to be sure that those who get the assistance are actual residents of Macasandig. What made his heart change? Did his allies promise him heaven on earth once they succeed in taking over city hall next year?

Aaron Neri reportedly hoarded relief goods in his house at the height of Typhoon Sendong. However, that accusation could be false. Nonetheless, such al-legation might have incensed City Hall.

Even ‘though, Neri should not deprive flood vic-tims in Macasandig of assistance they deserved. The evacuees during Typhoon Pablo cried because they were not able to enjoy the free house and lot offered by City Hall. They alleged that Neri convinced them not to accept the offer. Now, they are remorseful of their decision.

Whatever, one should remember that critical decision involving family’s welfare is a right that an individual should enjoy. No matter how tempting, one should not be swayed by promises of politicians who work to pursue their political ends. Certainly, residents of Macasandig learned bitter lessons from obsessed leaders engaged in lip service. React [email protected]

THE final version of the legislature’s amendments to the Intellectual Property Code (Republic Act No. 8293) proposes to make the following changes:

What saved the day for me, in my restlessness to become productive dur-ing those hours of getting holed in, was the full bat-tery charge of my laptop. I know for a fact that many Kagayanons remembered Sendong and its aftermath: I am not only concerned with the homes that were washed away, the death toll rising, but also, the diseases that are of public health concern.

Flood waters have a po-tential to increase the risk of transmission of com-municable or contagious diseases. These may fall under either water borne or vector borne.

THE Bangko Sentral ng Pilipinas has been vindicated in a decision recently issued by the Court of Appeals (CA), which effectively denied the petition by Banco Filipino investors to reopen the beleaguered bank.

“Unless the Banco Filipino can specify its independent and strong financial commitment to address its present predicament, we do not see any cogent reason to sustain its sought rehabilitation, much less its re-opening, at this time,” the CA said in a decision promulgated on November 21, 2012.

The appellate court reversed its earlier judgment is-sued in January 2012, which had granted the petition of Banco Filipino Savings and Mortgage Bank stockholders.

Considering that floods have a tendency to con-taminate the source of water supply, it is not uncommon to find, after the floods, an increasing number of people that may develop diarrheal disease, typhoid fever, hepa-titis A, and Leptospirosis.

Last time CDO was hit by a typhoon, there was a notable rise in the number of affected individuals with Leptospirosis, a disease that happens once the skin or mucous membranes get in touch with water contami-nated with rat urine.

The Department of Health conducted infor-mation dissemination as well as distribution of the appropriate medicine, as a preventive measure. It is only when the displacement of a population and when the source of water supply is compromised that the other types of water borne diseases as enumerated above can happen.

Thus, it is a very impor-tant measure as part of the government’s risk reduction and disaster preparedness

and Employment (DOLE), which can automatically investigate violations of labor standards. Unlike the IPO, the DOLE can issue an order requiring compliance or even writs of execution under Article 128 of the Labor Code. Similar powers are not given to the IPO. This may lead to malicious prosecution by the IPO and may open the IPO to a flood of suits from businesses and other establishments who may be harassed or offended by the unwarranted visitations of IPO officials. Second, this visitation power may be a superfluous and an unneces-sary act. As stated, the leg-islature expressly withdrew from the IPO the power to issue compliance orders and

TACURONG CITY, Sultan Kudarat, -- The Anti-Smok-ing Ordinance of Tacurong City will be fully implement-ed effective January 2013.

However, according to councilor Psyche Sucaldito, the ordinance will already take effect in the city govern-ment buildings and areas on December 10, 2012.

“We are setting the stan-dard so we need to start earlier than the rest of the city. We should be good examples,” said Sucaldito, author of the said ordinance.

To kick off the ordinance’s implementation, an orienta-tion among city anti-smoking enforcers was conducted on November 26.

the Bangko Sentral, its Monetary Board (MB), and the Philippine Deposit In-surance Corporation (PDIC) from enforcing and imple-menting MB Resolution No. 372-A, which closed the bank for insolvency in early 2011.

Citing grave abuse of discretion, the January 2012 judgment also ordered the BSP and the Monetary Board to reopen Banco Filipino and allow it to operate with a “viable rehabilitation plan, in order to ensure fast and immediate recovery of the bank from the ill-effects of the illegal closure.”

However, in its most recent decision, the ap-pellate court stressed that the Bangko Sentral “is the central monetary authority of the Government which has the statutory duty to supervise the operations of banks and to exercise regulatory powers thereon.”

The CA also pointed out that consistent with the BSP-MB’s findings on Banco Filipino’s insolvency, the PDIC likewise discovered that while Banco Filipino’s assets amounted to around P11.77 billion, its liabilities amounted to around P23.02 billion as of its closure date.

The appellate court fur-ther explained that the BSP, the MB and the PDIC “have merely exercised their le-gal and statutory duties as expressly granted to them by law.”

“Considering all the foregoing, we all the more disagree with this Court’s earlier finding of grave abuse of discretion amounting to lack or excess of jurisdic-tion on the part of any of the respondents BSP, the Monetary Board and the PDIC,” the CA declared in the decision penned by Associate Justice Noel G. Tijam, and concurred in by Associate Justice Ramon A. Cruz and Associate Justice Eduardo B. Peralta, Jr.

The CA also mentioned the Banco Filipino’s lack of a financial plan should it be given the chance to resume its business.

“This Court found par-ticularly disturbing the Ban-co Filipino’s admission that even if respondents BSP-MB gave Banco Filipino the sought emergency loan, such amount will just be exhausted in a matter of days in view of the deposits which the bank currently services for its depositors,” the appellate court said.

It added, “Sadly, this only confirms that Banco Filipino can no longer in-dependently resume its business with safety to its creditors, depositors and the general public and/or that it can operate without incurring losses.”

The CA also pointed out that in the absence of any commitment from the stockholders themselves to help rebuild the bank, the sought rehabilitation of Banco Filipino “would

related powers. In prac-tice, when the IPO visits an office or a manufacturing facility, it cannot do any-thing beyond visiting. It will still have to forward a report to the relevant government agency such as the police or the customs officials, which has the power to act on the matter.

Will this be another layer of bureaucracy? It may be, but it doesn’t have to be. For those who feel that they are victims of infringement, the best way will still be to file a report or complaint with the police, the Optical Media Board or the Bureau of Cus-toms, rather than investing time in complaining to the IPO who will nevertheless have to go to the other

It is likewise good to make people realize that drinking water in times of flooding, should be boiled and placed in clean and safe containers. Proper disposal of waste is as important as the getting or clean and potable water.

Another preventive mea-sure to help minimize water borne diseases, is vaccina-tion against Typhoid Fever and Hepatitis A, especially among the high risk groups, food and water handlers, waste or sewage workers.

Floods bring about an increase in vector borne diseases too, like Malaria, Dengue Fever, as there is an expansion in the number and range of vector habitats.

Stagnant water, water in the unused tires, vases or cans caused by the heavy rainfall or the overflow of the river can act as breeding sites for mosquitoes which are the known vectors for Malaria and Dengue.

Add to this, are the heavy congestion of evacuation centres where people are huddled together, with no protective clothing or mos-quito nets!

It is to the public’s best interest, if, there is continu-ing education and awareness conducted: teaching them the warning signals for these diseases, thus, prompting them to seek immediate consultation.

Remember, early detec-tion and diagnosis saves lives, and minimize costs in terms of medications and hospitalization.

Health education is as important as the giving of medicines, in the preven-tion of diseases associated with flooding.

Public health issues as these, will need the help and support of every member in the community....

But, you say, there is a catch-all phrase that states that the IPO may exercise “such other functions in furtherance of protecting IP rights and objectives of this Act.” True, but then, we must now apply the principle of statutory interpretation in deciphering what the intent of the law is. Expressio unius est exclusion alte-rius. (The express mention of one person, thing or consequence implies the exclusion of all others.) In this case, what is expressly granted is visitorial powers and no other. If the legis-lature wanted to include the power to confiscate or issue compliance orders, it would have said so. Should the implementing rules and regulations try to include these powers, it will be struck down by the Courts for being in excess of IPO’s jurisdiction. Again, as held many times by the Supreme Court, the spring cannot rise higher than its source. Rules made by a regulatory agency cannot be in excess of the law which gave that agency its powers.

Why did the IPO lobby for enforcement powers?

As far as I know there is only one other Intellectual Property Office in the world that has enforcement pow-ers, and that is Mexico’s. The other IPO which is thinking of asking for enforcement powers from its legislative is Pakistan’s.

The adoption of enforce-ment powers may have been a concession to the U.S. Trade Representative in order to remove the coun-try from its annual piracy watch list called the Special 301 report. A former press statement by the IPO cat-egorically asked the U.S. what it wants in order to remove the country from the watch list.

Will there be any signifi-cant changes in the coun-try’s status given the new enforcement powers? In the 2012 Special 301 report, and despite its enforcement powers, Mexico is in the watch list category together with the Philippines while Pakistan is included under the priority watch list. 2) It will add a Bureau of Copyright within the IPO.

The new Bureau of Copyright wil l resolve cases involving the terms of a copyright license and grant or deny accreditation to collective management organizations or agents of artists. It can also conduct studies and researches and provide other copyright-related services for a fee. What these services are are, again, omitted from the wording of the law.

While the accreditation of agents and the resolution of disputes on copyright li-censing will be taken cogni-zance of by this new Bureau, the registration and deposit of copyrighted works will still be with the National Library of the Philippines.

Under Section 229 of the current IP Code, “The Copyright Section of the National Library shall be classified as a Division .... The National Library shall have the power to collect, for the discharge of its services

under this Act, such fees as may be promulgated by it from time to time subject to the approval of the Depart-ment Head. “ This Section remains as is.

What are the functions of the Copyright Division of the National Library? Under the IP Code, the Library is in charge of registration and deposit (Section 191); filing of contracts of as-signments or licensing of copyright (Section 182); and posthumous enforcement of rights, should the deceased author or artist have no heirs (Section 198.1).

Artists will still have to deal with two copyright agencies. The registration function is retained by the National Library in conso-nance with the American system that we transplanted into our laws.

3) The reproduction of copies for the blind or visually-impaired is not copyright infringement.

“The reproduction or distribution of published articles or materials in a specialized format exclu-sively for the use of the blind, visually– and read-ing–impaired persons” does not constitute infringement. Such copies and distribution shall be not for profit and shall indicate the copyright owner and the date of the original publication.

This provision is in com-pliance with the World Blind Union’s appeal through Ste-vie Wonder to exempt use by the visually-impaired from copyright.

4) There will soon be a limit to the number of photocopies made for class-room use.

Previously, the use of copyrighted work for teach-ing, including multiple copies for classroom use, was considered fair. The amendment now changes the wording from “multiple copies” to “limited number of copies”. What the magic number is will have to be interpreted by the courts. It is possible that the courts will soon fix a percentage or a definite number such as 5% per class of 40 students. If that’s the case, any copy in excess of that “limited number” is no longer fair and is now likely to be pros-ecuted as an infringement.

5) Libraries may now make “limited number of ” copies of an original, as op-posed to just “one copy” in the previous IP Code.

The library or archive has to be a non-profit entity.

6) Performers’ per-mission is now required before any copy of their performance as recorded in a sound or audiovisual recording can be repro-duced and distributed to the public.

7) The right of the author or artist to be named as such will last in perpetuity, as opposed to the economic right of the author or artist which has a term of lifetime + 50 years after death.

The moral right to a by-line will now be perpetual. Previously, the IP Code mis-takenly gave moral rights a limited period of lifetime plus 50 years after the artist’s death, when it really should be perpetual. Case in point: we still recognize that Les Miserables is written by Victor Hugo, even though he died in 1885.

8) Agents (collective management societies) will have to be accredited by the IPO before they can enforce the copyright of their talents or artists.

Enforcement of copy-right in this regard may include collection of royal-ties. If foreign agents (or collective management so-cieties) such as the Ameri-can Society of Composers, Authors and Publishers or even Reuters wish to enforce its members’ copyright in the Philippines, it will have to first secure accreditation from the IPO.

9) Double damages are awarded in case the copy-right infringement is done through circumvention of technological measures or alteration or removal of electronic rights manage-ment information.

Technological measures and electronic rights man-agement are those features or encryptions which have to be unlocked (“jailbreak”) in order to allow users to enjoy content in other ways.

While we are only enact-ing our own version of the U.S.’ Digital Millennium Copyright Act, the U.S. Register of Copyrights has gone ahead and provided for exemptions for the blind, the hearing-impaired, and wireless headsets.

10) Statutory damages starting at P50,000.00 may be awarded if the copyright owner does not want to recover actual damages and profits. This may be reduced to P10,000 if the infringer pleads innocence or that he does not know that he was infringing.

11) Maximum prison terms (3 years, 6 years or 9 years for 1st, 2nd and 3rd time offenders) will be imposed if the infringement was committed by circum-vention of tech measures, alteration or removal of digital rights management.

12) Schools and uni-versities are required to adopt IP policies that will safeguard the intellectual creations of the school or university and its employees.

13) What about plagia-rism?

Contrary to IPO’s claim that the proposed amend-ments will bring “plagia-rism” under the purview of copyright infringement, no such categorical word-ing can be found in the amendments.

In a news report, Senator Vicente Sotto III, who faced netizens’ ire for plagiarising and translating copyrighted works without permission, cited an opinion from the IPO that “plagiarism was never classified as a crime in the country.” A formal request on the IPO to re-lease a copy of the opinion remains un-acted upon.

C opyr ig ht l i te ra l ly means the right to copy or reproduce. This right lies solely and exclusively with the author unless he or she gives others permis-sion. That’s Section 177 of the IP Code.

Copying other authors’ work without permission or authorization is a form of copyright infringement. In this particular case, there was an admission on record that the copyright was exer-cised by someone other than author and that exercise was without permission.

Gesta absorbed his first defeat in 28 fights with one draw and 14 knockouts while Vazquez, who used box and run tactic, improved at 33-2 with 13 stoppages.

Michael Farenas also absorbed loss against un-defeated Yuriokis Gamboa of Cuba who retained his WBA interim super feath-erweight title in a bloody 12-round undercard fight before Pacquiao-Marquez bout.
