8. PRESENTATIONS / AWARDS Frankston City Council recently won the Design and Building category at the 2015

Victorian Coastal Awards for Excellence for the new McCulloch Avenue Boardwalk.

The McCulloch Avenue beach entry services a large percentage of beachgoers and this boardwalk provides a safe and accessible path to the beach without damaging the surrounding dunes. Congratulations to everyone involved particularly the Senior Landscape Architect, Mr Andrew Stevens.

Recommendation That Council defers any further action being taken on implementation of NOM 1171, tabled at the 5th October 2015 Council Meeting, until a report is presented to Council advising of the costs of implementing the resolution as proposed and any alternate options which may provide a better and more cost effective solution to meet the intent of the resolution.

The report is to be presented to Council at its meeting on 16 November 2015.

11. CONSIDERATION OF TOWN PLANNING REPORTS 11.1 Earthworks and the Importation of Fill - Planning Controls

(MP Community Development)

1. Applies to the Minister for Planning in accordance with Section 9(3) of the Planning and Environment Act 1987 to obtain authorisation to prepare Amendment C112 which will introduce planning controls for: - Earthworks which change the rate of flow or the discharge point of water

across a property boundary; - Earthworks which increase the discharge of saline groundwater; and - Earthworks which involve the receipt, importation, stockpiling or placement of

more than 100 cubic metres of fill. 2. Authorises Council officers to prepare the amendment documents. 3. Once authorisation is received, exhibit Planning Scheme Amendment C112 in

accordance with Sections 17-19 of the Planning and Environment Act 1987, notifying all owners, occupiers and prescribed authorities.

1. Adopt the Frankston Native Vegetation Protection Study.

2. Applies to the Minister for Planning in accordance with Section 9 (3) of the Planning and Environment Act 1987 to obtain authorisation to prepare and exhibit a Planning Scheme Amendment to implement the recommendations of the Frankston Native Vegetation Protection Study.

3. Authorises Council Officers to prepare the amendment documentation.

11.5 Progress Update - Frankston Planning Scheme Amendment C99 - Western Port Highway (North) Upgrade (BH City Development)

Recommendation (Director City Development) That Council:

1. Notes that VicRoads supports Planning Panels Victoria conclusions that only northerly ramps be provided for at Ballarto Road and that provision be made for a northern half diamond interchange at Wedge Road;

2. Notes that VicRoads recommends that the Minister for Planning approves inclusion of Planning Scheme Public Acquisition Overlays (PAOs) for these options in relevant planning schemes; and

3. Notes that the Minister for Planning is expected to announce his decision on the plan changes in November.

4. Officers are directed to provide background information and the results achieved through Council’s lobbying through submissions to the community.

12.2 Proposed Lease of Council Land - Telecommunications Facility (New) - Part of 294N Frankston-Flinders Road Frankston South (Baxter Park) (GV Corporate Development)

Council Decision Moved: Councillor Taylor Seconded: Councillor Dooley That:

1. Visionstream on behalf of Optus, be advised that Council, acting in its capacity as the Public Land Manager, agrees in principle to the leasing of part of the Crown Land at 294N Frankston-Flinders Road Frankston South, being Crown Allotment 8F in the Parish of Frankston, temporarily reserved for a Racecourse and Public Recreation, for a term of ten (10) years, plus two (2) further options of five (5) years each, for the sum of $20,000 plus GST per annum, for the purposes of the construction and use of a Telecommunications facility, subject to:

(i) the satisfactory completion of statutory procedures for the leasing of

Council land pursuant to s.190 Local Government Act 1989, and, (ii) the granting by Council, acting in its capacity as the Responsible Authority

for administering the Frankston Planning Scheme, of a Town Planning Permit for the construction and use of the land for a Telecommunications facility.

2. The Chief Executive Officer be authorised to commence the statutory procedures

for the leasing of land including public notice.

Notes that the freezing of indexation of Federal funding for FAG’s will result in a significant impact on the finances and council’s ability to undertake projects – particularly in real terms over the next three year period and a reduced base grant forever thereafter. In addition, the introduction of rate capping further exacerbates the acute financial position as lost grant income cannot be offset by increasing rate income;

3. Acknowledges that Frankston City Council will receive $8.534 million in grants; 4. Will ensure that this federal funding, and other funding provided by the Federal

Government under relevant grant programs, is appropriately identified as Commonwealth grant funding in council publications, including annual reports; and

5. Writes to the Prime Minister, the Treasurer and The Australian newspaper raising the importance of financial sustainability in Local Government for our communities and the importance of financial assistance grants to Council’s budget.

Rationale I draw to this Council's attention the final report of the New South Wales Independent Pricing and Regulatory Tribunal on the strength and effectiveness of New South Wales local government. The report clearly identifies that that a majority of Councils are "not fit" for the future. A key reason for this is the parlous financial state of the Councils, no doubt brought on by over two decades of rate capping.
