The Council’s Charter

A council has the following charter:

- to provide directly or on behalf of other levels of government after due consultation, adequate, equitable and appropriate services and facilities for the community and to ensure that those services and facilities are managed efficiently and effectively

- to exercise community leadership

- to exercise its functions in a manner that is consistent with and actively promotes the principles of cultural diversity

- to promote and to provide and plan for the needs of children

- to properly manage, develop, protect, restore, enhance and conserve the environment of the area for which it is responsible, in a manner that is consistent with and promotes the principles of ecologically sustainable development

- to have regard to the long term and cumulative effects of its decisions

- to bear in mind that it is the custodian and trustee of public assets and to effectively account for and manage the assets for which it is responsible

- to facilitate the involvement of councillors, members of the public, users of facilities and services and council staff in the development, improvement and co-ordination of local government

1. MINUTES OF THE TOURISM/ECONOMIC DEVELOPMENT STEERING COMMITTEE MEETING (T26-005) MINUTES OF THE TOURISM/ECONOMIC DEVELOPMENT STEERING COMMITTEE MEETING OF LOCKHART SHIRE COUNCIL HELD AT THE ROCK MEMORIAL BOWLING CLUB, THE ROCK ON 6 AUGUST 2014 COMMENCING AT 6.40PM. PRESENT Councillor G Driscoll, Councillor Derek Douglas, Mrs Susan Creek, Mrs Myra Jenkyn, Mrs Raeleen Pfeiffer, Mr Rob Martin, Mr Roger Brand, Tourism/Economic Development Officer (Jennifer Connor). CONFIRMATION OF MINUTES The minutes of the Meeting held Wednesday, 2 July 2014, as printed and circulated be taken as read and confirmed on the Motion of M Jenkyn.

1. The Rock Museum

The Rock Hall Committee agreed to the dual purpose use of The Rock Hall, both as a meeting place and a museum. A letter from the Hall committee has been sent to residents in The Rock requesting feedback on this proposal. To date feedback has been very positive. The TEDO will arrange a meeting with representatives of Council and members of The Rock Hall and Museum committees to discuss how their committees can combine to work as a Section 355 committee. The Rock Museum Committee is working on a list of possible exhibits based on donated items only. The exception to this is any long term loan of important aboriginal artefacts. The Committee are working on an online museum and following a recent workshop now have a number of stories feature on ABC Online. The long term aim is to record as much local information and as many stories, images and artefacts as possible.

Recommendation: That support be given to The Rock Hall and Museum Committees in their efforts to establish The Rock Hall both as a meeting place and a museum.

2. Billboard Advertising

The TEDO has requested full requirements for the construction of a billboard on the Sturt Highway from Wagga Council and the RMS including all DA requirements. The TEDO will be meeting with a land owner next week to discuss potential leasing opportunities for a billboard sign. Following discussions with the landowner including size requirements the TEDO will request quotations to construct the sign and will report back to the Committee with costings.

3. Billboard Advertising

The contract for Billboard signage at the Silverlight Service station has been cancelled and will end on 10 August 2014. The TEDO is investigating costs, legalities and opportunities to install a double sided billboard on the Sturt Highway through direct, long term leases with landowners. The installation of double sided signage would allow for Shire promotion on one side of the board, with leasing opportunities on the other side of the board creating a potentially self-funded project. If successful a second billboard between Wagga and The Rock would be considered. Funds have been allocated in the 2014-15 budget for this project, subject to negotiation of any land lease and approval of the signage by Wagga Council and the RMS. The TEDO will report back to the TEDSC with costs and requirements. Recommendation: That the information be noted.

4. The Legend of the Fairy Tree

The Rock Progress Association has been notified that their application with FRRR was unsuccessful however further grants are being applied for. The working party will meet once applications for funding are successful. Recommendation: That the information be noted.

5. Galore Hill

The TEDO is working on the proposal for funding for Galore Hill which opens in mid-August. The application for funding will include the following proposed improvements, subject to approval by Council. The TEDO has contacted Council’s insurers for public liability purposes: • Improve all walking trails including longer walks and install timber trail markers • Install solar BBQs at the Summit and Saddle • Re engraving of the geodetic station which is the brass directional plaque on the tower • Replanting of native vegetation • New information boards and repairs to entrance and signs • Double Skyrider at the Summit (subject to Council’s consideration) • Horse riding, mountain biking trails with possibility of annual events.

6. Town Advertising Campaigns

The TEDO is working on promotional material for sale at the Lockhart and The Rock VICs. There will be target themes for each town, with an aim of producing attractive, local products that promotes the town, and ties in with further promotional opportunities. Lockhart advertising will be based on a “Lock Heart” theme – appeals to Grey Nomads, families and youth. Merchandise to include “Lockhart Locket”, keyrings, stickers, tea towels. This theme will tie in with the Lockhart Locks and Lockhart Love Heart Trail. Lockhart Locks is based on the world wide phenomena of people writing on locks and then attaching them to a designated site. A sculpture designed specifically for this purpose and able to take the weight would appeal very much to younger people and to the romantic at heart. The corner of Green Street and Urana Street on the edge of Cowen Gardens would be a prime position. Lockhart Love Heart Trail would tie in with next year’s Tidy Town campaign and would be based on as many residents and shop fronts as possible putting a love heart of any shape, size and style in their front gardens, on their fence, hanging from a tree etc. to create a trail. An added attraction in Lockhart with minimal cost – “There are 276 Lockhart love hearts in our town, how many can you see”. The Rock Advertising Campaign will consider “Top of The Rock” stickers, and “Lion of the Plains, Hear Us Roar” merchandise, designed to appeal to visitors as per selection below. The Fairy Tree will also offer extensive merchandising opportunities. A sign to include capital cities or unusual Australian names has the potential to create interest at an existing stopping point in Yerong Creek. The TEDO will visit Yerong Creek in August to consider possible locations and to meet with local residents. Local ownership may reduce vandalism if the sign could be made locally, i.e. through the Men’s Shed, local residents. Recommendation: That the town advertising campaigns be supported and the TEDO continue to investigate design details and costs for products and projects.

7. Committee Meeting Locations

At the July meeting the TEDSC voted to hold every second meeting at Lockhart, while taking alternate turns at Pleasant Hills and The Rock, excluding Yerong Creek unless they have a suitable representative willing to attend the meetings. At the Ordinary Monthly Meeting of Council in July, Council advised they very much appreciate the time, efforts and commitment of the TEDSC, but would like to see the meetings remain distributed throughout the Shire. It was therefore resolved that Council’s preferred option is that the meetings continue to be held on a rotational basis throughout the Shire as previously existed.

Recommendation: That the TEDSC continue to meet in Lockhart, The Rock, Pleasant Hills and Yerong Creek on a rotational basis as previously existed.

8. TEDO Projects

The TEDO is currently working on a number of additional projects to improve economic and tourist services in the Lockhart Shire. The TEDO will be reporting briefly on the following projects at the meeting.

Greens Gunyah Museum Roof is on and progress completion timeline received from

builder. Completion date of 15 September.

2015 Come On Home The TEDO compiled a 2015 Come on Home marketing campaign which has been sent to Riverina Regional Tourism The RRT would like to feature the campaign across the whole of the Riverina if their funding is successful. This campaign will have far reaching advertising opportunities for Lockhart Shire.

Wall / Walk of Fame The potential sites of the Wall/Walk of Fame will be reviewed after the Museum redevelopment is finalised.

The Rock Nature Reserve The TEDO has forwarded a ‘wish list’ of requirements. • Repair and upgrade both walking trails • Install timber trail markers • Ensure a trig marker or signage at the summit • Install galvanised steel bollards • Install solar BBQs (gas hotplates with solar batteries) • Install new information boards • Revamp entrance including signage • Timber seat on track just prior to ascent.

Local Event Opportunities Lockhart Picnic Races – Race night fund raiser, fundraising in conjunction with SOL TEDO able to get better value for money by negotiating advertising rates and by Sol and Races buying into Shire ads TEDO working to get Lockhart Arts group going TEDO looking to create sporting events, e.g. distance between The Rock & Lockhart is 42km, the distance of a marathon. Trail running and Peak to Peak Cycle Challenge (Galore to The Rock) being explored.

Community Garden 2 garden beds are completed with further beds to be constructed at the next working bee on 9 August. Awaiting replies re requests for donations. Schools have been invited to make scarecrows Relaxed, friendly concept.

Agri Tours TEDO contacted by Quadrant Tours, Australia’s largest agri tour operator advising they would like to include Lockhart agri industries/products in their itineraries where possible

Country Change Exhibition The TEDO will be attending the Country Change Exhibition in Sydney on 2 & 3 August.

Local Accommodation Accommodation for those looking to move to Lockhart, who are not in a position to build/buy needs to be considered.

Industrial Land Funding Policies

The TEDO is putting together information for a funding policy for the Industrial land. There is potential for an industrial/residential land package.

Business Opportunities A social media/marketing workshop will be held in August for

any businesses in Lockhart Shire wishing to attend. Date is Monday, 25 August from 9am to 12noon.

Youth Opportunities The TEDO is working on a number of ideas for youth opportunities including retail experience.

Newsletter TEDO and selected staff are working on improving the look of the newsletter to ensure readerships A monthly Facebook photo competition, with the winning picture to feature on the front cover of the newsletter will increase following on Facebook and add to interest in the newsletter through resident input.

2. MINUTES OF THE POLICE AND COMMUNITY CONSULTATION COMMITTEE MEETING (P35-005)

Minutes of Meeting

Police and Community Consultation Committee Held at the Pleasant Hills Community Hotel, 4 Manson St, Pleasant Hills

Friday, 1 August 2014 at 4.10pm

Present: The Mayor Cr Peter Yates, Inspector Mark Murphy, Sergeant Anthony Rice, Senior Constable Damien Davies, Cr John Paterson, Robert Martin, Director Engineering & Environmental Services - David Webb. Apologies: Superintendent Bob Noble, Sergeant Matt Couldrey, Senior Constable Amy Couldrey, General Manager Rod Shaw, Ross Edwards, Karen McPherson. Resolved: Paterson/Martin that apologies be accepted. Confirmation of Minutes: Resolved: Martin/Yates that the Minutes of the Committee Meeting held Friday 2 May 2014 be accepted. Business Arising From Minutes: • Vehicles Parking on Nature Strips

Council put another note in the June Council Newsletter. Seems to be in hand at the moment. Council will continue to monitor. Complete.

• Traffic Counters Follow up Director of Engineering to pass results onto SC Couldrey. 1 Aug 2014 - Traffic counters only just gone out. Will pass on results when available. Complete.

• Boree Creek – Yuluma Road Intersection Signage at intersection to be reviewed following accident. Director of Engineering to follow up. Signs complete.

• Break-ins at Lockhart Rec Ground Mr Shaw mentioned a number of break-ins by youths at Lockhart Recreation Ground Pavilion. SC Couldrey advised no reports to police since October 2013. Police advised no more incidents since but suggested that now that the new football season has started, the pavilion users will have to exercise diligence to ensure locked doors and windows and to keep stock levels to a minimum. 1 Aug 2014 - Nil reports of break-ins during current season. Complete.

• Attendance at Police and Community Consultation Committee Meetings

Mr Shaw also mentioned the poor attendance at the last 2 meetings and suggested that perhaps the meetings might be more beneficial if they were incorporated into the normal Council Meetings. An Agenda item could be established at the beginning of the Council Meeting for attendance by police and other community committee members in lieu of a separate meeting being held. Cr Yates advised that this would be put forward for discussion at the next Council Meeting. After discussion, it was agreed that efforts be made to attract 1 additional member to the Committee from Lockhart, and 1 or 2 from Pleasant Hills. Post Meeting Note: An ad seeking additional members was placed in the June 2014 Council Newsletter, but no enquiries were received. 1 Aug 2014 - Brief discussion on why meeting was held at 4.00pm on a Friday? Advised that this time suits the Police better to allow their attendance.

Sergeant Matt Couldrey • Suggested that mirrors be installed at the railway crossing at the western approach to

The Rock from Lockhart to improve driver visibility – refer to Traffic Committee. The next Traffic Committee meeting will be held on 14 August 2014.

Bob Martin • Prevalence of drug use at The Rock – issue discussed and police advised ongoing action.

1 Aug 2014 - Police advised that they are patrolling with unmarked cars and are regularly patrolling The Rock. Complete.

Ross Edwards • Advised some level of speeding in main street of Yerong Creek now that the road has

been reconstructed – Police advised they will keep a watching brief. 1 Aug 2014 - Cr Yates has also noted speeding trucks in Yerong Creek. Cr Yates also advised of people mistakenly going west on the north side in the main street. Council to investigate.

• Requested signage to be placed at the narrow section of Yerong Creek-Mangoplah Road (Lockhart and Wagga Shires). 1 Aug 2014 - Council to investigate.

• Advised of a traffic hazard at the corner of Moonba and Queen Streets, Yerong Creek. 1 Aug 2014 - Being addressed under Development Application. Complete.

Councillor Paterson • Advised meeting of plans for a 30m communication tower near police station at The

Rock – he suggested an alternative location may be preferable – Police advised will follow up Marlin Norbury, an interested resident from The Rock. 1 Aug 2014 - Tower is up. Complete.

Councillor Yates • Advised that small children are often playing on the main street in Yerong Creek and of

his concern that they may be hit by passing traffic. Police advised a watching brief. 1 Aug 2014 - Complete.

Inspector Murphy • Reiterated that the police can do their job better if members of the public were more

willing to come forward if they observe or become aware of criminal activities. Gradual process of building community confidence and improved communications. 1 Aug 2014 - Article by Police about reporting incidences to go in the next Council Newsletter.

• Advised that a Police Management meeting will be held at Lockhart in July/August and invited attendance. 1 Aug 2014 - Police advised that the next Police Management meeting will be held at the Lockhart EOC (Old Railway Building) at 12.30pm on Tues, 12 August (lunch provided). Senior Police from Wagga Wagga Local Area Command will be in attendance and an invitation to attend was extended to all Police and Community Consultation Committee members and Lockhart Shire Councillors.

New Business: Letter from Mrs Shirley Martin • Police have been patrolling the areas, including the school zones. The school zone signs

have just been replaced (RMS is responsible for school zones). Police advised that they will visit the Martins. 6 Aug 2014 - Post Meeting Note: Police have visited the Martins to discuss concerns expressed in Mrs Martin’s letter. Complete.

Note Received from Ross Edwards Re: New Business • Would it be possible to hold two information days, at say Lockhart and Henty, with

representatives from RMS, Highway Patrol and Local Police to explain rules and requirements when moving agricultural machinery on roads? There seems to be a lot of confusion among rural landowners and contractors. 1 Aug 2014 - Council advised that an information day was conducted in Lockhart recently that was well attended by local farmers. Council can issue permits as required for a $70 fee. All rules, regulations, etc. are set by RMS. DEES to contact Mr Edwards to discuss further.

• The Highway Patrol seems to be giving the Albury to Wagga area (including rural roads) more than its share of attention. Is there a reason? Police advised that Highway Patrol is tasked to certain areas as required. Inspector Murphy to invite Highway Patrol to attend every 3rd or 4th Police and Community Consultation Committee meeting.

• Mr Edwards advised that he hears a lot of positive comments about our local police and encourages them to keep up the good work. The Police expressed their thanks.

Councillor Paterson • Requested course of action a resident in The Rock should take if they feel they have an

issue with Highway Patrol. Police advised that if the resident feels they have been dealt with harshly they can make an appointment with a Senior Police Officer, write to NSW Debt Recovery or ultimately wait for the matter to be settled in Court.

• Requests that the Stop Signs at Rail Crossings in The Rock be considered to be changed to Give Way signs. To be discussed at the Traffic Committee meeting.

• Status of Repairs to The Rock Police Station? Inspector Murphy advised that it is still to be determined what would be the best course of action.

Next Meeting: Next meeting to be held at Lockhart on Friday, 7 November 2014 at 4.00pm.

Report MLHD is holding its twice yearly Forum for Local Health Advisory Committee (LHAC) members in Wagga Wagga on 8 and 9 October 2014. LHAC (230+ members) volunteer their time to advocate for their community’s health service needs, and enables MLHD to keep its communities informed about health services and partner effectively with its consumers. LHAC has 6 members from the Lockhart Shire area, the local Committee being chaired by Lorraine Hoffman.

MLHD is seeking financial support for the Forum as follows: • A contribution of $500 would enable 5 members to attend • A contribution of $1,000 would enable 10 members to attend. Any contribution will be modestly acknowledged as per the attachment. Legislative Policy & Planning Implications Our policy objective provides that any assistance will be based on the benefit to the Lockhart Shire Council community. Our policy statement states in part that Council will consider financial assistance to local cultural, educational, health, sport, welfare and other bodies and individuals where the applicants have demonstrated a community need. 5. FINANCIAL STATEMENTS - 2013/14 AUDIT (DCCS/F10-010)

Council’s Draft Financial Statements for the 2013/2014 Financial Year are being completed. Section 413(1) of the Local Government Act requires a resolution of the Council that Council must prepare financial reports for each year, and that the Financial Statements be referred for audit. 413 Preparation of financial reports (1) A council must prepare financial reports for each year, and must refer them for audit as soon

as practicable (having regard to the requirements of section 416 (1)) after the end of that year.

Note: Under section 416 (1), a council’s financial reports for a year must be prepared and audited within 4 months after the end of the year concerned, and under section 428 (2) (a) the audited financial reports must be included in the council’s annual report.

It is anticipated that these reports will be tabled at the December 2014 Meeting of Council where Council’s Auditors, Crowe Horwarth Auswild, in attendance. Recommendation: That: a) the Draft 2013/2014 Financial Statements be referred to Council’s Auditor, Crowe Horwarth

Auswild for audit; and b) Council delegate authority to the General Manager to authorise the accounts for issue to the

Executive Summary Council has requested a report on S355 Committees, specifically reporting on the cost of insurance and the subsidy provided by Council to each S355 Committee. Report The subsidy from Council is to assist these Management Committees in providing and maintaining the grounds and facilities they manage on behalf of Council. A cost of managing these S355 Committees is that of insuring buildings and facilities. Director of Engineering and Environmental Services 7. ENGINEERING REPORT (DEES/T10-005)

Executive Summary Monthly report on engineering matters. Report i. Works Report: All three grader crews are undertaking maintenance works as per schedule.

The reconstruction project at Osborne-Yerong Creek Road has been left due to winter months and will be completed when the warmer weather returns. A speed limit of 40 km/hr has been set along with appropriate signage. Construction projects are not due to commence till later in the year. Contract to win and crush gravel at Council managed gravel pits has been let and works due to commence late August 2014.

A marked up programme for the next 12 months will be presented at the meeting. Drainage works in Day Street, Lockhart is progressing well, and is over 95% complete. This drainage will reduce the effect of local stormwater runoff impacting along the kerb & gutter in the CBD and is expected to take another week to complete.

ii. Flood Claim: Works on the programme for 2013/2014 for the March 2012 Local Roads has been completed. Final approval of the works/payment currently being resolved with RMS.

iii. Flood Mitigation: See separate report in the business paper.

iv. Road Safety Officer: Nil to report.

v. Traffic Committee: Traffic Committee Meeting to be held 14 August 2014.

8. NOXIOUS WEEDS (DEES/N10-025) Executive Summary Monthly report on Noxious Weeds. Report Property Inspections Re-inspections on properties were encouraging as the majority of property owners were obliging in regards to weed control. Some herbicide applications were not completely successful due to climatic conditions, but owners have been agreeable in continuing future control or re-approaching their weed control methods. The weeds most commonly found were Privet (Ligustrum sp.), Coolatai grass (Hyparrhenia hirta), Prickly pear (Cylindropuntia sp.), Bridal creeper (Asparagus asparagoides), and Horehound (Marrumbium vulgare). Small infestations also included Wild radish (Raphanus raphanistrum), Sweet briar (Rosa rubiginosa), Willows (Salix sp.), Green cestrum (Cestrum parqui), Blackberry (Rubus fruticosus), Cape broom (Genista monspessulana), African boxthorn (Lycium ferocissimum) and Galvanised burr (Sclerolaena birchii).

Spraying has also occurred in the shire’s gravel pits and tips to eradicate weeds and eliminate the spread of weed seeds from these high traffic areas. 9. PARKS AND GARDENS REPORT (DEES/P10-005)

Executive Summary Monthly report on Parks and Gardens. Report General Maintenance Regular duties include inspections of parks and public facilities to remove litter, clean BBQ’s, check for damage or vandalism, clear footpaths and empty public and roadside bins. Most areas undergo inspections twice per week, including Galore Hill, where crews also clean and check the toilet facilities. Contract cleaners attend to the public toilet facilities in Lockhart, The Rock and Yerong Creek. The bird aviary at Hodgson Park is cleaned weekly and display branches are also replaced. Playgrounds in the shire are being inspected regularly as per Australian Standards, with any maintenance being noted and completed as necessary. Brookong Creek Grant Council has received grant funds to remove woody weeds from the Brookong Creek within the Lockhart town limits. Crews have removed a large number of Peppercorns and African Olives that have escaped from local gardens and Council street plantings. Both these species are spread by birds which often drop the seed at the base of existing native vegetation, the new species then competes with the native species for water and nutrients. Control of these weeds will be ongoing. Tube stock has been ordered for planting in a number of areas along the creek to enhance the area for use by locals and the biodiversity of the understory. Lockhart schools have been invited to assist with the planting to raise awareness of the local environment and National Tree Day. Works are currently on hold pending final agreement of location of planting and species. Further information on locations and species will be provided at the meeting. Lockhart Town Clock The master controller was been repaired and returned, and it has been refitted. Clock now appears to be keeping time accurately, however due to ongoing upgrade work at the Museum there could be power outages which will interfere with the clock and require manual adjustment. Caravan Park The AAA Star Rating Group has recently completed their annual inspection. Lockhart Caravan Park has been awarded a 3 star rating this year, up from 1.5 stars last year, as recognition for the improved facilities now provided. Pleasant Hills Preschool/Community Hall Playground A grant of $25,000 has been received to replace the current playground equipment at the Pleasant Hills Hall. Council has removed the existing equipment and the new equipment, including triple swing, kangaroo rocker and multi activity unit with slide have been installed by contractors. Council crews then topped up the softfall. Shade sail still to be modified and reinstalled. Lockhart Recreation Ground Playground A grant has also been received to refurbish/upgrade the playground at the Lockhart Recreation Ground. A contractor has been chosen and the purchase order processed. Installation is scheduled for September. Refurbishment will included replacement or upgrading of parts or equipment to bring them up to current standards, replacement of faded plastic panels and components, and the painting of faded/scratched steel poles and components.

Mowing and Slashing Mowing of irrigated areas has slowed to approximately monthly. Irrigation has been reduced or stopped in most areas. Scheduled winter slashing of town streets and facilities has started including town entrances and streets in Lockhart, The Rock, Yerong Creek and Milbrulong. Trees Pruning of the shires numerous Peppercorns and formative pruning of juvenile specimens has continued. Crews have also been pruning overhanging tree limbs in town laneways. Cemeteries Lockhart, The Rock and Yerong Creek cemeteries have received a general tidy up including spraying, removal of dropped branched and the removal of some self-seeded peppercorns at Yerong Creek. Parks and Gardens The shires Roses have been pruned and fertilized. Routine maintenance is being conducted including regular weeding, spraying, pruning, watering, planting/transplanting and mulching. Whippersnipping and edging of irrigated areas is being conducted has been reduced to monthly or as required due to the cooler weather. Playground softfall maintenance will be scheduled for The Rock and Yerong Creek after an extended period of drier weather. Pleasant Hills was attended to when the new equipment was supplied and installed. Weed Control Regular weed control is being conducted on Council property including hand spraying and weeding of gardens. 11. FLOODPLAIN RISK MANAGEMENT REPORT - LOCKHART AND THE ROCK

(DEES/F20-031 & F20-032) Executive Summary Following the devastating floods of 2010 & 2012 a Flood Study & Floodplain Risk Management Plan has been undertaken of both Lockhart and The Rock townships. The next stage is to commence implementation and detail the recommendations from these reports. Background Information At its July 2014 meeting Council adopted the completed Flood Study (FS), Floodplain Risk Management Study and Floodplain Risk Management Plan (FRMS&P) for both Lockhart and The Rock. A summary of the main recommendations for each town are listed below: Lockhart: - Option C2 – 10m wide drain along Brookong Street. Included in this option is to look at ways

to divert water east of Lockhart around the town rather than wide drain along Brookong Street.

- Option G3 – raised and extended levee along the southern side of Government Dams - Council to investigate and design additional stormwater drainage in the vicinity of railway line,

Treasure Street and Reid Street to assist in reducing localised flooding - Vegetation Management in Brookong Creek to prevent blockage impacts on flood behaviour - Develop policies and database for general maintenance of drainage infrastructure - Conduct a feasibility study in possible Voluntary Purchase (VP) of properties situated in the

Brookong Creek floodway - Include requirements for flood proofing for new development in development controls - Improve and implement flood warning including severe weather warnings on Council

Website, automatic rain gauges within the catchment, in stream warning gauge at Hollies Road and other areas, and use of community persons to act as Local Flood Wardens

- Update local flood plans, emergency management and safe access during flooding, including community education on preparedness

- Update Flood Planning Area maps for development control and include in new LEP, including introducing a Flood Policy.

The Rock: - Option N4/D2/U1 – levee at Nicholas Street and improved drainage downstream as well

improve culverts at Urana Street on Braithwaites Creek - Option S4/DD2 – upgrade the drainage underneath the Great Southern Rail Line and

Olympic Highway, and replace private access bridge as well as new drainage channel on Davidson Street

- Option ED3 – increase drainage capacity on Emily Street - Develop specific flood contingency for Emily Gardens - Vegetation Management in Burkes Creek to prevent blockage impacts on flood behaviour - Develop policies and database for general maintenance of drainage infrastructure - Conduct a feasibility study in possible Voluntary Purchase (VP) of properties situated in the

Burkes Creek floodway - Include requirements for flood proofing for new development in development controls - Improve and implement flood warning including severe weather warnings on Council

As there is still quite some way to go in the whole Flood Study and mitigation implementation process it is suggested that the previous Flood Study community groups are invited to work with Council Staff on not only prioritising recommended options but also the detail of the flood mitigation measures. It is intended these community groups, as with the recently completed studies, will provide input into the detail and priority of each recommendation. The extent of progress for each recommendation will be contingent on funding available, whether it is external or internal funding stream. Integrated Planning and Reporting Reference: D3.1.3a - Complete Flood Studies for Lockhart and The Rock. Legislative Policy and Planning Implications Nil. Budget and Financial Aspects The costs of some of the recommendations are eligible for funding from OEH with 6:1 ratios grants. Other recommendations will require future budget consideration from Council. Attachment Nil. Recommendation: That: a) Council endorses the Director Engineering & Environmental Services to invite the previous

Flood Study groups for each town to work with him on listing priorities and detailing mitigation options recommended in the reports

b) any priorities made and options recommended be approved by Council prior to any action being undertaken.

13. APPLICATION TO VARY COUNCIL POLICY - BUILDING LINE SETBACKS(DEES/P25-005) Executive Summary An application has been received from Mr & Mrs Bouma (Applicant) requesting Council to vary its policy “Building Line Setbacks” – to permit a 25m2, 2.2 metre high open carport with colorbond roof, to be erected to the front of the building line of their property at 26 King Street, The Rock (Lot 6 Sec 6 DP 977904). Report An application was lodged with Council on 7 August 2014 seeking consent to construct a new, open-walled carport in front of the building line to the primary road of the above described land. The site contains a modern brick veneer dwelling, set back approximately 10 metres from the front boundary. In accordance with Policy 2.19, in any case where two dwellings are not located within 40m of the Lot, Council fixes a building line setback of 10 metres (the size of the Lot being greater than 1500m2). Building line setbacks are enforced to assist in maintaining the aesthetics of streetscapes; in this instance, Bretton Street. Currently, there are no other buildings along Bretton Street that encroach upon the building line, and the large nature strips, manicured lawns and large street trees make for an appealing streetscape. A site plan submitted with the letter shows that the proposed carport is located off to the side of the house and garage, as a continuation of the concrete driveway, and will be set approximately 4 metres behind a 1500mm colorbond fence which runs along the property boundary. This will place the proposed carport approximately 6 metres in front of the building line of the dwelling. Photos of the site (attached) reveal that the No. 26 King Street is well screened with natural vegetation, allowing it to better blend in with its surroundings. While the property owners claim that vegetation will be used to screen the carport from view, which is very likely when travelling down Bretton Street from the north, this will be difficult to achieve when entering Bretton Street from the south. Cars parked in the carport will be easily visible when travelling in this direction. Council will need to consider its preference to have the cars parked inside the property boundary, as opposed to along the road, across the nature strip or in the driveway; as such actions will have a far greater impact on the aesthetics of the street, and will detract from the appeal of the dwelling. The owners also claim to have other possible, but less desirable locations for the proposed carport; however they will involve a secondary entrance to the property involving a vehicle path of travel across the grassed nature strip. Providing a secondary access to the property is far from ideal, particularly if it is not going to be sealed. Integrated Planning and Reporting Reference D3.2.1.c - Ensure the construction and maintenance of buildings and other structures within the Shire comply with appropriate standards.

Legislative Policy and Planning Implications The Environmental Planning and Assessment Act 1979, sets out certain criteria for the consideration of a development application under Section 79C. With regard to this request the matters for consideration of relevance are: i. the likely impacts of that development, including environmental impacts on both the natural

and built environments, and social and economic impacts in the locality; and ii. the suitability of the site for the development. The likely impacts are as stated above, in that the proposed location of the carport is considerably forward of the building line, and will be easily visible for road users travelling in a northerly direction along Bretton Street. The proposed carport will of an open construction, and the owners plan to use roofing material that will match that of the dwelling, in an attempt to create some degree of uniformity. It will also allow the owners to utilise their existing concrete driveway, as opposed to creating a secondary entrance to the property. The proposed building location requires a variation to Council’s Policy 2.19 Building Line Setbacks. Budget and Financial Aspects Nil. Attachments 1. Letter of request from applicant and associated proposed plan. 2. Photographs of proposed site (3). Recommendation: That Council give consent for the application from Mr & Mrs Bouma to erect a 25m2, 2.2 metre high, open carport in front of the building line of 26 King Street, The Rock, with the following conditions: a) That the proposed development be submitted to Council as a development application; b) That a standard conditions apply to the Development consent requiring:

i) that all walls of the carport are to remain open; ii) that the carport roof be of matching colour and material to that of the dwelling; and iii) that the carport remains screened from view through planting of native vegetation.
