Chairman welcomed the participants and gave a brief background of the

6. Trl8 Chief Executive stressed to accelerate the progress of

acquisition of land as the delay would add to the cost which may go out of reach

of the government employees. The LAC Informed the committee that award for

acquisition of land of Sector G-15/3 has been announced on 29.05.2008 beinu

acquired to rehabilitate the affectees of the area. The Chief Executive also

directed for early resolution of issue of assessment of built up structures and

constituted a task force comprising the following for expediting the acquisition,

assessment of BUilt up Property and getting possession of land to take up

development work:

Director Planning, CDA gave the assurance that revised layout plan

AGENDA ITEM NO.4 MATTERS PERTAINING TO DEFAULTERS OFPHASE-III.

11. Director General Housing Foundation explailled the efforts made :"l)

far regarding recovery of outstanding dues from the defaulters of Phase-III The

Committee expressed concern on the issue especially that how after passage of

morethan 10 years of the launching of scheme, the dues have not been paid by

all the allottees. It directed the Housing Foundation to give list of defaulters III

newspaper and approved the following:

i) The surcharge of 1% already imposed on cost of raw land

may be enhanced to 2% per month on the defaulted amount

with effect from 01.08.2008

ii) To impose surcharge @ 2% per month on defaulted amount

of development charges w.e.f. 01.08.2008 after giving fillal

notice to clear their dues by 31s: July 2008.

Iii) In case all these defaulters do not clear their dues by

31.12.2008, their allotments may be cancelled without any

further notice

12 Thp- Executive Committee gave appreciation to the four member

Sub-Committee for its efforts and approved the revised Service Rules of the

F.G E. Housing Foundation with the following amendments in Schedule II.

The words "Terms and conditions to he dpclcJerl hy tI,~

Government" to be indicated under column "Oualiflcations and Experience"

agalilst Sr.1 as Chief Operating Officer.

13. Chairman also directed Foundation to Include posts of Tehsildar

and Gardawar alongwlth their mode of Appointment InclUding Oualification and

experience.

AGENDA ITEM NO.6 BUDGET ESTIMATES OF HOUSING FOUNDATIONFOR THE FINANCIAL YEAR 2008-2009.

14. The Executive Committee expressed its satisfaction on the efforts

made by the Director General in ensuring financial diSCipline in the organization

The Chairman asked Director General to ensure adequate provision for pay

increase and enhanced strength. The Committee approved the budget estimates

of the Houslllg Foundation amounting to Rs.3982.213 million for the year 200()-

2009.

AGENDA ITEM NO.7 BANKING FACILITY FOR HOUSING FOUNDATION.

15. DG(HF) explained the present banking facilities available for,

allottees after shifting to its new building. This included provIsion of a banking

facility on the premises, convenience of on-line banklflg throughout the country

and ensuring timely credits of deposits. He further informed that the performance

of present bankers, Bank Alfalah Ltd had been lacking in various aspects hew ~

Foundation obtained proposals from various banks In this regard. The

comparative analysis was discussed in the meeting and it was decided to appoint

Askari Bank Limited as Bankers to Foundation. Chairman directed to get

maximum banking facilities for the allottees and for charging a reasonable rent

from the bank for the space provided to them.

AGENDA ITEM NO.8 ENHANCEMENT IN THE SANCTIONEDSTRENGTH OF HOUSING FOUNDATION.

16. The Director General Housing Foundation explained that the

present strength of 105 personnel was inadequate to cope with the work load

3nd requested to sanction additional posts. The Chairman directed to include the

posts of Gardawar and Tehsildar in the revised strength raising to make 133. /--Ie

alsodirected for adjustment of the staff already working on contract if otherwise

eligible and new recruitment to be made in most transparent and fair manner.

The Committee unanimously approved the reVised strength of the Housing

Foundation.

AGENDA ITEM NO.9 HOUSING SCHEME IN REGI LALMA TOWNSHIP,PESHAWAR.

17. The Committee was informed that in March 2007, 4 Category-I

plotsof Housing Scheme in Regi La/ma Township were cancelled whereas no

action was taken against few other defaulters. It was proposed that In order to

givea fair treatment to all the allottees it would be appropriDte, that the arbitranly

cancelled plob may be restored and their allotteos given a chance to cloor OWlr

dues within one month and upon their failure to clear the dues. their allotments

may be cancelled. Similarly the allotments of those 86 defaulting allottees who

havenot cleared their dues despite notices may be cancelled as decided by the

Executive Committee in its 95th meeting held on U5 U1.LUU8. It cllsu directed lh,~t

Foundation should publish the names of those 86 allottees who have not yet

cleared their dues in newspapers before canceling the same.

AGENDA ITEM NO.1 0 REQUESTS OF MIS .MUHAMMAD SADIQ ANDBASHIR AHMED KHAN FOR ALLOTMENT OFPLOT IN HOUSING SCHEME, PHASE-IV.

18. The issue was discussed in detail. The committee observed that

allotment of a plot I apartment / house was a service benefit and no governmc. It

servantshould be debarred if he manages to get a plot or house through savings

or inheritance. It directed Housing Foundation not to include any such clause in

ilsfuture phase.

19. The Committee approved the cases of Mr. Muhammad Sadiq and

20 The Committee unanimously approved the proposal. The Chairman

directed Housing Foundation to keep adequate provision of plots to otlv-:r

government servants who have died in service In this or next phase.

AGENDA ITEM NO.12 WELFARE FOR THE OFFICERS/OFFICIALS OFTHE FEDERAL GOVERNMENT EMPLOYEESHOUSING FOUNDATION -(1) ESTABLISHMENTOF WELFARE FUND. (II) GRANT OF RE-IMBURSABLE LOAN. (III) CREATION OF C.P.FUND.

21. The Chairman congratulated Housing Foundation for making

welfare fund rules, pension and C.P fund rules for the employees of Housing

Foundation. He further directed for providmg maximum facilities to the

employees. The Committee unanimously approved the (I) Constitution of Welfare

Fund. (II) Rules for Grant of Re-Imbursable Loan. (III) Creation of CPo Fund.

AGENDA ITEM NO.13 REQUEST OF MR. AAMIR ILYAS RANA Fur{ALLOTMENT OF HIGHER CATEGORY OF PLOTI.E. FROM CAT-IV (30FT X 60 FT) TO CATEGORY-III (35 FT X 70 FT) UNDER JOURNALIST QUOTA.

22. The request of Mr. Aamir Ilyas Rana was not approved as it was

not routed through Ministry of Information & Broadcasting and was against the

rules formulated for Phase-III.

AGENDA ITEM NO.14 RECOMMENDATIONS OF THE NJPMC FORPROVISION OF HOUSING FACILITY TO THELAWYERS COMMUNITY.

23. The Committee unanimously rejected the demand of NJPMC for

provision of housing facility. The Chairman directed that the demand be met

through Pakistan Housing Authority in its new scheme being launched.

ADDITIONAL AGENDA ITEM

24. The case was discussed in detail. The Chairman said that the cut

off line should have been a multiple of 1000 as was given in the brochure and It

does not appear logical to have a cut off price other than one which is not a

multiple of 1000. the committee decided to give a chance to the highest bidders

of plot 2A, Bazar NO.2, G-13, to rise their bid to RS.63000/- per s.yds and fulfill

the remaining conditions.

25. The meeting ended with a vote of thanks for the Chair.

EMPLOYEES SERVICE RULES

In pursuance of the provIsions of paragraphs IV-B(d) and VII/(h) of the

Memorandum and Articles of ASSociation of the Feder-ai Government Enlployecs

Housing Foundation and with the approval of the Board of Directors. the following

service rules are hereby made for regulating the terms and conditions of service.

together with matters connected therewith or ancillary thereto, of the employees

CHAPTER I - GENERAL

Short title and commencement

1 1 These rules rnay be called the Federal Government EmployeesHousing Foundation Service Rules, 2008'

3. Interpretation - The Board of Directors shall be the final author-Ity for the

interpretation of these rules.

4. Definitions - In these rules, unless there IS anything repugnant In the

subject or context

4.1 "Foundation" means Federal Government Employees HousingFoundation

4.2 "Government' means the Federal Government of Pakistan

4.3 "Ordinance" means Companies Ordinance, 1984

44 'Board" means the Board of Directors of the Foundation

4.5 "Executive Committee" means Members of the Board of Directors

4.6 "Company Secretary" means Secretary of the Board of Directors

4 7 "Headquarters" means the registered office of Federal GovernrnentEmployees Housing Foundation, Islamabad.

4.8 "Chalrman" means the Chairman of the Board

4 9 "Chief Executive" means Chief Executive of the Foundation

4,10 "Chief Operating Officer" means the Chief Operatlllg Officer of tilL'Foundation

4.11 'Appointing Authority" means the authority authorized by the Board!Chief Executive

4,12 "Competent Authority" means the authOrity in which a particularadministrative or financial power is vested or any other author-Ity towhom such power is delegated under these rules.

4 13 'Departmental Selection Committee (DSC)" means a Committeeconstituted by the Board of Directors of the Foundation for thepurpose of selection for appointment by initial appointment ortransfer

4.14 "Departmentai Promotion Comnllttee (DPC) rneans a Committeeconstituted by the Board of Directors of the Foundation fOI tilepurpose of recommending promotion

4 15 "Employee' means an Incumbent of a post. Including adeputatlon/st or a contract employee In the Foundation.

4 16 "I nltlal Appointment means appointment made other thanpromotion or transfer

4.17 "Contract Service" means service for a specified contract for :1limited period and on the terms clnd conditions specified In lil('contract

4 18 "Probation" means appointment In the prescribed manner against asanctioned post for a specified period, on satisfactory completion ofwhich the employee is entitled to be confirmed, or as otherwiseprescribed.

4.19 "Pay Scales' means the pay scales prescribed by the Board

4.20 "Month' means a calendar month

4.21 "Schedule" means Schedule to these rules

4.22 "Duty" means and Includes -

(a) Service as probationer' but not a period of training, if anybefore appointment to a post

(b) Joining time

(c) Period of training In or outside Pakistan after becofiling allemployee

(d) Period occupied In attending offiCially authorlL'ccJ LJlld

obligatory examinations

(e) Period during which an employee is on actual duty (includlllgrest days and official holidays) as well as on leaveauthOrized by the Competent Authority However.authOrized leave without pay shall be excluded from theperiod of duty for the purposes of calculating earned leaveand pensionable service.

CHAPTER II - DESIGNATION OF POSTS, PAY AND ALLOWANCESAND LOANS AND ADVANCES

5. Designation of Posts The designations of various posts In thE;

Foundation shall be as decided by the Foundation from time to time with the

approval of the Board of Directors

6. Classification of Posts - Each sanctioned post In the Foundation shall

be classified Into one or more of the pay scales.

7. Pay - An employee appointed to a post shall be entitled to the pay

prescribed for such post and any special pay deputation pay etc. that rnay be

classed as pay and allowed in individual cases In accordance with the rules

Provided that where an employee has. under an order, which IS latel' set

aSide, been dismissed or removed from service or reduced in rank he shall, on

8. Fixation of Pay and Grant of Annual Increments - Subject to SllCh

10 Allowances and Honoraria

be entitled to dally allowance at the rates as prescribed by the Board from tlrlle to

time

13. Stay in hotels, rest houses etc. - Any employee during offiCial tOllr

shall be paid equal to three times of DA as room rent charges Without production

of any bill I receipt If however, the room rent charges In respect of Chief

Operating Officer or equivalent are in excess of the maximum ceiling. fifty per

cent of the additional amount will be paid by the Foundation.

14 Self-controlling officers - For the puq)ose of TA/DA offlcer's of the

Foundation will be self-controlling officers. However. Chief Operating Officer

shall countersign all such bills. With regard to other employees. the TA/DA bills

will be initiated by 000 and countersigned by Company Secretary Tile Chief

Operating Officer, where considered necessary in the Foundation's interest. rnay

permit travel In a higher class.

15. Local travel - In the case of local travel. a distance allowance would be

paid to different categories of employees for different modes of travel. at tile

rates to be fixed by the Foundation from time to tlille

16. Other journeys - An employee who is summoned in his official capacity

by a court of law or any other authOrity in Pakistan. shall be entitled to traveling

allowance as on tour. However. any payment made by the authority summoning

him to meet his traveling expenses shall be refunded to trle Foundation

18. Loans and advances - Loans and advances. may be granted to the

ernployees of the Foundation for the purchase of a motor car, motorcycle. bicycle

CHAPTER III - APPOINTMENTS, PROMOTIONS. PROBATIONAND SENIORITY

19 Creation of Posts - The Board of Directors shall have full powers to

create or abolish any post subject to the budgetary pr-ovlslons

20. Appointments

26. Probation

Persons appointed by initial appointment, promotion or transfershall be on probation for a period of one year The period ofprobation may be curtailed for good and sufficient reasons to berecorded or if considered necessary, it may be extended for aperiod not exceeding one year as Illay be specified at the time ofappointment. On the successful completion of the probation period.the appointing authority shall, by specific order, terminate the

probation period. If no order IS Issued on expiry of the first year ofprobation, the period .of probation shall be deemed to have beensuccessfully completed.

27. Confirmation - On satisfactory completion of the period of probation

28. Seniority

28.1 The appointing authority shall cause a seniority list of all theemployees to be prepared separately for each grade / category andcirculated departmentally If no representation or objection isreceived within fifteen days of its receipt, the seniority of theemployee shall be deemed to be reckoned according to the listHowever. nothing therein contained shall be construed to conferany vested right on an employee to a particular seniority In anycategory

28.2 Seniority on initial appointment to a category shall be determined Inthe manner prescribed in the relevant rules applicable to the Civilservants of the Government

29. Promotions

29.2 The method of appointment (whether by initial appointmenttransfer or promotion), and the conditions of eligibility for promotionin respect of various posts to the Foundation shall be incorporatedIn Schedules-I to III to these rules. subject to any changes oramendments that may be made therein With the approval of Boardof Directors from time to time.

30. Ineligibility for Re-employment

30.1 No person who has been dismissed from the service of tilegovernment, provincial governments, Foundation, an autonomous /semi-autonomous body or who is convicted of a criminal offence bya court of law, shall not be re-employed by the Foundation

30.2 Re-employment of an employee beyond the age of superannuationshall not be made except with the approval of the Board and onsuch terms and conditions as may be prescribed by theGovernment from time to time for this purpose

31. Retirement - All employees of the Foundation shall retire from service of

the Foundation on attaining the age of sixty years or voluntarily on completion of

twenty-five years of qualifying service

32. Clearance Certificate - On leaving the sel.vice of the Foundation and on

proceeding on deputation or on leave preparatory to retirement, an employee

must obtain a clearance of a "No Demand' certificate from the Foundation before

leaving duty

CHAPTER IV - POSTINGS AND TRANSFERS, DEPUTATIONS,TRAINING, LEAVE AND JOINING TIME

33. Postings and Transfers - The Foundation may post or transfer any

employee under the administrative control of the Foundation to serve anywhere

in Pakistan

34. Deputation - An employee of the Foundation may be deputed or lent to

any other body or department on such terms and conditions as may be rnutually

agreed between the Foundation and the borrowing organization

35. Training - The Foundation may require an employee to undcrCJo lldlllllH}

within or outside Pakistan at any time and for any duration, on such terms and

conditions as it may specify from time to time.

36 Leave

361 A!7 employee shall be e!7t1tled to such leave /nclud/ng leavepreparatory to retirement, as is admissible / applicable to a CIvilservant of the Government under its leave rules, as amended fromtime to time. The grant of leave will depend on the exigencIes ofservice and will be at the dIscretion of the competent authority

362 An employee who overstays his leave except under circumstancesbeyond his control for which he must render satisfactoryexplanation shall not draw any emoluments for the period of theoverstayal He shall also be liable to diSCiplinary action for breachof discipline, and the period of overstayal may constitute a lJreak Ii)serVice unless regularized by the competent authority.

37. Joining Time

37.1 The employees shall be entitled to seven days JOining time ontransfer from one station to another'

37.2 An employee on JOining time shall be regarded as on duty and shallbe entitled to the pay which he would have drawn if he had notbeen transferred or the pay which he Will draw on taking charge ofthe new post. whichever is less.

37.3 An employee who does not join his new post Within his JOining timeis not entitled to any payor leave salary after the end of the jOiningtime. Willful absence from duty after the expiry of joining time maybe treated as misconduct.

37.4 Not more than one day is allowed to an employee to Join a newpost when the appointment to such post does not necessarilyInvolve a change of residence from one station to the other Aholiday counts as a day for this purpose

CHAPTER V - RESIGNATION, TERMINATION OF SERVICE,RE-EMPLOYMENT AND RETIREMENT

38. Resignation

38.1 An employee wishing to terminate his appointment in theFoundation will submit his resignation in writing.

38.2 The appointing authority may in Its discretion accept pay for fifteendays in lieu of notice or an amount equal to his pay for theunexpired period of the notice period if the employee so requests

38.3 Acceptance of resignation will be subject to recovery of any dues ormoneys recDveiabJe lio/77 the empJo)/C't?

38.4 The resigning employee shall continue to perform his duties in theFoundation until such time as hiS resignation is formally accepted

38.5 No resignation shall be deemed effective during the pendency ofany disciplinary proceedings against the resigning employee

38.6 The appointing authority may, at Its discretion and in the interest ofthe Foundation, refuse to accept the resignation of any employee

38.7 In case an employee wlthdr-aws his resignation before ItSacceptance by the appointing authority, the resignation shall bedeemed to have been withdrawn

38.8 If an employee withdraws his resignation after its acceptance by theappointing authority but before it becomes operative (ie before theemployee is relieved of his duties in the t=oundation), it will be opento the appointing authority to allow the employee to withdraw hisresignation on the merits of the case

38.9 Resignation, other than a resignation to take up anotherappointment entails forfeiture of past service

39. Termination of Service

39.1 The service of an employee may be terminated without notice In thefollowing cases-

(I) During the initial or extended period of his probation.provided that, where such an employee is appointed bypromotion, he shall be reverted to his lower post

(II) In case of contract employees as per terms and conditionsof his contract

(iii) On the abolition of post or reduction In the number of postsservice of Junior most in that grade shall ordinarily beterminated.

(iv) On the expiry of the initial or extended period of hisemployment

39.2 The service of an employee in temporary employment shall beliable to termination on fifteen days notice or pay in lieu thereof

CHAPTER VI - CONDUCT, PUNISHMENT AND APPEALS

40. Conduct

40.1 Every employee_shall undertake in writing to conform to and abideby these rules and obey all lawful orders and directions which may.from time to time, be given by any person or persons under whosejurisdiction, superintendence or control he may, for the timp hcin(jbe placed.

42. Suspension - The employee guilty of misconduct may be placed under

suspension for an offence which if established may lead to his dismissal or

removal from service. In the first place, no employee shall be placed under

suspension except when it is really necessary.

44. Medical Allowance - Employees from BS 1-16 shall be paid medical

allowance at the rate as prescribed by the Federal Government from time to time

45. Reimbursement of Medical Charges - As per Federal Government

policy.

46. Hospitalization - All employees shall be entitled to reimbursement of

hospitalization charges (designated hospitals). for themselves and their families

as defined in para 50 below. All such expenditure on hospitalization shall be

authOrized by the Foundation.

47 Treatment after discharge from hospitalization The cost of

medication, tests and consultation fee In connection with the same illness, If it IS

part of hospitalization of an employee or any member of his/her family

discharged from the hospital but require treatment as an outdoor patient, shall be

reimbursable on the authorization of a committee consisting of two Directors and

an Accounts Officer. The Committee while considering such cases shall also

consult the Medical Consultant appointed / nominated by the Foundation If the

claim pertains to any member of the Committee, the Foundation shall nominate

another member in his / her place

48. Treatment for prolonged illness - The cost of medication, tests and

consultation fee in connection with a prolonged JJ)ness of an emp)oyee, sha)) be

constituted by the Foundation as indicated in para 47 above.

49 Medical insurance - The Foundation may get a medical insurance cover

in due course and in that case the entitlement of hospitalization shall be sUitably

amended. The details of SUCll cover shall be notified by the Foundation f, om

time to time.

50. Family - For the purpose of thiS chapter the term "Family" Includes,

spouse, legitimate children, parents residing with and wholly dependent upon the

employee

CHAPTER VIII - SERVICE RECORD

51. Record of Service

51.1 The service record of each employee shall be maintained by theAdministration Section in such form as may be prescribed by theFoundation.

51.2 Annual confidential reports about the work and conduct of eachemployee except employees In scales 1 to 4, shall be recorded Insuch form as may be prescribed by the Foundation

51.3 The annual confidential reports shall pertain to each calendar yearand their initiation, completion. counter-signature etc shall becompleted by the end of February, following the year of report

51 4 The minimum period for which confidential report shall be writtenWill be three months

51.5 The adverse remarks, if any, in these reports shall immediately becommunicated to the employee concerned in order to give him anopportunity of representation against adverse remarks or to correctIllmself.
