DeSoto County Ozone Nonattainment
• The northern portion of DeSoto County was designated nonattainment for ozone on May 21, 2012.
• Mississippi filed a Petition of Reconsideration with EPA on July 17, 2012.
• Mississippi also filed a Petition of Review with U.S. Court of Appeals for the District of Columbia on July 18, 2012.
• The final designation was issued on July 21, 2012.
• EPA will propose a new ozone standard in late 2013.

PM Standards• Current primary and secondary PM2.5 standards are:
Annual = 15 µg/m3
24-hour = 35 µg/m3
• On June 29, 2012, EPA proposed an annual PM2.5 primary standard of a range between 12-13 µg/m3 and to retain the 24-hour standard of
35 µg/m3.
• EPA also proposed a secondary visibility PM2.5 standard of 28 or 30 deciviews.
• The 24-hour PM10 standard was proposed to be retained at 150 µg/m3.
• Mississippi submitted comments on these proposed standards on August 29, 2012.
• EPA is required by a court order to promulgate the final standards by December 14, 2012.

Title V Updates
• In 2012 Legislative Session, the state law was changed to remove the $250,000 cap on annual fee. The $250 minimum remained unchanged.
• The Title V Fee for Fiscal Year was set at $36/ton.
• Billable Tons continue to decline. 10
NSR Update
• December 14, 2011- Adopted GHG Biogenic Deferral which deferred the application of Title V and PSD/NSR permitting requirements on biogenic CO2 emissions for 3 years.
• April 28, 2011 – Adopted PM2.5 as a regulated pollutant. SO2 and NOx are precursors. Condensable PM2.5 (and PM10) must be included.

MACT Update
• Area Source Boiler MACT - EPA issued a No Action Assurance letter extending the time to complete the initial tune-ups until December 31, 2012, or until promulgation of the reconsidered rule, whichever is earlier. The proposed reconsidered rule actually extends the initial tune-up date until March 21, 2013. This NAA letter also extended the time required to submit the Notification of Compliance Status report as well. The NAA letter for area sources is linked on the Air Division's Home Page.
• Major Source Boiler MACT - Since the Court vacated EPA's stay on the requirements of the rule, EPA has issued a No Action Assurance letter that delays compliance with the rule until December 31, 2012, or until promulgation of the reconsidered rule, whichever is earlier. The NAA letter for major sources is linked on the Air Division's Home Page.

Cross State Air Pollution Rule (CSAPR)
• Vacated by DC Circuit Court August 21, 2012
• CAIR will continue to be administered• Could take years to resolve• Impacts Mississippi Regional Haze SIP
– The CSAPR better than BART determination and limited disapproval determinations by EPA may not have a legal basis.
– The facilities impacted by CSPAR are the Utilities.

Diesel Emissions Reduction Grants• Mississippi School Bus Retrofit Project
– Retrofitted school buses with Diesel Oxidation Catalysts, which reduce 40% of PM, 40% of CO and 70% of Hydrocarbon tailpipe emissions
– Retrofitted over 1,930 buses in 107 school districts
• FY 2009 – 2011 DERA State Grant– 2010 Assisted owners of 65 heavy duty diesel trucks to
purchase Auxiliary Power Units (APU) – 2011 & 2012 Assisted 20 public & private organizations
with projects
For 2013, MDEQ will except proposals from public & private organizations. Emphasis may be given to projects involving commercial marine fleets.
