The following information is being presented for the purpose of District Board monitoring of their Presidential Parameter policies #4HEE0100, Employment; #4FAF0300, Accounting; #4FFF0200, Investments; and their Desired Outcomes Policy #1TFT0200, Educate for Employment – Economic Development Contracting.

A. Employment

Resignations/Terminations

Raquel Boix-Pawlak, English Language Learning Project Specialist, submitted her resignation effective October 13, 2017. Raquel had been with the College since February 2015.

Recruitment – Support Professionals

Disability Resource Specialist/Interpreter, West Bend Campus. This full-time position was created when Mary Martin submitted her resignation. This position provides a variety of support services and sign language interpreting services to students with disabilities on various campuses. This position was posted internally/externally until filled.

Multicultural Student Support Specialist (Bilingual), West Bend Campus. This full-time position was created when Nicolle Schroeder submitted her resignation. This position’s primary function is to provide supportive services for outreach, recruitment, enrollment and retention of targeted multicultural student populations. This position was posted internally/externally. After interviewing and screening, Kevin Rodriguez was selected and his start date is October 23, 2017.

Wellness Program Assistant, Fond du Lac Campus. This new, part-time position is funded in the 2017-18 budget. This position will assist in the creation, implementation and evaluation of the wellness program for the purpose of educating and engaging employees in healthy lifestyle choices. This position was posted internally/externally until filled. After screening and interviewing, Haleigh Kaiser was selected and her start date was September 21, 2017.

Recruitment – Management/Instructional Staff

Software Developer Instructor, Fond du Lac Campus. This new, full-time position is funded in the 2017-18 budget. The primary teaching responsibility will vary within the Software Developer Associate Degree Program and included courses such as C#, JavaScript, SSQL, Web Scripting, ASP.Net and Systems Analysis. This position was posted internally/externally with a closing date of October 30, 2017.

Recruitment – Management/Instructional Staff (Continued)

Associate Dean of Economic and Workforce Development, Fond du Lac Campus. This full-time position became available when Charles Brendel submitted his retirement. This position is responsible for the operation of the Facilitate Teaching and Learning major process of the Primary Learning System, for the instructional areas of assignment, subject to the constraints imposed by the Dean of Economic and Workforce Development, MPTC District Board policy, State Board rules, laws and professional ethical behavior. This position was posted internally/externally. Interviews were held October 17, 2017.

Economic and Workforce Development Press Brake Instructor, Fond du Lac Campus. This new, full-time position is funded in the 2017-18 budget. The primary teaching responsibility for this position will be for classes in the Press Brake Boot Camp including the safe operation of press brake equipment, the use of Computer Numerical Control (CNC) programming for press brakes using Mastercam, blueprint reading and short-term training for businesses. This position was posted internally/externally with a closing date of October 12, 2017.

Dean of the Beaver Dam Campus. This full-time position was created when Dr. Matthew Hurtienne submitted his resignation. This position coordinates the Beaver Dam Campus operations with functional managers to maintain a campus culture that ensures quality programs and services and meets College strategic priorities. This position was posted internally/externally. Interviews were last held October 10 and 11, 2017.

HVAC-R Instructor, West Bend Campus. This full-time position was created with Robert Krug submitted his resignation. The primary teaching responsibility will be commercial and residential HVAC/R systems design, installation, service and repair. This position was posted internally/externally until filled.

Facilities Operations Manager, Fond du Lac Campus. This full-time position was created when Eric Hidde submitted his resignation. This position is responsible for managing all District daily building operations and maintenance functions to include supervision of the maintenance and buildings and grounds staff and also manages District facility operations to include snow removal, maintenance contracts and other procurement. This position was posted internally/externally until filled. Interviews were held September 14, 2017.

Economic and Workforce Development Industrial Maintenance Instructor, Fond du Lac Campus. This new, full-time position is funded in the 2017-18 budget. The primary teaching responsibility for this position will be for courses in the Industrial Maintenance Boot Camp. This position was posted internally/externally until filled. Interviews were held September 1, 2017.

IT Technical Support Specialist Instructor, West Bend Campus. This is a new, grant-funded position. The primary teaching responsibility will vary within the Information Technology – Technical Support Specialist Associate Degree Program. This position was reposted until filled. Interviews were held October 13, 2017.

Application Developer, Fond du Lac Campus. This full-time position was created due to the ending of the Ellucian Managed Services contract. This position designs and develops user interfaces to internet/intranet applications. This position analyzes and improves complex system logic and works with Systems Analysts and functional staff to determine user requirements and system solutions. This position was posted internally/externally until filled. Interviews were held on March 28, 2017. The College has decided to partner with TEK Systems effective April 17, 2017 on a contract-to-hire basis for this position.

ERP Developer, Fond du Lac Campus. This full-time position was created due to the ending of the Ellucian Managed Services contract. This position will work with the Senior ERP Developer to design and develop user interfaces to ERP applications. This position will work with Systems Analysts and functional staff to determine requirements and solutions. This position was posted internally/externally until filled. Interviews were held on March 23, 2017. The College has decided to partner with TEK Systems effective April 3, 2017 on a contract-to-hire basis for this position.

ERP Developer, Fond du Lac Campus. This full-time position was created due to the ending of the Ellucian Managed Services contract. This position uses budget dollars allocated for a Senior ERP Developer position that will not be filled. This position will work with the Senior ERP Developer to design and develop user interfaces to ERP applications. This position will work with Systems Analysts and functional staff to determine requirements and solutions. This position was posted internally/externally until filled. Interviews were held March 29, 2017. The College has decided to partner with TEK Systems effective April 17, 2017 on a contract-to-hire basis for this position.

BI Developer, Fond du Lac Campus. This full-time position was created due to the ending of the Ellucian Managed Services contract. This position designs and develops business intelligence objects, packages, processes and reports. This position was posted internally/externally until February 27, 2017. Interviews were last held on May 10 and 16, 2017. This position has been put on hold.

OTHER:

The interest rate National Exchange Bank and Trust remains at 1.375% for September 2017.

Annually, as required in Administrative Rule TCS 6.05(2)(h), the District will review all procurements of $50,000 or less of similar goods, supplies and services for the previous year to determine if a more competitive process should be used in succeeding years. This report will be used to evaluate continuous improvement and to strengthen cost-saving opportunities for the District. Mr. Timothy Keenan, Purchasing Manager, will present this annual procurement report as a consent item for formal Board approval.

Final audit fieldwork for 2016-17 began on September 25. The 2016-17 financial statements and corresponding reports will be presented at the December Board meeting.

A. Approval of Resolution – State Code of Ethics

Wisconsin's Code of Ethics for Public Officials and Employees applies to anyone holding a position "designated as assistant, associate or deputy district director of a technical college." At the October 19, 2016 meeting, the Moraine Park Technical College District Board adopted a resolution designating certain staff positions which are subject to the State Code of Ethics. The State of Wisconsin Ethics Commission, in correspondence dated October 10, 2017, is again requesting that the Board review prior designations and confirm or change these designations as appropriate. Therefore, the following resolution is presented for your consideration.

SUGGESTED MOTION:

I move that the Moraine Park Technical College District Board adopt the following resolution which designates the positions at Moraine Park which are subject to the Wisconsin State Code of Ethics:

WHEREAS, technical college district board members, presidents, and other key administrative staff of technical college districts are subject to the State Code of Ethics.

THEREFORE, BE IT RESOLVED that, for purposes of Wisconsin's Code of Ethics for Public Officials and Employees, Sections 19.41 through 19.59, Stats., the Moraine Park Technical College District Board designates the following positions and indicates its intention that the current occupants of these positions and their successors be subject to the Wisconsin Ethics Code:

B. Approval of Budget Adjustments – 2016-17 Budget

The following information is being presented for the purpose of District Board monitoring of their Presidential Parameter Policy, #4FBM0400, Budget Management.

Chapter TCS 7.05(7) of the Wisconsin Administrative Code requires that modifications to the District budget after adoption shall be by fund type or function within a fund type and shall be in accordance with s.65.90 of the State statutes.

Following are both fund type and function modifications which require Board action as any costs in excess of the budgeted amounts will be excluded from operational costs for State aid computations.

A net increase to the 2016-17 budget in the amount of $4,629,642 is recommended based on the level of activity. The budget changes are summarized as follows:

General Fund $2,000,000 Special Revenue (Aidable) Fund 362,266 Capital Projects Fund 2,000,000 Enterprise Funds 44,380 Internal Service Funds 222,996

$4,629,642

Function transfers in the amount of $362,266 in the Special Revenue (Aidable) Fund, $775,072 in the Capital Projects Fund, $44,380 in the Enterprise Funds, and $222,996 in the Internal Service Funds are technically required to establish budget appropriations to the level of expenditures by function. Additional transfers of $2,000,000 to the Capital Projects Fund are required to maintain General Fund reserves within the 25% cap limit.

None of these adjustments require additional local support. The operational mill rate for 2016-17 remains at .42942, and the debt service mill rate remains at .22642. In total, the mill rate remains at .65584.

C. Approval of Budget Adjustments – 2017-18 Budget

The following information is being presented for the purpose of District Board monitoring of their Presidential Parameter Policy, #4FBM0400, Budget Management.

Total $(1,219,898)

A net decrease in the amount of $491,254 in the General Fund is recommended based on an analysis of resources available, revised FTE projections, state aid allocations, and to recognize appropriation modifications for personnel and current expense. A net increase in the amount of $45,927 in the Special Revenue Fund is recommended based on the level of funded projects and grants received during the year. A net decrease in the amount of $790,888 in the Capital Projects Fund is recommended based on the adjustments of capital project and equipment expenditures. A net increase in the amount of $16,317 in the Debt Service Fund is recommended based on a revised note schedule. Based on the allowable net new construction growth rate, total tax levy from these adjustments will increase $185,264.

D. Approval of Resolution – Certification of Tax Levy

The following information is being presented for the purpose of District Board monitoring of their Presidential Parameter Policy #4FBP0100, Budget Planning.

The Moraine Park Technical College District Board adopted the budget for fiscal year 2017-18 on June 21, 2017, in accordance with Wisconsin Statutes. This budget includes the operational plan of the District as prepared by the Board and staff. Educational services will be provided to approximately 18,000 students.

The certification of the tax levy, by Statute, must be acted upon by the District Board by October 31, 2017. In addition, operational levy is capped at the District’s net new construction growth rate as certified by the Wisconsin Department of Revenue. This total is then adjusted by the Property Tax Relief Aid and may be further adjusted by no more than .5% of the prior year’s net new construction growth rate. Total levy dollars are calculated at $16,715,975. Following is a resolution for your approval.

WHEREAS, this review resulted in a modification of the budget based on a thorough analysis of resources available, a review of revenue projections and current expense and debt service appropriations, a complete revision of the personnel budget, and a change to the tax levy allocations as proposed in the budget document; and

WHEREAS, the tax levy required to support the 2017-18 budget represents a 3.05500%, or a $495,472 increase over the 2016-17 tax levy;

WHEREAS, the tax levy represents an operational mill rate on equalized value of .43178 and a debt service mill rate of .21752 for a total mill rate of .64931.

WHEREAS, the operational tax levy increase of 1.58125 % is equivalent to the net new construction rate as determined by the Wisconsin Department of Revenue.

NOW, THEREFORE, BE IT RESOLVED, that the Moraine Park Technical College District Board authorizes a tax levy of sixteen million, seven hundred fifteen thousand, nine hundred seventy-five dollars ($16,715,975) on the full value of the taxable property of the District for the purpose of operating and maintaining the schools of the District, payment of indebtedness, acquiring equipment, and making capital improvements for the year beginning July 1, 2017.

BE IT FURTHER RESOLVED, that the Moraine Park Technical College District Board pursuant to Section 38.16(1) of the Wisconsin Statutes authorizes that the aforementioned amount of levy be spread proportionately on the tax rolls for collection in each city, village, and town within the District, and that the respective clerks be informed of this action.

E. Approval of Investment Policy

The following information is being presented for the purpose of District Board monitoring of their Presidential Parameter Policy #4FFF0200, Investments.

The District Board approves and reviews the policy for Investments on an annual basis, most recently June 21, 2017. As a result of a new investment strategy, including the hiring of an investment advisor, a more detailed review of the policy was conducted. Edits have been made to simplify the policy and provide best practices regarding safekeeping and custody of the assets.

It is recommended that the Presidential Parameter Policy, #4FFF0200 – Investments, be approved as presented.

F. Resolution to Approve Board Policies

The District Board and District Administration recognize that the existing board policy governance manual is outdated and relatively complex and burdensome to administer. As such, the Board desires to create a new policy governance manual that clearly defines the roles and responsibilities for the Board and the President in a simplified format. Specifically, a new manual will be created that enables the Board to be efficient and effective with a focus on strategic leadership, but follows the basic concepts of a policy governance model to include a section on: governance process, board/staff relationship, executive limitations, and ends.

During 2017-18, the President will draft and discuss new board policies at each monthly board meeting. These drafts will be presented and discussed prior to submission for approval at subsequent meetings. The following board policies were reviewed and discussed at the September 2017 meeting and District staff are seeking approval of the same at this time:

G. Approval of Program Suspension – Legal Administrative Professional Associate Degree (10-106-3)

Rationale

Enrollment in the Legal Administrative Professional Associate Degree Program has been flat over the past five years. The program has averaged three graduates per year over the past five years.

The growing trend in this industry is that employers are minimizing their use of legal administrative professionals and moving legal-specific responsibilities such as research and writing to paralegal staff. The result is more demand and employment potential for paralegals in place of using legal administrative professionals.

In order to keep pace with employment trends in this field, the College is proposing the suspension of the Legal Administrative Professional Associate Degree Program (10-106-3).

Current students will be contacted and given ample time to complete the program. Many of the courses are shared with the Administrative Professional Associate Degree Program.

It is proposed that the Legal Administrative Professional Program (10-106-3) be suspended effective at the end of 2017-2018 academic year.

Rationale

There is a growing employment demand for paralegals in the Moraine Park Technical College District. Labor market data indicates a 14 percent increase in employment in the paralegal field within the College District (EMSI). There are currently 140 open job postings throughout the College District and over 300 open positions statewide.

To better support the employability of students and to meet the needs of District employers, it is proposed that the Legal Administrative Professional Associate Degree Program (10-106-3) be changed to Paralegal (10-110-1). Corresponding modifications will be made to the program curriculum to support the transition to a Paralegal degree. Further, this change is in alignment with other technical colleges in the state.

The College is currently in a shared agreement with Lakeshore Technical College (LTC) for the Paralegal Associate Degree Program. The College would allow this agreement with LTC to sunset at the end of the 2017-18 academic year. This modification will not negatively affect any current students. They will have the ability to complete the program through LTC or transfer their coursework to Moraine Park to complete their degree.
