Burg states corrections were made. M. McSweeney makes motion S. Grimes seconds. 13-0 in favor votes. J. LaRaia, E. Aguilera, and D. Teemsma abstain.

• Chair’s Report: Wishes to have brief discussion on 2015 and items going to potentially be
presented code updates bylaws, etc.

Elected Officials’ Reports:
Officer Adam McElroy: (Community Relations Officer) – Uptick in crime in Nov early Dec
across the board. Two commercial robberies at a 7/11 during 3 day period. Motel 6 room robbery, home depot stabbing, Residential burglaries up 40% Car burglaries 30% stolen cars up 125% (16 in Nov), Glacier Ave., Rancho Mission Rd, Reflection Dr., Wembley St., Golfcrest Dr., Jackie Dr., Mission Gorge Rd., Margerum Ave. Don’t advertise what you purchase, lock your vehicles, pay attention! You can view SDPD twitter and Facebook for latest updates.
Councilman Scott Sherman - (Ryley Webb): Quiet month, newsletter available if
interested. Council looking at Pure Water Program. Investing in potentially incorporated into SD water source. Budget surplus hopefully will go to deferred maintenance. Budget passed by Council in late Nov.
Public Comment on Non-Agenda Items (3 minutes each):
Michael Nolin: Wishes to open Coop. Called Green Door. Medical cannabis dispensary. Started
SD Einstein academy, nonprofit set up to help educate kids. Press conference in SF, San Jose
to help with gun buyback (bought back 180 guns). Comments that building is ADA compliant,
plenty of parking, and will better the community. Cycle issues just about cleared.
Chris Varond - Architect for local dispensary. Create visual depth to building where dispensary
is located. Showed drawing showing dimension of building.
Moffitt Timlake – Owner of property at 4427 Rainer. Attests to tenant. Operated dispensary in
2009 no complaints from public or police. Very secure and professional. Not currently operating.
Is very happy with tenant. D Smith asks about A&A how many improvements made over the
years in violation of the city. Building completely compliant.
Dan Northcutt - Adopted Park and looking for folks to assist in net cleanup. Paso Del Tempo.
Lots of trash recently. Suggested having a fund raiser and willing to assist. Michael Nolin.
Bob Isreal: Asks if Grantville EIR released. Not yet supposed to be in Dec. M Adams will shout
from rooftop the minute it is out.
J. Pilch – Scammers out. Suggest sign up for NextDoor.com. People supposedly from Second Chance organization scamming people and are aggressive so keep eye out for them. Watch out for packages.
INFORMATION ITEM:
Community Planning Groups Committee: Bylaws changes will need addressed, 9th update to land development code will warrant review. M. Adams thanks D. Smith for all his hard work in attending these meetings. D. Smith speaks about the meetings and their importance: 26 planning groups, high level planners, SANDAG, Development Services. Zoning changes – 4th changes coming up; parking regs has caused property values to plummet. Has letter he wishes for NCPI to review and bless. Frustrated with planners and various zoning changes. Wishes to get back to old business including flooding problems. Would like to invite Bill Harris to speak to NCPI about flooding problems. Second, use of clean water including wells. Would like to invite someone from Clean Water shop to speak with NCPI. Lastly, invite SANDAG. Invites all in attendance to Community Planning Groups Committee meetings. M Adams thinks it a great idea to invite SANDAG to see about transit funding. Flooding situation important component. J Pilch asks about Dec 9 & 11 scoping meeting. Pure San Diego indirect potable water.
ACTION ITEMS:
Living Green Medical Marijuana Consumer Cooperative (#379530)
Conditional Use Permit for a Medical Marijuana Consumer Cooperative to operate
in an existing 2,844 Sq. Ft. two story building located at 4417 Rainer Avenue.
Formal presentation last month with NCPI choosing not to take action since Cycle issues
were not completed. Living Green Cooperative stated they were not coming back since
they made their presentation and NCPI chose not to take action. Matt told Gutierrez (City
of SD) we were holding meeting in Dec to discuss this but we may have missed the boat.
Living Green has notice of violation since they are operating illegally. Living Green has
satisfied their requirements per City of SD Regulations. M. McSweeney believes strongly
in property rights and if you comply with the rules you should be entitled to open. Does
not personally like these businesses in neighborhood but was prepared to say yes no
matter his personal opinions. After reading Notice of Violation he became upset at the
audacity of Living Green wishing to acquire a CUP while currently operating illegally. M.
McSweeney makes motion to deny Living Green Medical Marijuana CUP application J.
Wilson seconds. Unanimous vote in favor. D. Smith supports motion after looking at
violation. L. Murray asks if their building is in violation how did their boxes get checked on
application. Was told Living Green agreed to make modifications to building. S. Grimes
echoes McSweeney comments. D. Northcutt also agrees with M. McSweeney. Not in
favor personally but land use and concern in their business model about just getting
customers in. D. Livingston has questioned how they could get approval thru planning
Dept.? Planning Dept. reviews application and check on all compliance. Hearing officer
has final determination than can be appealed to Planning Commission. J. LaRaia asks
about hearing compliance and code violations. J. Pilch speaks to his questions asked at
last meeting to applicant’s attorney. Does not feel applicant attorneys were forthright.
Drove by clinic on way to NCPI meeting and still open even though Stop Use Notice of
Violation has been issued. Rob Hall states there are impacts to neighborhoods. Asks we
exercise our responsibility and send City clear voice on issue. Judy Stray 9th District PTA
2008 AG guidelines are not being followed correctly cities are not required to regulate pot
shops. Sale and distribution of pot is illegal. Languages of guidelines need to be looked
at. Cities can ban pot shops via CA Supreme Court case. States, Planning Groups can
appeal CEQA for this application. Barbara works with youth and glad NCPI sees this
business for what it is. Need to look at these businesses closely it’s all about the money.
Cathy, a public health practitioner states SD City misunderstands State guidelines. No
background checks run, city ordinance does not ban hash oil. Ordinance only requires
guard during operating hours and what about after hours and potential robberies. Pot
farms harm the environment. M. Reed asks questions about violation and illegally so are
they not subject to criminal prosecutions. D. Smith makes sure we follow up with our
recommendation with City. Vote will be officially submitted to City tomorrow morning and
follow up call with Edith Gutierrez also. M. Adams says we are the eyes and ears of the
community and we need to look at more than just to see if land use project has checked
all the boxes. They (Living Green) are operating illegal business and are not good
neighbors and they cannot check that box and it warrants serious consideration. Going to
vote in favor of denying permit.
MMCC Review process Discussion on NCPI procedure for reviewing Medical Marijuana Co-ops.
M. Adams asks for discretion in bringing forward these prior to all cycles being checked. M. McSweeney asks where we can start. Second review appropriate place to start. J. LaRaia suggests we leave it up to planning group to decide. Do not lock us in after 1st or 2nd but be smart when they are coming forward and being good neighbor. D. Smith says building code has lot to do with approval process. S. Grimes agrees with what was said do we have any sense of how many people will come forward based on the guidelines. Can we find out how many are in application mode? M. Reed personally does not want to hear proposal if they are operating illegally and do not deserve to be heard by NCPI. What is definition of minor oriented facility? T. Cords does not understand Why Kaiser facility is not considered child oriented. Rob Hall states language for youth facility vary narrow. J. Pilch says we should wait till application process complete and can put responsibility for impediment on city. D. Smith says building has to be approved and asks if Edith Gutierrez is talking to building Dept. Community Group Reports:
