Legislative & Advocacy Updates

Fifth Circuit Vacates DOL Fiduciary Rule On March 15, 2018, the Fifth Circuit Court of Appeals vacated the Department of Labor (DOL) fiduciary rule. The rule is now on hold nationwide, awaiting a DOL decision to ask for a rehearing, appeal the Fifth Circuit decision, or acquiesce to it. In a two-to-one decision by a three-judge panel, the Fifth Circuit held that the fiduciary rule as drafted by DOL exceeds the agency’s statutory (ERISA) authority, and therefore could not stand. The court characterized the rule in its entirety as one that is unreasonable and one that constitutes an arbitrary and capricious exercise of administrative power. The court’s ruling kills the rule and DOL has announced it will not try to enforce it, pending a decision on whether to ask for an en banc rehearing of the case by the full Fifth Circuit court, or to appeal it to the Supreme Court, or to acquiesce to the three-judge holding. Prospects: DOL has until early May to decide whether to ask for a rehearing or appeal the decision. To date, the agency has not yet determined what its reaction to the ruling will be. The court’s decision could result in the agency halting its ongoing work on modifications to the rule. Or, the agency could decide to start over again on a new fiduciary rule proposal, probably building on the work already done on modifying the rule. In the meantime, the Securities and Exchange Commission (SEC) is working a new standard of care rule, with a proposal expected “this spring.” So, the status of the fiduciary rule issue should come a bit clearer within another month or two.
