DEAR MEMBERS :

The stock market might be having a roller coaster year so far,but judging from the successful 9th Annual“Communications Law 101” seminar last week thecommunications bar will have plenty of challenging issues -and new lawyers to tackle them - for the foreseeable future.Since the 700 MHz auction kicked off the morning of theconference that was perhaps the “hot topic” of the day, butthere were many other intriguing issues covered by the panels.My thanks to all of the excellent panelists for theircomprehensive (and comprehensible!) presentations, and also to Rick Chessen,Scott Delacourt, Jennifer McCarthy and Alison Minea for their great work inorganizing the conference.

The Nominations Committee will begin its work in earnest next week, selectingcandidates for FCBA and FCBA Foundation leadership positions. If you areinterested in serving in as a candidate, or would like to nominate someone else foran elected position, please contact immediate Past President Jennifer Warren, whochairs the Nominating Committee, or any of its members, who were listed in thiscolumn in January’s newsletter.

The next few months will feature a full slate of events, starting next week with aCLE on broadband deployment internationally organized by the Cyberspace andInternational Practice Committees. On February 19th, the FCBA will host aluncheon panel program on the DTV transition, which raises a host of thorny issuesno matter what happens with the 700 MHz auction. In addition to the CLEs, theluncheon and brown bags, the Legislation Committee is planning anotherCongressional Reception later in the Spring.

Finally, I’m delighted to report that the reaction to the recent announcement aboutthe FCBA’s new Excellence in Government Service Award for federal governmentemployees in the communications field has been incredibly enthusiastic. Details onthe criteria for the award and the nominations process are explained on page 1 inthis newsletter. Don’t forget to submit your nominations for individuals deservingof this recognition by February 15th.

Annual SeminarScholarshipsAvailable forGovernmentEmployees andAcademicsTo promote the goal of broadattendance and boost participationfrom public sector employees andacademics, the FCBA is again offeringAnnual Seminar scholarships. Lastyear, the scholarship program wasfully subscribed. An increase inattendance by the public sector andacademics provides a uniquenetworking opportunity and benefitsall Annual Seminar attendees. Thescholarship covers the registration fee(approximately $200), which includesmeals, entertainment, and attendance

at the seminar. Scholarship recipientswill be responsible for the other costsof attending the Seminar, includingtravel and lodging expenses. security practices to protect consumersand employees. Onlinemarketing efforts that involve thetracking of website usage and viewinghabits have raised the scrutiny of federaland state regulators as well as a host ofcomplex legal issues, plus various newFTC principles for behavioralmarketing. COMMITTEES AND CHAPTERS in the Spotlight

Young LawyersCommitteeThe Young Lawyers Committee (YLC)is co-chaired by Chris Fedeli of DavisWright Tremaine and Tarah Grant ofHogan & Hartson. Its membershipincludes law students, attorneys, andother professionals who are either underthe age of 35 or who have practiced lawfor fewer than eight years. The missionof the YLC is to provide opportunitiesfor networking, social interaction, andprofessional development to those whoare new to the bar. Unlike other FCBAcommittees where the co-chairs areappointed, the YLC co-chairs are electedby the membership of the YLC.Elections are held in May and each co-chair serves a staggered two-year term.This ensures that the YLC has year-round continuity in its programmingand outreach efforts.

Throughout the year, the YLC offersbrown bag lunches on a monthly basis.YLC brown bag lunches are informalgatherings with one or more YLC-invited guests presenting on a topic ofinterest to the YLC membership. Topicsrange from substantive law issues and“introductions” to niche areas ofcommunications law tocommunications law-focused career

development advice. Sincethe YLC elections in May, the YLC hashosted six brown bag lunches on variedtopics, including “Introduction toSatellite Regulation” in June;“Introducing the Industries: The Role ofCommunications Trade AssociationCounsel and Policymakers” in July;“Translating the Set Top Box Debate”(co-sponsored with the Cable PracticeCommittee) in September; “The FCCand the FTC: Do They See Eye to Eye”(co-sponsored with the Privacy andData Security Committee) in October;“The Role of Mentoring” (co-sponsoredwith the Diversity Committee) also inOctober; and, most recently,“FCCdotgov: Tricks & Tips to Using theFCC’s Online Resources Efficiently andEffectively” (co-sponsored with theAccess to Records Committee).Upcoming brown bag lunches includeone on community service and probono opportunities for communicationsattorneys and one on the role of in-house counsel at communicationsindustry businesses. Also, for the thirdyear in a row, the YLC will be workingwith the Diversity Committee to co-

sponsor a mentoring luncheon inconnection with the FCBA’s MentoringInitiative.

In addition to the monthly lunches, theYLC hosts monthly happy hours toprovide YLC members with anopportunity to get to know their peersin the communications bar in a relaxedsetting. These happy hours are held ina variety of locations throughout thecity to maximize attendance and arewell attended by FCBA members, lawstudents, and other prospectivemembers of the FCBA. Popular annualhappy hour themes are the “WelcomeNew Associates” happy hour in the fall;the “Post Comm Law 101” happy hourfollowing the day-long workshop; and“Welcome Summer Associates” happyhour in the summer. The YLC alsosometimes co-sponsors happy hourevents with other FCBA committees.

The YLC also works with the DiversityCommittee each year on the FCBA’s LawSchool Outreach Initiative. For thisinitiative the YLC and the DiversityCommittee co-sponsor and co-organizea series of career-development panels ateach of the area law schools. This yearthe committees plan to host events atAmerican, Howard, George Mason,George Washington, UDC, Catholic,and Georgetown.

The YLC also promotes young lawyerinvolvement with the FCBA’s AnnualSeminar. The YLC actively encouragesits members to attend the AnnualSeminar and, to facilitate suchattendance, coordinates a room-sharingand ride-sharing program for YLCmembers. In the past, the YLC has alsoworked with the Annual Seminarplanning committee to coordinate asocial event or other activity thatenables YLC members to interact withmore senior members of thecommunications bar at the AnnualSeminar.

In addition, the YLC engages in year-round charitable fundraising andcommunity outreach efforts. The YLCparticipates in the FCBA’s volunteer

program with Martha’s Table and hascontinued its efforts to sell FCBA-logopolo shirts to benefit the Foundation.In addition, the YLC frequently helpsthe FCBA Foundation publicizeopportunities for young lawyers to getinvolved with Foundation programs.Last year this assistance includedpromoting opportunities to volunteer tosell raffle tickets for the Foundation’sAnnual Seminar raffle prize drawingand to interview candidates for theFoundation’s scholarship program.

While the foregoing activities allcontribute to the YLC’s fulfillment of itsmission, the YLC activity of which itsco-chairs and members are proudest isits annual Charity Auction. The annualCharity Auction is the YLC’s flagshipproject and one of the FCBA’s signatureevents. Each year the YLC co-chairsconvene the Ad Hoc Charity AuctionCommittee, which is responsible forselecting the organization that willreceive the auction proceeds and forcoordinating all aspects of the annualevent. The process begins in the springby soliciting applications from localcharitable organizations. Then the

Charity Auction Committee carefullyscreens and reviews each application,and diligently makes site visits to seeeach charity in action and to meet itsdirectors and volunteers. Afterconsidering a number of factors,including the organization’s leadership,financial budget, sustainability, goals,and contributions to the community,the Charity Auction Committee selectsthe beneficiary. Working with a largeteam of dedicated subcommittee co-chairs, the Charity Auction Committeethen coordinates event planning,publicity, budget allocation, volunteerparticipation, and prize solicitation.The 18th Annual FCBA CharityAuction was held on November 15,2007 at the Marriott at Metro Centerand raised over $96,000 for this year’sbeneficiary, Kid Power-DC. Kid Power-DC is a community organization thatprovides year-round extracurricularprogramming to youth from under-served communities in the District ofColumbia. Kid Power-DC currentlyoffers its academic enrichment and civicengagement programs at fiveelementary schools and oneneighborhood site. In addition to Chris

Fedeli and Tarah Grant, this year’sCharity Auction Committee consistedof Micah Caldwell, Catherine Hilke,Steve Hitchcock, Adam Kirschenbaum,Kerry Loughney, Natalie Roisman,Nancy Ory, Megan Ann Stull, RyanWallach, and Larry Movshin and JaneMago representing the Foundation.

The YLC is always interested in newfaces and new ideas for educating lawstudents and young lawyers, providingopportunities for its members to getmore involved with the FCBA, anddeveloping young leaders in thecommunications profession. Interested in Hosting an FCBA event?The FCBA greatly appreciates the support of our members’ firms and companieswho provide space for our brown bag lunches, committee meetings, and CLESeminars throughout the year. We are, however, always looking for newlocations that can host FCBA events. We will be experimenting with some newpresentation technology in future CLE seminars, which require more technicalsupport than we have needed in the past.

In general terms, we need conference rooms that can seat at least 30 (more ifpossible) people at tables for brown bag lunches and committee meetings andconference rooms that can seat a minimum of 60 for CLE seminars. Firms andcompanies hosting brown bag lunches provide beverages and desserts; firmsand companies hosting CLE seminars provide beverages and snacks. CLEseminars are generally held from 6:00 – 8:30 p.m. Additionally, for CLEseminars we need facilities that can provide technology support formicrophones for as many as six speakers on a panel, the ability to tie the housesound system into a teleconference bridge, video projection capabilities forPowerPoint presentations, and access to the internet for presentations byspeakers. change in its lockbox provider -- fromMellon Bank in Pittsburgh to US Bankin St. Louis, Missouri. The FCC’slockbox provider serves as the filing andprocessing agent for the FCC –processing fees, payments, andapplications that are not submittedelectronically.

All non-electronic FCC filings requiringfee payments will be impacted by thechange except for Upfront Payments

made by potential spectrum auctionbidders, which will continue to beprocessed by Mellon Bank. All otherauction payments, however, will berequired to be submitted to the newlockbox bank, US Bank.

The transformation of telecommuni-cations from an analog, narrowbandnetwork optimized for voice to a digital,broadband network optimized for datatraffic has created a myriad ofchallenges for businesses, policymakers,and academics alike. Consider that, in2000, when then-FCC CommissionerMichael Powell coined the term “thedigital broadband migration,” the iPodhad yet to be rolled out to consumersand Google was not yet a verb. In 2009, the next President will takeoffice with an array of informationpolicy questions demanding attention.This conference aims to underscore thechallenging policy issues that will behigh on any new administration’sagenda. In particular, we will evaluatequestions related to changing broadbandand wireless markets; challenges relatedto protecting privacy and security; andthe optimal direction for intellectualproperty reform. of Google, for example, underscores theopportunities for upstart firms tocapitalize on new opportunities. Wellbefore Google, other firms likeQualcomm saw and capitalized on thepotential of innovative technologies thatincumbent firms either missed or wroteoff. Indeed, the pace of innovation inthe information industries has led somecommentators to suggest that today’sInternet-enabled economy reflectsSchumpeter’s vision of creativedestruction where the important battlesare not for customers of today’sproducts, but developing newtechnologies that can create a newmarket.

The importance of technological changeto our economy raises a series ofimportant questions for policymakers.One important set of questions revolvearound government investment in basicresearch and the nature of thetechnological landscape. In a number oftechnology markets today, includingwireless communications, the Internet,and biotechnology, government supportfor basic research as well as basicresearch by dominant firms laid thefoundation for later innovations. Today,however, there is an increasing level ofconcern that such basic research is notadequately being supported.A second set of questions revolvesaround whether and how start-up firmscontribute to the pace of innovation. Onone view, these firms are able to conductrisky experiments and basic researchwith the promise of being bought out bymore established firms. In other cases,upstart firms worry about the ability ofestablished firms to undermine theirsuccess once the upstarts establish thepopularity of a new product-particularlywhere the upstart must rely on theplatform of an established firm. In somecases, upstarts call for regulation, such

as the call for open access to wirelessphones, to prevent such conduct and tofoster innovation.

A final set of important questionsrelated to innovation revolves aroundthe role of intellectual propertyprotection. On one view, including thatof “neo-Schumpeterians,” strong patentrights enable firms to develop a firmposition in today’s market and providesthose firms with powerful incentives toinvest in innovations. Others, however,are concerned that today’s incumbents-or even others who strategically investin patents and not innovation per se-areable to abuse the patent system for theiradvantage.To evaluate the appropriate role forgovernment policy in facilitatingentrepreneurship and innovation, thisconference will bring together a groupof industry leaders to examine thesequestions.

FCBA FoundationNow AcceptingApplications forFunding of UnpaidLegal Internships atGovernmentAgenciesFor the fifteenth consecutive year, theFederal Communications BarAssociation (FCBA) Foundation willaward stipends to law students from itsChairman Robert E. Lee Scholarshipand Internship Fund. In 2008, theFoundation will award at least five$5,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and othergovernment agencies or entities with aconnection to the communicationsindustry (i.e., broadcasting, cabletelevision, telephony, satellite, wireless,and information technology).

In addition, the Foundation will selectone outstanding intern among thosechosen to receive an additional stipendof $600 for the summer—the “MaxPaglin Award.” Mr. Paglin was theformer General Counsel and ExecutiveDirector of the FCC, and the founder ofthe Golden Jubilee Commission onTelecommunications, which compiled adefinitive legislative history of theCommunications Act.

Applicants will be selected on the basisof: (1) a demonstrated interest in thecommunications field, (2) havingsecured or having pending, an unpaidsummer position (internship) for atleast 8 weeks in communications with agovernment agency, (3) dependence onfinancial assistance in order to acceptthe unpaid internship in a governmentagency or entity involved incommunications; and, (4) communityactivities. To the extent a recipientreceives unanticipated funding for theunpaid internship, the FCBAFoundation’s general policy is to reduceits scholarship awards by any amount

that a recipient’s total funding(including all sources) for theinternship would otherwise exceed$7,000.

McKenna’s WagonSeeking Volunteersfor February 24thMcKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.community. This is an especially goodexperience for the teens and pre-teensamong us who do not have a fullappreciation of the many privileges theyenjoy. Community service credits arealso available.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 p.m.in comfortable clothes and shoes.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), and

put on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The fooddistribution is conducted in an efficient,calm and orderly fashion and many ofthe people we serve are quiteappreciative of our efforts. Once weserve all of the food, we do a clean up ofthe immediate area. Total time for thedistribution takes about one hour andwe usually return to Martha’s Table byor before 6:30 p.m.

Ms. Baker is a member of the Texas StateBar. She earned a bachelor of arts degreefrom Washington & Lee University in1990, a law degree from the Universityof Houston in 1994, and worked for theFifth Circuit and the law firm ofDeLange & Hudspeth, LLP. From 1990to 1992, she worked in the LegislativeAffairs Office of the U.S. StateDepartment in Washington. Ms. Bakerand her family reside in McLean, VA.

Monica Shah Desai has served as Chiefof the Media Bureau since January 2007.She has worked at the Commissionsince 1999 in a variety of capacities.Most recently, Ms. Desai was the Chiefof the Consumer and GovernmentalAffairs Bureau from April 2005 untilJanuary 2007. She previously served asan interim legal advisor to thenCommissioner Martin on spectrum andinternational issues, and has also hadresponsibility for various commoncarrier and media issues. She has alsoworked as an attorney-advisor in the

Pricing Policy Division of the WirelineCompetition Bureau, as well as theCommercial Wireless Division and theformer Public Safety and PrivateWireless Division of the WirelessTelecommunications Bureau.

Before joining the FCC, Ms. Desai wasas an associate at the law firm ofSonnenschein Nath & Rosenthal whereshe worked on government contracts,commercial litigation andenvironmental regulatory matters. Shewas a law clerk to the HonorableDeborah K. Chasanow (United StatesDistrict Court, District of Maryland).She also served as an adjunct professorat the George Mason University Schoolof Law. Ms. Desai received her J.D., cumlaude, from Georgetown University LawCenter. She received her B.B.A., magnacum laude, in Finance from GeorgeWashington University, where she was aNational Merit Scholar.

Kyle E. McSlarrow began his tenure asPresident & CEO of the National Cable& Telecommunications Association(NCTA) on March 1, 2005. In this role,McSlarrow is the cable industry’sprimary public policy advocate inWashington, D.C., and represents theindustry’s interests before Congress, theFederal Communications Commissionand the Administration.NCTA is the primary trade associationof the cable television industry in theUnited States, representing cableoperators serving more than 90 percentof the nation’s cable televisionhouseholds and more than 200 cableprogram networks, as well asequipment suppliers and providers ofother services to the cable industry.

McSlarrow was appointed in 2007 toserve on the President’s NationalSecurity Telecommunications AdvisoryCommittee (NSTAC). The NSTACinforms and advises the President ontelecommunications issues affectingnational security and emergencypreparedness.

Prior to joining NCTA, McSlarrowserved as the Deputy Secretary of the

U.S. Department of Energy, an agencywith more than 100,000 federal andcontractor employees, 17 national labs,and a budget of $23 billion. In that role,he exercised policy and programmaticsupervision over a diverse portfolio thatincluded the nation’s nuclear weaponscomplex, non-proliferation programs,and a research and developmentportfolio that includes high energyphysics and the development ofadvanced technology to strengthen thenation’s energy and homeland security.

Prior to joining the Department ofEnergy, McSlarrow served as VicePresident of Political and GovernmentAffairs for Grassroots.com, a privately-held Internet company marketing web-based political tools and services.

McSlarrow, a native of Virginia, earneddegrees from Cornell University and theUniversity of Virginia School of Law. He,his wife Alison, and their children, livein Falls Church, Virginia.

David Rehr joined NAB as presidentand CEO in December 2005. During hisfirst year at the organization, Rehr madeit one of his priorities to visit directlywith, and obtain input from, as manystation groups and individual localbroadcasters as possible. His aggressiveschedule of meetings took him to 20state broadcast conventions. He alsomet with broadcasters in 25 states andvisited 22 local stations. Rehr deliveredmore than 40 speeches in 2006,including a major address on “TheFuture of Broadcasting” at theprestigious National Press Club.Another of Rehr’s top priorities in 2006was a realignment of NAB departmentsand staff to bring greater value to NABmembership.

Prior to his taking over the helm atNAB, Rehr was president of theNational Beer Wholesalers Association(NBWA). Under his leadership, NBWA’svisibility in the advocacy communitysoared, and the association was rankedas one of the top ten most influentiallobbying organizations by Fortunemagazine. With more than 25 years of

experience on Capitol Hill and in thelobbying community, Rehr has been anoutspoken advocate for entrepreneursand small business before the federalgovernment.

Rehr, who has a doctorate in economicsfrom George Mason University, has beennamed a “Top Association Lobbyist”multiple times by one of Congress’“must read” publications, The Hill. Hehas also been featured in Beachum’sGuide to Key Lobbyists, and after justseven months at NAB, Radio Inkmagazine named him the 21st mostinfluential person in radio.

Rehr is married to Ashley McArthur,whom he met when she was acongressional aide on Capitol Hill. Theyhave four young children – Andrew,Harrison, Emily and Henry.

Andrew Jay Schwartzman is thePresident and CEO of Media AccessProject (MAP). He has directed theorganization since June, 1978.

Mr. Schwartzman has appeared onbehalf of MAP before the Congress, theFCC and the courts on issues such as

cable TV regulation, minority andfemale ownership and employment inthe mass media,”equal time” laws andcable “open access.” In recognition ofhis service as chief counsel in the publicinterest community’s challenge to theFCC’s June, 2003 media ownershipderegulation decision, The ScientificAmerican honored Mr. Schwartzman asone of the nation’s 50 leaders intechnology for 2004.

Mr. Schwartzman is a faculty member ofthe Johns Hopkins University School ofArts and Sciences, where he teaches inits Communication in ContemporarySociety Program. He was co-founderand President of the Board of the SafeEnergy Communications Counsel from1991 through 2003. Mr. Schwartzmanis the 1994 recipient of the UnitedChurch of Christ Office ofCommunication’s Everett C. ParkerAward and the 2004 recipient of theMedia Matters Life Achievement Award.

After graduating from the University ofPennsylvania in 1968, and its lawschool in 1971, Schwartzman was staffcounsel to the Office of Communicationof the United Church of Christ. From

1974 until he took his current position.He is married to Linda Lazarus, anattorney/mediator practicing inWashington, DC.

Gary Shapiro is president and CEO ofthe Consumer Electronics Association(CEA), the U.S. trade associationrepresenting some 2000 consumerelectronics companies and owning andproducing the continent’s largest annualtrade show, the International CESÒ.

Shapiro is an active leader in thedevelopment, launch and marketing ofHDTV. He has testified before Congresson HDTV and other technology andbusiness issues more than 20 times. Heco-founded and chaired the HDTVModel Station and has served as a leaderof the Advanced Television Test Center(ATTC). He is a charter inductee to theAcademy of Digital Television Pioneers,and in 2003 received its highest awardas the industry leader most influentialin advancing HDTV.

Shapiro serves on the Board of Visitorsof George Mason University, Virginia’slargest university, and is a member ofthe board of directors of the NorthernVirginia Technology Council. He alsoserved as a member of theCommonwealth of Virginia’sCommission on InformationTechnology

Shapiro leads a staff of more than 130employees and thousands of industryvolunteers. Prior to joining theassociation, Shapiro was an associate atthe law firm of Squire, Sanders andDempsey. He also has worked onCapitol Hill, as an assistant to a memberof Congress. He received his law degreefrom Georgetown University LawCenter and is a Phi Beta Kappa graduatewith a double major in economics andpsychology from the State University ofNew York, Binghamton.

He is married to Dr. Susan Malinowski,a retina surgeon.
