AT a meeting of the Executive Council held in the Executive Council Chambers, at Perth, this 7th day of December, 1960, the following Order in Council was authorised to be issued: Road Districts Act, 1919. Esperance Road Board. Determination of Membership and Election of Members. ORDER IN COUNCIL. L.G. 149/60. WHEREAS the Governor, acting under the power conferred by section 30 of the Road Districts Act, 1919, by an Order in Council published in the Government Gazette of the 12th December, 1958, appointed a Commissioner to the Esperance Road District; and whereas it is enacted by section 32 of the said Act that whilst a Commissioner is in office for any District the Governor may, whenever he thinks fit, appoint a day for holding an election of members for the return of the whole number of members assigned to the said District and the Wards thereof; and whereas by an Order in Coun- cil published in the Government Gazette of the 22nd March, 1946, the Esperance Road District was redivided into four Wards; and whereas the Governor may declare the number of members of which a road board shall consist and may deter- mine the number of members for each Ward: Now, therefore, His Excellency the Governor, acting by and with the advice and consent of the Executive Council and in exercise of the power conferred by the said Act, doth hereby appoint the 15th day of April, 1961, for holding an election for the return of the whole number of members of the said Esperance Road District and the Wards thereof; declare that the number of members to constitute the Esperance Road Board shall be seven; determine that the number of members for each Ward of the Esperance Road Dis- trict shall be as follows:- Esperance WardTwo members. IT is hereby notified, for general information, that the areas scheduled hereunder are available for selection under Part Vof the Land Act, 1933-1960, and the regulations appertaining thereto, subject to the provisions of the said Act.

Applications must be lodged at the Department of Lands and Surveys, Perth, not later than the date specified, butmay be lodged before such date, if so desired.

All applications lodged on or before such date will be treated as having been received on the closing day, and if thereare more applicants than one for any block, the application to be granted wifi be determined by the Land Board. Shouldany lands remain unselected such will continue available until applied for or otherwise dealt with.

If a Land Board sitting becomes necessary, the applicants for the blocks will be duly notified of the date, time, andplace of the meeting of the Board, and there shall be an interval of at least seven days between the closing date and the sittingof the Board.

All indigenous marketable timber, including sandalwood and mallet, is reserved to the Crown, subject to the provisionsof Clause 14 of the Regulations.

Notice of Intention to Borrow.Proposed Loan (No. 20) of £1,475.

NOTICE is hereby given that the GoomallingRoad Board proposes to borrow the sum of £1,475to be expended on works and undertakings in theGoomalling Road Board District, the said worksbeing bituminous surfacing of roads.

Plans, specifications, an estimate of the costof the said works and undertakings, and a state-ment showing the proposed expenditure of themoney are open for inspection at the office of theGoomalling Road Board for one month after thelast publication of this notice, during ordinaryoffice hours.

The amount of £1,475 is proposed to be raisedby the sale of debentures, repayable with interestby 10 half-yearly instalments over a period of fiveyears after the date of issue thereof, in lieu ofthe formation of a sinking fund. The debenturesshall bear interest at a rate not exceeding fivepounds seven shillings and sixpence (5 Is. Gd.)per cent. per annum, payable half-yearly. Theamount of the said debentures with interest thereonshall be paid at the office of the Board, Goomal-ling.

The works and undertakings for which the loanis proposed to be raised will, in the opinion of theBoard, be of special benefit to the North Ward ofthe Goomalling Road District, and any loan rateapplicable to such loan will be levied on the rate-able land within the said North Ward.

THE Conciliation Commissioner, in pursuance ofthe powers and duties conferred upon him bysection 108B of the Industrial Arbitration Act,1912-1952, and in pursuance of a remission madeto him by the Court of Arbitration, doth herebymake the following Award in connection with theindustrial dispute between the abovenamed parties.

Award.1.Title.

This Award shall be known as the "Bag, Sackand Textile Award," and replaces Award No, 37of 1951, as amended.

3.Scope.This Award shall apply to all workers who are

employed in the manufacture of jute, hessian,calico and stockinette bags, water bags, tents, tar-paulins, blinds and covers: Provided that it shallnot apply to workers who are at present providedfor in any Award of the Court of Arbitration ofWestern Australia or in any Industrial Agreementregistered in accordance with the Industrial Arbi-tration Act, 1912-1952.

4.Area.This Award shall apply over the area comprised

within a radius of fifteen (15) miles from theGeneral Post Office, Perth.

5.Term.The term of this Award shall be for a period

of three (3) years from the beginning of the firstpay period commencing after the date hereof.

6.Hours.Forty (40) hours shall constitute a week's

work, to be worked in five (5) days, Monday toFriday inclusive.

Except in the case of shift workers, theordinary day's work shall be performed betweenthe hours of 7 a.m. and 6 p.m.

(C) No working day shall exceed eight (8) hours,which shall be worked in continuous shift.

7.Overtime.All time worked before the usual starting

time or after the usual finishing time, Mondayto Friday inclusive, and all time worked onSaturday shall be deemed overtime and be paidfor at the rate of time and a half.

All time worked on Sunday or the holidaysprescribed in clause 8 hereof shall be paid forat the rate of double time,

(c) Notwithstanding anything contained in thisAward-

an employer may require any worker towork reasonable overtime at overtimerates and such worker shall work overtimein accordance with such requirement;no organisation party to this Award, orworker or workers covered by this Award,shall in any way, whether directly or in-directly, be a party to or concerned in anyban, limitation or restriction upon theworking of overtime in accordance withthe requirements of this subclause.

(d) In the calculation of overtime rates, eachday's work shall stand alone.

(e) Overtime on shift work shall be based onthe rate payable for shift work.

(f) These overtime rates shall not apply toexcess time due to private arrangements betweenthe workers themselves or for the purpose ofeffecting the customary rotation of shifts, or whichis owing to a relieving man not coming on atthe appointed time. The time for which anyworker may be paid at ordinary rates instead ofovertime due to a relieving man not coming onat the proper time, shall not exceed two (2)hours, after the expiration of which overtimerates shall apply for the whole shift.

8.Holidays.The following days, or the days observed

in lieu, shall, subject to clause 7 (b) hereof, beallowed as holidays without deduction of pay,namely: New Year's Day, Australia Day, GoodFriday, Easter Saturday, Easter Monday, AnsacDay, Labour Day, State Foundation Day, Christ-mas Day and Boxing Day.

On any public holiday not prescribed asa holiday under this Award the employer's estab-lishment or place of business may be closed, inwhich case a worker need not present himself forduty and payment may be deducted, but if workbe done ordinary rates of pay shall apply.

Except as hereinafter provided, a period oftwo (2) consecutive weeks' leave with payment ofordinary wages as prescribed shall be allowedannually to a worker by his employer after aperiod of twelve (12) months' continuous servicewith such employer.

If any Award holiday falls within a worker'speriod of annual leave and is observed on a daywhich in the case of that worker would havebeen an ordinary working day there shall be addedto that period one day being an ordinary workingday for each such holiday observed as aforesaid,

If after one month's continuous service inany qualifying twelve-monthly period a workerlawfully leaves his employment, or his employmentis terminated by the employer through no faultof the worker, the worker shall be paid one-sixth(1/6th) of a week's pay at his ordinary rate ofwage in respect of each completed month of con-tinuous service.

Any time in respect of which a worker isabsent from work except time for which he isentitled to claim sick pay or time spent on holi-days or annual leave as prescribed by this Awardshall not count for the purpose of determininghis right to annual leave.

In the event of a worker being employedby an employer for portion only of a year, heshall only be entitled, subject to subclause (e)of this clause to such leave on full pay as is pro-portionate to his length of service during thatperiod with such employer, and if such leave isnot equal to the leave given to the other workershe shall not be entitled to work or pay whilstthe other workers of such employer are on leaveon full pay.

A worker who is dismissed for misconductor who illegally severs his contract of service shallnot be entitled to the benefit of the provisions ofthis clause.

The provisions of this clause shall not applyto casual workers.

9Absence through Sickness.A worker shall be entitled to payment for

non-attendance on the ground of personal ill-healthfor one twelfth (1/12th) of a week for each com-pleted month of service: Provided that paymentfor absence through such ill-health shall be limitedto one week in each calendar year. Payment here-under may be adjusted at the end of each calendaryear, or at the time the worker leaves the serviceof the employer, in the event of the worker beingentitled by service subsequent to the sickness toa greater allowance than that made at the timethe sickness occurred. This clause shall not applywhere the worker is entitled to compensation underthe Workers' Compensation Act.

A worker shall not be entitled to receive anywages from his employer for any time lost throughthe result of an accident not arising out of or inthe course of his employment or for any accidentwherever sustained arising out of his own wilfuldefault or for sickness arising out of his own wilfuldefault.

No worker shall be entitled to the benefitsof this clause unless he produces proof satisfactoryto his employer of sickness, but the employer shallnot be entitled to a medical certificate unless theabsence is for three (3) days or more.

Sick leave shall accumulate from year toyear so that any balance for the period specifiedin subclause (a) of this clause which has in anyyear not been allowed to any worker by his em-ployer as paid sick leave may be claimed by theworker, and, subject to the conditions hereinbeforeprescribed, shall be allowed by his employer in anysubsequent year, without diminution of the sickleave prescribed in respect of that year. Providedthat the sick leave which accumulates pursuant tothis subclause shall be available to the worker fora period of two (2) years but no longer from theend of the year in which it accrues.

Notwithstanding the provision of subclause(c) hereof, a worker who has already been allowedpaid sick leave on one occasion shall not be en-titled to payment for any further absence in thesame year unless during the ordinary working hoursthat the worker is absent the employer requests inwriting the employee to produce on his return towork a medical certificate stating that he was un-able to attend for duty on account of personal ill-health.

10.Time and Wages Record.The employer shall keep or cause to be kept a

record wherein shall be entered(a) the name of each worker;(b) the nature of his employment;(C) the total hours worked each day;

the wages and overtime (if any) receivedtherefor;the age of each junior worker.

The employer shall be responsible for the properposting of the record each week, which shall besigned weekly only if correct, by the worker. Suchrecord shall be open for inspection at the factoryoffice by a duly accredited representative of theUnion during working hours.

11.Contract of Service.All employees shall be engaged either as

weekly or casual employees: Provided that an em-ployer may engage a new employee as a casualand may alter the engagement to a weekly one atany time up to the pay day immediately followingthe day of engagement. If an employer so altersthe engagement he shall only be liable to pay theemployee concerned the proportion of the weeklyrate calculated on the basis of the time worked.

A week's notice shall be given on either sideor in lieu of notice, by the payment or forfeiture,to terminate the employment of a weekly hand,

Provided this shall not affect the right of anemployer to dismiss an employee without noticefor misconduct.

(d) Provided further that during the first weekof the employment, an employer may dismiss aworker or a worker may leave the employment byeither giving the other not less than one (1) hour'snotice.

12.Meal Money.A worker required to work overtime for more

than two (2) hours, without being notified on theprevious day or earlier, that he will be so requiredto work, shall be supplied with a meal by the em-ployer or paid five shillings (5s.) for a meal.

If the amount of overtime required to be workednecessitates a second or subsequent meal, the em-ployer shall, unless he has notified the workersconcerned on the previous day or earlier, that sucha second or subsequent meal will also be required,provide such meals or pay an amount of threeshillings and fourpence (3s. 4d.) for each secondor subsequent meal.

No such payments need be made to workers livingin the same locality as their workshops who canreasonably return home for such meals.

If a worker in consequence of receiving suchnotice has provided himself with a meal or mealsand is not required to work overtime, or is requiredto work less overtime than notified, he shall bepaid the amount above prescribed in respect of themeals not then required.

13.Right of Entry.(a) Accredited representatives of the Union shall

be permitted to interview the workers on the busi-ness premises of the employer during non-workingtimes or meal breaks.

(b) In the case of a dispute between the Unionand an employer which is likely to lead to a cessa-tion of work or to an application to the Courtand which involves the inspection of workers orof machines in the process of production, suchUnion representatives shall have the right of entryinto the factory at any time during which theworkers or machines concerned are working, butthis permission shall not be exercised without theconsent of the employer more than once in anyone week.

(c) Provided that the duly accredited repre-sentative shall notify the employer beforehand ofhis intention to exercise his rights under thisclause.

14.Board of Reference.(a) The Court may appoint for the purpose of

this Award a Board or Boards of Reference. EachBoard shall consist of a chairman and two (2)other representatives, one to be nominated by eachof the parties. There are assigned to each suchBoard in the event of no agreement being arrivedat between the parties to the Award, the functionsof:-

adjusting any matters of difference whichmay arise between the parties from timeto time except such as involve interpreta-tions of the provisions of the Award orany of them;deciding any other matters that the Courtmay refer to such Board from time to time.

(b) An appeal shaH lie from any decision ofsuch Board in the manner and subject to theconditions prescribed in the Industrial ArbitrationAct. 1912-1952, which for this purpose are embodiedin the Award.

15.Under Rate Workers.Any worker who by reason of old age or

infirmity is unable to earn the minimum wage,may be paid such lesser wage as may from timeto time be agreed upon in writing between theUnion and the employer.

In the event of no agreement being arrivedat the matter may be referred to the Board ofReference for determination.

(C) After application has been made to the Boardand pending the Board's decision, the worker shallbe entitled to work for and be paid the proposedlesser rate.

16.Junior Workers.(a) Junior workers, upon being engaged, shall

furnish the employer with a certificate containingthe following particulars:-

name in full;age and date of birth.

No worker shall have any claim upon an employerfor additional pay in the event of the age of theworker being wrongly stated either on the certifi-cate or, if no such certificate is furnished, verballyto the employer. If any junior shall wilfully mis-state his age either verbally to the employer or inthe certificate, he alone shall be guilty of a breachof this Award, and in the event of a worker havingreceived a higher rate than that to which he wasentitled, he shall make restitution to the employer.

(b) Proportion(i) Subject to the following para-graphs the proportion of junior male employees toadult male employees employed under classification(b) (i) of the Wages Schedule shall be not morethan one (1) junior to every three (3) adult maleemployees, and the proportion of junior femalesto adult females shall be not more than two (2)junior females to every one (1) adult female em-ployed.

(ii) The foregoing shall not necessitate the dis-missal of any person employed at the date of thisOrder, and it shall not constitute a breach of thisprovision if the retaining of existing staff does notconform to the aforesaid proportion.

(iii) It shall not constitute a breach of para-graph (1) hereof if the employer can establishthat he is not able to obtain the services of suitableadult labour.

17.Mixed Functions.A worker engaged for more than half (-) of one

(1) day or shift on duties carrying a higher ratethan his ordinary classification shall be paid thehigher rate for such day or shift. If employed forless than half () of one (1) day or shift he shallbe paid the higher rate for the time so worked.

18.Shift Work.An employer may, if he so desires, work his

establishment on shifts, but before doing so, shallgive notice of his intention to the Union and ofthe intended starting and finishing times of ordin-ary working hours of the respective shifts.

(i) Where any particular process is carriedout on shifts other than day shift, and less thanfive (5) consecutive afternoon or five (5) consec-utive night shifts are worked on that process, thenthe workers employed on such afternoon or nightshifts shall be paid at overtime rates.

(ii) The sequence of work shall not be deemedto be broken under the preceding paragraph byreason of the fact that work on the process is notcarried out on a Saturday or Sunday or on anypublic holiday.

The loading on the ordinary rates of payfor shift work shall be five per cent. (5%) forafternoon shift and ten per cent (10%) for nightshift.

Where a shift commences at or after 11 p.m.,then the whole shift shall be paid for at the ratewhich applies to the major portion of the shift.

Where an ordinary shift of a shift workerfinishes by 8 a.m., on Saturday such hours on theSatmday shall be regarded as ordinary hours ofemployment and shall not be subject to penaltyrates.

19.Breakdowns, Etc.The employer shall be entitled to deduct payment

for any day or portion of a day upon which theworker cannot be usefully employed, because ofany strike by the Union or Unions affiliated withit or by any other association or Union or throughthe breakdown of the employer's machinery or anystoppage of work by any cause which the em-ployer cannot reasonably prevent.

20.Casual Workers.Any worker dismissed through no fault of his

own before the expiration of one (1) week of hisemployment shall be considered casual and shallreceive ten per cent. (10%) above the rate specifiedfor the work performed.

21.Posting of Award and Union Notices.Every employer shall allow Union Notices, except

those which on reasonable grounds he considersobjectionable, and a copy of this Award to beposted up by the Union in a place accessible to theworkers and approved by the employer.

22.Rest Period.A rest period of seven (7) minutes between 10

a.m. and 10.15 am., each day shall be given to allemployees without deduction of pay.

23.Extra Rates.Any worker required to repair canvas goods of

all descriptions which are of an unusually dirtyor offensive nature shall be paid threepence (3d.)ner hour in addition to the ordinary rate.

24.Preference.Preference of employment shall be given to

suitable members of the Union. Provided that anyworker or applicant for employment who furnishesproof that he is a financial member of any otherregistered industrial union of workers shall sub-ject to the provisions hereinafter contained begiven equal preference.

Any worker or applicant for employmentwho is not a member of the Union or of any otherregistered industrial Union of Workers shall withinfourteen (14) days of commencing employmentunder this Award apply in accordance with itsRules to become a member of the Union and anyworker who is not a member of the Union but isa member of another registered industrial Unionof Workers shall within fourteen (14) days fromthe expiration of his then current membership withsuch other Union apply to become a member ofthe Union.

The provisions of this clause shall not debarfrom employment or continuance in employmentany applicant for employment or any worker whoseapplication to become a member of the Union hasbeen refused by the Union without reasonable causeunless and until such refusal is withdrawn.

Any worker or applicant for employmentwho becomes a member of the Union, shall con-tinue his financial membership of the Union inaccordance with its Rules, while he continues tobe employed under this Award.

The employer shall within fourteen (14) daysof being advised in writing by the Union of thebreach by a worker of the provisions of this clausedetermine the employment of any worker who failsto comply with the provisions of this clause unlesssuch breach is remedied by the worker concernedwithin such fourteen (14) days. Any dispute asto whether a worker has committed a breach ofthis clause may be referred to a Board of Ref er-ence by either the employer or the Union con-cerned.

The provisions of this clause shall not applyto any worker who objects on the grounds of con-scientious religious belief to being a member of anindustrial union of workers, so long as such worker,from time to time, pays to a charitable organisa-tion nominated by the Court an amount equivalentto the subscription and levies prescribed by therules of the Union to be paid by its members.

Should any dispute arise as to the con-scientious religious beliefs of any worker or appli-cant for employment the same shall be referredto a Board of Reference appointed under theAward.

"Union" shall mean The Federated Miscel-laneous Workers' Union of Australia, Western Aus-tralian Branch, Industrial Union of Workers.

26.Long Service Leave.(a) Right to Leave.

A worker shall as herein provided be entitledto leave with pay in respect of long service.

(b) Long Service.The long service which shall entitle a

worker to such leave shall, subject as herein pro-vided, be continuous service with the one and thesame employer.

Such service shall include service prior tothe 1st April, 1958, if it continued until such timebut only to the extent of the last 20 completedyears of continuous service.

(3) (i) Where a business has, whether beforeor after the coming into operation hereof, beentransmitted from an employer (herein called "thetransmittor") to another employer (herein called"the transmittee") and a worker who at the timeof such transmission was an employee of the trans-mittor in that business becomes an employee ofthe transmittee the period of the continuous ser-vice which the worker has had with the transmit-tor (including any such service with any priortransmittor) shall be deemed to be the service ofthe worker with the transmittee.

(ii) In this subclause "transmission" includestransfer, conveyance, assignment or successionwhether voluntary or by agreement or by opera-tion of law and "transmitted" has a correspondingmeaning.

(4) Such service shall includeAny period of absence from duty on anyannual leave or long service leave.Any period of absence from duty neces-sitated by sickness of or injury to theworker but only to the extent of fifteenworking days in any year of his employ-ment.Any period following any termination ofthe employment by the employer if suchtermination has been made merely withthe intention of avoiding obligations here-under in respect of long service leave orobligations under any Award in respect ofannual leave.Any period during which the service of theworker was or is interrupted by service-

As a member of the Naval, Militaryor Air Forces of the Commonwealthof Australia other than as a mem-ber of the British CommonwealthOccupation Forces in Japan andother than as a member of thePermanent Forces of the Common-wealth of Australia except in thecircumstances referred to in section31 (2) of the Defence Act, 1903-1956, and except in Korea or Malayaafter the 26th June, 1950;As a member of the Civil Construc-tion Corps established under theNational Security Act, 1939-1946;In any of the Armed Forces underthe National Service Act, 1951 (asamended).

Provided that the worker as soon asreasonably practicable on the completionof any such service resumed or resumesemployment with the employer by whomhe was employed immediately before thecommencement of such service.

(5) Service shall be deemed to be continuous not-withstanding

the transmission of a business as referredto in paragraph (3) hereof;any interruption of a class referred to inparagraph (4) hereof irrespective of theduration thereof;any absence from duty authorised by theemployer;any standing-down of a worker in accord-ance with the provisions of an Award,Industrial Agreement, Order or Determina-tion under either Commonwealth or Statelaw;any absence from duty arising directly orindirectly from an industrial dispute if theworker returns to work in accordance withthe terms of settlement of the dispute;any termination of the employment by theemployer on any ground other than slack-ness of trade if the worker be re-employedby the same employer within a period notexceeding two months from the date ofsuch termination;

(g) any termination of the employment by theemployer on the ground of slackness oftrade if the worker is re-employed by thesame employer within a period not exceed-ing six months from the date of suchtermination;

(h) any reasonable absence of the worker onlegitimate union business in respect ofwhich he has requested and been refusedleave;

(1) any absence from duty after the cominginto operation of this clause by reason ofany cause not specified in this clause unlessthe employer during the absence or withinfourteen days of the termination of theabsence notifies the worker in writing thatsuch absence will be regarded as havingbroken the continuity of service, whichnotice may be given by delivery to theworker personally or by posting it by regis-tered mail to his last recorded address, inwhich case it shall be deemed to havereached him in due course of post.

Provided that the period of any absence fromduty or the period of any interruption referred toin placita (c) to (i) inclusive of this paragraphshall not (except as set out in paragraph (4) here-of) count as service.

(c) Period of Leave.(1) The leave to which a worker shall be en-

titled or deemed to be entitled shall be as providedin this subclause.

(2) Where a worker has completed at least 20years' service the amount of leave shall be

in respect of 20 years' service so corn-pieted-13 weeks' leave;in respect of each 10 years' service com-pleted after such 20 yearssix and a halfweeks' leave.

(3) Where a worker has completed at least 15years' service since its commencement and his em-ployment is terminated

(a) by his death;(b) in any circumstances otherwise than by the

employer for serious misconduct,the amount of leave shall be-

(i) if such determination takes place beforethe worker has become entitled to leaveunder placitum (a) of paragraph (2) here-of such proportion of 13 weeks' leave asthe number of completed years of suchservice bears to 20 years;

(ii) if such termination takes place after theworker has become entitled to leave underplacitum (a) of paragraph (2) hereof theleave due under such placitum and inaddition such proportion of 13 weeks' leaveas the number of completed years of suchservice after the accrual of such entitle-ment bears to 20 years.

(4) Where a worker has completed at least 10years' service but less than 15 years' service sinceits commencement and his employment is termin-ated

by his death; orby the employer for any reason other thanserious misconduct; orby the worker on account of sickness of orinjury to the worker or domestic or otherpressing necessity where such sickness orinjury or necessity is of such a nature asto justify or in the event of a dispute is,in the opinion of the Special Board ofReference, of such a nature as to justifysuch termination;

the amount of leave shall be such proportion of13 weeks' leave as the number of completed yearsof such service bears to 20 years.

(5) In the cases to which paragraphs (3) and(4) hereof apply the worker shall be deemed tohave been entitled to and to have commencedleave immediately prior to such termination.

(d) Payment for Period of Leave.(1) A worker shall subject to paragraph (3)

hereof be entitled to be paid for each week of leaveto which he has become entitled or is deemed tohave become entitled the ordinary time rate ofpay applicable to him at the date he commencessuch leave;

(2) Such ordinary time rate of pay shall be therate applicable to him for the standard weeklyhours which are prescribed by this Award, but in thecase of casuals and part-time workers shall be theordinary time rate for the number of hours usuallyworked up to but not exceeding the prescribedstandard;

(3) Where by agreement between the employerand the worker the commencement of the leaveto which the worker is entitled or any portionthereof is postponed to meet the convenience ofthe worker, the rate of payment for such leaveshall be at the ordinary time rate of pay applicableto him at the date of accrual or, if so agreed, atthe ordinary time rate of pay applicable at thedate he commences such leave.

(4) The ordinary time rate of payshall include any deductions from wagesfor board and/or lodging or the like whichis not provided and taken during the periodof leave;shall not include shift premiums, overtime,penalty rates, commissions, bonuses, allow-ances or the like.

(5) In the case of workers employed on piece orbonus work or any other system of payment byresults payment shall be at ordinary time rates.

(e) Taking Leave.(1) In a case to which paragraph (2) of sub-

clause (c) applies:(a) Leave shall be granted and taken as soon

as reasonably practicable after the rightthereto accrues due or at such time ortimes as may be agreed between the em-ployer and the worker or in the absenceof such agreement at such time or timesas may be determined by the SpecialBoard of Reference, having regard to theneeds of the employer's establishment andthe worker's circumstances.

(b) Except where the time for taking leaveis agreed to by the employer and the workeror determined by the Special Board ofReference the employer shall give to aworker at least one month's notice of thedate from which his leave is to be taken.

(c) Leave may be granted and taken in onecontinuous period or if the employer andthe worker so agree in not more that threeseparate periods in respect of the first 13weeks' entitlement and in not more thantwo separate periods in respect of anysubsequent period of entitlement.

(d) Any leave shall be inclusive of any publicholidays specified in this Award occurringduring the period when the leave is takenbut shall not be inclusive of any annualleave.

(e) Payment shall be made in one of thefollowing ways:-

in full before the worker goes onleave;at the same time as his wages wouldhave been paid to him if the workerhad remained at work, in whichcase payment shall, if the workerin writing so requires, be made bycheque posted to an address specifiedby the worker; orin any other way agreed betweenemployer and the worker.

(f) No worker shall, during any period whenhe is on leave, engage in any employmentfor hire or reward in substitution for theemployment from which he is on leave;and if a worker breaches this provision heshall thereupon forfeit his right to leavehereunder in respect of the unexpired

period of leave upon which he has entered,and the employer shall be entitled to with-hold any further payment in respect ofthe period and to reclaim any paymentsalready made on account of such period ofleave.

(2) In the case to which paragraph (3) or para-graph (4) of subelause (c) applies and in any casein which the employment of the worker who hasbecome entitled to leave hereunder is terminatedbefore such leave is taken or fully taken the em-ployer shall, upon termination of his employmentotherwise than by death pay to the worker, andupon termination of employment by death pay tothe personal representative of the worker uponrequest by the personal representative, a sumequivalent to the amount which would have beenpayable in respect of the period of leave to whichhe is entitled or deemed to have been entitled andwhich would have been taken but for such termina-tion. Such payment shall be deemed to have satis-fied the obligation of the employer in respect ofleave hereunder.

(f) Granting Leave in Advance and Benefitsto be Brought Into Account.

Any employer may by agreement with aworker allow leave to such worker before the rightthereto has accrued due, but where leave is takenin such a case the worker shall not become entitledto any further leave hereunder in respect of anyperiod until after the expiration of the period inrespect of which such leave had been taken beforeit accrued due.

Where leave has been granted to a workerpursuant to the preceding paragraph before theright thereto has accrued due, and the employmentsubsequently is terminated, the employer may de-duct from whatever remuneration is payable uponthe termination of the employment a proportionateamount on the basis of 13 weeks for twenty years'service in respect of any period for which theworker has been granted long service leave to whichhe was not at the date of termination of hisemployment or prior thereto entitled.

Any leave in the nature of long service leaveor payment in lieu thereof under a State law or along service leave scheme not under the provisionshereof granted to a worker by his employer inrespect of any period of service with the employershall be taken into account whether the same isgranted before or after the coming into operationhereof and shall be deemed to have been leavetaken and granted hereunder in the case of leavewith pay to the extent of the period of suchleave and in the case of payment in lieu thereofto the extent of a period of leave with payequivalent to the amount of the payment and tobe satisfaction to the extent thereof of the entitle-ment of the worker hereunder.

An employer shall be entitled to offset anypayment in respect of leave hereunder against anypayment by him to any long service leave scheme,superannuation scheme, pension scheme, retiringallowance scheme, provident fund, or the like orunder any combination thereof operative at thefirst day of April, 1958.

(g) Records to be Kept.Each employer shall during the employment

and for a period of 12 months thereafter, or in thecase of termination by death of the worker a periodof three years thereafter, keep a record from whichcan be readily ascertained the name of each workerand his occupation, the date of the commencementof his employment and his entitlement to longservice leave and any leave which may have beengranted to him or in respect of which payment mayhave been made hereunder.

Such record shall be open for inspection inthe manner and circumstances prescribed by thisAward with respect to the time and wages record.

(h) Special Board of Reference.(1) There shall be constituted a Special Board

of Reference for the purpose hereof to which alldisputes and matters arising hereunder shall bereferred and the Board shall determine all suchdisputes and matters.

(2) There shall be assigned to such Board thefunctions of

the settlement of disputes on any mattersarising hereunder;the determination of such matters as arespecifically assigned to it hereunder.

(3) The Board of Reference shall consist of onerepresentative or substitute therefore nominatedfrom time to time by the Western Australian Em-ployers' Federation (Incorporated) and onerepresentative or substitute nominated from timeto time by the West Australian Trade Unions In-dustrial Council (A.L.P.) together with a chair-man to be mutually agreed upon by the organisa-tions named in this paragraph.

(i) State Law.The provisions of any State law to the extent

to which they have before the coming into opera-tion hereof conferred an accrued right on a workerto be granted a period of long service leave inrespect of a completed period of 20 or more years'service or employment or an accrued right on aworker or his personal representative to payment inrespect of long service leave shall not be affectedhereby and shall not be deemed to be inconsistentwith the provisions hereof.

The entitlement of any such worker toleave in respect of a period of service with theemployer completed after the period in respectof which the long service leave referred to in para-graph (1) hereof accrued due shall be in accordanceherewith.

Subject to paragraphs (1) and (2) hereof,the entitlement to leave hereunder shall be insubstitution for and satisfaction of any long ser-vice leave to which the worker may be entitledin respect of employment of the worker by themployer.

An employer who under any State law withregard to long service leave is exempted from theprovisions of that law as at the first day of April,1958, shall in respect of the workers covered bysuch exemption be exempt from the provisionshereof.

(j) Exemptions.The Special Board of Reference may subject

to such conditions as it thinks fit exempt any em-ployer from the provisions hereof in respect of itsemployees where there is an existing or prospectivelong service leave scheme which, in its opinion is,viewed as a whole, more favourable for the wholeof the employees of that employer than the pro-visions hereof.

(k) Liberty to Apply.Liberty is granted to any party to this Award

to apply to the Court at any time for an appro-priate variation of this clause if any of the termsand conditions operating under the code of LongService Leave being negotiated between the Aus-tralian Council of Trade Unions and Federal Em-ployers' Organisations is varied in any way.
