NIH Public Access Policy

Consolidated Appropriations Act, 2008Division G, Title II, Section 218 of PL 110-161

SEC. 218. The Director of the National Institutes of Health shall require that all investigators funded by the NIH submit or have submitted for them to the National Library of Medicine’s PubMed Central an electronic version of their final peer-reviewed manuscripts upon acceptance for publication to be made publicly available no later than 12 months after the official date of publication: Provided, That the NIH shall implement the public access policy in a manner consistent with copyright law.

NIH Notice NOT-OD-12-160Issued November 16, 2012 With this Notice, NIH informs grantees that in Spring, 2013, at the

earliest, NIH will delay processing of non-competing continuation grant awards if publications arising from that award are not in compliance with the NIH public access policy.  The award will not be processed until recipients have demonstrated compliance.

Submitting an RPPR with a non-compliant publication will generate an automated email notifying the grantee that the progress report includes citations that are out of compliance with the public access policy and requesting a response by a specified due date two weeks prior to the next budget start date.  As indicated above, no sooner than Spring, 2013, the non-competing continuation award will be delayed until a reply to the e-notification is received from the grantee with evidence of compliance or a satisfactory explanation.

Research articles published in a peer-reviewed journal, and

Articles accepted for publication on or after April 7, 2008, and

Articles resulting from NIH funded research, and

Articles written in a Latin-based language

Determine Submission MethodThere are 4 submission methods. The publisher's policy determines which method is used (A, B, C, or D). One task is to figure out which method applies.

Method A Journal deposits the final published article into PubMed

Journal in Process at the end of a citation in your NIH application, proposal, or progress report until the PMCID is available.

Method D Publisher deposits final peer-reviewed manuscript as a

service to their NIH-funded authors for no fee. Publishers have different mechanisms for determining

whether they will deposit the manuscript or not. Search SHERPA/RoMEO to determine publisher guidelines,

check the publisher’s website, and/or use the Method D list of publishers

Corresponding author approves the submission itself and later approves the PMC Web Version.

Method C Author (or a third party) deposits the final peer-reviewed

manuscript (or published article if publisher allows) into PubMed Central via submission system and NIHMSID is applied

Selected author approves the submission itself and later approves the PMC Web Version

After both approval steps are complete, the article is put into a queue for upload to PMC and the PMCID is applied.

Strongly encourage all NIH PIs to respond promptly to emails from NIH about noncompliance with the policy. Ask for assistance if needed.
