Complying developments are prescribed in Schedule 4 of the Development Regulations 2008.

In addition, the following forms of development (except where the development is non-complying) are complying:

1. Advertisements and/or advertising hoardings:(a) that comply with the conditions contained in Table

MtB/4—Design Guidelines for Advertisements; and(b) is not located within the Historic Conservation Area or

on an allotment containing a Heritage Place identified in Table MtB/9—State Heritage Places or MtB/7—Local Heritage Places.

2. A change of use to a shop, office, consulting room or any combination of these uses where all of the following are achieved:

(a) the area to be occupied by the proposed development is located in an existing building and is currently used as a shop, office, consulting room or any combination of these uses;

(b) the development is located inside any of the following area(s):(i) Business and Core Policy Area 5; and(ii) Gawler Street Policy Area 7.

(c) the building is not a State heritage place;(d) it will not involve any alterations or additions to the

external appearance of a local heritage place as viewed from a public road or public space;

(e) if the proposed change of use is for a shop that primarily involves the handling and sale of foodstuffs, it achieves either (i) or (ii):(i) all of the following:

(A) areas used for the storage and collection of refuse are sited at least 10 metres from any Residential Zone boundary or a dwelling (other than a dwelling directly associated with the proposed shop); and

(B) if the shop involves the heating and cooking of foodstuffs in a commercial kitchen and is within 30 metres of any Residential Zone boundary or a dwelling (other than a dwelling

directly associated with the proposed shop), an exhaust duct and stack (chimney) exists or is capable of being installed for discharging exhaust emissions.

(ii) the development is the same or substantially the same as a development, which has previously been granted development approval under the Development Act 1993 or any subsequent Act and Regulations, and the development is to be undertaken and operated in accordance with the conditions attached to the previously approved development;

(f) if the change in use is for a shop with a gross leasable floor area greater than 250 square metres and has direct frontage to an arterial road, it achieves either (i) or (ii):(i) the primary vehicle access (being the access where

the majority of vehicles access/egress the site of the proposed development) is from a road that is not an arterial road; or

(ii) the development is located on a site that operates as an integrated complex containing two or more tenancies (and which may comprise more than one building) where facilities for off-street vehicle parking, vehicle loading and unloading, and the storage and collection of refuse are shared.

(g) off-street vehicular parking is provided in accordance with the rate(s) specified in Table MtB/2—Off Street Vehicle Parking Requirements to the nearest whole number, except in any one or more of the following circumstances:(i) the building is a local heritage place;(ii) the development is the same or substantially the

same as a development, which has previously been granted development approval under the Development Act 1993 or any subsequent Act and Regulations, and the number and location of parking spaces is the same or substantially the same as that which was previously approved; and

Regions SA—Fisheries DivisionNOTICE is hereby given pursuant to Section 90 (2) of the Fisheries Management Act 2007, that the following items have been seized by Officers of the Department of Primary Industries and Regions SA, Fisheries and Aquaculture:

• Rock lobster pot with red neck, light blue rope, 1 x large pink float and 1 x small red oblong float.

• Rock lobster pot with black neck and green rope around the neck, white rope with 1 x white/red float.

• Rock lobster pot with red neck, yellow and red rope, 1 x small white oblong float.

• Rock lobster pot with black neck/cane, white rope,1 x large red float and 1 x small pink float.

The above items were suspected to have been used, or intended to be used, in contravention of the Fisheries Management Act 2007 and were taken into possession at Carpenter Rocks on21 February 2017.

After the expiration of one month from the date of this notice the items listed above shall, on the order of the Minister for Agriculture, Food and Fisheries, be forfeited to the Crown and shall be either disposed of by sale or destruction.

FISHERIES MANAGEMENT ACT 2007: SECTION 115TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, the persons listed in Schedule 4 (the ‘exemption holders’) are exempt from the provision of Section 70 of the Fisheries Management Act 2007 and Regulation 7 (b) Clause Streaky Bay—Blanche Port of Schedule 7 of the Fisheries Management (General) Regulations 2007, but only in so far as they each may engage in the taking of fish species listed in Schedule 2, using gear specified in Schedule 3, subject to the conditions set out in Schedule 4, during the period specified in Schedule 1, unless varied or revoked earlier.

SCHEDULE 3Haul net gear:

Hauling net that is a maximum of 600 metres in length, a maximum of 10 metres in depth, has attached to it a foot rope which exceeds 150 metres in length when measured from the first purse ring to the last purse ring or a rope or ropes the length or combined lengths to a maximum to 100 metres and a mesh size in the pocket of the net:

(a) in the case of a pocket with a mesh knotted in a standard manner—a minimum of 32 mm;

(b) in any other case—a minimum 35 mm; or(c) has a minimum mesh size in the net (other than in the

pocket) of 30 mm.Beach seine gear:

Beach seine net that is a maximum of 450 metres in length, a minimum mesh of 7.6 cm in the pocket and a minimum mesh of 8.9 cm in any other part of the net and maximum depth of10 metres.

SCHEDULE 41. The licence holders listed below or their agents are permitted

to undertake the exempted activity: Neil Schmucker—Marine Scalefish Fishery licence holder M012, John Paul—Marine Scalefish Fishery licence holder M518 and Jason Wright—Marine Scalefish Fishery licence holder M522.

2. The exempted haul net activities must only be undertaken in waters less than 5 metres in depth and in the waters of or near Streaky Bay contained within and bounded by a line commencing at the Mean High Water Springs closest to 324447.58S, 1341434.48E, then beginning north to the location closest to 322727.56S, 134755.52E, then south easterly following the Mean High Water Springs to the point of commencement.

3. The exempted beach seine activities must only be undertaken in waters less than 2 metres in depth, during daylight hours and in the following areas:

(a) The waters of or near Streaky Bay contained within and bounded by a line commencing at the Mean High Water Springs closest to 321229.45S, 1330732.31E (Point Bell), then beginning easterly following the line of Mean

High Water Springs to the location closest to 32 2816.61S, 13450.30E, then south to 322949.39S, 134512.49E, then westerly to 323045.72S, 1335949.94E, then north-westerly back to point of commencement.

(b) The waters of or near Streaky Bay contained within and bounded by a line commencing at the Mean High Water Springs closest to 324323.22S, 1340339.17E, then beginning north to 324243.7S, 1340320.29E, then to easterly to 324315.98S, 1341411.62 (small island off Point Gibson), then south to 324410.36S, 1341350.33E, then Westerly back following the line of Mean High Water Springs to point of commencement.

4. The exempted licence holders must continue to submit SARDI catch and effort returns during the exemption period accounting for all species taken. All present fishing arrangements and obligations continue to apply during the exemption period, except where specifically exempted by this notice.

5. The exemption holder must comply with a licence conditions when undertaking the exempted activity, except where specifically exempted by this notice. This includes licence conditions for School and Gummy Shark.

6. The exempted activities does not permit the take of King George Whiting.

7. All fish not taken as part of this exempted activity must as soon as reasonably practicable be returned to the waters from which they were taken.

8. The exemption holders must two hours before conducting the exempted activity contact PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity. You will need to have a copy of your exemption with you at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related issues. Exemption number 9902887.

9. Within 28 days of the expiry of this notice, the exemption holders must provide a report in writing to the Director Fisheries and Aquaculture Policy (G.P.O. Box 1625, Adelaide, S.A. 5001), including the following information:

• Background and objectives of the trial.• Summary.• Description of fishing gear and operations (including

images and maps).• Summarised information on daily catch and effort

(including tables and graphs), fish market prices, daily catch value and employment.

• Assessment of the economic viability (financial return = gross value of catch-fishing costs) and benefits to regional community.

• Tabulated information on interactions with TEPS and wildlife.

• Recommendations and discussion.• Appendices—data files maintained in MS Excel and

images.10. While engaged in the exempted activity the exemption

holders must have in their possession a copy of this notice and such a notice must be produced to a Fisheries Officer if requested.

11. The exemption holders or agents must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act or any condition of this notice, except where specifically exempted by this notice.Dated 2 October 2016.

3—Interpretation(1) In this notice—

4—Consumption etc of liquor prohibited in dry areas(1) Pursuant to section 131 of the Act, the consumption and possession of liquor in the area

described in the Schedule is prohibited in accordance with the provisions of the Schedule.

(2) The prohibition has effect during the periods specified in the Schedule.

(3) The prohibition does not extend to private land in the area described in the Schedule.

(4) Unless the contrary intention appears, the prohibition of the possession of liquor in the area does not extend to—

(a) a person who is genuinely passing through the area if—

(i) the liquor is in the original container in which it was purchased from licensed premises; and

(ii) the container has not been opened; or

(b) a person who has possession of the liquor in the course of carrying on a business or in the course of his or her employment by another person in the course of carrying on a business; or

(c) a person who is permanently or temporarily residing at premises within the area or on the boundary of the area and who enters the area solely for the purpose of passing through it to enter those premises or who enters the area from those premises for the purpose of leaving the area.

(5) The Schedule is in substitution for Schedule—Port Elliot Area 1 in the principal notice.

Schedule—Port Elliot – Area 1

1—Extent of prohibition

The consumption of liquor is prohibited and the possession of liquor is prohibited.

2—Period of prohibition

From 10 pm on each day to 6 am on the following day.

3—Description of area

The area in and adjacent to Port Elliot bounded as follows: commencing at the point at which the eastern boundary of Rosetta Terrace meets the southern boundary of North Terrace, then easterly along that boundary of North Terrace to the point at which it meets the western boundary of Mason Street, then in a straight line by the shortest route (across North Terrace) to the point at which the northern boundary of North Terrace meets the western boundary of Frederick Street, then northerly along the western boundary of Frederick Street to the point at which it intersects the northern boundary of Regent Street, then easterly along that northern boundary of Regent Street and the prolongation in a straight line of that northern boundary to the eastern boundary of Montpelier Terrace, then south-easterly along that boundary of Montpelier Terrace to the northern boundary of Rosina Crescent, then north-easterly along the northern boundary of Rosina Crescent to the western boundary of Lot 53 Deposited Plan 27840, then north-westerly along the western boundary of that Lot to the southern boundary of Lot 1010 Deposited Plan 52390, then easterly along that boundary of Lot 1010 to the western boundary of Lot 66 Deposited Plan 30324, then southerly along the western boundary of Lot 66 and the western boundary of Lot 865 Filed Plan 166114 and the prolongation in a straight line of that boundary of Lot 865 to the southern boundary of North Terrace, then easterly and north-easterly along that boundary of North Terrace and the southern boundary of the Victor Harbor - Goolwa Road to the northern boundary of the access road from the Victor Harbor - Goolwa Road to the Port Elliot Caravan Park, then south-easterly along the northern boundary of the access road to a car parking area on the northern side of that road, then around the outer boundary of the car park (so as to include the car park in the area) to the northern boundary of a walking track leading from the car park in an easterly direction to the beach, then generally easterly along the northern side of that walking track to the point at which the track reaches the beach, then in a straight line by the shortest route from the eastern end of the track to the low water mark on Encounter Bay, then generally easterly, south-westerly, northerly, south-westerly, south-easterly and westerly along the low water mark (including around the seaward boundary of any wharf, jetty, breakwater, boat ramp or other structure projecting below low water mark) to the point at which the low water mark is intersected by the prolongation in a straight line of the eastern boundary of Merrilli Close, then northerly along that prolongation and boundary of Merrilli Close and the eastern boundary of Rosetta Terrace to the point of commencement. The area does not include the Port Elliot Caravan Park (Lot 1 Deposited Plan 52281 and Lot 858 Filed Plan 166107).

Preamble1 By proclamation made pursuant to the Mining Act   1971 on 13 October 1977 (Gazette

13.10.1977 p1063) the following land, together with other land, was reserved from the operation of Parts 4, 5, 6, 7 and 8 of the Act:

(a) section 752, north out of hundreds (Shellpatch Bore);

(b) section 753, north out of hundreds (Sputnik Bore);

(c) section 756, north out of hundreds (Stuart Range No. 7 Bore).

2 It is now intended that that proclamation be varied under the Mining Act   1971 so that the land referred to in paragraphs (a), (b) and (c) of clause 1 is no longer reserved from the operation of those Parts of the Act.

Opal Mining (Reservation from Act) Variation Proclamation 2017under section 4(2) of the Opal Mining Act 1995

Preamble1 By proclamation made pursuant to the Mining Act   1971 on 13 October 1977 (Gazette

13.10.1977 p1063) the following land, together with other land, was reserved from the operation of the Opal Mining Act   1995 (see Opal Mining Act   1995 Schedule 1 clause 1):

(a) section 752, north out of hundreds (Shellpatch Bore);

(b) section 753, north out of hundreds (Sputnik Bore);

(c) section 756, north out of hundreds (Stuart Range No. 7 Bore).

2 It is now intended that that proclamation be varied under the Opal Mining Act   1995 so that the land referred to in paragraphs (a), (b) and (c) of clause 1 is no longer reserved from the operation of the Opal Mining Act   1995 .

This proclamation may be cited as the Opal Mining (Reservation from Act) Variation Proclamation 2017.

NOTICE is hereby given pursuant to Section 197 (3) of the Local Government Act 1999, that following community consultation, the Town of Gawler at its meeting held on 23 August 2016, resolved to adopt the Town of Gawler Administration Centre Community Land Management Plan.

Proposed Revocation of Community Land—Krieg ReservePURSUANT to Section 193 and 194 of the Local Government Act 1999, the Council wishes to notify the community that it proposes to revoke the Community Land Classification of the whole of the following Council owned property, known as Krieg Reserve (Subject Land):

• Undeveloped Reserve—Allotment 500, in Deposited Plan 6799, Certificate of Title Volume 5166, Folio 75, Evanston Park.

The revocation of the community land classification is proposed as the Subject Land has been identified as underutilised land which is surplus land to the requirements of Council.

The Public Consultation Report relating to the subject land is available within the Public Consultation section of Council’s website www.gawler.sa.gov.au or in person at Council’s Administration Office, 43 High Street, Gawler, or the Evanston Gardens Community Centre Library, 65 Angle Vale Road, Evanston Gardens.

Written submissions are encouraged from interested persons and must be received by Council, (P.O. Box 130, Gawler, S.A. 5118), not later than 5 p.m. on Monday, 10 April 2017.

Proposed Revocation of Community Land—Allotment 14Overway Bridge Road—Reserve

PURSUANT to Section 193 and 194 of the Local Government Act 1999, the Council wishes to notify the community that it proposes to revoke the Community Land Classification of the whole of the following Council owned property, known as Allotment14 Overway Bridge Road—Gawler West (Subject Land):

• Undeveloped Reserve—Allotment 14, in Deposited Plan 69827, Certificate of Title, Certificate of Title Volume 5960, Folio 832, Gawler West.

The community land classification revocation is proposed as the Subject Land has been identified as underutilised land which is surplus land to the requirements of Council.

It is proposed to divest the Subject Land and to invest the financial proceeds to assist in funding Capital Projects.
