1 .O Background

1 . I There are some 98 trusts applicable to the area covering the former County of Lanark. These range from small trusts which cannot be used either because they are too small or are out of date, to the two largest trusts, the Marshall Trust and the Lanarkshire Trust both of which were established in the 1930s to incorporate a large number of trusts which existed to that date.

1.2 A report on the subject of the Lanarkshire Educational Trust and the Marshall Trust, collectively dealt with under the terms of the Lanarkshire Educational Trust Scheme, was presented to and approved by the Education Committee on the 2nd August 1996. ( A copy of the paper is included, appendix i )

1.3 This allowed the Education Department to make the necessary arrangements in order to apply the free annual income of the endowment and in particular exercise their powers under sections 21-29 of the Scheme.

2.0 Procedures undertaken by North Lanarkshire Council

2.1 Detailed research was made into the terms of the I rust Scheme and in particular sections 21-29 to ascertain the nature of grants likely to be awarded under each category. Legal clarification was also sought on the basis of those eligible to an award. ( Most significantly only those residing within the area formerly know as the County of Lanark are eligible)

2.2 Subsequently the categories were broadly banded together as;

21 , 22, 23 - Application from individuals 24,26 or 28 - Applications from groups or clubs 25, 26,27 or 29 - Application from EA or educational establishment

2.3 During discussions between Mr. Dan Sweeney ( Head of Quality Development Service, North Lanarkshire ) and Mr. Jim Duffin ( Head of School Development, South Lanarkshire ) the individual categories were carefully considered. Guidelines to be applied to possible requests, including maximum sums to be awarded per category, were then produced. ( Appendix ii )

2.4 An application form for each of the three groupings (appendix iii ) was designed and reproduced in advance of an advert (appendix iv) which was carried in local newspapers within North Lanarkshire ( Cumbernauld News, Bellshill Speaker / Motherwell Times and Airdrie Coatbridge / Airdrie Advertiser ) in December 1996. A similar advert appeared in papers covering South Lanarkshire (East Kilbride News, Hamilton Advertiser and Carluke and Lanark Gazette ) in March 1997.

- 2.5 Both adverts carried a deadline of one month after which the applications were summarised and given preliminary consideration by Mr. Dan Sweeney and Mr. Jim Duffin.

2.6 On the basis of the comments shared by these respective Heads of Service from North and South Lanarkshire with respect to every application, a summary was compiled (appendix v). Subsequently awards are suggested, with appropriate sums, for consideration by the committee.

3.0 Proposals

3.1 In the past, under Strathclyde Regional Council, awards were made throughout the financial year. This was usually in response to a request for financial assistance, from educational establishments and members of the general public.

3.2 It is proposed that in the future requests for financial assistance are made in response to an annual public advert, possibly placed in the Autumn of each 0 financial year.

3.4 This would allow applications to be considered and if necessary clarified, before presenting these requests to the Educational Trust Committee shortly before the end of the financial year.

3.5 By adopting this timescale the amount requested within each category could be considered, in conjunction perhaps with requests for special projects, against the total sum available for that particular year.

3.6 It is also proposed that due to the heavy administrative demands placed upon the education department in North Lanarkshire in effectively operating the Trusts, the sum of €15,000 be allocated from the available annual income to facilitate the management and administration of the Trust. This sum would be subject to annual review. It is requested that a pro rata sum be allocated to North Lanarkshire Council in respect of Trust management and administration for the period 1st September 1996 - 31st march 1997.

4.0 Recommendations

EDUCATIONAL ENDOWMENTS - THE LANARKSHIRE EDUCATIONAL TRUST AND THE MARSHALL TRUST

REPORT BY THE DIRECTOR

1. BACKGROUND

1.1. On April 1st 1996 the Lanarkshire Educational Trust and the Marshall Trust. preliously vested with Strathclyde Regional Council. were transferred to and vested to the same e.\tent in North Lanarkshire Council.

1.2 At the committee meeting on 30th April 1996 the Education Committee authorised the Director of Education to administer all Endowments transferred to North Lanarkshire Council in terms of The Educational Endowments (Strathclyde Region). Transfer Scheme Order 1996. It further recommended under the amended terms of the Lanarkshire Educational Trust Scheme 1936. that North Lanarkshire Council constitute a Committee of the Council called the Educational Trust Committee to be composed of 3 persons nominated by North Lanarkshre Council and 3 persons nominated by South Lanarkshre Council.

2. THE LANARKSHIRE EDUCATIONAL TRUST dk THE MARSHALL TRUST

2.1

2.2

The Lanarkshire Educational Trust was established by the Lanarkshre Educational Trust Scheme 1936. amended by the Lanarkshire Education Trust Amendment Scheme Order in Council 1967. The Marshall Trust was established by the Marshall Trust scheme 1936 and adopts those parts of the Lanarkshire Educational Trust scheme relative to the administration of the fund and treats the Marshall Trust income as free annual income to be applied in accordance with the plan approved by the Scottish Education Department under the Lanarkshre Education Trust. In short it allows the two trusts to be administered as one.

Purpose of the Trust The purpose of the Lanarkshire Educational Trust are those set out in Schedules 2 and 3 of the trust scheme which determine specific prizes or bursaries and those set out in the approi.ed plan drawn up in accordance with sections 2 1-29 - travel scholarships. tra\,el agents. research scholarships. special equipment for the purpose of irnpro\.ing the efficiency of education in any of the Council's schools. provision and maintenance of sports facilities. promoting education in the visual arts. in music and in drama. support of clubs. societies and organisations for children and young people and educational esperiments conducted by the education authori?.

3. PROPOSALS

3.1 Under the terms of the Lanarkshire Educational Trust Scheme. there is an obligation on the Council to prepare and submit for the approval of the Scottish Office Education and Industry Department a plan for the exercise of their powers under sections 2 1-29 of the Trust deed. This plan would include details of the purposes to which the income and. where laibful. the capital of the endowment shall be applied together with the masimum sums which may be expanded upon each object. It is proposed that the existing plan (ref. para 2) continue to be applied until the Educational Trust Committee has had the tinie to review it and have a new plan approved.

3.2 Traditionally Directors of Education have been gwen delegated responsibilie to deal with applications under the Trust scheme. Matters of disbursement can be more efficiently and espeditiously processed by such an arrangement and it is proposed that it continues and that responsibility to deal with applications under the Trust Scheme is delegated to the Directors of Education of North and South Lanarkshre in respect of applicants from within their respective Council boundaries. '

Exceptional applications will be refered to the Educational Trust Committee for their consideration.

3.3 Official concern has been expressed in the past about the accumulation of income within the two trusts. This may be linked to a common lack of knowledge about the esistence of the trusts and the purposes to which they can be applied. It is proposed therefore that appropriate steps should be taken to publicise the trusts and to prepare appropriate mst applications procedures.

Guidelines as applied to applications 1996-97

21 .Travel Scholarships It shall be lawful for the County Council subject to the provisions of the approved plan to award travel scholarships to persons belonging to the County who require financial aid to travel furth of Scotland to a University, College, Educational Institution or Centre while undergoing a course of study, to pay any fees which may be charged for such a course and to obtain any necessary books or instruments. In granting such scholarships the County Council shall have regard to the diligence, attainment and promise of the applicants and in determining the amount of each scholarship the County Council shall have regard to the financial circumstances of the applicant or contributions to his expenses made or liable to be made which in the opinion of the County Council could reasonably be expected from his parents or any other person contributing or liable to contribute to his expenses ( including any other bursaries or grants paid to him ) and to the expenses likely to be incurred by him.”

22. “Travel grants It shall be lawful for the County Council subject to the provisions of the approved plan to make grants to persons belonging to the County to enable them to travel either in Great Britain or abroad for any purpose of an educational nature. The County Council shall require applicants for such grants to submit for their approval a statement of the purposes for which the journey is to be undertaken, the places to be visited and the probable length of absence from home. In making such grants the County Council shall have regard ts the diligence, attainment and promise of the applicants and in determining the amount of each grant the County Council shall have regard to the financial circumstances of the applicant or contributions to his expenses made or liable to be made which in the opinion of the County Council could reasonably be expected from his parents or any person contributing or liable to contribute to his expenses (including any other bursaries or grants paid to him) and to the expenses likely to be incurred by him. ”;

that needy individuals and their particualr circumstances would not be . . identified and (ii) multiple journeys (basically a claim for travelling expenses)

It shall be lawful for the County Council subject to the provisions of the approved plan to award scholarships for research work or special study to inhabitants of the County who have graduated at a Scottish University or obtained the diploma of a Central Institution, provided that such inhabitants require financial aid in order to enable them to undertake such research work or special study. Each candidate shall submit for the approval of the County Council a programme of the research work or special study to be undertaken by him. Each scholarship shall be tenable for one year and it shall be in the power of the County Council to extend the period of tenure from year to year on being satisfied with the progress made by the holder of the scholarship. In making awards under this section the County Council shall have regard to the records of the candidates at the Universities or Central Institutions attended by them. The annual value of each scholarship shall be such as the County Council may fix having regard to the financial circumstances of the holder and to the expenses likely to be incurred by him.

23. Research scholarships

24. Support of Clubs etc. It shall be lawful for the County Council subject to the provisions of the approved plan to make grants to assist in the establishment and maintenance of clubs, societies and organisations for children and young people resident in the County, provided that the County Council shall periodically satisfy themselves that such clubs, societies and organisations are so conducted as to be for the educational benefit, mental or physical, moral or social, of the said children and young people.

Guidelines Group application - maximum award €1000 Details of financial assistance requested necessary along with information

regarding similar applications for and success in gaining other grants . Club accounts, details of fund raising and history of the club required to substantiate claim.

25. Special Equipment It shall be lawful for the County Council subject to the provisions of the approved plan to make grants to themselves as Education Authority to be applied for the purpose of improving the efficiency of education in any of the public schools or further education centres within the County by providing special equipment for such schools or centres in supplement to that which as Education Authority they may reasonably be expected to supply.

26. Sports Facilities It shall be lawful for the County Council subject to the provisions of the approved plan to- (a) assist in the provision and maintenance of playing fields, swimming baths and other accommodation for sports with any necessary pavilions and other offices for the benefit of persons belonging to the County; (b) assist in defraying the expenses of inter-school sports meetings and providing such apparatus and equipment including such personal equipment and sports clothing as they think fit for the benefit of persons belonging to the County; (c) assist in defraying the travelling expenses of school, district and County teams engaged in national competitions; and (d) assist amateur sportsmen belonging to the County who show exceptional promise and who require financial aid for the development of their talents by special tuition under such conditions as may be approved by the County Council:

Individual applicants would apply under 26d. but would be treated similar to those applying under 21, 22, 23, and be restricted to a maximum of f250

27. Education Experiments It shall be lawful for the County Council subject to the provisions of the approved plan to make grants to themselves as Education Authority to be applied in assisting to defray the cost of any experiment of an educational nature conducted by the County Council as Education Authority.

28. Adult Education. It shall be lawful for the County Council subject to the provisions of the approved plan to promote and encourage or to assist in promoting and encouraging adult education in the County by arranging or assisting to arrange for lectures or other suitable types of instruction, by paying or assisting to pay the fees, travelling expenses and personal expenses of lecturers or other instructors, and by defraying or assisting to defray other expenditure necessarily incurred in connection therewith.

Group application maximum award €1 000 Award strictly to cover costs of lecturer / instructor. Subsequently details of these specific costs are essential.

29. Promoting Education in the Visual Arts It shall be lawful for the County Council subject to the provisions of the approved plan to promote education in the visual arts among persons belonging to the County by- (a)establishing and maintaining or assisting to establish and maintain a collection of works of art of which the whole or part shall be available for circulation among the educational establishments in the County; (b) granting assistance to any of the said persons who show exceptional promise in any of the visual arts and who require financial aid to enable them to obtain special tuition or to pursue private study under such conditions as may be approved by the County Council; and (c) organising and defraying or assisting to organise and defray the expenses of art exhibitions and lectures and demonstrations on any of the visual arts.’’

29A Promoting Education in Music it shall be lawful for the County Council subject to the provisions of the approved plan to promote education in music among persons belonging to the County by- (a) establishing, maintaining and equipping or assisting to establish, maintain and equip choirs, bands, orchestras and instrumental groups composed wholly or mainly of the said persons; (b) granting assistance to any of the said persons who show exceptional talent in vocal or instrumental music and who require financial aid to enable them to acquire, where necessary or desirable, a musical instrument and to obtain special tuition or to pursue private study under such conditions as may be approved by the County Council; and (c) organising and defraying or assisting to organise and defray the expenses of concerts for the educational benefit of pupils attending schools in the County and of musical performances and musical lectures.”;

298 Promoting Education in Drama It shall be lawful for the County Council subject to the provisions of the approved plan to promote education in drama among persons belonging to thecounty by- (a) establishing, maintaining and equipping or assisting to establish,

maintain and equip dramatic groups composed mainly or wholly of the said persons; (b) establishing and maintaining or assisting to establish and maintain a library of plays suitable for performances by such groups; (c) granting assistance to any of the said persons who show exceptional talent in dramatic art and who require financial aid to enable them to acquire, where necessary or desirable, a musical instrument and to obtain special tuition or to pursue private study under such conditions as may be approved by the County Council; and (d) organising and defraying or assisting to organise and defray the expenses of dramatic art performances and of lectures and demonstrations in dramatic art for the benefit of the said persons.”;

identify only that bid(s) specifically meeting the conditions of the category and allocate it the appropriate sum(s). Advisers within North and South Lanarkshire, responsible for the Visual Arts, Music or Drama, are entitled to apply for financial support of specific projects within these categories - with no financial limit.

The Lanarkshire Educational Trust and the Marshal1 Trust were established in the 193Os, with the purpose of providing some assistance for those people, residing within the County of Lanark and facing financial hardship in pursuit of their education. Initially this was in the form of educational bursaries and scholarships.

Arrangements have now been made to allow these Trusts to be reactivated under the collective heading of the Lanarkshire Educational Trust Scheme. The terms of the trust allow grants to be awarded for a number of educational purposes including; travel scholarships, travel grants, research scholarships, support of club/organisations for young people, special educational equipment for schools, provision and maintenance of sports facilities, educational experimentation, promoting education in visual arts, in music and in drama and limited aspects of adult education. The sums available under each of the above headings are limited and it is expected that the demands for grant support will exceed the funds available
