TAKE NOTICE that a runoff election will be held in the City of Corpus Christi, Texas on December 15, 2020, FOR THE ELECTION OF MAYOR AND TWO COUNCIL MEMBERS, ALL in obedience to an ordinance entered by the City of Corpus Christi, Texas on November 17, 2020, which ordinance reads substantially as follows:

One -reading Ordinance ordering a runoff election to be held on December 15, 2020 in the City of Corpus Christi for the election of Mayor and Council Member

Districts One and Four, designating polling place locations, enacting provisionsincident and relating to the subject and purpose of this ordinance.

WHEREAS, Ordinance 032176 ordered a General Election to be held on November 3, 2020

for the election of Mayor and Eight Council Members;

WHEREAS, Ordinance 032176 enacted provisions incident to and relating to said GeneralElection;

WHEREAS, the official canvass of said election reveals that none of the candidates for the offices

of Mayor and Council Member District One and Four received the number of votes required for

election; and

WHEREAS, the runoff election has been scheduled for December 15, 2020;

WHEREAS, the City has entered into a contract for Election Services with the Nueces

County Clerk pursuant to Contract No. 2020-299 filed of record with the Office of the CitySecretary;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,

TEXAS, THAT:

SECTION 1. A runoff election for the office( s) of Mayor and Council Member Districts One and

Four shall be held December 15, 2020, with the names of the following candidates for therespective office as follows:

SECTION 2. That at said election herein ordered, all qualified voters of the City of Corpus Christieligible to vote in the runoff election shall be permitted to vote as provided by law.

SECTION 3. The names of candidates for said offices shall be placed on said ballot in the manner

and form prescribed by law.

SECTION 4. The eSlate direct recording equipment shall be used at the election in accordance with

Texas Election Code.

SECTION 5. The election shall be held at the polling places in the regularly prescribed precincts ofthe City of Corpus Christi, as set forth on Attachment A hereto incorporated by reference andmade part of this ordinance. The election shall be held in accordance with the election laws of the

State of Texas and in accordance with ordinance of the City Council. Nueces County participates

in the Countywide Polling Place Program under Election Code Section 43. 007 as amended,

meaning that any qualified registered voter of the City of Corpus Christi can vote in the election

at any polling place identified in Attachment A. The polls shall be open from 7: 00 am to 7: 00 p. m. on the day of the election.

SECTION 6. The City Secretary shall conduct the election as directed by Ordinance of the CityCouncil and by law.

SECTION 7. Early voting for the election in person may be conducted at the times and locations ofthe temporary branch polling places set forth on Attachment B to this Ordinance heretoincorporated by reference and made part of this ordinance. The City Secretary is authorized, inthe event of an emergency, preventing any of the designated polling places from being utilized, toprovide for suitable replacement locations.

SECTION 8. The City Secretary is directed to post and publish such election notices as are

required by the Election Laws of the State of Texas. The City Secretary is further appointed as theauthority and officer responsible for the conduct of said election and is hereby authorized anddirected to make all necessary arrangements for the holding of said election in accordance withand subject to the laws of this State including but not limited to coordinatingthe election process, tabulation equipment, and supplies in accordance with the election agreement to be executed

with Nueces County. The City Secretary is authorized to approve all lawful changes and additionsto the procedures provided herein in order to implement such agreement, including, but notlimited to provisions for substations.

SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as his action allmatters recited in this ordinance which by law come within jurisdiction.

SECTION 9. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision

of this ordinance shall be held invalid or unconstitutional by final judgment of a court ofcompetent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause,

phrase, work, or provision of this ordinance, for it is the definite intent of this City Council thatevery section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full forceand effect for its purpose.

SECTION 10. The fact that it is necessary and essential that the governing body of the City ofCorpus Christi order the runoff election, that the notice of such election should be promptly

posted and published, that the City runoff election shall be held on December 15, 2020, andimmediate action is necessary for the efficient and effective administration of the city' s affairs,

creates a public emergency and an imperative public necessity requiring the suspension of the

Charter rule that no ordinance shall be passed finally on the date of its introduction but thatsuch ordinances shall be read on emergency reading. The City Council hereby ( 1) finds thatsuch emergency and necessity do exist due to the need for immediate action necessary for theefficient and effective administration of the City' s runoff election and ( 2) suspends the

Charter rule that requires consideration of and voting upon ordinances at two regular

meetings so that this ordinance is passed and takes effect upon first reading as an emergencymeasure on this !i'day of November, 2020

SE AVISA que se llevará a cabo una elección de desempate en la ciudad de Corpus Christi, Texas el 15 de diciembre de 2020, PARA LA ELECCION DE ALCALDE Y DOS MIEMBROS DEL CONCILIO, TODOS apegados a una ordenanza presentada por la Ciudad de Corpus Christi, Texas en 17 de noviembre de 2020, dicha ordenanza se lee sustancialmente de la manera siguiente:

La ordenanza decreta a una elección de desempate que se llevará a cabo el 15 de diciembre de 2020, en la Ciudad de Corpus Christi para la elección de Alcalde, y Miembros del Concilio de los Distritos Uno y Cuatro; designa los lugares de votación; y promulga las provisiones incidentales y relacionadas con el asunto y propósito de esta ordenanza.

EN VISTA QUE, la Ordenanza 032176 ordenó que se celebrara una Elección General el 3 de noviembre de 2020 para la elección del Alcalde y de Ocho Miembros del Concilio;

EN VISTA QUE, la Ordenanza 032176 promulgó disposiciones relativas a la dicho Elección General;

EN VISTA QUE, el escrutinio oficial de dicha elección revela que ninguno de los candidatos a las oficinas de Alcalde y Miembros del Concilio de los Distritos Uno y Cuatro recibieron el número de votos requeridos para la elección; y

EN VISTA QUE, la elección de desempate se ha programado para el 15 de diciembre de 2020;

EN VISTA QUE,

AHORA, POR LO TANTO, DECRETA EL CONCILIO DE LA CIUDAD DE CORPUS CHRISTI, TEXAS, QUE:

SECCIÓN 1. Una elección de desempate para las oficinas del Alcalde y Miembros del Concilio de los Distritos Uno y Cuatro se llevará a cabo en la Ciudad de Corpus Christi, Texas el 15 de diciembre de 2020, con los nombres de las siguientes candidatos para la oficina respectiva de la siguiente manera:

SECCIÓN 2. Que en la dicha elección ordenó, todos los votantes calificados de la Ciudad de Corpus Christi elegibles para votar en la elección de desempate se les permitirá votar según lo estipula la ley.

SECCIÓN 3. Los nombres de los candidatos para dichas oficinas se colocarán en dicha boleta en la manera y forma prescritas por la ley.

SECCIÓN 4. El equipo de grabación directa de eSlate se usará en la elección de acuerdo con el Código Electoral de Texas.

SECCIÓN 5. La elección se llevará a cabo en los lugares de votación en los recintos regularmente prescritos de la ciudad de Corpus Christi, tal como se establece en el Anexo A aquí, incorporado por referencia e hizo parte de esta ordenanza. La elección se llevará a cabo de acuerdo con las leyes electorales del Estado de Texas y de acuerdo con la Ordenanza del Concilio de la Ciudad. El Condado de Nueces participa en el programa del lugar de votación de todo el condado bajo Código de Elección Sección 43.007 como enmendado, significando que cualquier votante registrado calificado de la ciudad de Corpus Christi puede votar en la elección en cualquier lugar de votación identificado en el Anexo A. Los lugares de votación estarán abiertas de 7:00 a.m. a 7:00 p.m. el día de la elección.

SECCIÓN 6. La Secretaria de la Ciudad llevará a cabo la elección según lo indique la Ordenanza del Concilio de la Ciudad y por ley.

SECCIÓN 7. La votación anticipada para la elección en persona se puede llevar a cabo en los horarios y ubicaciones de los lugares de votación de la sucursal temporal establecidos en el Anexo B de esta ordenanza aquí, incorporado por referencia y hecho parte de esta ordenanza. La Secretaria de la Ciudad está autorizada, en caso de una emergencia, impidiendo que se utilicen cualquiera de los lugares de votación designados, para proveer ubicaciones de reemplazo apropiadas.

SECCIÓN 8. La Secretaria de la Ciudad está dirigida a enviar y publicar tales avisos electorales como son requeridos por las Leyes Electorales del Estado de Texas. La Secretaria de la Ciudad es designada además como la autoridad y oficial responsable de la conducta de dicha elección y por la presente está autorizada y dirigida a hacer todos los arreglos necesarios para la celebración de dicha elección de acuerdo con y sujeto a las leyes de este Estado incluyendo pero no limitado a coordinar el proceso de elección, el equipo de tabulación, y los suministros en acuerdo con el acuerdo de elección que se ejecutará con el Condado de Nueces. La Secretaria de la Ciudad está autorizada a aprobar todos los cambios legales y adiciones a los procedimientos aquí estipulados con el fin de implementar dicho acuerdo, incluyendo, pero no limitado a las provisiones para subestaciones.

SECCIÓN 8. Al aprobar y firmar esta ordenanza, el Alcalde confirma oficialmente como su acción todos los asuntos que se recitan en esta ordenanza que, por ley, están dentro de la jurisdicción.

SECCIÓN 9. Si por cualquier razón alguna sección, párrafo, subdivisión, cláusula, frase, palabra, o provisión de esta ordenanza se considerara inválida o inconstitucional por fallo final o por una corte de jurisdicción competente, no afectará a ninguna otra sección, párrafo, subdivisión, cláusula, frase, trabajo, o provisión de esta ordenanza, debido a que la intención del Concilio de la Ciudad de cada sección, párrafo, subdivisión, cláusula, frase, palabra o provisión de este documento entre de lleno y en efecto de su propósito.

SECCIÓN 10. El hecho de que sea necesario y esencial que el Consejo de administración de la ciudad de Corpus Christi ordene la elección de desempate, que el aviso de tal elección debe ser publicado y publicado puntualmente, que la elección de desempate de la ciudad se llevará a cabo el 15 de diciembre de 2020, y la acción inmediata es necesaria para la administración eficiente y eficaz de los asuntos de la ciudad, crea una emergencia pública y una necesidad pública imperativa que requiere la suspensión de la regla de la Carta que ninguna ordenanza será aprobada finalmente en la fecha de su introducción, pero que tales ordenanzas se leerán en la lectura de emergencia. El Concilio de la Ciudad (1) considera que tal emergencia y necesidad existen debido a la necesidad de acción inmediata necesaria para la administración eficiente y efectiva de la elección de desempate de la ciudad y (2) suspende la regla de la Carta que requiere consideración y votación sobre las ordenanzas en dos reuniones regulares para que esta ordenanza sea aprobada y entre en vigencia en la primera votación como medida de emergencia en este día 17 de noviembre de 2020.
