We would like to invite all of my fellow utility and excavation contractors and associate members to attend NUCA’s 50th anniversary convention. We can assure you that this year’s event will not only be informational and fun, it will also be memorable. Those of us who survived the recent recession are slowly but surely seeing work pick up.

And this year’s convention was put together to provide the information and tools for companies to examine their operations, learn ways to reduce costs, increase productivity, improve profits, and bring some innovative thinking into your company.

One of the best things about our conventions is interacting with peers from all over the country to discuss issues you are facing in your company and hear how other contractors resolved these issues. We also enjoy sharing helpful information with other contractors. Attendees will have many chances to interact—happy hours, informal dinners, roundtable discussions, social events, and just sitting around waiting for the next event to begin. There are a lot of other conventions out there, but the NUCA convention is unique because nearly all attendees are company owners or management—the people that have to confront company problems and make the tough decisions. We can’t put a value on having access to hundreds of other company owners under one roof.

One of the most exciting things about this convention is our celebration of NUCA’s 50th anniversary. Associations come and go, but the fact that NUCA has survived 50 years—despite facing many periods of economic diversity— says something about the kind of organization NUCA is and the constitution and commitment of its membership. And that is something that we can all be proud of. We encourage all of you to come to warm, sunny Florida and enjoy the educational opportunities, camaraderie, and great social events.

NUCA Legislative Update

The President released his Budget plan for Fiscal Year 2016. It will take me a while to get through the whole thing, but I wanted to get you some information about what’s in it as soon as I could. I’ll bullet some of the highlights I’ve found so far:

The budget proposes to again cut the SRF program. While simultaneously publically voicing support for building infrastruc-ture, the FY16 proposed budget cuts $54 million from the Clean Water SRF and the Drinking Water SRF from $2.35 bil-lion to $2.3 billion.

Eliminates the Dept. of Ag. Water and Wastewater Community Facilities Loan Guarantees. This is a part of the Rural Utility Service that helps rural areas finance water infrastructure projects.

Eliminates the Water Quality Research and Support Grants program from EPA.

Repeals a host of Energy, gas and oil production tax credits including the Domestic Manufacturing Tax Deduction for Oil and Natural Gas Companies, the expensing of intangible drilling costs, and percentage depletion for Oil and natural gas wells. These tax provisions will increase taxes on oil and natural gas producers by about $40 billion.

Reauthorizes surface transportation (MAP-21 and the Highway Trust Fund) for six years at $478 billion.

Requires employers to make part time employees eligible for their retirement savings plan if the employee has worked an average of 500 hours per year for at least three years.

Includes nearly $1.9 billion for the Dept. of Labor’s worker protection agencies. This will be used to encourage an increase in the minimum wage, empower OSHA and MSHA ($990 million), and expand civil monetary penalties for safety violations.

Corporate Tax rate would be cut to 28% paid for by eliminating tax expenditures and credits.

Businesses with gross receipts less than $25 million would be allowed to use ‘cash’ accounting for their tax accounting. This would allow small businesses to write off up to $1million in investments in equipment up font- eliminating most of the need for depreciation rules.

Would implement a 19% minimum tax on foreign earnings of U.S. companies without loopholes or deferrals. A one-time 14% transition toll on up to $2 trillion of untaxed foreign earnings will be used to pay for the HTF.

As I said, this is just the highlights from a quick read. There will be more to come. It will be helpful, in developing the next Political Insiders I send, if you would send me any questions you may have!

When we discussed President Obama's plans for a new Water Finance Center and a new type of

bond to finance water infrastructure projects in our January 21 and 28 blog posts , we said that

while we thought those ideas held promise, we retained a bit of skepticism over the source of their

funding, and wondered in particular if the Administration might seek to pay for them through cuts to

the EPA’s State Revolving Fund (SRF) allotment. Given that the President has proposed signifi-

cant cuts to the SRF program in the past, including hundreds of millions of dollars in proposed cuts

in early 2014, we were on the lookout for similar cuts in his fiscal year 2016 budget plan. We prom-

ised to scrutinize the details of that plan, and we did. Unfortunately, we were right to be skeptical.

Despite its generosity to infrastructure generally (requesting $478 billion to be spent on the High-

way Trust Fund and mass transit projects over the next six years), the President's budget proposes

cuts of $54 million from the Clean Water SRF and Drinking Water SRF, from $2.356 billion to

$2.302 billion. .

As we have noted before, preserving SRF funding is critical because these funds finance projects

that not only deliver clean water but grow our economy by providing jobs and supporting business-

es in rural, urban and suburban communities all over the country. CWC believes that these pro-

posed cuts are misguided, and reflect a failure to recognize the comprehensive and intertwined na-

ture of our infrastructure. Our country's infrastructure is not only the roads that carry our products

to market, but the water treatment and delivery systems that allow our businesses to produce

goods and services that rely on use of those roads. We will be lobbying strenuously to prevent wa-

ter infrastructure funding from being a casualty of the 2016 budget process, and we will keep you

updated on our efforts.

OSHA reminds employers to post OSHA 300A injury/illness summary February through April

OSHA is reminding covered employers to post OSHA's Form 300A, which summarizes the total number of job-related injuries and illnesses that occurred during 2014 and were logged on OSHA's Form 300, the log of work-related injuries and illnesses. The summary must be posted between Feb. 1 and April 30, 2015, and should be displayed in a common area where notices to employees are usually posted.

Employers with 10 or fewer employees and employers in specific low-hazard industries are normally exempt from federal OSHA injury and illness recordkeeping and posting requirements. Due to changes in OSHA's recordkeeping requirements that went into effect Jan. 1, 2015, certain

previously exempt industries are now covered. Lists of both exempt and newly covered industries are available on OSHA's website. Visit the Updates to OSHA's Recordkeeping Rule Web page for more information on recordkeeping requirements.
