PAUL CARRIEL MEMORIAL TROPHY OUTSTANDING JUNIOR SAILOR

To be awarded each year to the boy or girl in the Junior Sailing Program who has demonstrated both good sportsmanship and outstanding sailing and leadership skills. Named for Paul Carriel who was the first instructor in the Junior Sailing Program, serving for three years. Paul was the first sailor from the Nyack Boat Club and Hudson River Yacht Racing Association ever to reach the final round of a North American Yacht Racing Union (later USYRU, now USSA) championship, when he raced for the Sears Cup in 1967. Paul crewed for his father, Jon, when they placed second in the Thistle Atlantic Coast championship in 1964. Paul was an exceptionally popular and gifted young man. GENERAL 1. All members of the Club are responsible for themselves, their families, and their guests for

compliance with these Rules. Violators may be subject to penalties as specified under "Misconduct" in the By-Laws.

2. All members must register their guests other than members of their immediate family. Each member is responsible for the conduct of his guest while they are on Club premises. Guests may not use Club facilities unless accompanied by a Club member.

3. Guest privileges are extended to members of other recognized Yacht or Boat Clubs upon signing the guest register.

4. Children under 14 years of age must be under effective supervision of a responsible adult at all times while on Club property. Children under 18 years of age must vacate Club premises by 9:00 PM unless accompanied by a member.

5. Interior furniture is not to be taken out of the clubhouse except for a scheduled Club event and with the explicit approval of a member of the Board of Governors.

6. Dogs are not allowed on Club property except on leash being taken directly to or from a boat.

7. No member is allowed to use the Club for commercial purposes, except with the permission of Board of Governors.

8. Members are expected to turn out lights, lock clubhouse doors, and fence gates when leaving at any time except between 8:00 AM and 8:00 PM on Saturdays, Sundays, and holidays during the boating season.

9. The clubhouse pedestrian gate should be kept closed at all times. 10. The parking facilities adjacent to the northwest corner of the Clubhouse are for the use of

Club officers only. 11. Parking is not permitted along the North driveway at any time or the South driveway

between May 1 and October 31. 12. Parking facilities in the southwest corner of the property are for general member usage.

Vehicles should be parked so that they do not prevent other members from entering or leaving; if this cannot be done, members must either leave keys in the car or deposit them with the Snack Bar attendant.

13. Any event of social or business nature which is not a regular Club function or one of its constituted fleets, and involves the use of Club facilities and the attendance of more than ten non-members may be held only with the prior approval by the Board of Governors.

14. All refuse, including empty cans and bottles, must be deposited in the proper receptacles. All refuse brought from boats must be deposited in containers in the northwest corner of the property.

15. It is the responsibility of a group sponsoring any activity on Club property to insure that the Club is left in an orderly manner. This includes the kitchen, sound equipment, furniture; rubbish is to be removed to the dumpster in the northwest corner of the property.

16. Members, their families, and guests are requested to dress in a conservative manner in and around the upper Clubhouse area. Shirts must be worn, and bathing suits must be covered.

17. Members are responsible for reporting any observed vandalism or misuse of Club property to a member of the Board of Governors.

18. Members will be required to reimburse the Club for any property damaged through misuse.

19. Members are not permitted to store, dry sail, or launch motorized personal watercraft such as Jet Ski type boats at the Club.

20. No smoking is permitted during Club meetings.

Personal Boat Operation 1. All skippers are responsible for the operation of their own boats, or any Club boats that

they operate. It is expected that they will adhere to all governmental regulations and operate boats in a seamanlike manner at all times.

2. All members should maintain their boats and related equipment in good condition and in a manner that doesn't jeopardize other members or their property.

3. The "no-wake" rule applies to boat operation in the mooring and waterfront area. 4. Liability Insurance must be maintained for all members’ boats using any Flub facility. The

provider and policy number must be provided at the time of payment for the facility. Homeowners insurance is acceptable where it specifies liability coverage for the member’s yacht. Upon request of the Commodore or his(her) designee, a member shall provide a certificate of insurance within 30 days or remove his yacht from the Club premises.

5. To insure that appropriate fees have been paid and to facilitate contact with owners if needed, all boats moored or stored at the Club must have a current identification sticker attached to the starboard transom or as close to this location as possible. All equipment not attached to a boat that is stored on Club grounds must be labeled with the Club member’s name.

Use of Club Watercraft

1. The operation of Race Committee boat and the Rescue-Patrol boats is under the direction

of the Board of Governors and is to be used for Race Committee activities, rescue operations, race patrol, instructional programs, and other Club business only.

2. Only members designated by the Board of Governors may operate the rescue and Race Committee boats; except in an emergency, when life or property may be in danger, and in the absence of designated operator, any qualified member may operate these Club boats. This rule similarly applies to the use of Club radio equipment.

3. Club outboard dinghies may be used by members for transporting passengers and supplies for a maximum of 15 minutes. After their use, boats are to be returned to their designated area and properly secured with bows facing eastward to avoid swamping. Dinghies are not to be tied to moorings or moored boats for a period of time that would violate the 15-minute maximum usage period.

4. Children under 16 years of age may operate outboard dinghies only if they have a valid motorboat operator's license and are under adult supervision.

5. Dinghies shall not be loaded beyond their rated capacities. The operator is responsible for assuring that proper equipment is on board, especially personal flotation devices.

6. Only designated work boats may be used for checking moorings, pushing the "Holy Cow" and similar work.

7. Except on Club business, no Club watercraft may be removed from the Club premises without prior approval of the Board of Governors.

Use of Waterfront Facilities

The purpose of these rules is to assure efficient utilization of Club waterfront facilities, especially during racing events. 1. No member shall leave an unattended boat moored to any float or bulkhead if doing so

inconveniences other members or restricts access to hoists. 2. Boats may tie up to floats for provisioning, cleaning, and minor maintenance. For safety

and security reasons, boats may not be left at the dock while owners are absent from Club premises.

3. Shallow draft boats should use the western end of dock whenever possible. 4. When the Club launch is in service, no boat is to use the float designated for the launch. 5. When the launch operator displays a sign at the east end of the dock the following rules

will apply: a. To speed launch service, a maximum of two people will be delivered to or from a

moored yacht at any one time, and boat will pick up any remaining crew or guests from the touch and go.

b. No boats may be secured to the eastern end of the dock. These floats are to be kept open for "touch-and-go" loading and unloading of yachts and the Club launch.

6. The use of hoists for maintenance or repairs is permitted only if it doesn't inconveniences other members. Repair work is permitted on Club premises only if it doesn't inconvenience other members.

7. Parking is not permitted on the dry sailing dock, except for loading and unloading for a period of less than 15 minutes, during which time keys must be left in the car.

8. No swimming is permitted from the docks and floats except in training programs. 9. Dry sailed boats and must be removed from the premises by the Sunday following the last

scheduled Club race or their owners will be charged fines as specified for winter-stored boats. Owners of dry sailed boats are encouraged to remove their boats as soon as possible to facilitate hauling of winter-stored boats.

10. Winter stored boats must vacate the dock area or Club grounds by midnight of the second Saturday in May, cradles, mushrooms and blocking material, masts and other personal items included. Each cradle must be identified by its owner. Owners of boats left past this date will be charged $1.00 per foot per day until they are removed from Club property. Owners of mooring equipment, cradles and masts left on Club property after this date will be charged $5.00 per day until they are removed from Club property.

11. Summer and winter storage boat owners are expected to clean up around their boats; this includes bottom scrapings, paint drippings, tape, wood, cans, brushes, and any other debris, all of which is to be disposed of in the dumpster in the northwest corner of Club property.

12. All water hoses must have proper shutoff nozzles to conserve water and reduce utility bills.

13. No boat trailers are to be stored on upland grounds for more than three days, except during Club-sanctioned regattas.

14. Each trailer owner is responsible for identifying his trailer with a name tag.

15. Facility and equipment restrictions limit overall length of winter-stored boats to 30 feet and a gross weight limit of 10,000 pounds.

Facility Assignments

"Facility" in this section refers to winter storage space, mooring space, dry sail space, sunfish rack, pram/dinghy rack or locker.

1. A present user of a facility will retain the right to use that facility if the facility fee is paid

by the date specified on the annual Club bill. 2. A present user of a facility who wishes to move to a different location of the same type

of facility must request the change by writing to the committee chairman responsible for that facility. Such members who have paid the associated facility fee by the due date will be reassigned to available facilities on the basis of Club seniority.

3. A member who is not presently a user of a facility may apply for it by paying the fee for that facility by the due date specified in the annual Club bill. Applicants will be assigned to available facilities on the basis of Club seniority.

4. A present user of a facility who fails to pay the fee for that facility by the due date specified on the annual Club bill will forfeit his right to use that facility.

5. Members who are not presently users of a facility, as well as previous users who forfeited their right to use it as specified in 4. Above, may apply for use of a facility after the due date specified on the annual Club bill by forwarding payment for such facility to the Financial Secretary; these applications will be honored in order of their arrival, without regard to Club seniority.

6. With the exception of those members who are presently assigned dry sail space for multihull boats occupying more than a single dry sail space, no future assignments of dry sail space for such boats will be made.

7. In order to attract and maintain members, Club facilities must be available. Facilities will be limited to one per membership, when a waiting list exists for said facility.

Moorings and Moored Boats

1. Moorings must be located according to charted positions assigned by the Mooring

Committee. 2. Moorings which were deployed for the 2012 season are grandfathered for

subsequent seasons provided the chain and hardware meet or exceed Club recommendations. Any replacement mooring base purchased from March 7, 2013 forward, and any mooring base used by a member who is new to the mooring field in 2013 or thereafter must either be a Dor Mor or a standard or counterweighted mushroom of US manufacture, or a professionally set Helix of US Manufacture. Iron or concrete blocks may not be used. The Mooring Committee shall enforce this rule by means of an annual survey that must be completed each year by every member who applies for a mooring spot.

3. The maximum length of the mooring tackle shall be sixty feet plus the height of the freeboard at the bow plus the distance on deck to the cleat or Sampson post. Thirty feet of the overall length shall be heavy bottom chain according to NBC recommendations for the particular size of boat to be moored. The Mooring Committee shall enforce this rule by means of an annual survey that must be completed each year by every member who applies for a mooring spot.

4. The mooring committee chairman is the only person who can assign mooring locations. Mooring locations are assigned to the member who has paid for the facility (assigned member). In those cases where the assigned member is not going to use the mooring facility and plans to let another member use it, the assigned member needs to get approval from the mooring committee chairman and advise him of who will be using the mooring facility. The mooring committee will maintain a list of members using assigned members mooring facilities. The ruling of the mooring committee chairman is final.

5. All boats on moorings must be identified with NBC current identification numbers attached to the transom. No boats will be launched, hauled, or serviced by the launch without this identification number.

6. It is the responsibility of the individual member to frequently inspect his mooring equipment, assuring that fastenings are adequately safe-tied, equipment is adequately protected against chafing, and the chain is not fouled.

7. The launch shall be hailed on VHF radio Channel 9 using proper radio procedures. Alternatively, the launch may be hailed with three blasts of a horn.

8. Guest moorings may be used by guests after registering and signing the guest book. Members may use guest moorings in emergency only. Guest moorings may be used for a charge of $20.00 per day.

9. When a deserted or lost mooring is found and cannot be returned to its rightful owner, the mooring will be turned over to the Club. Such equipment in excess of Club needs may be sold by the Mooring Committee to Club members.

Haul-Out/Launch Procedures

1. Any boat with a cradle that, in the opinion of the haul-out/launch chairman, is unsafe will not be hauled.

2. Winter storage fees are due by September 30th. No boat will be hauled without fees paid and a signed contract. In the event of late payment, item 4 of Facility Assignment in the House and Grounds Rules will apply.

3. Past user and pay on time = assured of storage; 4. Non-user and pay before due date = assigned available space based upon Club

seniority; 5. Past user or non-user and paying after due date = assigned available space based

upon order of receipt of payment. 6. Fines, as listed in Use of Waterfront Facilities item 10, are increased to $1.00 per foot

per day starting midnight on the second Saturday in May. Fines for cradles are $1.00 per foot per day starting midnight on the second Saturday in May and will accrue weekly ie.(9' cradle-$9.00/day x 7 days = $63.00 per week for the first and subsequent weeks).

7. Boats must be launched on their assigned date. Exceptions may be granted by making written requests to the haul-out/launch chairman. Members that miss their assigned haul-out/launch dates may be denied storage for the next year.

8. Boats and cradles that are for sale or sold are the responsibility of the owners of record. If launched late, all fees, etc., must be paid before the boat will be launched.

9. No boat shall be hauled/launched without a member of the committee present. 10. All cradles must be labeled with member's name and number marked on the cradle. 11. Any unidentified mast or mushrooms left on Club property after May 31 shall be

considered abandoned. Any member terminated from membership, or who shall have resigned from Club membership, or defaulted in payment of fees and assessments, or has sold a vessel and/or equipment stored or moored at Club facilities, who was, prior to the aforesaid events, a user of Club facilities for the vessel owned, in whole or in part by said member shall within thirty (30) days of sale of the vessel or equipment, or notice from the Board of Governors of termination of membership or default, cause any vessel, trailer or other marine equipment, sold or stored, to be removed from Club property. Any such property not so removed shall be considered abandoned and the Club shall have the right, without further notice to the member or owner, to sell, or otherwise dispose of the property at the expense of the owner(s) or member. The Club shall not be accountable to the member or owner(s) for any part of the proceeds of any sale. The member and owner(s) of the vessel shall pay and indemnify and hold harmless of and from any and all damages, loss, costs and expenses including attorney’s fees. All users of the Club facilities, as herein provided, acknowledge the lien of the Club pursuant to NYS Lien Law Section 80 et seq. as a condition of their usage of Club facilities and covenant and agree that upon abandonment of the vessel, trailer, ore marine equipment, consent to the entry of an Order of Sale pursuant to NYS Lien Law Section 82 and waive any right to contest the entitlement of the Club arising out of the seizure of the property.
