Dear friends at GLSF,I wish to thank all those who came and helped and worked to

make our annual Christmas Party a fun evening for those whocame.

When many hands pitch in, it makes our job much easier...with Barb havinga bad back and me with a torn bicep muscle we had to rely on our grandson Mattto do our heavy lifting to load and unload food and roasters. After awhile ourkitchen helpers took over.

We didn’t have our usual blizzard, but it did get bitter cold which may havekept some of you from attending. I’m sorry for that, but it was better than a snowstorm.

Jerry Kozar certainly had quite an array of things for the raffle which turnedout to be one of the largest ever.

Dave and Pat’s Toys for Tots had lot of toys and money which went to the Ma-rine’s drive. Last but not least, thanks to Gene Winger for keeping the good cheerflowing.

Asian Carp was the topic at a summit at Michigan State University last month,and participants learned from Carp Czar John Goss that it will take three years tocome up with the plan to contain the invasive species in the Mississippi river basinand protect the Great Lakes.

Goss said the carp are a threat, but only one of many. "In terms of invasivespecies, this is probably in the top three or four," Goss said.

Michigan Fish Chief Kelly Smith said the fact that carp DNA and at least onefish has been found beyond the current barriers makes this an urgent matter. "Howmany are actually above the barrier, no one knows. But there is evidence there areat least some above the barrier, and that's the concern," Smith said. �

appeal the ruling or continue the legalbattle. A hearing on the status of the suitis scheduled for January 7. In the mean-time, Michigan Attorney General MikeCox called on President Barack Obamato overrule the Army Corps of Engi-neers, which operates the lock systemand has declined to shut it down.

Bighead and silver carp, both Asianspecies, have migrated up the Missis-sippi River and its tributaries fordecades after escaping from sewagetreatment plants and aquaculture pondsin the Deep South. They have advancedto within about 25 miles of Lake Michi-gan, and DNA evidence suggests atleast some may have evaded an elec-tronic barrier on the Chicago Sanitaryand Ship Canal, part of a network ofwaterways eventually linking the lakesand the Mississippi.

Biologists disagree on what wouldhappen if they established a breedingpopulation in Lake Michigan. But aworst-case scenario envisions themspreading across most or all of the lakesand decimating their fishing industry,valued at more than $7 billion.

The Obama administration in Febru-ary released a $78.5 million strategy forbattling the carp. It calls for strengthen-ing the fish barrier system, netting andpoisoning carp in selected areas of theChicago waterways and developing bi-ological controls such as methods todisrupt their spawning.

In their July 19 suit, the states calledfor closing the two locks and placingscreens, nets and other devices at se-lected points as temporary measures.They requested an order that the corpsspeed up a promised study of ways topermanently separate the Great Lakesand Mississippi River watersheds. Thesuit contends the corps' position on thelocks is arbitrary and accuses theagency of operating a nuisance. �

"Because the level of certainty ofharm is low based on the evidence ad-duced to date, it cannot be said that ir-reparable injury is ―likely,� as mustbe the case to justify the entry of anypreliminary injunction. And here, theshowing of irreparable harm wouldhave to be higher still under the slidingscale, given the less than compellingshowing on the merits of both of Plain-tiffs’ substantive claims and the judicialrestraint principles that come into playwhere, as here, multiple federal andstate agencies are expending significanteffort carrying out their statutory andregulatory duties to maintain and oper-ate the CAWS (Chicago Area WaterwaySystem), study and address the threat ofAsian carp, and take whatever emer-gency measures they deem appropriateto prevent Asian carp from dispersinginto the Great Lakes."

U.S. District Judge Robert Dow saidthe states had failed to show that closingthe locks immediately was essential toblock the Asian carp's path to LakeMichigan. Dow acknowledged in his61-page opinion that a carp invasionmight do great harm to the lakes butsaid the states had not shown it waslikely or imminent.

In fact, he said, the evidence sug-gests that flooding and economic dam-age to barge operators and businessesthat rely on them would "outweigh themore remote harm associated with thepossibility that Asian carp will breachthe electronic barriers in significantnumbers, swim through the sluice gatesand locks, and establish a sustainablepopulation in Lake Michigan." Chicagobusiness groups urged Michigan and theother states to drop the lawsuit, sayingthere was little chance it would prevail

The decision does not end a lawsuitfiled by Michigan, Minnesota, Ohio,Pennsylvania and Wisconsin that seekslock closure and other measures to keepthe unwanted invaders out of the lakes.But Dow's refusal to issue a preliminaryinjunction appears to settle the lockissue for the foreseeable future.

The ruling stated in part "Plaintiffshave not established that Asian carp arepositioned to establish a breeding pop-ulation above the electric barrier. Norhave Plaintiffs shown that the fish isanywhere near, much less on the vergeof, establishing a population in LakeMichigan. In short, as Mr. Chapmanconcluded, there is ―no evidence as yetthat [Asian carps have entered the Great

MADISON – Cold weekend weather helped firm up ice in many parts of Wis-consin to kick off what is often some of the best fishing of the hard water season,state fish biologists say.

"Early ice fishing can be some of the best fishing for walleye, bigger gamefish, for a lot of species," says Steve Avelallemant, fisheries supervisor for north-ern Wisconsin. "Especially on those lakes that are shallow and weedy. The fishseem to be accessible and biting more early in the hard water season, any time be-fore Christmas."

Fishing pressure nearly triples in December in Wisconsin after lakes freezeover, based on results from a 2006-7 statewide mail survey of anglers. Fully one-third of the state's 1.4 million licensed anglers reported ice fishing, and they spentabout 1,589,000 hours in December alone, up from 624,000 hours in Novemberof that year, according to Brian Weigel, the DNR fisheries researcher who ana-lyzed the survey results.

Across the entire ice-fishing season, anglers caught 14 million fish in the sur-vey year and released more than half of them during the survey year.

Avelallemant advises that ice anglers who want to maximize their chances ofcatching fish go to a lake with a good northern pike population. "Northern pike,when you look at their distribution worldwide, you'll find them all the way up intothe Arctic Circle. They prefer cold water. Pike tend to get cranked up when it getscold."

He advises that anglers check in with local bait shops to find out what the wall-eye are hitting on, and fish that. "A pike will take whatever you throw down," hesays. �

Cold Weather Kicks Off Ice Fishing Season

Early ice can also be treacherous ice,so it's important to take a few basicsafety precautions.

Ballast water from ocean-going shipshas carried more than 186 invasive speciesinto the Great Lakes, according to currentscientific data, and new invasive species ar-rive at the rate of one every six months.

The New York regulation will protect allof the Great Lakes even though it’s only astate law. New York took a leap ahead offederal efforts to create similar enforce-ment. It did so by adding the clause that thisrule applies even to ships just passingthrough New York waters. Since the ErieCanal and Chicago canals are too small formost ocean-going ships, these vessels mustenter the Great Lakes through the St.Lawrence River and a series of locks inNew York. Thus, they’re all affected by thisnew standard.

National efforts from the Coast Guard,EPA, and Congress to create such ballastregulations have been less than lackluster todate, and Congress presently has nothing inthe hopper that comes close to a definitivefederal ballast bill.

Anglers have tried for years to get ade-quate ballast water regulations in place toprotect our Great Lakes and coastal watersfrom invasive species. And as long as stateslike New York, Michigan and others con-tinue to lead the way by establishing theirown protective standards, there is still hopefor protecting our precious resources.

The Great Lakes are a unique ecosystemrepresenting 1/5 of the Earth's surface freshwater, but the vitality of the ecosystem hasbeen threatened by alien species that havewreaked havoc on native fish and plants.Over 186 invasive species have been iden-tified in the Great Lakes; since the St.Lawrence Seaway opened in 1959, 65% ofinvasive species introductions have been at-tributed to ballast water. Alien species havealready cost the Great Lakes economy bil-lions of dollars.

The entire Lake Michigan ecosystemhas been changed by invasive species. Thefiltering of invasive mussels has, for thefirst time ever, allowed the lake floor to becarpeted with algae. These conditions havehelped the invasive round goby become themost numerous fish in the lake, while all buteliminating many of the native species. Inthe 80’s, high profile invasions by the zebramussel and sea lamprey decimated localdrinking water infrastructure and fishing in-dustries. �

Great Lakes anglers won a sizable vic-tory in the war against invasive species lastmonth. In short, New York courts upheld anew rule that requires all ocean-going shipspassing through the state’s waters meettough ballast water standards, meaning lessintroduction of foreign species.

A New York appellate court dismissed achallenge brought by shipping interestsagainst the state’s tough new ballast waterrequirements, which are designed to limitthe introduction of more invasive speciesinto the Great Lakes. This is the second timethat the state successfully defended the bal-last water restrictions in court. Legal expertshail the win as a huge victory for states inthe region that have taken an aggressivestand to limit dumping of water containingbiological pollution from ocean going ves-sels.

The Appellate Division of the New YorkState Supreme Court, Third Judicial De-partment, rejected shipping industry argu-ments that the New York ballast waterregulations were illegal because they werestricter than the U.S. EPA's nationwide dis-charge permit. The new state regulationmandates that starting January 1, 2012 theseships must have ballast cleansing systemsthat meet some of the strictest standards inthe world. Treatment systems must dis-charge water almost completely free of in-vasive species.

The New York court's ruling that stateshave authority to adopt ballast water rulesthat are more protective than federal stan-dards is consistent with the decision lastyear in a lower state court as well as the fed-eral appeals court in Cincinnati to upholdMichigan's ballast water rules against a sim-ilar shipping industry challenge.

Shipping interests had fought the newstandard in court and called it unconstitu-tional, likely because it’s stricter than theEnvironmental Protection Agency’s nation-wide Clean Water Act ballast discharge per-mit. The case was eventually appealed allthe way to the New York Court of Appeals,the state’s highest court, which just lastmonth refused to overturn the ballast stan-dards. That decision means the rule staysand the appeals are finished.
