Local Law 142 goes into effect Nov 13th, 2017, prohibiting food establishments in New York City from using plastic foam cups and contain-ers. Mayor de Blasio pursued this ban after a study by Sanitation Commissioner Kathryn Garcia concluded that there is no way to prop-erly recycle these materials at their designated facility.

Ban BasicsAs of July 1st, 2015: no food service establish-ment, mobile food commissary, or store throughout New York City will be able to use, sell, or o�er e xpanded p olystyrene ( EPS) single service food items or loose fill packag-ing (commonly known as packaging peanuts). The law allows for a six-month grace period with fines going into e�ect beginning January 1st, 2016.

Why is this important?EPS does not biodegrade and cannot be recy-cled at the designated NYC recycling process-ing facility in a manner that is environmentally e�ective, economically feasible, and safe for employees. EPS makes up an estimated 20,000 tons of the city’s annual waste and contaminates the stream of recyclable metal, glass, and plastics.

What does this mean for your customers?Prior to July 1st, 2015, they must use up any existing inventory of EPS items. There are many alternative packaging options available including paper, plastic, aluminum, and biode-gradable and compostable products.
