TIMBER SALE AGREEMENT IN MENDOCINO COUNTY

In furtherance of the timber management program endorsed at the May, 1980 Commission meeting, the staff has prepared a harvest plan and solicited sealed bids for the sale of 1,571,000 board feet of commercial sawtimber within a 420-acre portion of State school land, seven airmiles northeast of Covelo, Mendocino County.

The sale was advertised in October in local newspapers and notices sent to a mailing list of over 90 operators in Northern California. Two bids were received as shown on the attached Exhibit 11 C11 and the high bid at $174,148 was submitted by Louisiana - Pacific Corporation. The bid was at ten ~ercent (10%) above appraised value.

OTHER PERTINENT INFORMATION: 1. A Timber Harvesting Plan was prepared by

Commission staff and submitted to the ca+ifornia Department of Forestry and Fire Protection (CDF) for review and approval.

2. The sub~itted environmental analysis document (Timber Harvest Plan) was certified for this project by the CDF under its certified program (14 Cal. Code of Regulations 15251(a)).

3. Staff has reviewed the document and determined that the conditions, as specified in 14 Cal. Code of Regulations

TIMBER AND TIMBERLAND OWNER RESPONSIBILITY

The attached Notice of Conformance designates a Timber Harvesting Plan (THP) ~ has been approved in which you were either named as the timber owner or timber-land owner. A copy of the TH? may be obtained from the submitter or the Registered Professional Forester (RPF). I would like to take this opportunity to explain your responsibilities concerning this operation.

1. The Public Resources Code (PP.C) defines timber owner as •any person who owns commercial timber, tir~erland, cutover land or timber rights, including Christmas tree rights, on lar.ds of another except federal agency." (PRC 4527.5)

2. All Forest Practice rules and regulations must be adhered to in the harvest ·. operations.

3. Within one month after completion of the work described in the THP, excluding stocking, a Work Completion Report must be filed with the Department of Forestry and Fire Protection by the timber owner or his agent. (PRC 4585)

4. You must restcc~Jthe operating area with trees to th~ standards set forth by the Board of Forestry in Title 14, California Administrative Code, Section 912.7. You may meet the requirements im~ediately by leaving· healthy trees uncut, or within five (5) years if trees must be plante,i or seeded. Planted trees mcst be in the ground two growing seasons and alive before they can be co~~ted for stocking. When stocking is ~t,. the timber owner or his age~~ must subrait to the Department of Forestiy and Fire Protection a Repor~ of Stoc~ing. A cop7 of the Report of Stocking form can be obtained frc~ the R?: who prepared your plan. ~

5. Any change in ownership (la~d or ti~ber) mus~ be reported to tne Department if such a change occurs before the ~eport of Stocking has been filed (14 CAC 912.7: Al though it is not required by the Forest Practice Act, it is your··civili liabilit: to notify the new landowner of this timber harvesting plan and the outstanding stocking require~ents.
