Kids are back to school, and I, for one, am excited to get back to a routine.

Thank you to everyone who attended the Bird Rock August 1

community picnic. Beaumont's continued their tradition of providing the food this year, and it was enjoyed by all. A big thank you to the Heine family, owners of Beaumont's - you once again did a tremendous job! This was the 2nd year the event was held at the Bird Rock Elementary Joint Use Park, since Calumet Park is no longer available to hold the picnic. School’s auditorium. Council Member Barbara Bry provided us with a district 1 update and Joe LaCava presented the viewpoint of “Public Land, Public Vote,” a group opposed to the San Diego River Park and Soccer City Citizens’ Initiative. Thank you Barbara and Joe for your attendance.

Last year, Halloween fell on a Monday and Bird Rock experienced even bigger crowds than normal. This year it will fall on a Tuesday which may make it a bit tamer. We are recommending trick-or-treat hours from 5 p.m. to 8 p.m. to help promote a safe, family-friendly event and to reduce late-night noise and disturbances.

We encourage all Bird Rock residents to turnoff porch or front lights at 8 p.m. and to bring in pumpkins for safe keeping. If you usually leave your front porch light on all night, please remember to turn it back on prior to retiring for the evening.

Speaking of Halloween, we will have our annual Halloween merchant window painting event this year on Sunday, October 22nd at 10:00am. This event is sponsored by the Bird Rock Community Council (BRCC). I know, first hand, that the merchants enjoy having the local neighborhood kids get into the Halloween spirit by continuing a great tradition here in Bird Rock. We do need volunteers to assist our painters and help with cleanup after Halloween, please email me at [email protected] if you can help.

November brings the BRCC Community meeting on Tuesday, November 7, 6 pm, at the La Jolla Masonic Lodge, followed by the Annual Bird Rock MAD meeting. BRCC Board elections will take place later in November.

“Dogs benefit by being protected from rattlesnakes, ticks, traffic and various other hazards and distractions. Also, poison oak is spread from dogs to humans.

"We understand that people love their dogs and want a place for them to run free, play fetch and socialize with other dogs. The City of San Diego has designated off-leash dog areas for just this reason. It is necessary to keep your pets within the boundaries of the posted "Designated Dog Off-Leash" areas. The perimeters may be unsafe for your dog (such as traffic, sharp objects that can injure them, etc.).

“Along the beach shoreline and Mission Bay, the City of San Diego has two designated leash-free exercise areas for dogs. Dogs are allowed at Dog Beach and on Fiesta Island. Dogs are restricted at other beach and bay locations.

“These restrictions do not apply to service animals, as defined by the federal Americans with Disabilities Act (ADA). The ADA defines a service animal as any guide dog, signal dog or another animal individually trained to do work or perform tasks for an individual with a disability. “In general, dogs are allowed on beaches after 6 p.m. from April 1 to Oct. 31 or after 4 p.m. from Nov. 1 to March 31.

Licensed dogs are allowed on the beach, and on sidewalks and park areas near the beach, during the night and early morning hours until 9 a.m.

BIRD ROCK COMMUNITY MEETING, September 5, 2017 at Bird Rock Elementary Auditorium, 5371 La Jolla Hermosa Ave.

Bird Rock Community Council (BRCC) Board President Andrew Ward called the meeting to order at 6:05 pm, welcomed attendees, and introduced BRCC Board members. The BRCC thanks the Bird Rock Elementary School for providing its auditorium for the community meeting.

Update from District 1 Council Member Barbara Bry District 1 Council Member Barbara Bry announced that San Diego Police Department chief Shelly

Zimmerman would be retiring in March 2018, that a national search would be underway for a replacement, and that community input would be sought.

She outlined her proposed Short Term Vacation Rental (STVR) ordinance. In response to a question regarding the timeline, she mentioned that the ordinance would be discussed and possibly voted upon at the October 23 City Council meeting.

A community member expressed concerns about potential local wild fires and asked about preparations or proactive steps such as brush abatement to reduce the risk of fires. The predicted unusually hot weather increases the risk of fires starting or getting out of control.

Ms.  Bry  noted  her  opposition  to  the  San  Diego  River  Park  and  Soccer  City  Citizen’s  Initiative  and  that the San Diego City Council voted not to hold a special election in November 2017 which was estimated to cost $5,000,000 and to explore other options. The City attorney issued an opinion that there  was  no  guarantee  that  the  project  would  be  completed  and  that  taxpayers  might  be  “on  the  hook”  for  environmental  cleanup.    Ms.  Bry’s priority is to make the best use of the land. She opined that Soccer City was the first option but not the best. She was confident that something would built in Mission Valley and noted that San Diego State University was in need of more space for its expanding campus.

Attendees were reminded that Scripps Institution of Oceanography (SIO) professor  Walter  Munk’s  100th birthday is October 19. There will be extended celebrations of his lifetime achievements and spirit which will include the renaming the 8100 block of La Verada Street in La Jolla Shores in honor of Dr. Munk. A public celebration is being scheduled by UCSD. [Dr.  Munk,  called  the  “world’s  greatest  living  oceanographer,”  was  first  appointed  to  the  SIO  faculty  in  1947.]

Joe LaCava – Public Land, Public Vote Joe LaCava disclosed that he is a paid consultant for a group called  “Public  Land,  Public  Vote”

that is opposing the FS investors-backed  San  Diego  River  Park  and  Soccer  City  Citizens’  Initiative, which will be on the November 2018 ballot. His work in opposition has involved going to a lot of community meetings. He distributed hand-outs  titled  “The  Truth  about  the  Initiative  Process.”

The land under discussion includes the Mission Valley stadium (fka Qualcomm Stadium) and parking areas which occupy about 160 acres with an additional 70 acres of surrounding property, river, and training facilities, all of which are City owned. Joe characterized the Soccer City Initiative as an aggressive real estate deal. The Public Land, Public Vote group argue that the Initiative would take City land from the taxpayers, avoids an EIR, does not include a complete environmental analysis, and is not the best use of the land. He stated that Mission Valley community groups were not consulted as FS Investors prepared their plan.

The group claims the best use of the land could include more housing and meeting the land needs of SDSU. Depending upon whether the football stadium remains or is razed, the process of determining the best use will take a while since a lot of acreage could be involved. Joe stated that the Initiative is not about soccer, but is a real estate deal.

Originally,  the  proponents  of  the  San  Diego  River  Park  and  Soccer  City  Citizens’  Initiative  wanted  the City Council to approve the project in lieu of a public vote; subsequently, a public vote was requested. The vote, scheduled for November 2018, could be moved to June.

Traffic impact is a big concern to the group due to the size of the proposed project or any other similar projects in the area. Joe felt that the initial traffic study was not adequate. The project also will appear before the LJCPA [La Jolla Community Planning Association].

One community member asked who the developers were who funded the Public Land, Public Vote opposition to the initiative. Joe responded that funding was from HG Fenton Company and Sudberry Properties.

Joe noted that the initial FS investors deadline was a result of the December 2017 date for a decision by Major League Soccer (MLS) as to the location of its 4 expansion teams and that FS Investors have stated that they will walk away from the proposal if San Diego does not receive one of the 4 MLS Soccer expansion clubs. Joe commented that MLS may decide to award franchises to 2 cities now and award the remaining 2 later.

One attendee commented that it would be nice to have soccer and a river park and asked whether there were aspects of the FS plan that could be implemented. In reply, it was noted that if SDSU develops the land, then the City will get a football stadium. It was noted that the San Diego Sockers, an indoor soccer team [MASL, Major Arena Soccer League] plays in the Viejas Arena and a new third-tier NASL [North American Soccer League] team will be playing in north county (no location specified). The River Park will be a part of any development of the land regardless of which plan is implemented.

member Todd Gloria, gave an update regarding recent assembly bill activities. The Council District 1 field representative Mauricio Medina ([email protected]) was present.

Bird Rock Elementary School School started on August 28. There are 3 kindergarten classes and one transitional kindergarten

(TK) this year.

Public Announcements (2 minutes each on non-agenda topics) Omar Passons (www.Omar.Passons.com) introduced himself and gave a brief statement

regarding his candidacy for the San Diego County Board of Supervisors. A longtime Bird Rock resident noted that those interested in the San Diego River Park and

Soccer City initiative should fully inform themselves and review all aspects of the issue. A resident asked for community attendance at the Sept. 7 La Jolla Community Planning

Association meeting where a permit request for seawall maintenance to stabilize a portion of the coastal bluff within a dedicated public right of way between 5322 and 5328 Calumet would be discussed.

Everyone was invited to attend BRCC merchant promotion event, Sunsets on the Boulevard, scheduled for Friday, 9/8/17, and to support local merchants along La Jolla Blvd.

The BRCC community picnic was on August 1 at Bird Rock Joint Use Park which is shared with the Bird Rock Elementary School. The BRCC wants to thank Megan and Dave Heine for partially underwriting the annual BRCC Community picnic and  the  great  Beaumont’s  restaurant  crew. Beaumont’s provided great cooking, wonderful service, and fabulous food selections for the picnic.

Additional questions and comments were fielded from the attendees on other topics.

Infrastructure Donations are being received which will help fund several new BRCC Art Project mosaic benches

for the community. Donations are being collected for additional small benches to be created by Bird Rock artist Jane Wheeler.

The BRCC and community members requested that the City remove the beige net fencing that was placed at the Midway Bluff Restoration Project to allow the vegetation to become established last year. There was an additional request to remove deteriorating sand bags and netting which the City placed at that location to protect the adjacent storm drain. It was noted that the Midway Bluff area is not part of the Bird Rock MAD traffic calming area and is the responsibility of the City. Council member Bry and her representative Mauricio Medina were asked to help with these requests.

There are 2 missing MTS bus stop benches at the northwest corner of Bird Rock Ave. and La Jolla Blvd. The original benches were removed during the construction of the building at 5702 LJ Blvd and have not been replaced. Assistance was requested from Council District 1.

Complaints and concerns from citizens have been voiced about speeding on La Jolla Mesa Dr., the configuration of the La Jolla Mesa intersection with Linda Rosa and Colima St., and the proposed City traffic calming roundabout on La Jolla Mesa Dr. at Cottontail Dr. The City is scheduled to add a pedestrian sidewalk to the west side of La Jolla Mesa.

Follow up continues regarding the median street lamp outages adjacent to 5640 and 5622 La Jolla Blvd. that were previously-reported via  the  “Get-It-Done”  app.

Mauricio from Council District 1 will follow up about the previously-reported, unrepaired, hazardous raised-up sidewalk section on the south west side of La Jolla Blvd at Colima St.

Community complaints about illegal realtor signage in the public rights of way were discussed with Council Member Bry and her representative. Signs placed in the Public Right of Way, including the Bird  Rock  MAD  areas,  violate  the  City’s  municipal code, create safety hazards, block pedestrian access, are a visual pollution, and are illegal marketing or advertising on public areas. [Public right of ways include the street, bike lane, sidewalk, public landscape areas, crosswalks, handicap ramps, roundabout aprons, driveway access points, etc.] Council District 1 was asked to help facilitate code enforcement and solutions to this growing problem.

Residents  can  use  the  City  of  San  Diego’s  “Get  It  Done”  App  to  report  non-emergency problems including: potholes, curb or gutter blockages or issues, sidewalk issues, storm drain problems, street light outages, missing or damaged traffic signs, malfunctioning traffic signals or cross walk lights, graffiti, litter/dumping, tree hazards, dead animals, and abandoned vehicles. A resident can take a photo of the problem and share the photo with the City when using the  “Get-It-Done”  app.      For  more  information,  go  to https://www.sandiego.gov/get-it-done.

Bird Rock Maintenance Assessment District (MAD) Repair work is underway at the southwest MAD section adjacent to the Colima St. roundabout

now that most of the construction defect repairs at the adjacent buildings have concluded. Repairs will also be made to the Colima roundabout plants, irrigation system, and utility box that were heavily damaged by earlier hit-and-runs through the roundabout. Illegal dumping, construction debris, litter, animal waste, and illegal signage within the Bird Rock MAD areas continue to be problems.

There have been extensive discussions between the MAD manager and the City regarding the damaged east-side lamp of the median light adjacent to 5727 La Jolla Blvd which was blown down during the heavy winds on 1/21/17. The City has no funding for either replacement or repair. Due to safety concerns, the Bird Rock MAD will replace the lamp. The City will install it. The MAD manager is arranging for the City to check the lamps on all median lights; two others are not working, and all need to be checked for safety reasons.

Membership Renewals Membership dues help fund the Bird Rock Newsletter, web site, member communications, the

promotion of merchant events, community improvement activities and projects, community movies, Neighborhood Watch, Halloween window painting, the Bird Rock Tour of Homes, other fundraising activities, and more. The BRCC also obtains Micro-BID (Business Improvement District) grants for projects which benefit the Bird Rock business district, manages the Bird Rock Maintenance Assessment District under a contract with the City of San Diego, and advocates for the Bird Rock neighborhood. Bird Rock Maintenance Assessment District (MAD)

In 2000, the Bird Rock community began discussions about neighborhood traffic calming (vehicular speed reduction), traffic management, parking issues, pedestrian and vehicular safety,  neighborhood  “walkability,” and lighting. The discussions included ways to implement traffic calming, improve safety for pedestrians crossing La Jolla Blvd (5 lanes), enhance parking and beautification in Bird Rock, and help improve the Bird Rock business district.

In 2004, the Bird Rock community and BRCC initiated formation of the Bird Rock Maintenance Assessment District for the purpose of assuming responsibility for maintenance of the public landscaping associated with the City-planned traffic-calming improvements along La Jolla Blvd and nearby residential streets in order to become a self-managed MAD as opposed to one managed by the City of San Diego. This effort culminated in March 2005 when more than 30% of the property owners signed a petition agreeing to the formation of the district. In July 2005, property owners formally voted, via a ballot from the County Registrar of Voters, to approve formation of the MAD, to appoint the non-profit Bird Rock Community Development Corporation (BRCDC) dba Bird Rock Community Council (BRCC) as local managers, and to set the initial maximum assessment at $90 per year per single family property. In August 2005, the San Diego City Council certified the ballots and approved the formation of the Bird Rock MAD. Upon certification, the BRCC began negotiations with the City for a maintenance agreement which successfully concluded with the first contract. The Bird Rock MAD is “self-managed”  (BRCC-managed) as opposed to City-managed. The City requires that self-managed MADs be managed by stable community non-profit organizations. The BRCC took over landscape maintenance of phase one in 2008 and assumed maintenance responsibilities of phases two and three in May 2009. The MAD and BRCC Board selected and contracted with an independent contractor to manage day-to-day MAD operations and perform bi-weekly inspections and other management tasks and with a City-approved, licensed landscape maintenance contractor for regular landscape and irrigation system maintenance and repair, selected public right of way clean up and trash disposal, and additional services.

The Bird Rock MAD encompasses the Bird Rock area bounded on the west by the Pacific Ocean or the east side of 5800 block of La Jolla Blvd; on the north by La Cañada Street or the 5800 block of Camino de la Costa; on the east by Folsom Drive, Bellevue Avenue, Linda Rosa Avenue, and La Jolla Mesa Drive; and on the south by Bellevue Place, Bird Rock Elementary School/Bird Rock Joint Use Park, the Park La Jolla property, and Wrelton Drive.

The annual meeting of the Bird Rock Maintenance Assessment District (MAD) is for review and approval of the proposed annual budget for Fiscal Year 2019 (FY19) which runs from July 1, 2018, to June 30, 2019. The November meeting date allows time for adequate review, revision, and acceptance of the proposed budget. The proposed budget must be submitted to the City of San Diego Park and Recreation Department MAD Division by the January deadline for inclusion in the City annual budget process which starts February 1, includes further review and revision, and concludes with approval by the Mayor and City Council in June 2018.

The City reviews the Bird Rock MAD landscaping, irrigation, and related issues as well as traffic calming, safety, and line-of-sight issues during quarterly inspections. The City has been very satisfied with our operations, supervision, financial oversight, and water saving efforts. The BRCC Beautification Committee independently inspected the MAD areas and reviewed the

landscape palette and various MAD-associated environmental, safety, maintenance, irrigation, water conservation, and aesthetic issues. General community beautification or walkability improvements have been suggested. MAD landscaping improvements were approved in 2010 and continue to be implemented in phases to enhance traffic calming and safety improvements. Plants that created safety problems or succumbed to pests, traffic emissions, or other causes were replaced. These ongoing efforts result in safer conditions, better adherence to line-of-sight height limits, traffic calming, reduction of drive overs, adherence to mandated water restrictions and water conservation, decreased long-term maintenance, increased visual appeal, and conformance to the original community-chosen California coastal/ Mediterranean palette.

The Capital Improvement Bird Rock Median LED Light project on the La Jolla Blvd medians between Forward and Camino de la Costa was successfully completed by the City at the end of 2012. The median lights provide mid-block lighting, enhanced pedestrian and vehicular safety, a better walking environment, and improved visibility of adjacent businesses and buildings. Maintenance of the median lights, cross-walk lighting system, and street lights are not duties of the MAD, however the BRCC monitors the cross-walk systems, street lights, and median lights and reports problems. Similarly, problems noted with street signs, public rights of way, graffiti, and related issues are also reported to the City.

The BRCDC’s  MAD  and  BRCC  financial  accounts  are  independently  audited  at  the  end  of  each fiscal year. The MAD account audit is required by the City. The independent audit for the recent fiscal year ending June 30 determined that the BRCDC regular and MAD accounts are in great condition with proper operating procedures, financial controls, and operating reserves.

The Bird Rock MAD budget is funded by annual homeowner county property tax assessments, gas tax funds from the City, and offsetting payments from the City for services provided by the MAD which should have been provided by the City (General Benefit Offsets). Currently, there are 1468 assessment-paying property parcels within the 1546 parcel Bird Rock MAD Map Boundary. 78 properties located north of Camino de la Costa do not pay a MAD assessment as part of their county property tax.

The annual residential assessment rate was $90 in Fiscal Year 2006 (FY2006), $50 in FY2007, $75 in FY2008, $79 in FY2009 when BRCC assumed full maintenance of the MAD. The rate dropped to $25 in FY2010 when the MAD reserve fund maximum balance was reached at the beginning of FY2010. As mandated by state law, the excess funds (reserve fund balance) accumulate in an interest-bearing account and are reserved and protected for the Bird Rock MAD. The Bird Rock MAD is required by the City to maintain a reserve operating balance between 10% and 50% of annual operating expenses and maintains an emergency reserve.

For FY2011, FY2012, FY2013, and FY2014, the assessment rate was set at $78 in order to maintain the appropriate reserve balance and meet budgetary obligations. To fund increasing MAD costs, normal expense increases, anticipated guard railing improvements, and the required reserve fund balance level, the assessment rate for FY2015 and FY2016 was increased to $90 for residences. The rates for FY2017 and FY2018 were originally set at $90 but were decreased to $84 due to less spending in the prior fiscal year and a healthy reserve fund balance. The rate for FY 2019 should be $95 for residences, well below the $173.62 maximum amount allowed due to consumer price index increases. The condominium rate is proportionally lower at $66.50, and the rate for a typical commercial property should be $475.

The annual meeting is an opportunity for Bird Rock property owners to review the budget for the next fiscal year, ask questions, and offer comments. Your participation is welcome.
