Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:
A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
As of 2013/05/24, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.
As of 2013/05/24, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses.
I am a qualified person and have the qualifications required by section 5 of the regulation.
I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.
I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.
The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.
I do not hold and have not held and my employer ENVIRON EC (CANADA), INC.does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessmentor risk assessment upon which this record of site condition is based

Phase One Conceptual Site Model Underpass Park – City of Toronto Owned Lands Part of Lot 21 on the north side of Eastern Avenue on Plan 108 Toronto, Ontario Phase One Conceptual Site Model Site Setting
The Site was vacant sidewalk during the 2012 Site visit. During the 2009 visit, the Site was a sidewalk located at the entrance to the 2 St. Lawrence Street building, which was being used by Peter’s Taxi as an auto repair facility. The Site appears to have been a sidewalk and/or vacant prior to 2009.
The Site is approximately 4.6 m2.
Physical Setting
The general physical setting of the Phase One Property is depicted on Figure 1 – Site location Map; and Figure 2 – Site and Surrounding Land Use map.
• Existing Buildings and Structures: No buildings were present on-Site during the 2009 or 2012 Site visits. There are no known underground utilities at the site.
• Water Bodies: There was no water bodies located in whole or in part in the Phase One Study Area. As illustrated in Figure 1, the nearest surface water body is The Don River is located approximately 290 m to the east of the Phase One Property.
• Areas of Natural Significance: A search on the Ontario Ministry of Natural Resources Biodiversity Explorer indicated that there are no areas of natural significance present on-Site or within the Phase One Study Area.
• Drinking Water Wells: The Ontario Well Water Information System did not have any records of drinking water wells within the Phase One Study Area.
• Adjacent Properties: At the time of the investigation, surrounding properties were used for community, residential or commercial purposes. Surrounding property uses are depicted on Figure 2.
Potentially Contaminating Activities
No potentially contaminating activities were identified.
Geological and Hydrogeological Information

Based on the Ontario Ministry of Northern Development and Mines, Ontario Geological Survey Map 2556, the Site appears to be straddling a till deposit consisting of undifferentiated, predominantly sandy silt to silt matrix, commonly rich in clasts and often high in total matrix carbonate content and Glaciolacustrine deposits consisting of silt and clay with minor sand; basin and quiet water deposits. According to a previous Phase One ESA report by Jacques Whitford conducted at 104 Eastern Avenue west of the Site, the depth to bedrock is 8.4 mbgs.
The Site is relatively flat and is generally at grade with surrounding properties. Groundwater was found to flow in a general southwesterly to southeasterly direction toward Lake Ontario and the Don River during the Phase Two ESA conducted at the UPP properties west of the Site.
Areas of Environmental Concern
No areas of environmental concern were identified.
Phase Two ESAs have been conducted on properties west of the Site but did not include the Site property.
No uncertainties or significant information gaps were identified during the course of the Phase One ESA. However, ENVIRON notes that an absence of information in any of the components of the Phase One ESA could affect the conclusions of this report. ENVIRON cannot rule out the presence of subsurface impacts due to unreported spill incidents or other potentially contaminating activities which have taken place on-Site and not documented by the records reviewed or site interviews.
