The administrator cannot register your product for this Plan if youdo not complete the registration The administrator reserves the right to reject a registration and will refund thepurchase price through the retailer

PRODUCT ELIGIBILITY, COVERAGE AND TERM

This Plan covers computer or game software purchased as new and manufactured for use in the United States, whichat the time of purchase included a manufacturer's original written warranty valid in the United States. In order to beeligible for a Plan, the manufacturer's original warranty must provide at least e<l days parts and labor coverage ThisPlan is for one (1) year from the date of computer or game software purchase and is inclus",e of the manufacturer'swarranty Coverage under this Plan shall commence immediately upon the expiration of the manufacturer's originalwritten warranty During the manufacturer's warranty period, any replacement of the covered computer or gamesoftware product is the sole responsibility of the manufacturer. This Plan must be purchased at the same time and onthe same sales receipt as the covered software product. Coverage only applies to products used nort-commerciallyAccessories and/or add-on options purchased separately and not essential to the basic function of the coveredproduct are not eligible for coverage There is no deductible under this Plan. This Plan is not renewable

In the event the covered game software product should become inoperable for reasons other than system mechanicalor electrical defects, manufacturer's software defects or .ollful customer abuse, this Plan will replace your originalcomputer or game software product with a product of equal or similar features and functionality. This Plan is limited toone replacement during the lifetime of the Plan and does not covertrip, labor, or shipping charges

Technological advances may result in a replacement product .oth a lower selling price than the original product Norefunds will be made based on the replacement product cost difference The most we will pay on any singlereplacement is the price you paid for the original product, excluding taxes If we replace the covered product in itsentirety, our maximum liability has been met under this contract and there will no longer be coverage under the terms

of this contract. Replacement products .oIl include a manufacturer's warranty and the retailer has the option to offeran additional extended service contract on the replacement product. If a replacement product is not available, we .oIlrefund up to the product purchase price, excluding taxes, and this contract will be fulfilled and all obligations satisfiedReplacement products may be new or rebuilt products. In no event shall the obligation to administer claims extendbeyond the term of coverage commencing upon the date of product purchase You may be required to ship or del"'erthe defect"'e product prior to rece",ing reimbursement or a replacement product. This Contract, including the terms, conditions, imitations, exceptions and exclus"ns, and the sales receipt for yourcovered product, constitutes the entire agreement and no representation, promise or condition not contained hereinshall modify these items, except as required by law

EXClUSIONS FROM COVERAGE

This Plan does not cover any loss or damage resulting from: pre_existing conditions; manufacturing defects;improper installation or the covered computer or game software product; unauthorized repairs ormo difications; improper us e of electrica~powersu pply; loss of p ower, power s urge or overload; any result ofa malfunction of damage of an operating part from failure to provide manufacturer's recommendedmaintenance; intentional or accidental damage by th ird parties; losses on any compo nent(s) never covered bya manufacturer's warranty; reception and transmission problems resulting from external causes. Otherexclusions include but are not limited to: labor, trip, or shipping charges; any repair covered by amanufacturer's warranty; neglect, misuse, abuse of covered computer or game software product, including

adjustments, manipulation or modifications; damage caused by any repair personnel or any owner, employeeor third party; products used for commercial purposes; pro ducts provided for pu bWc us e or rental.

DISClAIMER OF CERTAIN LIABILITIES

Under no circumstances shall the retailer, IM:PS, or the Insurer be liable for indirect, consequential, or incidentaldamages (including damages for lost profits, business interruption, loss of data, and the li<e), even if any party hasbeen advised of the possibility of such damages This Ran wil not cover any defects that are subject to amanufacturer's program of reimbursement. This Plan is not a warranty or insurance policy; it is a Service ContractThis Set'llice Contract is not intended to create or limit any implied warranties concerning your product, which mayormay not exist under applicable law

OUR RIGHT TO RECOVER PAYMENT

If you have a right to recover against another party for anythng we have paid under the set'llice contract, your rightsshall become our rights. You shall do whatever is necessary to enable us to enforce these rights We shall recoveronly the excess after you are fully compensated for your loss

CANCELLATION FLORIDA ONLY

This Plan is between the Administrator, WCPS of Florida, Inc., the Provider, Technology Insurance Company, andyou, the purchaser. You may cancel your service contract by informing the selling dealer orthe administrator of yourcancellation request. In the event the Plan is canceled by the warranty hokJer, return of the premium shall be basedupon ninety percent (9:)%) of the unearned pro-rata premium less any claims that have been paid or less the cost ofrepairs made on behalf of the warranty holder. In the event the Plan is canceled by WCPS, return of the premiumsh all be based upo n on e hu nd red percent (1 00 %) of th e un eo me d pro- rata pre mium

CANCELLATION

This service contract provides a 30-day free look period from the purchase date of the servOce contract You maycancel this service contract by informing the selling dealer/retailer of your cancellation request .othin 3J days of thepurchase of the set'llice contract and you .oIl rece",e a 100% refund of the full purchase price of the service contractThe set'llice contract is non-cancelable after 30 days from the date of contract purchase. For those states that donot perm~ non_cancellatio n of your service contract, the law of that state shall apply to residents requestingcancellation.

If we cancel this set'llice contract, we must provide you wrth a written notice at least 15 days prior to cancelation atyour last known address, with the effect"'e date for the cancellation and the reason for cancellation Return of thepre mium is base d up on 100% of the unea rn ed pro-rata premiu m

SPECIAL STATE REQUIREMENTS

State amendments to specific provisions of the terms of this Plan are as follows

Alabama only: If your cancellation request is made more than 30 days from the date of purchase, we will refund theunearned portion of its full purchase price. However, we .oIl retain an administrat"'e fee of $25.00 h1y refund maybe credited to any outstanding balance of your account and the excess, if any, returned to you. A 10% penalty permonth wil be added to a refund that is not paid or credited .othin 45 days after return of the service contract to us. Inthe event we cancelthis set'llice contract, we .oIl mail a written notice to you at your last known address at least 5 daysprior to cancellation with the effect"'e date for the cancellation and the reason for cancellation But, we are notrequired to mail you written notice if the reason for cancellation is nonpayment of the Provider fee or a materialmisrepresentation by you to the Provider relating to the covered property or its use

Arizona only CANCELLATION - You may cancel this set'llice contract at anytime prior to the expiration date bysending written notice to the AdministratorWarrantech Consumer Product Set'll ices, Inc. at P.O. Box 1189, Bedford,TX 76095.
