1. SUMMARY OF REPORT:
This report incorporates the VCAT appeals update and decisions made by Council officers under delegation. This report also details some performance indicators. 1.1 Performance.
Included within this report are bar charts illustrating the following key performance indicators:
Planning applications received and determined in the previous month
Outstanding applications
Average gross days in dealing with planning applications and
Total number of planning applications currently with Council. October saw an increase in the number of permits issued compared to September and for the same time last year. There was a slight increase in applications lodged and a marginal decrease in the amount of outstanding applications. There was also a decrease in the gross days to determine an application to below 100 days. There has been a new feature added to this graph showing a comparison to the average gross days taken to determine applications for growth area Councils and metropolitan Councils. The percentage of applications dealt with in less than 60 days also increased.
1.2 VCAT status update The table in section three of this report lists all files related to VCAT matters
1.3 Delegated matters. The table within Section 4 of this report further details applications that have been determined under delegated authority and planning applications that receive 2 objections or less, applications to amend planning permits or plans, applications to extend planning permits, applications to certify plans of subdivision, and the issuing of Statements of Compliance under the Subdivision Act and Section 173 Agreements signed under delegation.

3. APPEAL DECISIONS RECEIVED
3.1 An Application for Review lodged by the applicant in regard to Council’s refusal for 12 dwellings and a reduction in the car parking requirement at 16-20 Elliot Avenue, Broadmeadows was heard by the Tribunal on 2 October 2012. Council refused the application submitted by the Department of Human Services due to the proposal falling well short of several aspects of ResCode including car parking where 14 spaces are required and only six were proposed. VCAT set aside Council’s decision and directed that a Permit issue and deleted proposed conditions relating to landscaping, noise and the condition of boundary walls. VCAT did not agree with Council in regard to neighbourhood character. With respect to parking, VCAT felt that as the dwellings were limited to people over 55 they would not need as many cars.
3.2 VCAT has set aside Council’s decision to support a proposal for a 16 room motel at
121-123 Mickleham Road, Tullamarine. In directing that no permit be issued, VCAT considered that the proposal met all the relevant policy considerations in terms of its location and that the site was suitable for redevelopment, however in this case it considered that this proposal does not have the appropriate balance between having a more intensive development on the site and strengthening the preferred neighbourhood character. The Tribunal suggested that a more modest development may be suitable for the site.
3.3 An Application for Review against Council’s decision to refuse a proposal for five
double storey dwellings at 16 Riddell Street, Westmeadows was initially heard by the Tribunal on 27 June 2012 when the applicant was given the opportunity to revise the design to resolve outstanding issues or alternatively VCAT would uphold Council’s decision. These issues in part included a garage being set back further, combining two of the dwellings into one dwelling and improved vehicle access. Revised plans were subsequently submitted and on 25 October 2012 the Tribunal having considered that the latest plans addressed the unresolved issues directed that a permit be issued. The revised plans addressed many of Council’s issues.
3.4 An Application for Review has been lodged by the applicants against Council’s refusal
to approve four double storey dwellings at 30 Henderson Road, Tullamarine.
