1 PROCEEDINGS 2 MR. GUNN: Good evening and welcome. 3 My name is Gene Gunn. I'm the branch chief of 4 the Superfund program for the EPA in Kansas 5 City, Region 7. And I'm also the hearing 6 officer tonight so it's my job to open the 7 meeting and officially close the meeting. 8 We have a court recorder that's going 9 to record the presentation. And then after the 10 presentation, we'll have a public comment 11 period and people can come up and make comment. 12 I think I only have one card that 13 indicated they wanted to make a comment so 14 we'll start with that one and then open the 15 floor up for everyone at that point. 16 I wanted to recognize a few people as 17 we get started here. This is a public meeting 18 on the proposed plan for the Madison County 19 lead site, Offer Unit 3, residential soils. 20 And I've got Bob, or Robert, Mooney, presiding 21 county commissioner. We've got Harold Thomas 22 from the City of Fredericktown. And Becky 23 Hunt, health department, the administrator 24 there. Evan Kifer, MDNR. Also Larry Baer from 25 MDNR. Lorena Locke from the health department.

1 And then from EPA, we've got Karim 2 Dawani who is right here inside now. And of 3 course Dan Kellerman who is the project 4 manager. Karim is from our public affairs 5 office. 6 If there's anybody that I missed? 7 Arthur Bush from the health department, I'm 8 sorry, Arthur, I apologize, from the health 9 department, Missouri Health Department. And I 10 think that's it. 11 Is there anybody else that needed to 12 be recognized? 13 Okay. With that, Dan Kellerman, the 14 project manager, is going to make a 15 presentation of the operable unit proposal. As 16 you know, we've already got an interim record 17 decision for this action. This is the 18 follow-on to that to kind of say what we're 19 going to do in the end of this cleanup and Dan 20 is going to go through that for you right now. 21 With that, as soon as Dan is 22 finished, I'll get up again and open it up for 23 public comments, and at that time we'll start 24 with the one comment that I've got and then 25 move on from there. 1 MR. KELLERMAN: Thank you, Gene. And 2 good evening to everybody. Good evening, 3 Raymond. He's the only one I believe in the 4 room that was not introduced and Raymond does 5 work with the Madison County Public Water 6 Supply District and is very instrumental in 7 coordinating some efforts to comply with our 8 voluntary institutional control program. 9 And it's refreshing to see a great 10 balance. Should I say it's not even really a 11 balance. Other than Raymond, there's nobody 12 here that doesn't hold some position with the 13 local or state or federal government and I 14 think that's valuable in the work that we do. 15 Knowing that everybody here who has some 16 position of authority is interested and 17 committed to remediating lead in Madison 18 County. 19 Tonight's meeting is concerning the 20 proposed plan for the continued residential 21 cleanups that have been implemented back in 2 2 2 0 0 2 .

23 A lit bit of an odd name associated 24 with it. This is the name that was attached to 25 it when it was originally designed in CERCLIS

1 so "Madwide" really means Madison wide 2 residential soils. 3 The purpose of this meeting is just 4 to provide basic background for the site, 5 information concerning what has been done, what 6 led up to the issues here and what's being done 7 about these issues. 8 We'll also identify and explain the 9 preferred alternatives for the remedial action 10 on the residential properties. 11 Once again, this is a continuation of 12 the similar actions that have taken place both 13 through the initial remedial actions and the 14 remedial actions. 15 Also, perhaps the most important 16 aspect of this meeting is to solicit the public 17 comments in the public comment period which 18 runs from July 17th to August 18th. And 19 there's always the possibility that that 20 comment period could be extended if anyone so 21 desires. 22 The remedial process is somewhat 23 daunting in terms of the laws that regulate the 24 Superfund and the national contingency plan. 25 But in general, the process involves

1 five major steps: The pre-remedial process; 2 the remedial investigation and feasibility 3 study; proposed plan, which is the public 4 comment period and ultimately leads to a record 5 of decision; after a record of decision is 6 developed, the remedial design follows that 7 which is then followed by remedial action. 8 This is a map of the operable units 9 for Madison County. There are seven operable 10 units. If you can see my pointer on the 11 screen, Operable Unit 1 is the Northern Madison 12 County Unit which includes the Mine La Motte 13 tailings and the slime pond, as well as the 14 Copper Mine Wastes, Harmony Lake, Offsets Mine, 15 the Old Jack Mine. Copper Mines was also 16 referred to as the Basler Tailings and we also 17 have referred to it by the current owner as the 18 Schumaker property. 19 Operable Unit 2 is the former Madison 20 Mine, one of the original mines in the Madison 21 County, and it is located right here in this 22 general area on the southeast side of 23 Fredericktown. Anschutz Subsite is the CERCLIS 24 name of this location. 25 Operable Unit 3 is the residential

1 properties that we're discussing tonight. It 2 covers the entire Madison County boundary as 3 well as southern St. Francis County. 4 Operable Unit 4, Conrad Tailings, we 5 currently use that as our repository. It 6 includes the Ruth Mine complex, as well as some 7 of the residual wastes from that processing 8 plant. 9 Operable Unit 5, Catherine Mines and 10 Skaggs Tailings off of Highway H. 11 Operable Unit 6 is Silver Mines 12 district. 13 And Operable Unit 7 is the Little 14 St. Francis River watershed, which includes all 15 of the water forces that may not directly be 16 addressed under one of the operable units. 17 Just to give you a brief history of 18 the mining in Madison County, it is part of the 19 old lead belt. Mining began in the 1700s. It 20 was developed by French explorers. And 21 industrial mining began in the mid to late 22 1800s. 23 And as a result of the mining and the 24 processing, an estimated 10 to 15 million cubic 25 yards of mine waste was generated.

1 The first Superfund studies were done 2 around 1995, although there have been some 3 records that predate that both by the state and 4 I think.by some local interested citizens. 5 As a result, the health department 6 began doing blood lead testing in the mid-1990s 7 and determined that there was elevated blood 8 lead levels in children. It was also 9 suspected, and I think we've now confirmed, 10 that mine waste was placed in residences, both 11 mine waste and contaminated soil from the mine 12 waste was placed at residences for fill and 13 topsoil as well as for dry wells. 14 EPA's response actions took place in 15 the early 2000s in the Harmony Lake area. 16 Again, that was an area where it was identified 17 elevated blood levels were revealed. High 18 concentrations were ranging from 200 parts per 19 million to over 1100 parts per million. 20 And the EPA began the removal actions 21 in 2001 to excavate lead-contaminated soils at 22 these residential properties based on the very 23 high concentrations and the immediate danger or 24 risk to the children that were playing in these 25 areas.

1 Remedial actions resulted in the 2 cleanup of approximately 880 properties. 3 In 2008, an interim record of 4 decision was produced and EPA then began the 5 remedial actions which we are continuing today. 6 Again, this presentation essentially 7 presents the same information that was 8 presented back in that time with a few 9 additional components added to the operable 10 unit. 11 Approximately 4200 properties have 12 been sampled to date. And about 40 percent of 13 every property, of all the properties that have 14 been sampled, have shown to be contaminated 15 above 400 parts per million. And we estimate 16 that there are somewhere in the neighborhood of 17 300 additional properties that will require 18 remediation. 19 Currently we have about 280, plus or 20 minus, properties that will require remediation 21 under the interim record of decision. 22 This map is a little difficult to 23 see, but the yellow and green dots on this 24 represent the properties that we were able to 25 map based on available geographic coordinates

1 that require sampling. And the green dots 2 represent the properties that would require 3 remediation. 4 Again, there's up to probably 800 5 properties that will still require sampling 6 under this action here and we suspect, again, 7 about 300, 320 or so properties will require 8 remediation. 9 The original remedial investigation 10 was completed back in 2006 and there was a 11 total of about 970 residential properties 12 sampled at that time just to determine the 13 frequency and level of contamination and then 14 for future use in the human health risk 15 assessment. 16 There was also approximately 45 17 residences that were sampled by EPA in addition 18 to indoor dust samples. 19 Two of the wells sampled by EPA 20 exceeded the maximum contamination level of 15 21 parts per billion. But those two properties 22 were re-sampled and the results came back below 23 the maximum contamination level. 24 Madison County Health Department has 25 done well sampling since 2000. These are not

1 official records that have been used by the 2 Environmental Protection Agency. But out of 3 the 400 to 410 wells, nine of those revealed 4 concentrations of lead above the maximum 5 contamination level. 6 I feel a little bit like I'm 7 preaching to the choir here because I know that 8 everybody at this public meeting has attended 9 the round tables so I'll try not to be too 10 laborious in my process here to explain things 11 that you already know. But for the purpose of 12 conducting a public meeting, this is a 13 necessary procedure. 14 Lead in residential soil obviously 15 presents a great threat to human health at a 16 lead-mining Superfund site. This is a 17 nationally listed priority site and, typically, 18 lead sites rank very high in priority for 19 funding. 20 A site-specific human health risk 21 assessment is used to evaluate the current and 22 future risks to humans. And the risk 23 assessment is a base line and informs people 24 about the potential human health risks and 25 assists in determining what site needs to be

1 addressed in future cleanup. 2 Again, lead is a primary concern 3 here. There are other contaminants that are 4 collocated with lead. It has been determined 5 that when lead is found in high concentrations, 6 that typically the other contaminants that 7 coexist with lead may also be elevated in 8 concentration. 9 For the purpose of this collocation, 10 or for the purpose of the actions that we're 11 taking here, we typically would just look at 12 lead, but we will also do confirmation sampling 13 to confirm that the other contaminants of 14 concern are not in excess of what would 15 conceivably coexist with the elevated lead 16 concentrations. 17 A lead-specific model is used to look 18 at different ways that humans can be exposed by 19 lead, different routes of exposure, different 20 scenarios based on construction worker presence 21 or people living in the area, recreational 22 visitors, that sort of analysis. 23 And, obviously, the sample results 24 from the Remedial Investigation were used in 23 the human health risk calculation.

1 The most sensitive group of humans to 2 lead contamination are children. Typically you 3 won't find the same side-effects or health 4 effects to adults that you would find in 5 children. And the sensitive age group is zero 6 to six months. It could be zero to 84 months, 7 but there's not many children that are a week 8 or two old out there playing in the lead. 9 So health effects from the lead 10 include damage in the development of the 11 central nervous system, neurological damage in 12 the development of the brain which can lead to 13 very severe learning disabilities in extreme 14 cases. Fortunately we have no really extreme 15 cases in this county. 16 All of the results from the Human 17 Health Risk Assessment that have been 18 incorporated into Madison County Mines 19 Superfund Site exceed the EPA's health 20 protection goal of 400 parts per million. 21 And it's pretty obvious based on all 22 of the sampling and all of the data that we've 23 collected that there are a very large number of 24 residential properties, again approximately 25 40 percent of the residential properties in

1 Madison County, posses lead contamination 2 somewhere on the residential property, whether 3 it's the soil under the driveway. Many 4 properties are underlane by contamination used 5 as base material for the construction of some 6 or a very large percentage of the homes in 7 Madison County. 8 Health protection goal that EPA 9 established for this site, and perhaps all 10 sites, is that there should be no more than a 11 5 percent chance of a human exceeding the blood 12 level of 10 micrograms per deciliter in a given 13 child or a group of similarly-exposed children. 14 As a side note, the remedial actions 15 that have taken place in Madison County for the 16 past -- how many years -- 13 years, has 17 hopefully assisted in reducing the blood lead 18 levels in children with 15 percent originally 19 detected back in the late 190s to currently 20 less than 2 percent for the target child 21 population. 22 The proposed plan again includes this 23 background information. As you know, and as we 24 continue forward with this same project that 25 was conducted in the interim record of

1 decision, the cleanup level calculated through 2 the Human Health Risk Assessments is 400 parts 3 per million. 4 The proposed plan includes presenting 5 the alternatives that would be available. Once 6 again, and this is a little bit redundant for 7 me to keep telling you this, but this is really 8 a continuation of the same proposal that was 9 presented in the interim record of decision. 10 The first alternative is no action. 11 The second alternative is excavation, 12 disposal, vegetative cover, potable water 13 corrective action, health education and 14 institutional controls. 15 And alternative three would include 16 phosphate stabilization for a portion of the 17 soils, excavation for higher concentration of 18 soils, disposal, vegetative cover, potable 19 water correction action, health education and 20 institutional controls. 21 The difference between the 22 alternatives presented for the interim record 23 of decision and the three proposals that were 24 presenting here tonight is that this action 25 does include potable water corrective action

1 and the formal implementation of the 2 institutional controls in the form of the 3 voluntary institutional control program. 4 The alternatives are evaluated based 5 on nine criteria. These criteria are threshold 6 criteria, primary balancing criteria, modifying 7 criteria. 8 The threshold criteria are the 9 make-or-break criteria. If an alternative does 10 not meet the conditions of either of the 11 protection to human health or meeting state and 12 federal regulations or requirements, which are 13 referred to as ARARs, then it cannot be 14 considered as a viable alternative for 15 remediation. 16 The balancing criteria includes 17 implementability, cost. I have to think here a 18 minute. I reviewed this before the meeting and 19 I have a difficult time remembering it. 20 Reduction of the contaminants, which would 21 include reduction of the toxicity and the 22 mobility of the contaminants; long-term 23 protectiveness; short-term protectiveness. 24 That's it. I guess that's it. 25 Modifying criteria is what could

1 modify the remedial action or the remedial 2 alternatives through either community input and 3 acceptance and the state's input and 4 acceptance. 5 The no action alternative does not 6 meet the threshold criteria. So without 7 further ado to bore you with anymore 8 information about that one, it is not 9 considered as a viable alternative for this 10 remedial action. 11 Jumping to alternative three, which, 12 again, is very parallel to the previous action 13 that we completed at this site; however, it 14 includes the incorporation of phosphate 15 stabilization for soil contamination that does 16 not exceed 800 parts per million. 17 There have been a couple studies for 18 phosphate reduction in soils and there are a 19 lot of concerns with the success that has been 20 measured from the studies. 21 There's difficulty in mixing 22 phosphate with soils to where it actually will 23 positively affect the lead to prevent it from 24 being bio available. 25 There's some potential that over

1 time, even though it was initially deemed 2 bioaccessible, that over time perhaps the 3 treatment could lose its effectiveness. Nobody 4 wants a bunch of acid put in their yard because 5 kids and acid don't really mix, nor do their 6 animals and the birds that want to fly on the 7 property. 8 The health departments at other sites 9 have not been very supportive of phosphate 10 stabilization. This alternative would come at 11 an estimated cost of around $13.5 million which 12 is on the order of a third more cost than what 13 the preferred alternative is. 14 The preferred alternative is 15 alternative two. It's the removal, 16 replacement, restoration of contaminated soils 17 in residential properties. 18 I didn't mention that our definition 19 0f "residential properties" includes 20 residential yards, public areas, child high-use 21 areas. And with this proposed action, it also 22 incorporates stormwater drainages, 23 right-of-ways and roadways that would be 24 associated with residential properties. 25 This process would be used for the

1 remediation of approximately 300 additional 2 properties. At this time, that's our best 3 estimate on how many properties there are to 4 remediate. 5 It would be to, at a very minimum, 6 provide 12 inches of clean soil at the surface. 7 This 12 inches of clean soil would allow for 8 almost unlimited use of the property. It would 9 prevent any exposure to lead contamination that 10 may still exist in the subsurface. 11 Excavation could be as deep as 12 24 inches if the contamination measures above 13 1200 parts per million. 1200 parts per million 14 is considered a time critical concentration so 15 any child exposed to 1200 parts per million 16 could very readily be adversely affected. 17 We will place barriers in the 18 subsurface if it is determined that 1200 parts 19 per million cannot be achieved within a 24-inch 20 excavation. 21 Garden areas would typically be 22 excavated to 24 inches if any contamination 23 above 400 parts per million exist in that 24 24-inch horizon. 25 Again, we would replace the excavated

1 soil with clean soil, hydro-seed it, maybe sod 2 it. Try to restore it to the best of our 3 ability, the property, to its original 4 condition. 5 We've used the Conrad Repository for 6 disposing of the contaminated soils. We will 7 continue to use the Conrad Repository until we 8 develop a new repository which is included in 9 this plan but not designed or detailed 10 specifically. 11 The new repository would be used as a 12 public repository in the future which is an 13 important component of the voluntary 14 institutional controls, providing the community 15 with the location to readily and economically 16 dispose of lead-contaminated soils that may 17 otherwise be very costly to address. 18 Again, groundwater has not been 19 identified as a major issue with this site. 20 Much of that can be contributed to the 21 alkalinity of the water with the natural 22 geologic formations in this area that overly 23 the igneous formations. Limestone and dolomite 24 tend to have basic properties to them and helps 25 assist with buffering the groundwater from

1 dissolving the lead which could result in 2 dissolved lead in the groundwater. 3 Part of our alternative here would 4 involve, of course, identifying contamination 5 in groundwater wells. And we will primarily be 6 looking at wells that are located in close 7 proximity to the tailings locations, mine works 8 locations and some of the outfall locations 9 from the run-off from these mining areas. 10 We would also evaluate the phase of 11 contamination which could either be dissolve 12 phase or it could be contamination as a result 13 of suspended solids in the groundwater which 14 may be as easy as filtering them to prevent 15 exposure. 16 I want to make it clear that these 17 three components of addressing groundwater are 18 included in one option because we don't really 19 have enough information to know what is causing 20 groundwater contamination in some of these 21 private wells that have been sampled by the 22 health department. So we want to evaluate what 23 the actual cause of the contamination is. 24 We want to evaluate the potential 25 that if a well structure integrity issue is a

1 potential cause because it's located close to a 2 mining location, that run-off from the mining 3 location is going directly into the well, then 4 obviously repairing this well, or, perhaps, 5 even worse-case scenario replacing the well, 6 would be potential corrective action. 7 And, of course, the other corrective 8 action would be providing or connecting to an 9 alternate water supply. 10 This alternative also includes 11 institutional controls, health education which 12 has been conducted very well over the past many 13 years in Madison County by the Madison County 14 Health Department in conjunction with the 15 Missouri Department of Health and Senior 16 Services. 17 And then the institutional controls 18 is the Voluntary Institutional Control Program 19 which is a program that was to be developed and 20 evaluated during the interim ROD actions and 21 the development process went perhaps a little 22 bit slower than we would have liked and we were 23 not truly able to evaluate its effectiveness. 24 Part of that is due to the fact that 25 we did not complete the remedial action in the

1 originally projected time frame. So we will 2 continue to evaluate this upon its final 3 implementation and we are expecting the final 4 implementation to be in the very, very near 5 future. 6 The estimated costs of this action is 7 approximately $8.5 million. 8 I believe everybody in this room, 9 with the exception of the court reporter, our 10 current community involvement coordinator and 11 perhaps Mr. Gunn, although he is always my 12 first order of reference for any answers to 13 issues at these Superfund sites, the 14 development, essentially, is to protect people 15 from exposure to mine waste through proper 16 handling, proper disposal, proper recognition 17 that mine waste remains an issue in Madison 18 County and perhaps always will remain an issue

in Madison County. 20 And it1s also to protect the barriers 21 that have been placed, both the clean soil 22 barrier as well as the demarcation barriers 23 that overly highly elevated concentrations of 24 lead in the subsurface beneath clean barriers. 25 Once again, we will continue to

1 evaluate the effectiveness of the Voluntary 2 Institutional Control Program. And the plan 3 would be to provide for a very formal 4 evaluation of this during the next five-year 5 review which would be in just a little over 6 four years from today. 7 I really do want to compliment 8 everybody's involvement here. I see only two 9 of you are still awake. Fortunately, I'm one 10 of them. 11 I really would like to elaborate more 12 on the Voluntary Institutional Control Program 13 in that we feel that placing an institutional 14 control in local hands is going to be much more 15 effective than placing this control in state or 16 federal hands where we do not have the 17 immediacy to come to this site when an issue 18 arises. 19 And Madison County Health Department 20 has been provided, in cooperation with the 21 Missouri Department of Natural Resources, to 22 actually perform testing. 23 The education efforts, you know, both 24 through the Voluntary Institutional Control 25 Program and the education program with Madison

1 County will play a valuable role in educating 2 the children of today to properly handle the 3 lead in the future. 4 Public comment period starts today 5 and it runs through August 17th. Again, that 6 period can be extended if anyone is so 7 compelled to make such a request. 8 Administrative record file will be 9 available at the Ozark Regional Library here in 10 Fredericktown or at the EPA Region 7 records. 11 I will open it up for questions for 12 anybody who would like to go on record in the 13 record of decision. 14 MR. GUNN: We had one official 15 comment that somebody was going to make. John 16 Bennett. 17 MR. BENNETT: Yes. Dan, as you're 18 well aware, as a member of the City of 19 Fredericktown Source Water Protection 20 Committee, I've had some very grave concerns 21 about our city lake, which is the city of 22 Fredericktown's potable water source. 23 Last November we collected a sample 24 from the upper little St. Francis River which 25 is just upstream from our city lake and

1 downstream from the Sweetwater branch which 2 flows adjacent to the Montgomery site that was 3 recently remediated. 4 During November we discovered at a 5 sandbar at that location that a sample we had 6 tested by PDC Laboratories came in at 7 2200 milligrams per kilogram lead. This led us 8 to have concerns about the sediment, 9 accumulated sediment in the city lake. 10 And we had applied for a grant, 11 engineering grant through the Missouri 12 Department of Natural Resources and received 13 authorization to go ahead with the program and 14 conducted additional testing on July 3rd this 15 year. 16 And this week we just received the 17 results of ten samples that were taken starting 18 with the confluence of the unnamed tributary 19 from Catherine Mines or the Skaggs site up here 20 with the little St. Francis River and at 21 strategic points downstream all the way to the 22 damn. 23 Nine of the ten samples exceeded 400 24 parts per million lead, with the highest at 25 10,000 parts per million lead in the delta

1 region. 2 Water sample was also collected at 3 the 14-foot depth just upstream of the damn and 4 it came in at .028 milligrams per liter, which 5 exceeds the public drinking water MCL of 6 .015 milligrams per liter. 7 This is concurrent with earlier 8 testing in April at the water plant of raw 9 water samples that range from .023 to 10 .028 milligrams per liter. 11 Fortunately, through the use of 12 enhanced coagulation and treatment the city is 13 currently using, our most recent finished water 14 samples have been below .001 milligrams per 15 liter. So the treatment process is removing 16 the lead, but we do have the source water 17 contamination issue. 18 I have copies of the laboratory 19 results from PDC I'd like to give to Region 7. 20 And I want to make a request that 21 Region 7 take another look at their HHRA and 22 also the Ecological Risk Assessment that was 23 prepared back in 2006 that is relative to this 24 watershed. 25 And one further comment through the
