    L.G. 404/70.WHEREAS it is provided, inter alia, by subsection(la) of section II of the Country Towns SewerageAct. 1948-1967 that where a local authority inwhose district a sewerage area is situate, under-takes any works in that sewerage area and itappears after inquiry that

    (a) the maximum general rate that the localauthority may impose under the LocalGovernment Act, 1960-1971, will not per-mit a sufficient amount to be provided for

    the construction, alteration, repair ormaintenance of the works, and for pay-ment of the instalments of capital debtand interest on any of the works withrespect to which any debt is owing; and

    (b) the local authority should be permittedto levy a general rate beyond the limitsprescribed by the Local Government Act,1960-1971,

    the Governor may, by proclamation, grant to thelocal authority such permission and may in theproclamation specify new limits of the maximumgeneral rate that the local authority may imposeunder the Local Government Act, 1960-1971; andwhereas the Carnarvon Sewerage Area consitutedunder section 4 of the Country Towns Sewerage Act,1948-1967 by Order in Council published in theGovernment Gazette on the 28th March, 1969, iswithin the district of the Municipality of the Shireof Carnarvon and the Shire has undertaken workswithin that area; and whereas it appears after in-quiry that the maximum general rate that theCouncil of the Municipality of the Shire of Car-narvon may impose will not permit a sufficientamount to be provided for the construction, altera-tion, repair or maintenance of the works, and forpayments of the instalments of capital debt andinterest on the works to which any debt is owingand that the Council of the Municipality of theShire of Carnarvon should be permitted to levy ageneral rate beyond the limits prescribed by theLocal Government Act, 1960-1971: Now, therefore,I, the Governor, acting with the advice and consentof the Executive Council and in exercise of thepowers conferred under subsection (la) of sectionII of the Country Towns Sewerage Act, 1948-1967do hereby grant to the Council of the Municipalityof the Shire of Carnarvon permission to levy ageneral rate not exceeding forty cents (40 cents)for each dollar of the annual value of the rateableproperty in any year in its district that is withinthe Carnarvon Sewerage Area aforesaid.

    Local Government Act, 1960-1971.ORDER IN COUNCIL.

    L. & S. Corres. 554/69 (R.3557).WHEREAS by section 288 of the Local GovernmentAct, 1960-1971, it shall be lawful for the Governor,on request by a Council of a Municipal District, byOrder published in the Government Gazette todeclare any lands reserved or acquired for use bythe public or used by the public as a street, way,public place, bridge or thoroughfare, under thecare, control, and management of the Council, orlands comprised in a private street, constructedand maintained to the satisfaction of the Council,or lands comprised in a private street of which thepublic has had interrupted use for a period of notless than ten years, as a public street and if theCouncil thinks fit, that the Governor shall declarethe width of the carriageway and footpaths of thepublic street; and whereas the Shire of Ashburtonhas requested that certain lands named and des-cribed in the schedule hereunder, which have beenreserved for a street within its municipal districtbe declared a public street: Now, therefore, HisExcellency the Governor, by and with the adviceand consent of the Executive Council, doth herebydeclare the said lands to be a public street, andsuch land shall, from the date of this Order, beabsolutely dedicated to the public as a streetwithin the meaning of any law now or hereafterin force.

    Cones. 2316/72.WHEREAS by section 33 of the Land Act, 1933-1971, it is inter alia, made lawful for the Governorby Order in Council, to direct that any land re-served pursuant to the provisions of this Act shallbe granted in fee simple to any person (as de-fined in the said section) subject to the conditionthat the person shall not lease or mortgage thewhole or any part of the land without the consentof the Governor and subject to such other con-ditions and limitations as the Governor shall deemnecessary to ensure that the land is used for thepurpose for which the land is reserved as afore-said; and whereas it is deemed expedient thatReserve No. 31650 (Swan Location 8753) should,subject as aforesaid be granted in fee simple toThe St. John Ambulance Association in WesternAustralia Incorporated to be held in trust for"Ambulance Station": Now, therefore, His Excel-lency the Governor by and with the advice andconsent of the Executive Council doth herebydirect that the beforementioned reserve shall begranted in fee simple to the aforesaid body, to beheld in trust for the aforesaid purpose, subject tothe condition that the land shall not be leased ormortgaged in whole or in part without the consentof the Governor.

    Corres. 1709/72.WHEREAS by section 33 of the Land Act, 1933-1971, it is made lawful for the Governor to directthat any Reserve shall vest in and be held by anyMunicipality, Body Corporate, or other person orpersons to be named in the Order, in trust for anyof the purposes set forth in section 29 of the saidAct, or for the like or other public purposes to bespecified in such Order and with power of sub-leasing; and whereas it is deemed expedient thatReserve No. 31640 should vest in and be held by theShire of Kondinin in trust for the purpose of"Recreation (Bowling Green)": Now, therefore, HisExcellency the Governor, by and with the adviceand consent of the Executive Council, doth herebydirect that the beforementioned reserve shall vestin and be held by the Shire of Kondinin, in trustfor "Recreation (Bowling Green)", with power tothe said Shire of Kondinin, subject to the approvalin writing of the Minister for Lands being firstobtained, to lease the whole or any portion of thesaid reserve for any term not exceeding 21 yearsfrom the date of the lease subject nevertheless tothe powers reserved to him by section 37 of thesaid Act.

    WHEREAS by the Country Towns Sewerage Act,1948-1967, it is provided that before undertakingthe construction of Water Works, the Ministershall submit plans, descriptions, books of refer-ence and estimates of the proposed works to theGovernor for approval; and that if they are ap-proved, the Governor may forthwith by Order inCouncil empower the Minister to undertake theconstruction of the proposed works. Now, there-fore, His Excellency the Governor with the adviceof the Executive Council doth hereby approve ofthe plans, descriptions, books of reference andestimates marked on Plan P.W.D., W.A. 47356-1-1for the construction of Albany Sewerage—Reticula-tion Area No. 29 which was duly submitted forapproval and hereby empowers the Minister toundertake the construction of the said works.
