Appendix C

ADDENDUM TO BROOKS WOODLAND PRESERVE MANAGEMENT PLAN

While researching and preparing baseline documentation for the Conservation Restrictions on the Brooks Woodland Preserve, it was discovered that a restriction to the Town of Petersham exists on a 200-foot wide strip of land on either side of the Swift River where it passes through the Preserve on lands formerly owned by the Brooks Wildlife Sanctuary. This restriction was given to the Town by the Sanctuary in October 1973. It was recorded on February 11, 1974 in the Worcester South County Registry of deeds at Book 5436, Page 102. The terms are that neither the Grantor nor its successors or assigns will ever perform or permit the following acts or uses on the Property:

1. No building, road, sign, advertising, utility pole or other temporary or permanent structure shall be constructed, placed or permitted to remain on or over the Premises, except (a) dams and impoundments for the feeding and shelter of wild creatures (b) unimproved trails, woods roads and access roads without surfacing except for sand or gravel (c) gates, fencing and bridges and (d) signs not exceeding 5 square feet in area setting forth restrictions on use of the Premises or identifying road names locations or natural features.

2. No trees, shrubs or other vegetation on the Premises shall be removed or destroyed

except as reasonably necessary for (a) maintenance of views, (b) maintenance of trails and woods roads as reasonably necessary for fire lanes and for the uses herein permitted, (c) maintenance of open areas and pasture areas, (d) grazing of livestock and cultivation and harvesting of flowers, crops and hay, or (e) maintenance of the wooded portions of the Premises in accordance with good woodland management.

3. No loam, peat, gravel, sand, rock or other mineral resource or natural deposit shall be

excavated or removed from the Premises in such a manner as to affect the surface, and no soil or other substance or material as land fill and not refuse, trash, waste or unsightly or offensive materials shall be dumped or placed on the Premises.

4. No one use of or activity upon the Premises shall be permitted or suffered which in the

reasonable opinion of the Grantee is or may be detrimental to retention of the Premises predominantly in their natural condition.
