Waigum Rud Section (N-70)
1. Introduction
1. Through ADB financial support, National Highway Authority (NHA), Pakistan is upgrading Qila Saifullh-Loralai-Wagum Rud Section of N-70 under National Highway Network Development in Baluchistan Project (NHNDP) through loan Pak 3134. The Project road section is part of the National Highway N-70 in Northern Baluchistan and it starts at Qila Saifullah on N-50, and terminates at Waigum Rud with a total length of 120 km. For rehabilitation and improvement works the project road has been divided into two sections: Lot-I is from RD 0+000 to RD 67+300 (before entering into Loralai city), and Lot-II starts after crossing Loralai city at RD 78+500 to RD 128+375. The project works include rehabilitation and upgrading of existing side single lane Qila Saifullah-Loralai-Waigum Rud Section of N-70 road into 7.3 meter wide carriageway with 2.5 meter shoulders on each side. As per design the total pavement width of the road is13.3 meters (44 ft.).
2. The designated NHA owned ROW of project road section is 110 feet in urban areas and 220 feet in rural areas and project did not entail acquisition of land. However, in some sections the ROW was encroached by the locals near settlements and agricultural lands. To address the resettlement issues in sections wherever ROW was encroached near settlements and agricultural land along the project road, NHA endorsed and ADB cleared updated resettlement plan is being implemented since January 2017 and affected/displaced persons have been compensated before clearing construction limits to ensure implementation of project is consistent with ADB’s IR requirements.
3. RP implementation progress is being tracked and monitored to achieve RP objectives and quarterly monitoring reports are being prepared and submitted for ADB’s review and acceptance. This third quarterly internal monitoring report includes RP implementation progress achieved between August to October 2017 and highlights the progress on consultations, information disclosure, handling of grievances and issues encountered during the reporting period.
1.1. Objectives of the IMR
4. The objective of this internal monitoring report is to:
• Review and assess the process of ongoing progress on payment of compensation for assets and entitled allowances to the DPs;
• Review implemented coordination progress and payment activities performed to project affected families and facilitate them in compensation processing and payment.
• Consultations, recording, tracking and handling of grievances at local and GRC levels.
• Recommend actions for improved RP implementation and execution of project works.
1.2. Monitoring Methodology
5. Methodology for this monitoring report includes a continued review of LARP implementation progress data and consultations with key informants and the displaced persons. The monitoring instruments included review of progress on the a) institutional set-up placed for RP implementation, b) RP disclosure and community outreach efforts implemented, c) compensation payment progress achieved for impacted assets, d) consultations progress and meeting proceedings by DPC and project GRC etc. Based on the review the results are summarized in the sections below explaining the achieved progress and actions required to ensure project implementation is consistent with IR requirements.

2. LARP implementation and Institutional Arrangements
2.1. RP implementation status as of 2nd Monitoring report.
6. NHA endorsed and ADB cleared updated RP required to clear construction limits within ROW after compensating impacted assets of 282 DPs for which compensation amount Rs. 98.355 million was to be paid. Implementation of updated RP was commenced in January 2017 for both contract packages i.e Contract Package Lot-1 and Contract package Lot-2. The compensation payment progress reported in 2nd Internal monitoring report (IMR) presented that 218 DPs (77%) were paid in both contract packages and Compensation amount Rs- 74.658 million (75.9%) was disbursed. Out of remaining 64 DPs the impact of 47 DPs (16.66% of Total DPs) were avoided through design adjustment and an amount of Rs 17.479 Million (17.8% of the total amount) was saved. Payment process for remaining 17 DPs (6%) was ongoing to disburse compensation cost Rs. 6.217 million (6.3%). Due to unpaid affected assets of 17 DPs, 1.47 Km of road section (0.17 Km in contract package lot-1 and 1.305 km in contract package lot-2) was put on hold until payment is confirmed. The table 2.1 below summarizes unpaid and withheld LAR section in each contract package as of 2nd Internal monitoring Report.

2.2. RP costs and availability of Funds
7. Total RP cost was estimated as Rs. 109.39 million that included Rs 98.356 million for delivery of compensation costs against affected assets and entitled allowances and Rs.11.036 million as RP implementation support cost. The table 2.2 below summarizes the compensation costs disbursed by close of 2nd monitoring report for delivery of entitled compensation, balance amount available with PMU for payment of compensation to unpaid DPs and RP implementation support costs i.e contingencies and salaries for the social mobilizers. The balance Compensation amount and 10% contingency cost provided in RP as implementation support will be utilized to compensate remaining unpaid DPs and emerging construction related LAR impacts if GRC recommends so.

2.3. LAR institutional Set-up and RP implementation process
8. The LAR unit headed by the GM, including Deputy Director Land and Resettlement Specialist mobilized by the DCSC is in place and project grievance redress committee headed by the Project Director have already been operationalized and functioning. For improved coordination, consultations and DPs participation in the GRM, Displaced Persons Committees are functional at village level. Through DPC meetings, the DPs representatives and local notables are being coordinated and engaged in consultations and the grievance redress process.
9. During the reporting months, RP disclosure efforts were continued and unpaid DPs were informed about their entitled compensation and submission of claims by serving compensation payment notices. Sample copy of notice is attached as Annex-II. The DPs were assisted to approach the project team for timely processing and delivery of their compensation before clearing of their assets. Meanwhile the DPs having impediments were approached and mobilized for early resolution of their issues and were informed about the process and documents to be prepared and submitted for receiving compensation after resolution of their issues.

3. RP Implementation Progress achieved during monitoring period.
10. During the reporting months, the payment process for 17 unpaid DPs was continued in withheld LAR sections of both contract packages (Lot-1 and Lot-2) as presented in table 2.1 above. Accordingly, the compensation payment notices were issued and disbursed to payable DPs for processing of claims. The sections below provide details on compensation payment progress achieved during the reporting period and highlight the sections where LAR implementation is fully completed and the sections where LARP implementation is still progressing.
3.1. Compensation Payment Progress achieved
11. The previous monitoring report reflected that compensation amount Rs. 23,697,64/-2 including LAR cost (Rs. 6,217,744) payable to 17 DPs and LAR costs (Rs. 17,479,897) saved for 47 DPs was available with PMU to complete payment to unpaid 17 DPs and address construction related emerging LAR impacts. During monitoring period, after delivering compensation notices to 17 unpaid DPs, compensation claims were processed and subsequently compensation Cheques amounting to Rs 2,951,177/- were delivered to 6 DPs. While efforts were continued to ensure disbursement to remaining 11 DPs including 6 unpaid private asset owners having legal and administerative impediments and 5 community and public assets. The compensation payment progress achieved during reporting period is shown in table 3.1 below and list of paid DPs (signed payment receipts) is attached as Annex I.

12. The above tables give disbursement details during the monitoring period i.e from August to October 2017. While, review of achieved overall RP implementation progress illustrate that 224 DP (79.4 %) have been paid compensation amount Rs 77.609/- million (78.9 %) and out of remaining 58 DPs the impact of 47 DPs (16.66% of Total DPs) were avoided through design adjustment and an amount of Rs 17.479 Million (17.8% of the total amount) was saved. The remaining balance compensation amount Rs. 3.266 million (3.32%) is due for unpaid 11 DPs (3.9%). For left over unpaid 11 DPs (3.9%) including 6 DPs facing loss of their private assets (including 2 DPs unwilling to receive compensation, 3 DPs having dispute among themselves and one DP not available in project area) and 5 affected government and community assets (2 Government and 3 community assets) efforts will continue to disburse entitled compensation amount Rs 3.266 million (3.32%) during next monitoring period. The table 3.2 represent summary of payment made during different months since RP implementation is started.

In 2nd IMR (April-July 2017) it was confirmed that LAR Impact on 47 DPs were avoided through design adjustments and saved compensation costs could be utilized to address and pay compensation for construction related emerging LAR impacts.
3.2. LAR Sections where compensation fully paid
13. During the reporting months the LARP implementation process were continued in withheld LAR sections as reported in table 2.1 above and payment to the payable 6 DPs were made as per their entitlements. After payment of compensation the DPs were advised to remove their assets for clearing the construction limits. In cases where DPs requested for uprooting of trees by use of machinery, they were facilitated in removing trees through machinery provided by the contractor and salvage material was handed over to the DPs. The handing over of salvage material to DPs was properly documented by the project team.
14. Reported LAR section in previous monitoring report also included 0.95 Km (84+500 to 85+450) which was kept on hold to review and address a complaint on bridge design height and corresponding LAR impacts. During reporting period the complainant/DP was engaged and his concerns on bridge design were addressed by lowering bridge height up to 1 meter following recommendations from hydrologist and design consultants. Meanwhile claimed LAR impacts/issues were reviewed and assessed through district land revenue authorities. A series of joint meetings (complainant, NHA and the District Revenue officers) were held with the Deputy Commissioner Loralai to seek his guidance, who after hearing the complainant and reviewing record and survey reports tendered by the land revenue officers decided that the complaint is without justification and advised NHA for evading such fake claims. So this 0.95 km section is also considered free from encumbrances and is included in LAR free sections provided in table below.
15. The table 3.3 below reflect the compensation is delivered to the DPs in withheld LAR section measuring 0.12 Km in Lot-1 and 1.115 Km in Lot-2, affected assets are removed by the DPs and construction limits are cleared. Thus the total length where LAR impacts are paid in lot -01 and lot -02 is 1.235 KM that could be considered for allowing construction activity. The linear plan showing cleared LAR areas after making payment in green, the LAR area where compensation is yet to be paid as red and previously allowed section as white also attached as Annex- II.

3.3. Sections where Compensation Payment is under process
16. The compensation is yet to be paid to 11 DPs including private asset owner 6 DPs and 5 government and community owned assets (affected assets like Water Supply pipe line, trees of 2 government departments, one regular mosque and 2 prayer place (patio) with 2 ft high wall) located in scattered sections in lot-1 and lot-2. Out of 6 remaining private DPs 3 DPs have ownership disputes among themselves, 2 DPs are not willing to get compensation and one DP is away. For early disbursement of compensation to remaining DPs, local administration has been approached to resolve the dispute between them and it is expected that issue could be resolved with the help of local administration in current monitoring period.
17. Cumulative length of unpaid LAR section is 0.240 Km out of which 0.05 Km is in Lot-1 and 0.190 Km is in Lot 2 which could also be considered to allow the construction activity because the payments are pending due to legal and administerative impediments faced by DPs. The unpaid LAR sections in both lot-01 and lot-02 are presented in table 3.4 below.

3.4. Reasons for unpaid and efforts implemented
18. The impediments like dispute on compensation entitlement between DPs household members caused delay in payment to the left over unpaid 6 DPs including 3 DPs having disputes on compensation entitlement, 2 DPs are unwilling to receive compensation that required re-adjustment in design alignment to avoid their assets and one DP is away. Efforts are being made to convince and facilitate unwilling DPs to receive their compensation and DPs with disputes are being followed up for early resolution of issues and claiming their compensation amount as and when disputes are resolved. It is planned that all unpaid DPs are compensated by 30 November 2017 for which the project LAR team assisted by the village DPC will continue approaching unpaid DPs on daily basis to pursue them for resolution of their disputes/issues and submission of their claims.
19. While for relocation of community assets (One mosque and 2 prayer places and water channels), the local community is being mobilized to constitute committees for payment of compensation and construction of alternate mosques, prayer places and community owned water channel out of construction limits. Efforts are being ensured to constitute a community representatives committee by 15 of November 2017 for compensation and construction of replacement mosques and water channels out of construction limits. Existing mosques and water channels will be cleared after construction of replacement mosques and water channels. While, for relocation of the government assets (security check posts), the respective departments have already been approached for payment of assessed compensation and relocation of their assets (security posts) out of construction limits.

4. Unanticipated Impacts emerged during construction.
20. During the preparation and updating process of RP the trees, structure and other assets located above ground and underground pipe line reported by the DPs during impact assessment and census were include in the inventory of losses and compensated as per LARP provisions. However, during implementation of RP some of the DPs and other community members informed that their underground irrigation water supply pipe lines falls within construction limits along the road and at locations wherever these lines crosses the road. The detail survey has been conducted with collaboration of consultant staff, Contractor staff and DPs regarding their underground pipelines and after verification claims of 72 DPs were considered genuine and accordingly the GRC recommended compensation for verified affected assets. The detail is given in subsequent section 5.2 on grievances recorded and redressed.
4.1. Public utilities (water supply line)
21. The Public Health and Engineering Department (PHED) Loralia claimed for underground water supply pipelines at different location near city portion from RD 62+000 to 67+000. During monitoring period the consultations were continued with superintending engineer of PHED and his staff for assessment and shifting of utility lines. The matter was also brought in the knowledge of Commissioner Zhob Division. Following consultation, a joint survey was conducted by PHED and consultant staff who verified and reported the exact locations, where utility line is crossing the road or buried under road. Responding to decision from Commissioner Zhob Division, the PHED Loralai assessed and demanded Rs 9.266 million as relocation cost for utility lines. The Project Director processed and submitted the case to NHA HQ for approval and to release demanded costs from the Physical Contingencies provided in the PC-1. Subsequent to approval from NHA HQ, a cheque amounting to Rs 9.266 million has been issued and sent to Secretary PHED by the GM (Const-North). As the compensation amount for relocating PHED water supply pipeline has been paid now, PHED Loralai will relocate the pipeline in sections wherever it is required in parallel with ongoing construction activities on the project road.

5. Consultations, information disclosure and grievance redress
22. Consultation and information disclosure is a continuous process for effective safeguards management and implementation of the RP. So, during monitoring period the efforts were continued to disclose the RP provisions, compensation payment mechanism and inform the DPs on project based grievance redress system. The LARP provisions and compensation entitlements were disclosed to the DPs through delivery of claim notices at their door steps.
5.1. Public Consultations/Meetings
23. In addition to individual meetings, structured public consultations were continued through the DPCs. During monitoring period, consultation meetings (gender segregated) were arranged through DPCs at different location and the meeting proceedings were recorded. In consultation meetings, resettlement specialist and his team clarified the and discussed issues with community, documented community concerns and provided information to the DPs regarding resettlement impacts, compensation payment process and mechanism for unanticipated impacts as well as on mechanism for recording and redress of grievances. In total 6 consultation meetings were convened including 4 consultation meetings with male DPCs and 2 consultation meetings with female DPCs. out of 4 meetings of male DPCs 2 consultation meetings were held in Lot-I and 2 consultation meetings were conducted in in Lot-II. While in each lot one female DPC meeting was also conducted during monitoring period. Minutes of DPC meetings (male and female) were recorded and are attached as Annex IV.
5.2. Grievances Recorded and Redressed
24. During monitoring period the DPs and local community continuously approached the project GRM for raising their concerns about impacts assessment compensation payment for underground irrigation water supply pipes crossing the road and buried within the construction limits and construction related issues. The application/complaints received form the DPs were properly registered in complaint register and upon guidance of the project GRC process for verification of pipeline and assessment of losses was initiated during the monitoring period. The GRC received total 139 complaints (66 previous and 73 New) that were reviewed and resolved by close of monitoring period.
25. During the reporting months (August-October), GRC conducted 4 meetings i.e two meetings were conducted in August 2017 and two in October 2017, wherein the grievances of the DPs were reviewed, discussed and resolved as GRC batch-1 and GRC Batch-2. During August GRC reviewed and resolved 43 complaints by allowing compensation to the complainants after verification of affected assets through joint survey by NHA, Consultant and Contractor staff and the complainants. Following GRC’s decisions the 43 DPs / Complainants were paid compensation amounting to Rs. 6,340,382/- through crossed cheques dated 11.08.2017 as GRC Batch-1. The GRC recommended compensation was paid by using 10% contingencies cost (amount Rs 9,835,564/-) provided in the RP.
26. The concerns of remaining 96 complainants were reviewed in GRC meetings conducted in October 2017. After through assessment and verification of claimed impacts through joint surveys by the NHA, Consultants, Contractors and the Complainants, the GRC recommended payment of compensation to 29 DPs/complainants, rejected claims of 55 complainants, and referred 9 complaints to the Engineering staff i.e PD and Construction supervision Consultants to assess requests for providing culverts and take appropriate action. The compensation amount Rs 5,700,798 was allowed for 29 DPs/complainants by GRC and accordingly it was paid as GRC batch 2 through cross cheques dated 12-10-2017 from available LAR funds amounting to Rs. 20,975,079/- that included remaining contingency funds Rs 3,495,182/ and Rs 17,479,897/- LAR cost saved by avoiding impacts on 47 DPs through design adjustments. 27. The above discussion represent that the GRC, after adopting due process to verify the complainants concerns/demands and doing consultations with local notables and aggrieved parties resolved the complaints. Out of 139 complaints, the GRC allowed compensation for 72 complainants, rejected claims of 55 complainants, forwarded 9 complainants to the engineering team for their review and consideration provision of culverts etc. and three complaints were under scrutiny by close of monitoring period. Table below summarizes GRC proceedings explaining overall status of grievances recorded and redressed during different GRC meetings conducted during reporting months. The GRC meetings minutes were recorded properly and the record about complaints received and resolved is fully maintained. Sample copy of Minutes of GRC meetings is attached as Annex-VI.

5.3. Complaint on Bridge Design and LAR issues at (RD 84+625) referred to ADB
28. A complaint of one land owner Dr. Malik Aman about bridge design issues and corresponding LAR impacts at RD 84+625 was pending meanwhile the complainant also approached ADB on the same issue during previous monitoring period. So, 0.95 KM area was kept on hold as LAR area and construction activities were stopped between KM 84+500 to 85+450 untill the complainant’s concerns on bridge design and corresponding LAR impacts are reviewed and resolved.
29. During monitoring period a close follow-up was retained with the complainant to address his concerns. In this regards, various formal and informal meetings were held with the aggrieved person by General Manager (Const-North), Project Director N-70, Deputy Director (L&S/Legal) and project resettlement team. In such meetings the bridge design, NHA owned ROW limits, LAR impact assessment including eligibility, entitlement provisions under project resettlement plan were explained but the complainant was not convinced with provided explanations. So, the complainants concerns regarding bridge heights were forwarded to the design review consultants and hydrologist for review and proposing optimal design solution to address complainant’s concerns and the concerns on LAR impacts were referred to the Land Revenue Authorities at Division and District level “The Commissioner Zhob Division and Deputy Commissioner Loralai District” for their support and guidance to resolve claimed LAR issues.
30. After reviewing complainant’s concerns on bridge design hydrology consultant the M/S Water Wise recommended i) reduction of bridge height by one meter or ii) replacement of the bridge with 11 cell culvert. The NHA after reviewing the recommendation accepted the option i) as it did not involve cost impact and advised the Team Leader M/S Minconsultant through the GM (Const-North) to reduce the bridge height by one meter.
31. Meanwhile, after review of claimed LAR issue the Commissioner Zhob Division directed Deputy Commissioner Loralai to step in and resolve the issue. The Deputy Commissioner Lorali invited NHA and the complainant to visit his office for resolution of claimed LAR issues. Upon DC’s direction, LAR impacts were verified through a joint survey conducted by the PD N-70, DD (L&S), Tehsildar Bori (Loralai) along with Revenue staff and in presence of Malik Aman. After field survey and review of land record, the Tehsildar Loralali submitted his physical survey report to the Deputy Commissioner Loralai confirming that the project works are limited within government owned ROW and impacts/damages to complainant’s tree or other assets are not identified. This followed several meeting sessions chaired by the Deputy Commissioner Loralai on 3rd and 4th October 2017 in his office. The meetings were attended by the PD N-70, DD (L&S), Malik Aman (Complainant) and Tehsildar Loralai.
32. After thorough review of the field verification report and hearing the parties, the Deputy Commissioner adjudicated the complaint and issued his directions as meeting minutes of meeting dated 4th Oct 2017. The DC’s decision confirmed the claim of Malik Aman regarding removal of trees, water channel / Pond, pipeline and Land is fake and he advised NHA for not entertaining the fake claim. In his decision, the DC also advised NHA to continue construction works at bridge location (between KM 84+500 to 85+450) and completing the Project of national interest at the earliest to facilitate the general public. Copy of the Minutes of Meeting is attached as Annex - III.

6. Conclusion and Recommendations
33. The RP implementation progress achieved during this monitoring period (August -October 2017) illustrate that out of 17 unpaid DPs in withheld LAR sections presented in table 2.1 of the report, 6 DP have been fully paid and an amount Rs 2.951/- million is disbursed on account of payable compensation. The remaining balance compensation amount Rs. 3.266 million is due for unpaid 11 DPs including 6 DPs having legal and administrative impediments and 5 public and community assets for which efforts are progressing to pay compensation during November 2017.
34. Out of withheld 1.475 Km LAR sections (0.17 Km in contract package Lot-01 and 1.305 Km in contract package-Lot-2) compensation is fully is paid for affected assets in 1.235 Km (0.12 Km LAR sections in contract package Lot-01 and 1.115 Km LAR sections contract package-Lot-2. Due to unpaid compensation to 6 DPs with legal and impediments and 5 government/community assets cumulative length of 0.24 Km (0.05 Km in Lot-1 and 0.19 Km in Lot-02) is still under LAR impacts.
35. Institutional set-up for delivery of unpaid compensation, management of emerging LAR issues and redress of grievances is in place and operational. However, for delivery of pending compensation, improved consultation, early resolution of grievances following actions will be ensured during next monitoring period:
• The issue of DPs having ownership/title disputes will be resolved with assistance of Local Administration and their compensation will be paid as and when they show-up after resolution of their ownership/title issues. Meanwhile the mechanism for compensation and relocation of government and community assets will be finalized and affected public/community assets and unpaid DPs will be compensated accordingly in November 2017.
• Verification and assessment process for under review complaints (3 complaints) on construction related emerging LAR issues will be completed and presented in next GRC meeting in November 2017 for its review and decision.
• The community consultation, participation and information disclosure at village level will be continued through increased frequency of DPC meetings; project GRC will convene its meetings regularly to review and redress construction related emerging LAR related grievance (as and when received) till completion of the project; and all consultation and GRC meetings will be recoded and meeting records will be maintained.
36. Based on achieved progress it can be safely concluded that the RP implementation is completed substantially in all withheld LAR sections in Lot – 1 and Lot -2 and the unpaid compensation for affected private, public and community assets in 0.240 km is because of legal and administerative issues beyond NHA’s control. The LAR institutional set-up and GRM is in place and efforts are progressing to compensate left over public/community assets and 06 DPs having legal and administrative impediments by 30th November 2017. Therefore it is recommended that ADB may be requested to consider allowing construction works in previously withheld 1.47 Km LAR sections of both contract packages i.e 0.17 Km withheld LAR section in Contract Package Lot-1 and 1.305 Km withheld section in Contract Package Lot-2.
