The standard expressly acknowledges ‘‘the scope of a Phase II ESA is related to the objectives of the investigation.’’
‘‘The user and Phase II Assessor must have a mutual understanding of the context in which the Phase II ESA is to be performed and the objectives to be met by the investigation.’’

All Appropriate Inquiry (AAI) Rule Congress passes Brownfields Amendments to CERCLA in 2002
Congress instructed EPA to issue AAI rule outlining 10 elements
that EPA must include in the rule. Until AAI rule is adopted,
ASTM E1527-97 & 1527-2000 become interim standard
EPA developed rule in collaboration with a Federal Advisory
Committee, and a final rule adopted in 2005 effective November
1, 2006
Compliance with AAI (or an alternative standard compliant with
AAI) is precondition for CERCLA liability defenses or Brownfields
grants
EPA determined that ASTM E1527-05 is compliant with AAI rule
Dramatically expanded applicability of Phase I ESAs

E1527 Task Group Objectives
Task group convened in early 2010
Nothing particularly “broken” in the existing standard
Task Group agreed in two primary objectives:
Clarify existing language
Strengthen the deliverable

REC: The term recognized environmental condition means the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to any release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment. De minimis conditions are not recognized environmental conditions.
