Whereas the fish landing in the Stateof Goa takes place at various major landingcentres as well as traditional landing centres.
And Whereas it has become necessary tomonitor all the fish landing centres in theState and restrict the number of landingcentres in the State from the point of view ofCoastal Security.
And Whereas it has been recommendedby the Coastal Security Co-ordinationCommittee that the State Government maydesignate the existing fish landing centresby notifying the same and not to allow fishlandings at any landing centres other thanabove notified.

And Whereas the Government has therefore decided to make it mandatory for the fishing
vessels to land their fish only on the notified landing centres.

mechanised fishing vessels from the State of Goa.

The following draft rules which are proposedto be made in exercise of the powers conferredby section 53 of the Legal Metrology Act, 2009(Central Act 1 of 2010) (hereinafter referred toas the “said Act”), are hereby pre-publishedas required by sub-section (4) of section 53 ofthe said Act for information of all the personslikely to be affected thereby and notice ishereby given that the said rules will be takeninto consideration by the Government on theexpiry of 15 days from the date of publicationof this Notification in the Official Gazette.
All objections and suggestions to the saiddraft rules may be forwarded to the Controller,Legal Metrology, Government of Goa,Department of Legal Metrology, Panaji, Goa,before the expiry of the said period of 15 daysfrom the date of publication of this Notificationin the Official Gazette so that they may be takeninto consideration at the time of finalization ofthe draft rules.
DRAFT RULES
In exercise of the powers conferred bysection 53 of the Legal Metrology Act, 2009(Central Act 1 of 2010), and all other powersenabling it in this behalf, the Governmentof Goa, after consultation with the Central

Government, hereby makes the following rules,namely:—
1. Short title and commencement.— (1)These rules may be called the Goa LegalMetrology Rules, 2011.
(2) They shall come into force on such dateas the Government may, by notification in theOfficial Gazette appoint, and different datesmay be appointed for different provisions ofthese rules.
2. Definitions.— In these rules, unless thecontext otherwise requires,—
(a) “Act” means the Legal MetrologyAct, 2009 (Central Act 1 of 2010);
(b) “Government” means the Govern-ment of Goa;
(c) “Reference Standards Laboratory”means a laboratory setup by the CentralGovernment under the Act, whereReference Standards, Secondary Standardsand Working Standards are maintained;
(d) “Schedule” means a Scheduleappended to these rules;
(e) Words and expressions used in theserules but not defined herein shall have thesame meaning as respectively assigned tothem in the Act.
3. Reference Standards, SecondaryStandards and Working Standards.— (1) EveryReference Standard, Secondary Standard andWorking Standard shall be verified andstamped in such manner and after paymentof such fee as may be prescribed by theCentral Government under sub-section (2) ofsection 9 of the Act.
(2) The Reference Standards shall be keptat such place, in such manner and insuch custody as prescribed underthe Legal Metrology (National Standards)Rules, 2011.
(3) The Secondary Standards shall be keptat such place and in such custody as theController may direct.
(4) The Working Standards shall be kept inthe custody of Legal Metrology Officer.
4. Secondary Standard Balances.— (1) A setof Secondary Standard Balances shall bemaintained at every place where theSecondary Standard Weights are kept.
(2) The number, types and specifications ofsuch balances shall be such as may beprescribed under the Legal Metrology(General) Rules, 2011.
(3) Every Secondary Standard Balance shallbe verified at least once within a period oftwelve months and shall be adjusted, ifnecessary, to make it correct within the limitsof sensitivity and other metrological qualitiesspecified under the Act or rules framedthereunder, by the Reference StandardsLaboratory or by the Controller or such otherOfficer as may be authorized by the Controllerin this behalf.
5. Working Standard Balances.— (1) A setof Working Standard Balances shall bemaintained at every place where WorkingStandard Weights are kept.
(2) The number, types and specifications ofsuch balances shall be such as may beprescribed under the Legal Metrology(General) Rules, 2011.
(3) Every Working Standard Balance shallbe verified at least once within a period oftwelve months and shall be adjusted, ifnecessary, to make it correct within the limitsof sensitivity and other metrological qualitiesprescribed under the Legal Metrology(General) Rules, 2011, by the ReferenceStandard Laboratory or at any of the placewhere Secondary Standards are maintainedby the Government.
6. Physical characteristics, configuration,constructional details of Weights and

Measures.— Every Weight or Measure usedor intended to be used in any transaction orfor protection shall conform as regards physicalcharacteristics, configuration, constructionaldetails, materials, performance, tolerances andsuch other details, to the specificationsspecified under the Act or the Legal Metrology(General) Rules, 2011.
7. Use of bullion weights, carat weights,etc.— (1) No weight other than a bullionweight as specified in the Legal Metrology(General) Rules, 2011, shall be used in anytransaction or protection in bullion includingprecious metals, pearls, ornaments or otherarticles made of gold or silver.
(2) No weight other than a carat weightshall be used in any transaction in preciousstones.
(3) Only beam scale of class ‘A’ or class ‘B’category or a non-automatic weighinginstrument of high accuracy class (class II) orspecial accuracy class (class I) shall be usedin any transaction referred to in sub-rules (1)and (2).
8. Use of weights only or measures only ornumber only in certain cases.— Except in thecases of commodities specified in Schedule Ihereto, the declaration of quantity in everytransaction, dealing or contract or forprotection shall be in terms of the unit of,—
(a) weight, if the commodity is solid,semi-solid, viscous or a mixture of solid andliquid;
(b) length, if the commodity is sold bylinear measure;
(c) area, if the commodity is sold by areameasure;
(d) volume, if the commodity is liquid oris sold by cubic measure; or
(e) number, if the commodity is sold bynumber.
9. Licencing of manufacturer, repairer anddealer of weights and measures.— (1) Everymanufacturer or repairer of, or dealer in,weights or measures shall make an applicationfor the issue of a licence to the Controller orsuch other Officer as may be authorized by himin this behalf, in FORM-LM-IA, FORM-LM-IB,FORM-LM-IC, hereto, respectively:
Provided that no licence to repair shall berequired by a manufacturer to repair weightor measure manufactured by him and used ina State other than the State of manufacture ofthe same, but the manufacturer shall informin advance the concerned Legal MetrologyOfficer about such repairing:
Provided that a person who bonafidelyrepairs any weight or measure owned orpossessed by him shall not require a licenceto repair.
(2) Every manufacturer or repairer of, ordealer in, weights or measures shall make anapplication for the renewal of a licence withinthirty days before the date of its expiry to theController or such other Officer as may beauthorized by him in this behalf, in FORM-LM--IIA, FORM-LM-IIB, FORM-LM-IIC, hereto,respectively.
(3) Every licence issued to a manufacturer,repairer or dealer shall be in FORM-LM-IIIA,FORM-LM-IIIB, FORM-LM-IIIC, hereto,respectively.
(4) Every licence issued to a manufactureror repairer or dealer shall be valid for a periodof one calendar year and may be renewed fromyear to year on an application made withinthirty days before the date of expiry of licenceto the Controller or such other Officer as maybe authorized by him in this behalf alongwithfee as specified in Schedule II hereto. The feefor the renewal of licence shall be the sameas for the issue of licence as specified inSchedule II hereto:
Provided that the Controller may entertainthe application made within a period of three

months from the date of expiry of the licence,if he is satisfied that applicant was preventedfrom making application within the timeaforesaid for bonafide reasons, on payment ofadditional fee at full the rate specified inSchedule II hereto.
(5) The fee payable for the alteration of alicence or for issue of a duplicate licence shallbe as specified in Schedule II hereto.
(6) The Controller or such other Officeras may be authorized by him in this behalfshall maintain a register of licencedmanufacturers, dealers and repairers inFORM-LM-IV hereto.
(7) Every manufacturer, repairer, or dealerlicenced under the Act and these rules shallmaintain such workshop, equipments, toolsand registers, etc., as the case may be, as perthe terms and conditions of the licence.
(8) Every repairer licenced under the Actand these rules shall furnish a security depositof rupees two hundred for each licence to theGovernment.
(9) Every licence issued or renewed underthis Act shall be displayed in a conspicuousplace in the premises where the licenseecarries on business.
(10) A licence issued or renewed under thisAct shall not be salable nor transferable.
10. Suspension and cancellation of licencegranted.— (1) The Controller or such otherOfficer authorized by him in this behalf may, ifhe has any reasonable cause to believe thatthe holder of any licence issued, renewed orcontinued under this Act has made anystatement in, or in relation to any applicationfor the issue, renewal or continuance of thelicence, which is incorrect or false in anymaterial particular or has contravened anyprovision of the Act or any rule or order madethereunder, suspend such licence, pending thecompletion of any inquiry against the holderof such licence:
Provided that no such licence shall besuspended unless the holder thereof has beengiven a reasonable opportunity of being heardin the matter:
Provided further that where the inquiryreferred to in this sub-section is not completedwithin a period of three months from the dateof suspension of a licence, such suspensionshall, on the expiry of the period aforesaid,stand vacated.
(2) The Controller or such other authorizedOfficer if he is satisfied, after making suchinquiry as he may think fit, that the holder of alicence has made a false or incorrect statementof the nature referred to in sub-rule (1), or hascontravened any law or order referred to inthat sub-section, cancel such licence:
Provided that no such licence shall becancelled unless the holder thereof has beengiven a reasonable opportunity of being heardin the matter.
(3) Every person whose licence has beensuspended shall, immediately after suchsuspension, stop functioning as such licenceeand shall not resume business as such licenceeuntil the order of such suspension stands, orhas been, vacated.
(4) Every licencee whose licence has beensuspended or cancelled shall, after suchsuspension or cancellation, as the case maybe, surrender such licence to the authority bywhom such licence was issued.
(5) Every licencee whose licence has beencancelled shall, within a period of thirty daysfrom the date of such cancellation, or withinsuch further period not exceeding threemonths from such date as the Controller orsuch other Authorized Officer on sufficientcause being shown allow, dispose of theweights or measures which were in hispossession, custody or control on the date ofsuch cancellation and in the event of his failureto do so, the Controller or such otherAuthorized Officer may seize and dispose of

the same and distribute the proceeds thereofin such manner as may be prescribed.
11. Records to be maintained bymanufacturers, etc.— Every manufacturer orrepairer of, or dealer in weights or measureslicenced under the Act and these rules shallmaintain records and registers in FORM-LM--VA, FORM-LM-VB, FORM-LM-VC, hereto,respectively, and also submit such periodicalreport/returns as may be specified in thatbehalf.
12. Periodical interval for the verification ofweights or measures.— Periodical interval forthe verification of weights and measures asshall be specified in the Legal Metrology(General) Rules, 2011.
13. Verification and inspection of weights ormeasures.— (1) Every person using anyweight or measure in any transaction or forprotection shall present such weight ormeasure for verification or re-verification, atthe Office of the Legal Metrology Officer or atsuch other place as the Legal Metrology Officermay specify in this behalf on or before the dateon which the verification falls due:
Provided that where any weight or measureis such that it cannot, or should not, be movedfrom it’s location, the person using such weightor measure shall report to the Legal MetrologyOfficer at least thirty days in advance of thedate on which the verification falls due.
(2) Where any weight or measure is suchthat it cannot, or should not, be moved fromit’s location, Legal Metrology Officer shalltake necessary steps for the verification ofsuch weight or measure at the place of it’slocation.
(3) For the verification of weight or measurereferred to in sub-rule (2), the user shallprovide such facilities as may be specified bythe Controller.
(4) Every weight or measure presented forverification shall be complete in itself.
(5) Every weight or measure shall beverified in a clean condition, and if necessary,the Legal Metrology Officer shall require theowner or user to make necessary arrangementfor the purpose.
(6) A Legal Metrology Officer may visit, asfrequently as possible and during theperiodical interval as referred to in rule 12,every premises within the local limits of hisjurisdiction to inspect and test any weight ormeasure which is being or is intended or likelyto be used in any transaction or for protection.
(7) The Legal Metrology Officer shallobliterate the stamp on any weightor measure, if it is found during inspectionthat,—
(a) any weight or measure which beingdue for re-verification has not beensubmitted for such re-verification;
(b) any weight or measure which doesnot conform to the standards establishedby or under the Act:
Provided that where the Legal MetrologyOfficer is of opinion that the defect or error insuch weight or measure is not such as torequire immediate obliteration of the stamp,he shall inform the user about the defect orerror found in the weight or measure and callupon user to remove the defect or error withinsuch time, not exceeding eight days andshall,—
(i) if user fails to remove the defect orerror within that period, obliterate thestamp, or
(ii) if the defect or error is so removedas to make the weight or measureconform to the standards established byor under the Act, verify and stamp suchweight or measure.
Explanation.— The obliteration of the stampon any weight or measure shall not take awayor abridge the power of the Legal Metrology

Officer to seize such weight or measure inaccordance with the provisions of the Act.
14. Stamping of weights or measures.— (1)The Legal Metrology Officer shall stamp everyweight or measure, if af ter testing andverification, he is satisfied that such weight ormeasure conforms to the standards establishedby or under the Act, with a stamp of uniformdesign, issued by the Controller, which shallindicate the number allotted for administrativepurpose to the Legal Metrology Officer bywhom it is stamped:
Provided that if by reason of the size or natureof any weight or measure it is not desirable orpracticable to put a stamp thereon, the LegalMetrology Officer shall take such action as maybe directed by the Controller by a general or aspecial order in writing.
(2) The Legal Metrology Officer shall alsomark the year and it’s quarter of stamping onevery verified weight or measure except whenthe size or nature of such weight or measuremakes it impracticable.
Explanation.— A year shall be deemed toconsist of four quarters of which first quartershall be of the months of January, Februaryand March, which shall be marked as A;second quarter shall be of the months of April,May and June, which shall be marked as B;third quarter shall be of the months of July,August and September, which shall be markedas C; and fourth quarter shall be of the monthsof October, November and December, whichshall be marked as D.
(3) On completion of verification andstamping, the Legal Metrology Officershall issue a Certificate of Verification inFORM-LM-VI hereto.
(4) Where a Certificate of Verification is lostor destroyed, the holder of the Certificate ofVerification shall forthwith apply to the LegalMetrology Officer who had issued theCertificate, for the issue of a duplicateCertificate of Verification. Every such
application for the issue of a duplicateCertificate shall be accompanied by a fee ofRupees ten.
(5) On receipt of an application undersub-rule (4), the Legal Metrology Officer shallissue to the applicant a duplicate copy ofthe Certificate of Verification marked‘DUPLICATE’.
15. Fee for verification.— (1) Fees payable forverification and stamping of weight or measureat the Office or Camp Office of the LegalMetrology Officer shall be as specified inSchedule III hereto.
(2) If, at the request of the user of weight ormeasure, verification is done at any premisesother than the Office or Camp Office of theLegal Metrology Officer, an additional fee shallbe charged at half the rate specified in theSchedule III hereto and the user of the weightor measure shall pay the expenses incurredby the Legal Metrology Officer for visiting thepremises, including the cost of transportingand handling the Working Standard and otherequipment subject to a minimum of RupeesOne hundred:
Provided that no additional fee shall becharged for verification and stamping ofweights and measures in situ of,—
(i) vehicle tanks for petroleum productsand other liquids, Meter for Liquids otherthan Water (Fuel Dispenser, LiquidPetroleum Gas, Milk Dispensers),Compressed Natural Gas Dispensers, Non--automatic Weighing Instruments likeWeighbridges, Platform Machines, CraneScale, Automatic Gravimetric FillingInstruments, Automatic Rail-weighbridge,Discontinuous Totalizing AutomaticWeighing Instruments, and such otherweight or measure which cannot, andshould not be moved from it’s location;
(ii) weight or measure in the premises ofmanufacturer or dealer of such weight ormeasure.

(3) If a weight or measure is presented tothe Legal Metrology Officer for re-verificationafter expiry of the validity of the stamp, anadditional fee at half the rates specified inSchedule III hereto shall be payable for everyquarter of the year or part thereof.
(4) Full fee shall be payable for re-stampingany weight or measure held in stock withmanufacturer or dealer within the periodspecified in rule 12 from the date on which itwas last stamped, provided that the originalstamp was not obliterated.
(5) A weight or measure which onverification or inspection is found to beincorrect shall be returned to the personconcerned for adjustment informing him, in aproforma specified by the Controller, of thedefects found in the weight or measure, andcalling upon him to remove the defects withina period not exceeding seven days. When thenecessary adjustment has been carried out,such weight or measure shall be verified onpayment of the fees specified in Schedule IIIand if found correct shall be stamped.
16. Collection of fees and deposit into theTreasury.— (1) Before commencing the workof verification or re-verification, the LegalMetrology Officer shall inform the personconcerned of the fees payable by him and shallreceive the same in the manner as authorizedby the Controller and issue a receipt on theform approved by the Controller, one copy ofsuch receipt being kept for record:
Provided that the fees payable by aDepartment of the Central or State Governmentunder these rules may be realized in suchmanner as may be directed by the Controller.
(2) The Legal Metrology Officer shallmaintain a register, in the form approved bythe Controller, which shall be written up fromday-to-day and shall show the amount of feesand other charges collected during the day.
(3) All payment received by the LegalMetrology Officer during the week shall be
paid into the Government treasury under theappropriate “Head of Account” on such datesor days as may be specified by the Controllerfrom time to time, and a receipt thereof beobtained and an intimation to that effect besent to the Controller or other Officerauthorized by him in this behalf.
17. Disposal of seized weights, measures,etc.— (1) Any un-verified weight or measureshall be returned to the person from whomsuch weight or measure was seized if thatperson gets the same verified and stamped,within fifteen days of the return of seizedgoods on payment of the prescribed fee,including the additional fee, payable forundertaking re-verification after the expiry ofthe validity of the stamp.
(2) Any weight or measure or document orthing or goods seized and detained undersection 15 of the Act, which is the subjectmatter of proceedings in a Court shall beproduced by the Legal Metrology Officerbefore the Court and after conclusion of theproceedings, the Legal Metrology Officer shalltake possession of the same and deal with it inaccordance with the orders of the Court:
Provided that in the absence of the ordersof the Court, weight or measure or documentor thing or goods shall be dealt with as theController may, by special order, direct and thematerial thereof shall be sold and the proceedscredited to the Government treasury.
(3) If any goods seized under section 15 ofthe Act are subject to speedy or natural decay,the Legal Metrology Officer shall have thegoods weighed or measured on a verifiedweighing or measuring instrument availablewith him or at the nearest place from the placewhere such goods are seized and enter theactual weight or measure of the goods in aform specified by the Controller for thispurpose, and shall obtain the signature of thetrader or his agent or such other person whohas committed the offence and return thegoods in question to the trader or thepurchaser, as the case may be:

Provided that if the trader or his agent orany other person who has committed theoffence refuses to sign the form, the LegalMetrology Officer shall obtain the signaturesof not less than two persons present at the timeof such refusal by the trader or his agent orsuch other person. In the case if goods arereturned to the trader, he shall give anundertaking stating that he shall not sell thedefective goods without rectifying the defectsthereon.
(4) Where the goods seized under sub--section (1) of section 15 of the Act arecontained in a package and the package isfalse or does not conform to the provisions ofthe Act or any rules made thereunder andthe goods in such package are subject tospeedy or natural decay, the Legal MetrologyOfficer may dispose of the goods in suchpackage in accordance with the provisions ofsub-rule (3):
Provided that the Controller shall be the finalauthority to decide whether the goods seizedand detained are subject to speedy or naturaldecay.
(5) Where the goods seized under sub--section (1) of section 15 of the Act are notsubject to speedy or natural decay, the LegalMetrology Officer may retain the package forthe purpose of prosecution under the Act aftergiving the trader or his agent or the otherperson who has committed the offence a noticeof such seizure.
(6) The goods referred under sub-rules (4)
and (5), which are not the subject matter of
proceedings in a Court, shall, after the expiry
of sixty days from it’s seizure, be so dealt with
as the Controller may by special order direct.
18. Validity of weights or measures dulystamped.— (1) A weight or measure which is,or is deemed to be, duly verified and stampedunder these rules shall be deemed to conformto the Standards established by or under theAct at every place within the State of Goa inwhich it is stamped unless it is found on
inspection or verification that such weight ormeasure has ceased to conform to theStandards established by or under the Act.
(2) No weight or measure which is, or isdeemed to be, duly verified and stamped underthis Act shall require to be re-stamped merelyby reason of the fact that it is being used atany place within the State of Goa other thanthe place at which it was originally verifiedand stamped:
Provided that where a verified weight ormeasure, installed at one place is dismantledand re-installed at a different place, suchweight or measure shall not be put into useunless it has been duly re-verified and stamped,notwithstanding that periodical re-verificationof such weight or measure has not becomedue.
(3) Where a verified weight or measure hasbeen repaired, whether by a licenced repaireror by the person owning and possessing thesame, such weight or measure shall not be putinto use unless it has been duly re-verifiedand stamped, notwithstanding that periodicalre-verification of such weight or measure hasnot become due.
19. Qualifications of Legal MetrologyOfficer.— Qualifications of Legal MetrologyOfficer shall be as specified in the LegalMetrology (General) Rules, 2011.
20. Provision of supply of Working//Secondary Standards, equipment, etc. to theLegal Metrology Officer.— (1) Every LegalMetrology Officer shall be provided withWorking/Secondary Standard Weights,Working/Secondary Standard Balances, andsuch other equipments including weighingand measuring devices as may be approvedby the Controller from time to time.
(2) Every Legal Metrology Officer shall beprovided with such dies, punches, paper seal//sticker and such other equipment as may benecessary for affixing the verification stamp,the design and number of which are to beapproved by the Controller.

(3) Every Legal Metrology Officer shall beprovided with punches of suitable sizes ofeight-pointed star as shown below forobliterating stamps.
21. Provisions relating to use of weights,measures, etc.— (1) Every person using abeam scale in any transaction in his premisesshall suspend the same to a stand or to a chainby a hook:
Provided that this sub-rule shall not applyto itinerant vendors.
(2) Every weight or measure shall be usedin a clean condition and in proper lightingarrangement.
(3) Any weight or measure, which has beenverified and stamped in situ, shall not bedismantled and removed from it’s originalsite without prior intimation to the Controlleror other person authorized by him in thisbehalf.
(4) To ensure a proper check of the accuracy
of a weighing instrument, the user shall keep
at the site of each weighing instrument duly
verified and stamped weights equal to one-
-tenth of the capacity of the instrument or one
tonne and consumer can also check the
accuracy of the weighing instrument:
Provided that the Controller may specify the
total number of verified and stamped weights
to be maintained in trade premises where the
number of weighing instruments are more
than one.
(5) To ensure proper delivery of the petrol
and diesel at pumps, the retail dealer of the
pump shall keep a verified 5 litres and 10 litres
capacity measure in his premises and check
the out put from the pump every day to ensure
it’s correct delivery. In case of any short
delivery the dealer shall stop the delivery
through the pump immediately and inform the
Legal Metrology Officer concerned to
recalibrate the pump.
22. Certificate of Verification to beExhibited.— The person to whom a Certificateof Verification is issued shall exhibit the samein a conspicuous place in the premises wherethe weights, measures or weighing ormeasuring instruments to which theCertificate relates are used:
Provided that in the case of itinerantvendor, the Certificate shall be kept with theperson:
Provided further that in the case of vehicletank, the Certificate of Verification shall be keptwith the vehicle.
23. Penalty for contravention of rules.—Whoever contravenes any provision of theserules, for the contravention of which nopunishment has been separately provided inthe Act, shall be punished with fine, whichmay extend to five thousand rupees.
24. Form of appeal.— (1) Every appeal
under the Act and these rules shall be
preferred in FORM-LM-VII hereto and shall be
accompanied by a copy of the order appealed
against.
(2) An appeal to the Government shall be
accompanied by fee of Rs. 500/- (Rupees Five
hundred only) and an appeal to the Controller
shall be accompanied by fee of Rs. 200/-
(Rupees Two hundred only) paid either by
cash or by affixing Court fee stamp of the
said value.
25. Fee for compounding of offences.— The
fee for compounding of offences committed
under the Act shall be as specified in Schedule
IV hereto.

Conditions of Licence
(1) The person in whose favour this licence is issued shall,—
(a) comply with all the relevant provisions of the Legal Metrology Act, 2009 and Rules framedthereunder for the time being in force;
(b) not encourage or countenance any infringement of the provisions of the Act or the Rules asamended from time to time;
(c) exhibit this licence in some conspicuous part of the premises to which it relates;
(d) comply with any general or special directions that may be given by the Controller of LegalMetrology;
(e) surrender the licence in the event of closure of business and/or cancellation of Licence;
(f) present the weights, measures, weighing or measuring instruments, as the case may be,manufactured and meant for use within the State, to the Legal Metrology Officer for verificationand stamping before sale;
(g) submit the application for renewal of this licence as required under the rules within thirty daysbefore the date of its expiry.
(2) Every condition prescribed after the issue of this licence shall, if notified in the Official Gazette,be binding on the persons to whom the licence has been granted.

Conditions of Licence
(1) The person in whose favour this licence is issued shall,—(a) comply with all the relevant provisions of the Act and Rules for the time being in force;(b) not encourage or countenance any infringement of the provisions of the Act or the Rules for the
time being in force;(c) exhibit this licence in some conspicuous part of the premises to which it relates;(d) comply with any general or special directions that may be given by the Controller of Legal Metrology;(e) surrender the licence in the event of closure of business and/or cancellation of Licence;(f) (i) present the weights, measures, weighing or measuring instruments, as the case may be, duly
repaired to the Legal Metrology Officer for undertaking verification and stamping beforedelivery to the user.
(ii) in the case of weights, measures, weighing or measuring in struments, if they, are serviced//repaired before the date on which the verification falls due and where, in the process and theverification stamp of the Legal Metrology Officer is defaced, removed or broken, they shall bepresented duly repaired to the Legal Metrology Officer for re-verification and stamping beforedelivery to the user.
(g) submit the application for renewal of this licence as required under the rules within thirty daysbefore the date of its expiry.
(2) Every condition prescribed after the issue of this licence shall, if notified in the Official Gazette, bebinding on the persons to whom the licence has been granted.

In exercise of the powers conferred by the proviso to Article 309 of the Constitution ofIndia, read with section 21 of the General Clauses Act, 1897 (Central Act 10 of 1897), theGovernor of Goa hereby amends the Government of Goa, Goa Medical College, Group ‘C’,Non-Ministerial, Non-Gazetted post, Recruitment Rules, 2008, published vide NotificationNo. 1/2/2006-PER dated 4-8-2008, in the Official Gazette, Series I No. 19 dated 7-8-2008, asfollows, namely:—
1. Short title and commencement.— (1) These rules may be called the Government of Goa,Goa Medical College and Directorate of Health Services, Group ‘C’, Non-Ministerial, Non--Gazetted post, Recruitment Rules, 2008 (First Amendment) Rules, 2009.
(2) They shall be deemed to have come into force on the 7th day of August, 2008.

1/10/2005-PER
In exercise of the powers conferred by the
proviso to Article 309 of the Constitution of
India, the Governor of Goa hereby makes the
following rules to regulate the recruitment to
the Goa General Service, Group ‘A’, Gazetted
post, under the Directorate of Health Services,
Government of Goa, namely:—
1. Short title, application and commence-
ment.— (1) These rules may be called the
Government of Goa, Directorate of Health
Services, Group ‘A’, Gazetted post,
Recruitment Rules, 2011.
(2) They shall apply to the post specified in
column (1) of the Schedule to these rules
(hereinafter called as the “said Schedule”).
(3) They shall come into force from the date
of their publication in the Official Gazette.
2. Number, classification and scale of pay.—
The number of posts, classification of the said
post and the scale of pay attached
thereto shall be as specified in columns (2)
to (4) of the said Schedule:
Provided that the Government may vary
the number of posts specified in column (2)
of the said Schedule from time to time subject
to exigencies of work.
3. Method of recruitment, age limit and
other qualifications.— The method of
recruitment to the said post, age limit,
qualifications and other matters connected
therewith shall be as specified in columns
(5) to (13) of the said Schedule.
4. Disqualification.— No person who has
entered into or contracted a marriage with a
person having a spouse living or who, having
a spouse living, has entered into or contracted
a marriage with any person, shall be eligible
for appointment to the service:
Provided that the Government may, if
satisfied that such marriage is permissible
under the personal law applicable to such
person and the other party to the marriage
and that there are other grounds for so doing,
exempt any person from the operation of this
rule.
5. Power to relax.— Where, the
Government is of the opinion that it is
necessary or expedient so to do, it may, by
order, for reasons to be recorded in writing,
and in consultation with the Goa Public
Service Commission, relax any of the
provisions of these rules with respect to any
class or category of persons.
6. Saving.— Nothing in these rules shall affect
reservation, relaxation of age limit and other
concessions required to be provided for
Scheduled Castes and other special categories
of persons in accordance with the orders issued
by the Government from time to time in that
regard.
These rules are issued in consultation with
the Goa Public Service Commission conveyed
vide its letter No. COM/II/13/24(1)/2011/4347
dated 24-02-2011.
