1. Short title and commencement.— (1) ThisScheme may be called the Goa Stray CattleManagement Scheme, 2013.

(2) It shall come into force with effect fromthe date of its publication in the Official Gazette.

2. Introduction.— The Government of Goais concerned about the stray cattle menacewhich is causing traffic obstruction, deathsdue to accidents on roads, agricultural damageand intrusion into the touristic places likebeaches. The traffic on Goa’s roads is everincreasing and with it the road accidents areon the increase. It is observed that several ofthe road accidents are caused due to directvehicular hits to the animals or because thedriver of the vehicle had to turn to avoid hittingthe animals on the road. Animals on the roadare accident prone and pose greater problems

during the night hours when visibilitybecomes poor and movement of traffic goesfaster.

The animals not only get injured or killedbut invariably involve human beings gettinginjured or even killed in the accidents. It isdesirable that animals are not found roamingfreely on the roads or near wayside garbagebins etc.

Goa being a tourist destination, the strayanimals on the beaches and wayside conveysan ugly picture of Goa. These animals shouldbe shifted to a place where they can be betterlooked after, rather than being left to go aboutas scavengers and be a nuisance to tourists.

For past few years agriculture is on thedecline. The few enthusiastic farmers who stillwould like to pursue agriculture have to spendlarge amount of money to fence theiragricultural crops so as to prevent strayanimals from destroying their standing crops.

To overcome this nuisance on the roads, toimprove the image of the State and to helpencourage agriculture, a scheme needs to beformulated to control the stray animal menaceby appointing an agency to impound the straycattle from the roads.

The scheme envisages the impounding ofthe stray cattle and transporting them byspecialized vehicle to the Government CattlePound, where arrangements will be made tolook after the animals.

To make the scheme citizen centric, thescheme encourages the citizens to inform theCommissioner, Corporation of the City of Panajior person/individual nominated by him onmobile about the presence of the stray cattlein any area, the mobile number shall be widelypublicized and displayed at all themunicipalities, panchayats and public places.

3. Objectives.— (a) To ensure removal ofstray cattle from public areas without injuringthem and carry them safely to a place wherethey will be fed properly and looked after in ahumane manner.

(b) To make farmers responsible fortethering their own animals.

(c) To ensure that animals on grazing beaccompanied by a responsible shepherd//owner.

(d) To ensure agriculture is not damaged bystray cattles.

4. Definitions.— (a) “Agency” means theCorporation of the City of Panaji;

(b) “Director” means the Director of AnimalHusbandry and Veterinary Services;

(c) “Government Cattle Pound” means theGovernment Fodder Seed Production Farm atKalay, Sanguem Taluka-Goa or any otherGovernment facility that is declared to beused for the purpose of the scheme.

(d) “Stray Cattle” includes all bovine specieswhich are found roaming freely on publicplaces without any person/shepherdattending on them.

(e) “Scheme” means the Goa Stray CattleManagement Scheme, 2013.

5. Impounding (Catching and Trans-

portation) of Stray Cattle.— The Agency shall

be responsible to catch the stray cattle from

the roads, beaches, fields, public places and

transport them to the Government Cattle

Pound. The Agency shall impound, look after

the animals during the holding period and

transport the animals by specialized vehicle

to the Government Cattle Pound, and hand

over the impounded cattle to the In-charge of

the Government Cattle Pound at Kalay with an

acknowledgement.

The Police shall render all the protection

required for a successful implementation of the

scheme. Co-operation of the concerned

municipalities and the village panchayats shall

be the pivotal factor in the success of the

scheme.

6.Housing of Stray Cattle.— The Stray Cattlewill be maintained at the Government CattlePound, Kalay, where feed, fodder, water, shadeand pound keeper will be provided to theimpounded cattle. Medical care and cross--breeding activities will be undertaken as andwhen required.

7. Procedure for release of impoundedcattle.— (a) The claimant will have to provehis ownership by making a representation tothe Director through the Panchayat//Municipality. He shall produce a letter fromthe Village Panchayat countersigned by theAssistant Director/Veterinary Officer statingtherein that he is the owner of the impoundedcattle. Thereafter, on scrutinizing theapplication, if the Director in his opinion isconvinced that the claimant is the legal ownerof the impounded cattle, shall direct theIn-charge of the Government Cattle Pound torelease the impounded cattle subject topayment of the specified fines as per clause(c) below.

(b) The Cattle taken to the GovernmentCattle Pound shall be released on payment offine and cost of removal as also an undertakingfrom the owner that he shall not allow cattleto escape again on roads etc.

(c) The release of the stray cattle will besubject to the payment of cost of removal andfines as follows:—

(i) Cost of removal……..…. Rs. 1,000/-(Rupees one thousand only).

(ii) If the stray cattle is claimed within aperiod of 7 days ……….....……… Fine ofRs. 3,000/- (Rupees three thousand only)plus delivery charges.

(iii) If stray cattle is claimed beyond aperiod of 7 days but within 15days……………. Fine of Rs. 5,000/- (Rupeesfive thousand only).

(vi) Subsequent or frequent impoundingwill attract increased charges @ 20% extraon each escape.

(d) In case the stray cattle is not claimedwithin 15 days, then the Government shallhave the option to take appropriate measuresincluding distribution, on a consideration orwithout to, other farmer.

8. Medical Care.— There will beinfrastructure for veterinary care andassistance. Artificial insemination, treatmentof sick or wounded animals and otherpreventive measures like vaccination againstall the diseases will be undertaken as andwhen required.

9. Visiting Committee.— The VisitingCommittee shall consist of representatives ofthe Directorate of Animal Husbandry andVeterinary Services, Police Department,Directorate of Panchayats, Directorate ofMunicipal Administration, NGOs working inanimal welfare to be nominated by theGovernment.

The Visiting Committee shall visit the

Government Cattle Pound and assist and

suggest some remedial measures, if any, to the

scheme or the condition of the animals, to the

Department of Animal Husbandry and

Veterinary Services.

The Visiting Committee shall meet at least

once every six months to review the progress

of the scheme and submit a report to the

Government.

10. Implementing Agencies.— The

Department of Animal Husbandry and

Veterinary Services, along with the Agency

and with the help of the Police, Municipalities,

Panchayats will be responsible for

implementation of the Scheme.

to authorise payment and appropriation of certain further sums fromand out of the Consolidated Fund of the State of Goa for the servicesand purposes of the financial year 2012-13.

Be it enacted by the Legislative Assembly of Goa in the Sixty-fourthYear of the Republic of India as follows:—

1. Short title.— This Act may be called the Goa Appropriation(No. 2) Act, 2013.

2. Issue of Rs. 12,51,63,000 out of the Consolidated Fund of theState of Goa for the financial year 2012-13.— From and out of theConsolidated Fund of the State of Goa, there may be paid and appliedsums not exceeding those specified in column (5) of the Schedule heretoamounting in the aggregate to the sums of twelve crore fifty one lakhsixty three thousand rupees towards defraying the several chargeswhich will come in the course of payment during the financial year2012-13 in respect of the services and purposes specified in column(2) of the said Schedule.

3. Appropriation.— The sums authorised to be paid and applied fromand out of the Consolidated Fund of the State of Goa under this Act,shall be appropriated for the services and purposes expressed in thesaid Schedule in relation to the said financial year.

1. Short title and commencement.— (a) Thescheme shall be called as “ATAL ASRAYOJANA”.

(b) The scheme shall come into force fromthe date of its notification in the OfficialGazette and shall replace the scheme earliernotified in the Official Gazette, Series I No. 29dated 18-10-2012.

2. Introduction.— Housing is one of thebasic requirements of human survival. For ashelterless person, own house providessignificant economic and social security andstatus in the society. Cost of housing has gonevery high in the State of Goa. There are manytribal families who do not have Pucca Housesand many others do not have their own house.There are two housing schemes at presentimplemented namely, Indira Awas Yojana(IAY) and Rajiv Awas Yojana (RAY). WhileIndira Awas Yojana is for BPL families, theRajiv Awas Yojana is for poor families withannual income upto Rs. 1.5 lakhs. The amountsanctioned under the schemes are inadequateto construct the house and supplementaryfinance from Banks comes at very high rates.Therefore there is a need to extend furtherfinancial assistance over and above theassistance provided under the Rajiv AwasYojana or Indira Awas Yojana. HoweverAssistance under the scheme will beprocessed independently.

3. Objectives.— The objective of thescheme “Atal Asra Yojana” is to providefinancial assistance for construction andrepairs of houses to ST population whichis in addition to the amount sanctionedunder Rajiv Awas Yojana or Indira AwasYojana.

4. Eligibility Criteria.— (a) The scheme willbe applicable to any individual from STcommunity.

(b ) ST families who have beensanctioned benefit/eligible for benefitunder the scheme of Rajiv Awas Yojanaor Indira Awas Yojana will also be entitled

for the financial assistance prescribedunder this scheme.

5. Benefit under the Scheme.— (a) Underthis scheme following assistance shall begranted:

(i) Financial Assistance for constructionof new house is up to Rs. 2.00 lakhs andfor repairs of existing house is up toRs. 75,000/-. However in deserving casesthe Committee with approval of Govern-ment shall have the powers to increase thelimit to Rs. 2.50 lakhs and Rs. 1.00 lakhrespectively, after confirming from theappropriate sanctioning authority, thatthe applicant has not taken any benefitunder Rajiv Awas Yojana or Indira AwasYojana.

(ii) Fees of the Chartered Engineer/

/Architect or the Engineer/Architect

empanelled by the Department for the

purpose of preparation of estimate of house

construction/repairs and certification

required under the scheme subject to

maximum limit to be fixed by Government

by separate order.

6. Priority in Selection of Beneficiaries.—The priority for selection of beneficiary targetgroup is as below:—

(a) BPL families will be considered on firstpriority.

(b) Household headed by widow orunmarried women.

(c) Physically disabled person.

(d) Household affected by flood, fire andother natural calamities.

(e) Forest dwelling applicant.

7. Conditions of Sanction.— (a)Construction of the House in accordance withthe plan prepared by the Chartered Engineer//Architect.

(b) Under this scheme every beneficiaryshall be eligible for benefits to the extentindicated in clause 5 of the scheme.

(c) Applicant seeking financial assistance

for the construction of house should be owner

of the land on which he plans to construct

house or should have irrevocable NOC of the

landlord or should produce evidence to prove

that he is Mundkar or Panchayat recon-

struction license or any other evidence that

can be accepted by the Committee

constituted under the scheme for that

purpose consisting of:

(i) Director of Tribal Welfare asChairman.

(ii) Project Director Rural Developmenthaving jurisdiction as Member.

( i i i ) B lock Development Of f icerhaving jurisdiction over the area asMember.

( iv) Deputy Collector & SDO havingj u r i s d i c t i o n o v e r t h e a r e a a sMember.

(v) Dy. Director (Tribal Welfare) or anequivalent level officer to be appointed bySecretary (Tribal Welfare) shall be theMember Secretary.

(d) The committee shall meet as per therequirements for implementation of thescheme and for the purpose of reco-mmending sanction to the Director (TribalWelfare).

8. Application and procedure forsanctioning amount.— (a) Application inthe prescribed form along with therequired documents submitted induplicate.

(b) Application should be supported withthe detailed estimate of the construction orof the repairs of the existing house in

respect of which financial assistance issought.

(c) Estimate should be prepared byChartered Engineer/Architect or anyEngineer/Architect empanelled for thepurpose with the Department.

(d) Affidavit in prescribed proforma.

(e) Income Certificate issued by Competent

Authority showing family income upto Rs. 1.50

lakhs per annum from all sources. For the

purpose of this scheme, family means father/

/mother/spouse/son and unmarried daughter.

However, if the son is major of age and is

residing separately, he can be considered not

to be part of the family, if the Committee is

satisfied of the same.

(f) Director of Tribal Welfare will sanction

the case and along with the sanction order,

25% of the sanctioned amount will be

released in the form of first installment.

Balanced sanctioned amount will be credited

to the account especially created for the

purpose of this scheme in the Goa ST

Finance and Development Corporation and

the Goa ST Finance and Development

Corporation shall deposit interest received

on the principal amount back to Government

treasury in the month of January and July

of each year.

(g) On the basis of the Chartered

Engineers/Architect or Empanelled Engineer/

/Architect report of utilization of the amount

released on first installment; second

installment of 50% of the sanctioned amount

will be released through Goa ST Finance and

Development Corporation.

(h) On the basis of the Chartered

Engineers/Architect or empanelled engineer

/architect report of utilization of the amount

released in first and second installment, the

third installment of 20% of the sanctioned

amount will be released on inspection by

the official appointed by the Director

(Tribal Welfare).

(i) Balance 5% amount shall be released

on the certificate of the Chartered Engineers/

/Architect or Empanelled Engineer/Architect

for utilization of the amount granted so far

and on inspection by the official appointed

by the Director (Tribal Welfare).

9. Monitoring of the Scheme.— (a) Forissues relating to the eligibility, operation-alization, or issues on account of newsituation, not envisaged at the time offormulation of the scheme, would be resolvedby the Monitoring Committee, whosedecision will be final.

(b) The committee shall consist of:—

1. Secretary (Tribal Welfare) — Chairman

2. Joint Secretary, Finance or his — Member

representative not below the

rank of Under Secretary

3. Project Director RDA/or his — Member

representative not below the

rank of Dy. Director.

4. Director of Tribal Welfare — Member

Secretary

10. Reports.— (a) Reports in the prescribed

proforma should be submitted to the

Government in respect of the “Atal Asro

Yojana”.

(b) A quarterly progress report is required

to be furnished by 10th of April/July/

/October/January succeeding month by

the sanctioning authority to the Director of

Tribal Welfare.

11. Evaluation of the Scheme.— Scheme

will be implemented for five years.

Performance of the scheme will be

evaluated af ter two years of its

implementation and if required scheme will

be suitably modified to meet the new

challenges/requirements so as to achieve

the set objective.

12. Removal of Difficulties.— Government

shall be empowered to remove any difficulties

arising out of implementation of this

scheme with prior approval of finance

department.

13. Relaxation.— The Government shall

be empowered to relax any or all clauses

or conditions of the scheme in genuine

cases or case to case basis for release of

financial assistance to be recorded in

writing.

14. Interpretation.— If any question arises

regarding interpretation of any clause,

word, expression of the scheme, the

decision shall lie with the Government,

which shall be final and binding on all

concerned.

15. Redressal of Grievances and

Disputes.— Grievances if any, arising out

of the implementation of this scheme,

shal l be heard and decided by the

Minister for Tr ibal Welfare and the

decision of the Minister for Tribal Welfare

in this regard shall be final and binding

on all concerned.

The subscribers to the Official Gazette are kindlyreminded that their present subscription term ends onthe 31st March, 2013, being the end of financial year.
