TRIAL, JUDICIAL & ARREST UPDATES

• Trial will begin for the murder of Gala Garbero, daughter of Janet Garbero, in February of next year. Gala was

killed in December of 2016.

• Trial will begin in November for the murder of Justin Guerena, son of Elaine Arzuaga. Justin was killed in June

of 2015.

COLD CASE REGISTRY FOR PHOENIX POLICE DEPARTMENT

The Phoenix Police Department has a Cold Case Registry on line. The link is

COLD CASE REGISTRY FOR HOMICIDES MCSO (SHERIFF'S OFFICE)

The Maricopa County Sheriff's Office has a cold case registry for any victim, victim's family member, or other

lawful representative of a victim of a cold case who requests to be included in the registry. This process provides

law enforcement with an avenue to contact family when there are new developments in the case. In order to

HOLIDAY MEMORIAL SERVICE IN DECMEBER

Saturday, December 1st, will be our annual Holiday Memorial Service, “In Their Loving Memories”, held at

Church of the Beatitudes in Phoenix. Invitations will follow in the mail later in November. We have a Memorial

Video Tribute of our loved ones’ pictures. If your loved one’s picture has not been previously submitted for the

tribute and you plan to attend, pictures must reach us by November 15, to guarantee they will be in the tribute this

SPEAKER INFORMATION MEETING- Prosecutor from MCAO

Our meeting this month featured Treena Kay, a prosecutor with the Maricopa County Attorney’s Office, who

spoke about the trial process and answered members’ questions. Treena has been a prosecutor for 19-years, 14 of

those prosecuting homicides. She also supervises a group of prosecutors teaching them to be respectful and

advocates for victims. She admits to being very protective of her victims, so it made her sad to hear so many

stories during the meeting of not being treated that way in the criminal justice system. Treena advises that the

squeaky wheel gets heard and to write down or talk logically about your case and ask questions until you fully

understand why certain decisions are made in prosecuting or declining to prosecute because of a weak case. She

reminds us they only get one chance to try someone and if the case is not strong, double jeopardy stops the person

from being tried again so they must make sure everything is done correctly the first time. Your prosecutor should

also be your advocate and you should always ask to talk to them about your case. Make sure you are comfortable

with your prosecutor and remember the system is slow and sometimes it is good that is goes slowly to make sure

the best case is presented so there is no chance of appeals because something was not done right. Sometimes plea

agreements are a necessary means to ensure the person serves time for the murder. And with a plea agreement, the

perpetrator gives up rights to many appeals therefore, you don’t have to worry about the jury not reaching a

unanimous decision of guilt.

The role of the prosecutor is first to get a copy of the police report and learn as much as possible about the case.

The prosecutor also works with police departments and missing persons in which those cases are suspected

homicides, especially if the case has problems that a jury might not convict because of them.

In the criminal justice system there are different level of murder sentencings:

•First degree premeditated

•First degree felony

•Second degree

•Manslaughter

First degree premeditated: once premeditation is proved and aggravators exist, such as if the crime was

especially cruel and heinous, had multiple victims killed or the murder was for financial gain. This sentence

would be the death penalty. First degree felony: would be either a life sentence or life with the possibility of

parole after 25-years served. Second degree (intention of knowing or reckless, but without premeditation): has a

sentencing frame of 10, 16, or 25 years flat time. Manslaughter: has a sentencing range of 7 – 21 years with a

presumptive sentence of 15. Aggravated assault, in addition to the murder, can add another 5 – 15 years to the

sentence.

Treena also shared that while DNA is still important to a case, ironically a lot of cases are now based on social

media, i.e., GPS evidence to prove.

Treena expressed how sorry she was for everyone’s pain from the murder of their loved one and if anyone, even

though she is not their prosecutor, has questions, she would be willing to speak with them.

BOARD OF DIRECTORS ELECTION MEETING FOR CHAPTER

January 8th, at our Speaker Information meeting, we also have our elections for open positions on our board of

directors. A few of you have submitted your names for consideration already. This is a volunteer position and you

must attend bi-monthly board meetings the second Saturday beginning January 12 and help with all chapter

events and duties as necessary. It is a lot of hard work but also rewarding helping others. If you want to be

considered for a position on our board of directors, please submit your name by email to [email protected] or

had an awesome time and were so excited Det. Roestenberg and his daughter came. I know he was very touched.

Wish we could have stayed longer.

In addition, when returning home, I read Jeff’s name and was so very honored for that recognition. I pledge to
